Background: At the public hearing of December 12, 1968, the Planning Commission approved the zone change request, subject to "the dedication and acceptance by Spokane County of a public road furnishing the required frontage to the applicant's property". Thls recammendation was to "becom. null and void one year from the date of the Planning Commission`s hearing" of December 12, 1968. The Planning Commission at the December 12, 1968, hearing did not make a judgment on the proposed trailer court since such a use "would require furthar public hearing before the Zoning Adjustor The required dedication was not completed by the deadline date although the dedication was eventually obtained by the County. The application had, Lherefore, been scheduled for the june 23, 1970 hearing for recon- sideration. . A. Reasons: 1. The property is located fn an area (east of Pines Rosd between Fourth Avenue and the Milwaukee Railroad tracks) indicated on th. Comprehc;nsive Plan as being suitable for high density residential development. 2. The members of the Committee present are Jane Myers, Chairperson, Lunell Haught and Verona Southern. PROPOSAL The sponsor, J. Anthony Scroggin, requests approval of a zone reclassification from Agricultural Suburban (AS) to Urban Residential-22 (UR-22), File No. ZE-31-90. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located 650 feet east of Pines Road at the end of Third Avenue, and adjacent to and south of the abandoned railroad right of way in the N 1/2 of Section 22, Township 25 N, Range 44 EWM, Spokane County, Washington 2. The committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area are vacant, vacant railroad right-of-way (future arterial), and single-family dwellings. 4. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of mulciple family development, including residential densities of those allowed in the Urban Residenrial-22 (UR-22) Zone. 5. The Arterial Road Plan designates the north property as a principal arterial, with a recommended right of way width of 160 feet, with 30 feet of future acquisition area being set aside. 6. The existing zoning of the property described in the application is Agricultural Suburban. 7. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been complied with and a Deterrnination of Nonsignificance was issued. 8. The legal requirements for public notice have been fulfilled. 9. The owners of adjacent lands expressed questions about Third Avenue and traffic generated from the rezone. 10. The proposed use is compatible with existing uses in the area. 11. The proposed zoning does implement and conform to the Comprehensive Plan. 12. The applicant has demonstrated that conditions have substantially changed since the origina] zoning of this area and accordingly, the proposed zone reclassification is justified. The Committee add.itionally finds/concludes: That the proposal should not be limited in height especially in light of the amount of road dedication and future acquisition area required of this property. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Cond.itions of Approval apply to the real property described below: The West 1/2 of the West 1/2 of Block 182, Opportunity, as recorded in Volume "K" of Plats, page 20, Spokane County, Washington. HEARING EXAMINER COMMITTEE 1. Third Avenue be extended as recommended by the Spokane County Engineer. COUNTY PLANNING DEPARTMENT 1. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning I?irector/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 2. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 3. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building pernuts. 4. All current standards of the Urban Residential-22 (UR-22) Zone, as amended, shall be complied with in the development of this site with 20 feet of Type III Landscaping as required by.ihe UR-22 Zone be required along Third Avenue extended. 5. The project is subject to Section 14.706, the Aquifer Sensitive Area Overlay Zone ' of the ZONING CODE FOR SPOKANE COUNTY, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 6. Landscaping shall be provided for this site, in conformance with Standards as identified in Section 14.806 Landscaping of the SPOKANE COUNTY ZONING CODE. • I-i.r_C Order for ZE-31-90 Page 3 7. Applicant shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 8. The applicant shall comply with all agency's regulations as amended prior to issuance of building permits. 9. A new site plan will be required as Third Avenue extended will cause a need for a new site plan which complies with Urban Residential-22 (UR-22) standards and conditions of approval. Note: The site plan as submitted is not approved. 10. Spokane County Planning Department shall record with the County Auditor a"Title Notice," prepared and signed by the applicant, for a future acquisition area for road right of way and utilities to run with the land The future acquisition area reservation shall not be remaved without prior approval by the Spokane County Planning DepartmenG The notice shall be recorded prior to the issuance of a building permit and shall provide the following: 11. At least 30 feet of future acquisition area for road right of way and utilities along the C.M. & ST. P. & P. RY (abandoned railroad right of way). 12. Building and other setbacks required by the Spokane County Zoning Code shall be measured from the future acquisition area reserved for road right of way and utilities. (Site plan will dictate yard setback, however a rear yard setback or side yard setback may be utilized from the Future Acquisition Area.) 13. No required landscaping, parking, '208' areas, drainfield or allowed signs should be within the future acquisition area for road right of way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. 14. The futune acquisition area, until acquired by Spokane County, shall be private property and may be used as allowed in the zone except any improvements (such as landscaping, parking, surface drainage, drainfields, signs, or others) shall be considered "interim" uses. ' 15. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 16. Requireri landscaping shall be placed as far away from future right of way improvements as possible such that they may remain after roadway improvements are made. . 17. The Spokane County Planning Department shall prepare and record with the Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This "Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The "Title Notice" shall be recorded within fifteen (15) days of final disposition of the approved land use action and shall only be extinguished by the Spokane County Planning Deparnnent. Applicant shall dedicate 60 feet for the extension of Third Avenue through the project for right-of-way. 2. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 3. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water d.isposal plan for the enrire project, or porrion thereof, if the development is to be phased. 5. A parlang plan and traffic cinculation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parlcing stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. ' 7. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Third Avenue, which is to be constructed within the proposed development. This will require the installaaon of 40 feet of asphalt. The construcrion of curbing and sidewalk is also required. 8. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construcrion and other applicable Counry stand.ards andJor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 9. Roadway standards, typicai roadway sections and dra.inage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 10. No construction work shall be performed within the existing or proposed public right-of-way until a pernvt has been issued by the County Engineer. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building pemvt, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 12. The County Arterial Road Plan identifies the C.M. & ST. P. & P. RY right of way as a Principal Arterial. The existing right-of-way width of 100 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 30 feet in width along the C.M. & ST. P. & P. RY right of way frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to the C.M. & ST. P. & P. RY right of way. Special Condiaons: 12. There shall be no access to C.M. & ST. P. & P. RY right of way which is to become a new Principal Arterial. 13. The beginning of the road extension is 690' east of Pines Road and extends approximately 180' east. Century West Engineering retained Howard Consuftants, Inc., to sample and conduct an "R" value test on the subgrade soils for this road extension. The results of that test are attached. Based on the resulting WSDOT "R" value of 27, please provide the pavement section that the County will require for this extension.
