Dear Mr. Poe, The City executed an Agreement for provision of Street and Stormwater Maintenance and Repair Services on March 13`h, 2020, by and between the City of Spokane Valley, hereinafter "City", and Poe Asphalt Paving, Inc. hereinafter "Contractor" and jointly referred to as"Parties." The original Agreement states that it was for one year, with four optional one-year terms possible if the parties mutually agree to exercise the options each year. This is the fourth of four possible option years that can be exercised and runs through December 31, 2024. The city would like to exercise the 2024 option year of the Agreement. The increase in Compensation as outlined in Exhibit A to the Agreement, includes the labor and material cost negotiated and shall not exceed $1,585,120.00. The history of the annual renewals, including dollar amounts, is set forth as follows: Original contract amount ..$ 1,500,000.00 2021 Renewal ..... $ 1,515,439.95 2022 Renewal $ 1,530,307.70 2023 Renewal $ 1,566,980.77 2024 Renewal $ 1,585,120.00 The Parties further agree that, in addition to all other terms of the original Agreement, Contractor (and any subcontractor or other person doing work under this Agreement) shall (a) comply with the requirements of chapter 39.12 RCW, and (b) pay each employee an amount not less than the Prevailing Rate of Wage, as specified by the Industrial Statistician of the Washington State Department of Labor and Industries ("L&I"). If employing labor in a class not shown, Contractor shall request a determination of the correct wage rate for the class and locality from the Industrial Statistician. Contractor shall provide a copy of any such determinations to City. The Parties further agree that before commencing, during, and upon completion of the work, Contractor shall (a) file all forms and pay all fees required by L&I and shall indemnify and hold City harmless from any claims related to its failure to comply with chapter 39.12 RCW; and (b) secure and provide the City with a payment bond securing Contractor's prevailing wage obligations. All of the other contract provisions contained in the original Agreement shall remain in place and remain unchanged in exercising this option year. The following information is provided pursuant to RCW 39.12.030: A. State of Washington prevailing wage rates applicable to this public works project, published by L&I, are located at the L&I website address: B. This Project is located in Spokane County. C. The effective prevailing wage date for year 2024 shall be the same date the renewal option for year 2024 was signed by all Parties. D. A copy of the prevailing wage rates is also available for viewing at the City Community & Public Works Department located at 10210 East Sprague Avenue, Spokane Valley, WA 99206. Upon request, the City will mail a hard copy of the applicable prevailing wages for this project. If you agree with exercising the 2024 option year, please sign below to acknowledge the receipt and concurrence to perform the 2024 option year.
