RECEIVED JAN 1 Z 1990 EiiTREER Please find enclosed copies of two recorded documents County Auditor's Numbers 8808240043 and 8909130044. These documents are the Joint Use and Maintenance Agreement and Addendum to the Joint Use and Maintenance Agreement referenced on page 4 of the Report for Plat Certificate. Sharing and maintenance of common parking areas is addressed much more thoroughly in these documents than the one I previously submitted for your review. I was unaware such recent agreements existed until we began circulating the new one for signatures and were asked why another needed to be signed. My apologies for any inconvenience. A revision has been made on the parking plan to address concerns raised by the Pool World owners in the area where they receive truck deliveries. The revision results in a reduction of 1 space. All parties are in agreement with a continued shared parking arrangement. Mr. Engstrom has indicated he will provide the additional parking spaces per the parking plan as soon as weather permits paving and striping. With this information and a forthcoming letter from Vera Water and Power, we should have fulfilled the requirements to proceed with filing the final Binding Site Plan. The said sign will require periodic maintenance and these parties agree that each of the above -named owners in the park' shall share, prorata, the cost of maintenance based upon the amount of signage area each owner and their respective tenants are utilizing as compared to the whole. 2. PARKING LOT LIGHTING The parking lot throughout the park has overhead lighting to provide for niuht visibility and security. Each of the owners of the above - described property agree to share, prorata, in the cost of maintenance and electricity to keep the parking lot lighting in good and operable condition, each owner to pay his prorata share on the same basis as set forth in the preceding paragraph. 4. WASTE DISPOSAL Located on the property and available for the use of ail owners'and.tenants are one or more garbage dumpsters.. Each owner agrees to pay his prorata share of waste disposal bills, again based .upon the same formula as set up in tl.a preceding paragraph relating to maintenance of parking and ways. S. BINDING EFFECT This Agreement shall run with the land, be perpetual in nature, and shall be binding upon the heirs, assigns and successors in interest of the parties to this Agreement. G. ENFORCEMENT In the event that any person whose ownership is serviced by this Agreement shall fail, refuse or neglect to pay his or her respective share of the costs and expenses recited herein within thirty (30) days of the date of -2- YG;. 989 Face 508 billing, then such share shall be delinquent and shall constitute a lien against their : active property, and his or her share may be contributed by one or more u other parties who are owners within the above - described property, which other party or parties may bring action in any competent i Court for the amount due from the nonpaying party, ir._l.:ding foreclosure of the lien in the same manner as is provided for the foreclosure of mortgages, together with costs and reasonable attorney fees incurred in such action. 7. INDIVIDUAL MAINTENANCE Each owner within the Sherwin Business Park shall maintain his or her own building, together with landscaping, in good and presentable condition at all times; shall. allow no waste or trash to collect upon their respective property; and shall keep the exterior of their buildings in clean and presentable condition so as not to detract from the remainder of the park. 8. BSP -24 -89 ) CONCLUSIONS AND COMPANION FILES: CE- 49 -88, ) DECISION SP -86 -417 AND ZE -7 -71 ) THIS MATTER, an application from Steve Engstrom has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the 24th day of October, 1989. The individual signing below has been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. FINDINGS OF FACT AND CONCLUSION 2. 7 The proposal is to divide 1.6 acres into two lots, recognizing several existing buildings and their adjacent lands, such buildings being used for a variety of business and commercial purposes. The proposal is located in the Spokane Valley, south of and adjacent to Sprague Avenue, about 800 feet west of Evergreen Road, in Section 22, Township 25 N, Range 42 EWM, Spokane County, Washington. The current zoning of the property is Commercial, File No. ZE -7 -71. The proposed lot sizes, frontage and intended uses are allowed within this zone. The property has also been the subject of SP -86 -417 and CE- 49 -88. The Spokane County Comprehensive Plan designates this area as Major Commercial. The development and uses proposed are generally in accord with this planning category. The required notice was provided for this proposal and no one commented on the proposal. Agencies having a potential interest in the project were notified and their conditions are contained hereinafter. With the recommended conditions of approval and Spokane County development standards, the proposal: is not detrimental to the public health, safety and general welfare; implements the underlying zoning as well as the Comprehensive Plan; and complies with the adopted Binding Site Plan Chapter 4 of the County's Subdivision Regulations, Board of County Commissioners Resolution 89 -0511. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Rule (WAC 197 -11) and the Spokane Environmental Ordinance, the proposal is equivalent to a short plat in concept. The property shall cross over under the new Zoning Code classification on January 1 st, 1991 to B -3 (Regional Business), based upon the present crossover implementation program. After questions arose during the Planning Department review about parking and circulation, the applicant's agent, Adams & Clark, presented a sketch plan study of the entire Engstrom ownership, which suggested adequate parking available upon additional paving and stripping of directional arrows and parking stalls. An on -site inspection found discrepancies, suggesting too few parking spaces. A subsequent meeting with Adams & Clark representatives came close to resolving parking concerns (see Exhibit A attached). An agreement was reached whereby, prior to filing the final binding site plan, the following will occur. (a) Preparation, review and approval by the Spokane County Engineer's office and Planning Department of a parking/circulation plan, including approximately 125 parking spaces and trash container locations for Lots A and B of SP -86 -417; and (b) A parking - sharing agreement for the appropriate owners (to run with the land and be filed in the Auditor's office), reviewed and approved by the Planning Department and the Engineer's office. Additionally, paving and stripping of the lots shall occur prior to any new Certificate of Occupancy's being issued (especially for a travern use) for proposed Lot 2 or within 180 days of the filing of the final binding site plan. BSP -24 -89 Findings, Conclusions & Decision Page 2 DECISION Based upon the above -noted Findings of Fact and Conclusions, Preliminary Binding Site Plan 24 -89 is hereby APPROVED, subject to the following conditions, which shall be complied with by the applicant, sponsor and/or successors in interest prior to finalization of the Binding Site Plan.
