The County Engineering-Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-31-90
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. 3rd, Typical Roadway Section No. Local Access
Standard. This will require the installation of 40 feet of
asphalt. The construction of curbing and sidewalk is also
required.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County

make a nice landscape feature out of the swale and I don't want to complicate the drainage plan unnecessarily.

Planning Commission Recommendation: Approve to Multiple Family
Suburban, subiect to the followinQ conditions:
1. The zone change shall not bECOme effective until mobile home s as a
permitted use and trailer courts, as a conditional use have been
deaeted from the Multiple Family Suburban Zone.,

Background:
At the public hearing of December 12, 1968, the Planning Commission
approved the zone change request, subject to "the dedication and
acceptance by Spokane County of a public road furnishing the required
frontage to the applicant's property". Thls recammendation was to "becom.
null and void one year from the date of the Planning Commission`s hearing"
of December 12, 1968. The Planning Commission at the December 12,
1968, hearing did not make a judgment on the proposed trailer court since
such a use "would require furthar public hearing before the Zoning Adjustor
The required dedication was not completed by the deadline date although
the dedication was eventually obtained by the County. The application
had, Lherefore, been scheduled for the june 23, 1970 hearing for recon-
sideration.
. A. Reasons:
1. The property is located fn an area (east of Pines Rosd between
Fourth Avenue and the Milwaukee Railroad tracks) indicated on th.
Comprehc;nsive Plan as being suitable for high density residential
development.
2. Becausc of the proximity of the subjact property to the railroad
tracks and the existing multiple family structure on tha property,
the Commission is of the opinion that the area could not reasonab'
be developed for standard single family residences.
3. The Commfssion is of the opinion that the subject property cou:d
be utilized for apartmenfis and court apartments in the same
manner as the apartment developments in a complementary locer.ic

4. However, the Commission is of thz opinion that a trailer court
facility on the subject property would be detrlmc;ntal to the
existing single family residences to the south of the ownership
along Fourth Avenue. Therefore, the Commission recommends
that the zone change not become effective until mobile homes as
a permitted use and trailer courts as a conditional use have becn
deleted from the Multiple Family Suburban Zone.(The Commis sion
has been in the process of evaluating the existing Multiple
Family Suburban Zone s to determine whether they are appropriate
for apartment uscs, mobile home uses, office uses, or other uses
and has been progressively zoning such areas into the appropriate
cla s sification . Thz Commis sion anticipate s taking action on the
appropriate revisions of the Zoning Ordinance in the near future.) '

A. Reasons:
1. The property is located in an area (between 4th Avenue and the
railroad tracks) indicated on the Comprehensive Plan as being . .
suitable for high density residential development.

HEARING EXAMINER COMMITTEE
FINDINCS OF FACT, CON .I.i1SIONS AND n$DE$
INTRODUCTION
This matter has come before the Hearing Examiner Committee on August 23, 1990.
The members of the Committee present are Jane Myers, Chairperson, Lunell Haught
and Verona Southern.
PROPOSAL
The sponsor, J. Anthony Scroggin, requests approval of a zone reclassification from
Agricultural Suburban (AS) to Urban Residential-22 (UR-22), File No. ZE-31-90.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located 650 feet east of Pines Road at the end of Third
Avenue, and adjacent to and south of the abandoned railroad right of way in the N
1/2 of Section 22, Township 25 N, Range 44 EWM, Spokane County, Washington
2. The committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area are vacant, vacant railroad right-of-way (future
arterial), and single-family dwellings.
4. The Comprehensive Plan designates this site as Urban. The Urban category is for
the purpose of mulciple family development, including residential densities of those
allowed in the Urban Residenrial-22 (UR-22) Zone.
5. The Arterial Road Plan designates the north property as a principal arterial, with a
recommended right of way width of 160 feet, with 30 feet of future acquisition area
being set aside.
6. The existing zoning of the property described in the application is Agricultural
Suburban.
7. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
complied with and a Deterrnination of Nonsignificance was issued.
8. The legal requirements for public notice have been fulfilled.
9. The owners of adjacent lands expressed questions about Third Avenue and traffic
generated from the rezone.
10. The proposed use is compatible with existing uses in the area.
11. The proposed zoning does implement and conform to the Comprehensive Plan.
12. The applicant has demonstrated that conditions have substantially changed since the
origina] zoning of this area and accordingly, the proposed zone reclassification is
justified.

13. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
14. The Committee add.itionally finds/concludes:
That the proposal should not be limited in height especially in light of the amount of
road dedication and future acquisition area required of this property.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Cond.itions of Approval apply to the real property described below:
The West 1/2 of the West 1/2 of Block 182, Opportunity, as recorded in Volume "K"
of Plats, page 20, Spokane County, Washington.
HEARING EXAMINER COMMITTEE
1. Third Avenue be extended as recommended by the Spokane County Engineer.
COUNTY PLANNING DEPARTMENT
1. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning I?irector/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired.
2. Direct light from any exterior area lighting fixture shall not extend over the property
boundary. 3. The specific development plan will be submitted for Planning Department review
and approval prior to issuance of building pernuts.
4. All current standards of the Urban Residential-22 (UR-22) Zone, as amended, shall
be complied with in the development of this site with 20 feet of Type III
Landscaping as required by.ihe UR-22 Zone be required along Third Avenue
extended.
5. The project is subject to Section 14.706, the Aquifer Sensitive Area Overlay Zone '
of the ZONING CODE FOR SPOKANE COUNTY, which sets forth various
measures for Aquifer protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
6. Landscaping shall be provided for this site, in conformance with Standards as
identified in Section 14.806 Landscaping of the SPOKANE COUNTY ZONING
CODE.

7. Applicant shall comply with '208' recommendations concerning stormwater runoff
and provide necessary landscaping for runoff.
8. The applicant shall comply with all agency's regulations as amended prior to
issuance of building permits.
9. A new site plan will be required as Third Avenue extended will cause a need for a
new site plan which complies with Urban Residential-22 (UR-22) standards and
conditions of approval. Note: The site plan as submitted is not approved.
10. Spokane County Planning Department shall record with the County Auditor a"Title
Notice," prepared and signed by the applicant, for a future acquisition area for road
right of way and utilities to run with the land The future acquisition area reservation
shall not be remaved without prior approval by the Spokane County Planning
DepartmenG The notice shall be recorded prior to the issuance of a building permit
and shall provide the following:
11. At least 30 feet of future acquisition area for road right of way and utilities along the
C.M. & ST. P. & P. RY (abandoned railroad right of way).
12. Building and other setbacks required by the Spokane County Zoning Code shall be
measured from the future acquisition area reserved for road right of way and
utilities. (Site plan will dictate yard setback, however a rear yard setback or side
yard setback may be utilized from the Future Acquisition Area.)
13. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be within the future acquisition area for road right of way and utilities. If any of the
above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
14. The futune acquisition area, until acquired by Spokane County, shall be private
property and may be used as allowed in the zone except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses.
' 15. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
16. Requireri landscaping shall be placed as far away from future right of way
improvements as possible such that they may remain after roadway improvements
are made. .
17. The Spokane County Planning Department shall prepare and record with the
Spokane County Auditor a"Title Notice" noting that the property in question is
subject to a variety of special conditions imposed as a result of approval of a land
use action. This "Title Notice" shall serve as official public notice regarding
conditions of approval affecting the property in question. The "Title Notice" shall
be recorded within fifteen (15) days of final disposition of the approved land use
action and shall only be extinguished by the Spokane County Planning Deparnnent.
The "Title Notice" shall generally provide as follows:

The parcel of property legally described as (legal description and tax parcel
number) is the subject of a land use action, imposing a variety of
special development conditions, by a Spokane County Hearing Body
or Administrative Ofticial on (date) and as maybe amended, altered or
supplemented by official action or as already changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department.
COUNTY ENGINEER'S OFFICE
Prior ToThe Issuance Of A Building Permit Or Use Of The PrUertv As Et?nosed:
1. Applicant shall dedicate 60 feet for the extension of Third Avenue through the
project for right-of-way.
2. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water d.isposal plan for the enrire project, or porrion thereof, if the
development is to be phased.
5. A parlang plan and traffic cinculation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parlcing stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
6. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
' 7. The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of Third Avenue, which is to be constructed
within the proposed development. This will require the installaaon of 40 feet of
asphalt. The construcrion of curbing and sidewalk is also required.
8. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construcrion and other applicable
Counry stand.ards andJor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. Roadway standards, typicai roadway sections and dra.inage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
10. No construction work shall be performed within the existing or proposed public
right-of-way until a pernvt has been issued by the County Engineer. All work

within the public road right-of-way is subject to inspection and approval by the
County Engineer.
11. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building pemvt, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements

12. The County Arterial Road Plan identifies the C.M. & ST. P. & P. RY right of way
as a Principal Arterial. The existing right-of-way width of 100 feet is not
consistent with that specified in the Plan. In order to implement the Arterial Road
Plan, in addition to the required right-of-way dedication, a strip of property 30 feet
in width along the C.M. & ST. P. & P. RY right of way frontage shall be set aside
in reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to the C.M. & ST. P. & P. RY right of way.
Special Condiaons:
12. There shall be no access to C.M. & ST. P. & P. RY right of way which is to
become a new Principal Arterial.
13. A one foot strip shall be dedicated at the terminus of Third Avenue on the eastern
portion of the proposed subdivision.
COUNTY UTILTTIES DEPARTMENT
1. Any water service for this project shall be provideri in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. Applicant will make connection to Public Sewer System. Plans and specificarions
are to be submitted to the Utilities Department for review. Applicant will be
required to pay additional GFC charges as per the County Ordinance.
COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilides Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
5. Use of private wells and water systems is prohibited.

COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Departrnent of Building and Safety at the earliest
possible stage of design/development in order to be informed of Code requirements
administered,/enforr-ed by the department, e.g., State Building Code Act regulations
such as requirements for fire hydrant/flow, fire apparatus access roads, smeet
address assignment, bairier-free regulations, energy code regulations, and general
coord.ination with other aspects of project implementation.
2. The issuance of a build.ing permit by the Department of Building and Safety is
required.
3. Requirements of Fire I?istrict No. 1 need to be satisfied during the building permit
process.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of acrivity during certain weather conditions. Haul roads
should be treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related activities.
2. All travelled surfaces need to be paved and kept clean. If traclang or spills occur on
paved surfaces, measures must be taken immediately to clean these surfaces.
3. Debris generated as. a result of this project must be d.isposed of by means other than
burning.
4. Solid fuel heating device regulations must be meL It now appears that any plat that
has more than one solid fuel heating device per acre has the potential to violate the
air quality standards for PM 10 (fine particulate matter). Possible mirigating
measures should be addressed in any plat with more than one solid fuel heating
device per acre. Such mitigating measures might include such things as limiting the
number of devices to less than one/acre, using of only "certified" devices, gas logs
in fireplaces, etc.

GENERAL:
Approach Permits are required on all new approaches as well as all
approaches that will be altered. Contact Sylvia Lightfoot at the
County Engineer's Department. Approach permits for county roads
will not be issued until a site plan is approved.
A bond or some other form of financial surety approved by Spokane
County needs to be submitted for proposals that require
improvements within the adjacent right-of-way. To expedite your
request for a building permit the County has 3 pre-approved bond
f ormats . I f you chose to use a dif f erent f ormat a member of the
County's legal staff will have to review it which will likely
result in a delay. The bond amount for this project has been
determined to be $29,000.00.
PLANS :
Sheet C1.1: Stationing must be adjusted to not ref lect negative
stationing.
The taper length should be extended to 100 feet. This direction has
come from Bob Brueggeman, County Traffic Engineer.
The swale on the south side of 3rd should be sodded. Hydroseeding
will be allowed only if there is a note on the plans must
indicating that the swale will be sodded when the property is
developed.
The area marked 4 on the plans is not shown on sheet C1.4. Please
correct the discrepancy.
The swales taking the road runoff must be covered by easement. A

Bill:
Third Road will be extended as a part of the above-referenced project. The beginning of
the road extension is 690' east of Pines Road and extends approximately 180' east.
Century West Engineering retained Howard Consuftants, Inc., to sample and conduct an
"R" value test on the subgrade soils for this road extension. The results of that test are
attached.
Based on the resulting WSDOT "R" value of 27, please provide the pavement section that
the County will require for this extension.

calculations marked "ORIGINAL". Please make the corrections and resubmit them to the
Building Department in order that the review process may proceed. When the plans are
resubmitted, mark all chanees on the revised print in color and include the mark-up. .
Please note that the plan set and calculations marked "ORIGINAL" are official public
documents, and must be returned with the revised plans and calculations. Review of the
