General Overview - The owners, Joe and Diane Scwehr, are proposing to construct a 40' X 80' pole building. Proposed used at this time is for storage of drywall and related materials, construction of some pre-fabricated walls, storage of steel studs and possible storage of several pieces of heavy-duty equipment. No floor is proposed for the building at this time. This may be added within the next 2-3 years. There will be no storage of hazardous materials. SUMMARY OF DEPARTMENTAL REQUIREMENTS: I. Planning Department (456-2205) - Francine Shaw A. Discussion Items 1. The proposed is located in a I-2 zone. The proposed use is allowed in the zone. Zone reclassification f ile number is ZE 35-87C for which there are conditions. The applicant is required to meet the conditions of that zone change. 2. The proposed is located on parcel number 45044.0104. 3. The existing house is being used as an office and will need to be shown in detail on a revised site plan illustrating height of building and number of stories. Page 2 r . • . ' . 4. The zone map shows the property dimensions to be 140' X 3501. The applicants drawings indicate 115' X 3151. The zone change application describes the parcel as 128' x 3201. Please verify the current property dimensions. A survey may be required. 5. All uses of the property, including indoor and outdoor uses, need to be illustrated in detail on a revised site plan. The floor plans need to show what areas are to be used for storage, manufacturing, and office space. Al1 traffic circulation patterns need to be illustrated. 6. Revised site plan needs to show parking areas. At this time it is determined that parking requirements are 1 stall per 2000 square feet for storage areas; 1 stall for each 400 square feet of office space; and, 1 stall for each 400 square feet of manufacturing area (pre-fab walls). 7. Al1 traveled surfaces must be paved, including parking. If track equipment is used, traveled areas may not need to be paved. Contact SCAPCA giving the details of the proposed equipment area. Should paving requirements be waived, a copy of the waiver should be forwarded to the Planning Department for review. 8. All traffic control devices, i.e., painted parking, directional arrows,' curb stops must be shown on the revised site plan. 9. No signage or lightning is proposed at this time, however in the future should any exterior lighting be installed the illumination must be directed away from adjacent properties. 10. Should there be any outdoor storage, such storage must be enclosed by a minimum of 6'or a maximum of 8' site-obscuring fence. If it is necessary to use fencing in excess of 8' to obscure stored equipment from eye-level view, the fence will be reviewed as a structure • and must comply with set back requirements. The applicant stated an existing fence currently surrounds the property but is not slatted. Francine Page 3 • • • ~ indicated the fence should be illustrated on the revised site plan for review and approval. 11. A landscape plan is required to be submitted for review and approval. A minimum 5' Type III landscape strip must be installed along the property line fronting Empire Road. The adjacent north and east properties are in a UR 3.5 zone, therefore 20' of Type I landscaping will be required along these boundaries. Landscape areas must be protected by 6" curbins and must be auto-irrigated. 12. A promissory letter is also is required stating that the landscaping will be done prior to issuance of Certificate of Occupancy. 13. Proposed must meet the requirements and standards of all applicable federal, state and local agencies' statutes, laws, and ordinances with regards to protecting the soil, ground and surface water, air, and human health. B. Permit Release Requirements 1. Please submit revised site plan illustrating: a. the existing house which is being used as an of f ice, b. all uses of the property, as discussed above, c. parking and paved areas, d. traffic circulation pattern and control devices, e. all fencing, both existing and proposed, f. landscaping. 2, Please submit documentation of a survey verifying the the actual size of the property. 3. A promissory letter stating that the landscaping will be done prior to issuance of Certificate of Occupancy. 4. Submit an estimate from a nursery that includes the size, type, and quantity of landscaping, itemized cost of irrigation system, and cost of labor. Page 4 + . . . ' II. Spokane County Air Pollution Control Authority (456-4727) - Kelle Vigeland A. Discussion Items 1. A SCAPCA representative was not present at the meeting and written comments were not available, however Bill Benish indicated that a copy of comments by SCAPCA will be forwarded with a copy of the minutes. III. Division of Engineering & Roads (456-3600) - Bob Turner A. Discussion Items 1. Comments were given to the applicant and the De artment of Buildings by Bob Turner. 2. Please submit a drainage plan for the site that is in compliance with Spokane County Guidelines for Stormwater Management as detailed in the handout given to the applicant at the meeting and also attached to the applicant's copy of these minutes. The plan must contain: a. Drainage calculations for stormwater volumes generated on site. b. Calculations for total impervious surfaces contained within the site. c. Finished grade elevations for structures to be constructed on site. d. Finished grade elevations at the top an bottom of the 208 swale. e. A typical cross section of the 208 swale. f. Calculations to justify the number and type of drywells proposed. g. Elevation of drywell inlets where applicable. h. Copy of the proposed landscape plan. Note: metal roofs may be drained into dry wells. /3. 10' dedication on Empire Road is required as per the zoning reclassification. There is no record that this has yet been done. 4 . Improvements to Empire Road must be completed to ✓ include sidewalks, curbs, and paving. As an alternative, an RID Agreement can be signed verifying that when road Page 5 irnprovements are assessed, applicant agrees tv be responsible for his portion of the assessment. SMauld the owner choose to sign an RIfl Agreement, a copy of the recorded deed must be submitted to the cvunty engineers so it can be prepared. 5. An Agreement to Pay Fees was given to the applicant durinq the meeting. The agreement is to be signed by the owner and returned to the Division of Engineering & Roads. Plan review will not be completed until this document is executed. 6. The proposed steel roof may drain to a drywell. S. Permit Release Requirements 1. P3ease submit a drainage plan as described above fQre revIew and approval. 2. An RID agreement needs to be signed for Empire Raad and recorded property deed submitted. 3. Any new approaches to the property will require an approach permit for the county engineers, 4. Al1 t~avelecl surfaces must be paved. A parking and traffic circulation plan needs to be submitted for review and approval. IV. Health District (324-1577) - Daryl Way A. Discussivn Items 1. The water purveyor for the proposed is Irvin Water D~strict No, 6. Flease contact the water purveyor to review requirernents for back flow preventers. 2. Propased inust connect to the existing sewage disposal system until such time as the system fails to function. 3. Due to the nature of the bl1Slne55 r it does not appear that any critical materials will be used. 4. All construction debris shall be taken ta alicensed disposal site. Page 6 ! . . . • 5. It is understood that all old storage units will be removed, and that scaffolding will be moved into the building when completed. B. Permit Release Requirements 1. The Health District is ready to release their portion of the building permit as proposed. V. Fire District No. 1 Clyde Wisenor (928-2462) A. Discussion Items 1. Fire flow for the proposed has been calculated for 2250 G.P.M.. 2. One (1) fire hydrant is required to be installed off of Empire Road. The fire hydrant shall be installed as per an approved water plan. Prior to the preparation of the water plan, the applicant shall contact Irvin at 924-9320 as soon as possible to obtain the purveyor requirements including specifications. The water plan shall contain the location of the hydrant, hydrant assembly detail, and plumbing detail. The water plan shall be submitted to the Fire District and water purveyor for approval prior to installation. The fire hydrant shall be installed prior to occupancy. 3. A lock (Knox) box entry system for fire department personnel access is required to be installed. Forms for ordering was given to the applicant. The completed forms are to be returned to the Fire District prior to release of the building permit. The box shall be installed prior to occupancy. B. Permit Release Requirements 1. The order form for the lock (Knox) box entry system shall be submitted to the Fire District prior to release of the building permit. VI. Department of Buildings Bobby Stone (456-3675) - A. Discussion Items Page 7 . . . ' . 1. A preliminary plan review has been completed on the site plan. 2. A critical materials list is to be filed with the Department of Buildings. 3. The proposal must meet Washington State Regulations for Barrier-Free Facilities. 4. If the building is heated to more that fifty degrees, the proposal must meet specifications of the Washington State Energy Code. If not, please specify in the drawings. 6. The east wall must be 1-hour fire resistive construction. 7. All building uses must be identified, such as assembly, plumbing and mechanical, office areas, etc. 8. There was some concern with regards to the existing residence being used as an office. Further review of the matter will be required to determine if a change of use permit will be needed as part of this permit. B. Permit Release Requirements 1. 3 sets- of complete site plans and construction drawings with the original signature of the architect on the first page of the plans along with structural calculations need to be submitted for review and approval. 2. A letter from the owner is required stating that no wood studs will be stored in the building. Upon receipt of the deed our staff will prepare the RID/CRP agreement and Right of Way document. 5. Approach permits must be obtained from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Empire D) Insuff icient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. 2. Drainage plan as specif ied. 3. Other information: ' a. RID on Empire. b. All traveled surfaces shall be paved. c. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. E) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the improvement. F) The owner of the property or the authorized representative must complete and sign Spokane County Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Office. Plan review will not be completed until this document is executed. This document is attached to these comments. Please return the completed Agreement to your contact person at the Engineers Department. Only after all the information and requirements listed above are supplied or completed and the necessary review has been accomplished will your building permit be released. Proposal: A request to rezone an approxima.te 41,000 square foot site from - Agricultural to Light Industrial (I-2) Zone for the purpose of developing a contractor's office and storage. Location: 7he site is generally loeated north of and adjacent to Empire Way approximately 125 feet east of the intersection of Empire Way and Pit Street in Section 4-25-44. Tax Parcel Number: 04544-0104. Street Address: E. 11915 Empire Way. II. SITE ANALYSIS Comprehensive Plan: URBAN Category - Inside General Sewer Service Area (GSSA) Boundary - Inside Priority Sewer Service Area (PSSA) Boundary - Inside Urban Impact Area (UTA) Boundary The Urban category is primarily a land use designation appropriate for residential development with some limited neighborhood commercial and light industrial uses. Major Comnercial and Heavy Industrial uses are specifically identified as incompatible uses in the Urban category. Light nonresidential uses are encoUraged'to locate adjacent to arterials in those areas that have site-specific characteristics supporting the proposed use. Review of specific proposals should consider the development's impact on adjacent properties as well as measures to mitigate those impacts; such as buffering, landscaping, orientation of Zoning: Existing on SITE: AGRICULTURAL (established 1942) and within: Aquifer Sensitive Area Overlay Zone To the NORTH: Manufacturing (established 1956) Plining (establ ished 1956) To the SOUTH: Agricultural (established 1942) To the EAST: Agricultural (established 1942) Manufacturing (established 1956) Restricted Industrial (established 1956) To the WEST: Restricted Industrial (established 1979) Land Use: Existing on SITE: House, storage and open area To the NORTH: Industrial, railroad tracks and open area To the SOUTH: Kingdom Hall, single f amily residential, and open area To the EAST: Single family residential, industrial and open area To the WEST: Single family residential, manufactured home, and open area Properties imnediately adjacent to the site on the southeast and west are generally in single family residential use or open area. Lots along the south side of Empire Way generally consist of the open area back yards of double-fronting lots which have single family residences oriented toward Portland Avenue. Land imnediately to the north, northeast and easterly of the site was zoned in 1956 under an area-wide rezoning to three basic industrial type iones; Restricted Industrial, Manuf acturing, and Mining. The land in those areas has - generally developed for industrial and warehousing uses. An approximate two-acre site immediately west of the current proposal' was zoned to Restricted Industrial in 1979 for the specific purpose of warehouse and storage development. To date that property on the west has not developed. With few exceptions, the majority of the land in this area was zoned and developed prior to adoption of the Spokane County Comprehensive Land Use Plan. Site Characteristics: Site Size: Approximately 41,000 square feet Existing Buildings: One Topography: Flat Yegetation: Residential Agricultural Summary: Urban category is not intended for agricultural protection. Adjoining Streets: Empire Way to the south of the site is a 40 foot County right of way improved with two paved lanes. It is designated as a future collector . arterial within the Transportation Section of the Spokane County Comprehensive Plan 3 . , Proposed Site Plan: Use: Contractor's Office and Storage Proposed Buildings: Existing to be used as office PROPOSED REQUIRED Parking: 5 ~ Site Plan Considerations: The proposed site plan indicates retention of the existing house for conversion to a contractor's office. Existing residential landscaping, imnediately south of the house, will be retained. Parking area for five (5) cars and two (2) gated twenty-foot driveways would be added within the front portion of the property. The remaining northerly part of the property, that area ' approximately 70 feet north of the Empire Way property line, would be used for open storage of contractor's material and equipment. The site plan indicates existing and proposed fencing to enclose the open. storage area; five foot fence on the east property line, four foot fence on the west property line and a six foot adjacent to the house. A five foot setback for the*open storage is indicated along the north property line. However, that same setback is required but not indicated on the site plan along the east property line. The proposed site plan does not indicate provision of landscaping as required by the Spokane County Zoning Code; particularly along the , easterly and southerly (adjacent to Empire Way) property lines. Nowever, adequate room is available to accomodate the required landscaping. - note: - The site plan submitted for review by the Zoning Hearing - Examiner Committee is general in nature. Detailed review to determine compliance with all Ordinance regulations and conditions of approval is recommended to be administrative and to occur at the 6uilding Permit stage. III. SITE OEYELOPMENT RECOMMENDATIONS Design: The proposal is to_convert an existing residential use and lot to a contractor's office and open storage area. Conversion of the house to office space is fairly straight forward. The conversion of the open area to outdoor storage of equipment and materials will require conformance to Zoning Code requirements for screening and setbacks. The Zoning Code requires that the outdoor storage be completely screened, from a level view, by a site-obscuring fence at least six feet in height. The screening requirement may be waived along the site's westerly property line adjacent to the existing Restricted Industrial Zone, if agreed to by that adjoining property owner. The screening requirement however will apply to all other boundaries of the storage area. The Zoning Code specifically requires that outdoor storage ma i nta i n a setback *f rom property 1 i nes common to res i dent i a 11 y zoned property. This will require a five foot outdoor storage setback from the north property line and from the east property line. 3 3 , f • III. SITE DEVELOPMENT RECOMMENOATIONS (continued) Bufferinq/Landscapin q: The Spokane County Zoning Code requires a landscape buffer along the east property line and along the south property line comnon to Empire Way. Along the easterly property line a minimum twenty foot wide landscape strip consisting of Type I - landscaping is required. The Type I landscape requirement can be accomp 1 i shed i n as 1 i tt 1 e as a f i ve foot area. The f i ve feet of Type I landscaping could coincide with the required five foot setback in this area. The remaining fifteen feet of the twenty foot landscape strip could be maintained in minimal landscape cover and utilized as driveway access only. However, storage would not be allowed within the twenty foot area. The intent of the landscaping requirements along the Empire Way frontage may already be substantially met by the existing residential landscaping there now. Required would be a minimum five foot wide Type III landscaping strip along the property line common with Empire Way. The addition of some plant material between the proposed parking lot and Empire Way should serve to meet the intent of the landscape provisions along public streets. . Pl na e: The Light Industrial (I-2) Zone allows up to a forty square t ~tached sign to a maximum height of twenty feet. Circulation/Access: The Spokane County Engineer wil) require an additional ten feet of roadway dedication along the site's frontage on Empire Way. Required improvements to Empire Way may be deferred to a Road Improvement District (RID) provided the applicant sign a statement to that effect. With development of the project the Engineers will require the applicant to develop a paved and delineated approach to Empire Way. - The Zoning Code requires that the parking area and driveways be maintained in hard surfacing. However, there is no such requirement for the open storage area. Sewa~ e Disposal: Both the Spokane County Health District and the Spokane County Utilities Department can authorize the use of on-site sewage disposal systems subject to the applicant agreeing to participate in a Utility Local Improvement District (ULID) for an area-wide sewage system. It should be noted that, pursuant to new Spokane County procedures, the applicant has already signed and agreed to participate in such a ULID as a requirement for submitting a rezone request. Critical Materials/Use ActivitY: This development will be reviewed, at the building permit stage, for use of any critical materials. If found to use critical materials, the project must provide spill containment control measures for those critical materials. . , IV. SEVA ENVIRONMENTAL REVIEW . An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-S i qn i f i cance ("DNS" The "ONS" was circulated to eight other agencies of jurisdiction and other agencies/departments affected by the future development for review and cotrment. The "DNS" comnent period ends September 2, 1987, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a si.gn posted on the proposal site. The Hearing Examiner Corrmittee may consider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY Approval of both the requested rezone from Agricultural to Light . Industrial (I-2) Zone, and the use is supported by the following facts : - a) The Urban category of the Comprehensive Plan provides - opportunities for development of a variety of land uses; . including 1 ight industrial. The location of such industrial uses is subject to proximity of arterial access, site-specific considerations, and provision of adequate buffering to adjacent residential uses. bY Access to the site is proposed from Empire Way which is a designated collector arterial in the Spokane County Comprehensive Land Use Plan. Access from an arterial is a Comprehensive Plan criteria for siting nonresidential uses in an Urban category. c) This area has an established precedent for industrial rezones and developments to the north, east and west of the proposal. Wh i 1 e-most of these deve 1 opments predate adopt i on of the Comprehensive Plan, their existance indicates a virtually non-reversable trend to industrial development for this areae d) The proposed Light Industrial (I-2) Zone, when coupled with the spec i f ic proposed use of a contractor' s off i ce and storage yard, provides the light industrial use envisioned by the Comprehensive Plan's Urban category. e) The Spokane County Zoning Code's standards for development of a Light Industrial (I-2) Zone should provide adequate protection to adjacent residerttial properties. These standards include requirements for screening, setbacks, landscape buffers, and . signage controls. The submitted site plan will need to be modified to provide conpliance with some of those standards. r VI. CONDITIONS-OF APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be . binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT STANDARD: 1. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Cortmittee. Yariations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. Al1 variations must conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY.. The original intent of the development plans shall be maintained. 2. All current standards of the Light Industrial (I-2) Zone, as amended, shall be complied with in the development of this site. 3. That the project'is subject to Section 7.06, the Aquifer Sensitive Area Overlay Zone of the ZONING COOE FOR SPOKANE COUNTY, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 4. Applicant shall comply with '208' recomnendations concerning stormwater runoff and provide necessary landscaping for runoff. 5. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting . Ordinances prior to issuance of building permits. SPECIAL: 6. That development of this property for outdoor storage must be consistent with the Spokane County Zoning Code Section 6.32.355 - Storage Standards which requires fencing and screening of storage areas. 7. That development of the site for outdoor storage area must be consistent with the setback requirements of the Spokane County Zoning CQde Section 6.32.325. 8. That landscaping adjacent to the easterly property line and the southerly property line (comnon to Empire Way) shall be consistent with the Spokane County Zoning Code Section 8.02.240 - Landscapinq Requirements for Parkin Areas, and Section _ 8.D-6. n40 - Locat i on of-'tequ i red-l..anap i ng. ; . . ~ ~ . b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit Or Use Of The Property As Proposed: STANDARD: l. Applicant shall submit for approval by the Spokane County , Engineer road, drainage, and access plans. 2. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Nealth District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or any portion thereof, if the development is to be phased. 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be requ i red for any port i on of the pro ject wh i ch i s to be occup i ed or traveled by vehicles. 4. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 5. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge - Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 6. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Comnissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. 7. 7he applicant should be advised that individual driveway access permits are required prior to the issuance of a building permit. SPECIAL: 8. Applicant shall dedicate ten feet on Empire Way for right of waya 9. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be wi 11 ing to participate in any petition or resolution . which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County wi 11' not-participate in the cost of these improvenientse ?t r VI. CONOITIONS OF APPROVAL (continued) b) CUUNTY ENGINEERING OEPARTMENT (continued) . 10. As an a 1 ternat i ve method of construct i ng the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road iniprovements stated herein by joining and participating in a County Road Project (CkP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. 11. The County Engineer has designated Typical Roadway Section Number One, Collector Street standard.for the improvement of Empire Way which is adjacent to the proposed development. This wi 11 require the addition of approximately 10 to 12 feet of asphalt along the frontage of the development. Curbing and sidewalk must also be constructed. 12. The applicant shall construct a paved and delineated approach(es) to meet the existing pavement on Empire Way. 13. Applicant shall sign and record Spokane County Notice to the Public #6 which specifies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of - a ballot, the formation of a RIO by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If a RID is formed by either the petition or - resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successar(s) f urther agree: (1) that the improvements or construction contemplated within the proposed RID is feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed. Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either petition or resolutiori method under Chapter 36.88 RCW. c) CUUNTY UTILITIES DEPARTMENT STANDARD: l. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and'regulations of the Spokane County Health District and is further conditioried and subject to specific application approval and issuance of permits by the Health District. . , VI. CONDITIONS OF APPROVAL (continued) c) COUNTY UTILITIES DEPARTMENT (continued) 2. The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvenrents called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. • 3. Any water service for this project shall be provided in accordance with the Coordinated Water System P1an for Spokane County, as amended. . d) COUNTY HEALTH DISTRICT STANDARD: - l. Sewage disposal method shall be as authorized by the Oirector of litilities, Spokane County. . 2. Water service shall be coordinated through the Director of Utilities, Spokane County. • 3. Water service shall be by an existing public water supply when 'approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 4. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 5. Subject to specific_application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage disposal system may be authorized. e) COUNTY BUILOING AND SAFETY DEPARTMENT STANDARD: l. The site is located in Fire District #l. 2. The applicant shall provide verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of bu i 1 d ing permi ts . 39 r • VI. CONOITIONS OF APPROVAL (continued) e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) SPECIAL: -3. The Department of Building and Safety will require the applicant to identify critical materials and submit design requirements for the containment prior to the issuance of a building permit. f) WA7ER PURVEYOR l. Water Purveyor is Irvin Water District #6, and they will supply the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY All air pollution regulations must be met. This includes but is not limited to the following: . STANDARD: 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on September 3, 1987, and the members of the Committee present being Phillip 0. Harris, Chairman, and Gary N. Anderberg and John W. Skadan. B. PROPOSAL The sponsor,Joseph Schwehr, is requesting approval of a zone reclassification, File No. ZE-35-87, for the purpose of developing a contractor's office and storage. C. FINDINGS OF FACT 1. That the existing land use in the area is single family residential, manufactured home, Kingdom Hall, industrial, railroad tracks, and open area. 2. That the Comprehensive Plan designates this--area'as appropriate for URBAN development. 3. That the existing zoning of the property described in the application i s Agr i cu 1 tura 1. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the ' Determination of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfi 11 ed. 6. The location of such industrial uses is subject to proximity of arterial access, site-specific considerations, and provision of adequate buffering to adjacent residential uses. b) Access to the site is proposed from Empire Way which is a designated collector arterial in the Spokane County Comprehensive Land Use Plan. Access from an arterial is a Comprehensive Plan criteria for siting nonresidential uses in an Urban category. c) This area has an established precedent for industrial rezones and developments to the north, east and west of the proposal. While most of these developments predate adoption. of the Comprehensive Plan, the-ir existance indicates a virtually non-reversable trend to industrial development for this area. d) The proposed Light Industrial (I-2) Zone, when coupled with the specific proposed use of a contractor's office and storage yard, provides the light industrial use envisioned by the Comprehensive Plan's Urban category. e) The Spokane County Zoning Code's standards for development of a Light Industrial (I-2) Zone should provide adequate protection to adjacent residential properties. These standards include requirements for screening, setbacks, landscape buffers, and signage controls. The submitted site plan will need to be modified to provide compliance with some of those standards. . D. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance wi th standard traff i c engi neeri ng pract i ces . Pav i ng or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 4. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 5. All required improvements shall conform to the current State of Washington Standard Specif ications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 6. Spokane County will not participate in the cost of these improvements. 10. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements by joining and . participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 11. The County Engineer has designated Typical Roadway Section Number One, Collector Street standard for the improvement of Empire Way which is adjacent to the proposed development. This wi 11 require the addition of approximately 10 to 12 feet of asphalt along the frontage of the development. Curbing and sidewalk must also be constructed. . 12. Applicant shall construct a paved and delineated access approach(es) to meet the existing pavement on Empire Way. 13. Applicant shall sign and record Spokane County Notice to the Public #6 which specifies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36e88 RCW, which resolution includes the owner(s) property. If a RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID is feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed. Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formotion of a RID by either petition or resolution method under Chapter 36.88 RCW. c) COUNTY UTILITIES DEPARTMENT STANDARD: l. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Nealth District. 2. The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to . object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. d) COUNTY HEALTH DISTRICT STANDARD: l. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 4. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 5. Subject to specific application approval and issuance of permits by the Nealth Officer, the use of an individual on-site sewage disposal system may be authorized. e) COUNTY BUILDING AND SAFETY DEPARTMENT STANDARD: l. The site is located in Fire District #l. 2. The applicant shall provide verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of building permits. SPECIAL: 3. The Department of Building and Safety will require the applicant to identify critical materials and submit design requirements for the containment prior to the issuance of a building permit. f) WATER PURVEYOR 1. Water Purveyor is Irwin Water District #6, and they will supply the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY All air pollution regulations must be met. This includes but is not limited to the following: STANDARD: I. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Naul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken inmediately to clean these surfaces. 3.
