A. INT
ROOUCTION
This matter having come before the Zoning Hearing Examiner Committee on
March 4, 1982, and the members of the Committee present being Ron McVicker,
Chairman, Kathleen Carstens and John R. Cutler. B. PRO,POSAL
The sponsor, David,Mielke, is requesting approval of a zone reclassification, File
No. ZE-5-82, Agricultural to Commercial, fori the purpose of devetoping a
produce stand (Na site ~pian availale at this time).

C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial, and culti=
vated.
2. That the Comprehensive Plan designates `this area as appropriate for
Commercial development.

3. That the existing =oning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Oeclaration of
Non•Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed,use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantiatly
changed since the original zoning of this area and accordingly, the pro-
posed rezone is r justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor dis-
approval of the,proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwlse detrimental to the public
health, safety, and welfare.

D. CONDITIONS OR CONTINGENCIES APPLIEO T'O THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. Approval by the Zoning Administrator of a specific lighting and sign-
ing pian for the described property prior to the release of any build-
ing permits.
2. The specific development plan will be submitted for Planning Depart-
ment review and approval prior Lo issuance ot building permits.
3. All current standards of the Commercial Zone, as amended, shail be
complied with in the development of thls site.
4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be jnitiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements.
5. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, wrjiten
comments and/or public testimony contain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final dectaration of non-significance is hereby to be
issued.
6. Applicant shall comply with 1208' recommendations concerning storm-
water runoff and provide necessary grassed percolation areas for
runoff.
7. The appiicent shall comply with RCW 58-17 - Binding Site Plan Review
and the Spokane County Platting Ordinances prior to issuance of
building permits.
b) COUNTY ENGINEERING DEPARTMENT
1. Applicant shall dedjcate 10 feet on Progress Road and a 20 foot radius
on Progress Road and Sprague Avenue for right-of-way prior to any
use of the property.
2. Applicant shall improve Progress Road in a manner consistent with
Spokane County TYPICAL roadway section No. 1 minimum paving width
Access Standard.
3. Applicant shall improve Sprague Avenue in a manner consistent
with Spokane TYPICAL roadway section No. 1 mintmum paving
wldth Major Arterial Standard.

4. Appticant shall submit for approval by the Spokane County Engineer
road, drainage, and access pians prior to the issuance of a building
permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal pian for the
entire project prior to the issuance of any building permit on the
property.
6. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, location, and arrange-
ment of parking stalfs shall be in accordance with standard traffic
engjneering practices. Paving or surfacing as approved by the
County Engineer, will be required for any portion of the project
which is to be occupied or traveled by vehicles. (THIS CONDITION
IS SU6JECT TO CONDITION #12 BELOW. )
7. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. To construct the road improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be a
willing participant in any petition or resolution which purpose is
the formation of a Road Improvement District ( R I D) for said
Improvement pursuant to RC1N 36.88, as amended. Spokane
County will not participate in the cost of these improvements.
9. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project
, (CRP) to the extent of the required road improvement.
Spokane County will not participate in the cost of these improve-
ments.
10. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
11. AII required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Construc-
tion, and other applicable county standards and/or adopted reso-
lutions pertaining to Road Standards and Stormwater Manage-
ment in effect at the date of construction, unless otherwise
approved by the County Engineer.
12. Applicant shall construct a paved and delineated access
approach(s) to meet the existing pavement on Progress Road for the
use of the produce stand. If the business use is changed at some ~
time in the future, paving will be required for the parking area as ~
well.

c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to 8oard of County Commissioners Resolutian No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authori=ation is conditioned on comptiance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
► Heaith District.
2. The owner, his heirs or successors shall join and participate in
any petition or resotution which purpose is the formation of a
utility tocal improvement district (UIID) pursuant to RCW,

1. Sewage disposal method shail be as authorized by the Director of
Utilities, Spokane County.
2. Subject to specific application approval and issuance of permits by the
Heaith Officer, the use of an individual on-site sewage system may be
authorized.
3. Water service must be coordinated through the Director of Utilities,
Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

2. A plan for emergency equipment access is required to be submitted

general partnership, its successors and assigns, a perpetual non-
exclusive easement affectinq the solar and air use and facilities
on the property described as:
The South half of Tract 58 EXCEPT the North one-third
of the West one (1) acre of said South half and that
part of Tract 62 lying North of the North line of the
right of way of Spokane Inland Empire Railway Company,
in VERA, in the County of Spokane, State of Washington,
as per map thereof recorded in 8ook "O" of Plats, page
30, in the office of the County Auditor of said County.
Grantees shall be entitled to plant trees and landscape a
10 foot stzip ovex and across the South 10 feet of the West 303.10
feet of pzoperty descxibed above, includinq use of that area for
surface watex drainage percolation sometimes referred to as a
"208 qxass percolation area".
Grantees shall be entitled to erect buildings, fences and
trees on the property adjoining and affecting the property described
above.
Grantees shall bear all costs of expenses in connection there-
with and comply with all laws, rules and requlations imposed by the
County or other governmental agencies.
' Grantors understand that this easement may result in interference
with the sunlight and natural flow of air over, across and around
Grantors' property and that is the purpose for which this easement
is granted.

A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
March 4, 1982, and the members of the Comnnittee present being Ron McVicker,
Chairman, Kathleen Carstens and John R. Culler.

The sponsor, David Mielke, is requesting approval of a Zone reclassification, File
No. ZE-5-82, Agriculturai to Commerciai, for the purpose of developing a ,

D. CONDITiIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. Approval by the tonjng Administrator of a specjfic lighting and sign-
ing plan for the described property prior to the release of any build-
+ng permits.
2. The specific development plsn wili be submitted for Planning Depart-
ment review and approval prior to issuance of building permits. ,
3. All current standards of the Commercial Zone, as amended, shall be
complied with in the development of thi's site. ;
~ 4. That the provisions of SEPA's NOT t CE OF ACT I ON pursuant to ~
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77•1392 be initiated by the project applicant within

thirty (30) days of final disposition of thls application, and prior to ti
any on-site improvements.
5. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide- ~
lines (WAC 197=10) and the Spokane County Environmentai Ordinance ~
(SCEO), a proposed declaration of non-significance has been issued at ~
N4 least fifteen (15) days prior to this date; the offjcial flle, written
comrqents and/or pubiic testimony contain 1ntorr»ation regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final declaration of non-significance is hereby to be
issued.
6. Applicant shall comply with 1208' recommendations conterning storm-
water runoff and provide necessary gressed percolation areas for
runoff.
7. The applicant shail comply with RCW 58-17 - Binding Sjte Plan Review
and the Spokane County Platting Ordinances prior to issuance of
building permits.
b) COUNTY ENGINEERING OEPARTMENT
1. Applicant shall dedicate 10 feet on Progress Road and a 20 foot radius
on, Progress Road antl Sprague Avenue for ri9ht-of-way prior to any
use of the property.
2. Applicant shall imprave Progress Road in a manner tonsistent with
Spokane County TYPICAL roadway section No. 1 minimum paving width
Access Standard.
3. Applicant shall irnprove Sprague Avenue in a manner consistent a

b) COUNTY ENGINEERING DEPARTMENT (continued)
4. Applicant shall submit for approval by the Spokane County Engineer ~
road, drainage, and access plans prior to the issuance of a building ;
permit on the property. r

on-site sewage system plan and surface water disposal ptan for the
entire project prior to the issuance of any building permit on the

6. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, location, and arrange-
ment of parking stalls shall be in accordance with standard traffic
engineering practices. Paving or surtacing as approved by the
County Engineer, wili be required for any portion of the project
which is to be occupied or traveled by vehicles. (THIS CONDITION
IS SUBJECT TO CONDITION #12 BELOW. )
7. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. To construct the road improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be a
willing participant in any petition or resolution which purpose is
the formation of a Road Improvement Djstrict ( R I D) for said
improvement pursuant to RCW 36. 88, as amended. Spokane
County will not participate in the cost of these improvements.
9. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project
, (CRP) to the extent of the required road irnprovement.
Spokane County will not participate in the cost of these improve-
ments.
10. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
11. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Construc-
tion, and other applicable county standards and/or adopted reso-
lutions pertaining to Road Standards and Stormwater Manage-
ment in effect at the date of construction, unless otherwise
approved by the County Engineer.
12. Applicant shall construct a paved and delineated access "
approach(s) to meet the existing pavement on Progress Road for the

c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to 6oard of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorited. This
authoriZation is conditioned on compliance with all rules and regulations
of the Spokane County Health Oistrict and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District.
2. The owner, his heirs or successors shall join and participate in
any petition or resolution which purpose is the formation of a
utility Iocal improvement district (ULID) pursuant to RCW,
Chapter 36. 94, as amended. The owner, hi s hei rs and suc-
cessors shall further agree not to oppose or protest any legal
assessments for any utitity local improvement district (ULID)
estabiished pursuant to RCW Chapter 36.94, as amended.
3. Any water service for this praject shall be provided in accord-
ance with the Coordinated Water System Plan for Spokane
County.
d) COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an indiv►idual on-site sewage system may be
authorized.
3. Water service must be coordinated through the Director of Utilities,
Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently
prohlbited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT

1. The siie is located in Fire District #1.
2. A pian for emergency equipment access is required to be submitted
prior to any land development. tl
3. Recommend approval with condition that prior to development of
this property that an engineered water distribution system plan
shali be submitted to the Spokane County Oepartment of Building
and Safety. This distribution plan shall include water main siZe,
flows, locations, fire hydrant type and locations, water storage

valuable consideration, the Grantors, C. HAROLD MIELKE and MARCIA
MIELKE, husband and wife, and DAVID MIELKE, a single person, hereby
convey and warrant to the Grantees, Y& D PROPERTIES, a Washington
general partnership, its successors and assi.gns, a perpetual non-
exclusive easement affecting the solar and air use and facilities
on the property described as:
The South half of Tract 58 EXCEPT the North one-third
of the West one (1) acre of said South half and that ~
part of Tract 62 lying North of the North line of the ~
right of way of Spokane Inland Empire Railway Company, 441P
in VERA, in the County of Spokane, State of Washington, 0
as ner ma thereof recorded in Book "O" of Plats, a e ,

Grantees shall be entitled to plant trees and landscape a
, 10 foot stzip over and across the South 10 feet of the west 303.10
feet of pzoperty descxibed above, including use of that area for
surface water drainage percolation sometimes referred to as a
"208 grass percolation area".
Grantees shall be entitled to erect buildings, fences and
trees on the property adjoining and affecting tiie property described
' above.

Grantees shall bear all costs of expenses in connection there-
with and comply with_all laws, rules and regulations imposed by the
County or other governmental agencies.
Grantors understand that this easement may result in interference
with the sunlight and natural flow of air over, across and around
Grantors' property and that ig the purpose for which this easement
is granted.
