GENERAL INFORMATION APPLICANT: DOUGLAS DEAN LLOYD STATUS OF APPLICANT: Owner REQUESTED ZONING: Multiple Family Suburban EXISTING ZONING Commercial and Agricultural (established in 1958/1942) PROPOSED USE: Six-unit Apartment Complex and Conversion of Dwelling to a Three-unit Apartment. PROJECT LOCATION: This site is generally located west of Progress Road, approximately 160 feet and north of Trent Road, approximately 150 feet, located entirely north of Trentwood Drug Store. II. SITE PLAN INFORMATION SITE SIZE: Approximately .45 acres SITE CHARACTERISTICS: The site north of Trentwood Drug Store is weedy and presently vacant. The area of land south of the area proposed for re- zoning owned by Mr. Lloyd has a drug store and an area recently paved for parking and access to the northern portion of the property. NEIGHBORHOOD CHARACTER: The neighborhood can be described as having scattered residential and commercial activities in it. Kaiser Aluminum rests approximately one mile away to the south of the proposal. Most land north of the proposal is vacant or has new residential development. BACKGROUND/ANALYSIS Several factors are important to note in analyzing this proposal. A prob- lem may exist with the proposal since two differing uses are being proposed on the same property without appropriate subdivision review. Furthermore, the proposal may not be considered to comply with the Com- prehensive Plan. The Plan states that residential uses may be limited to existing uses in the Major Commercial category because the category was established to reserve lands for commercial use. Proper easements per- mitting access to the property should correct any problems regarding traffic congestion, but required septic systems may make it difficult to place this many units on this one parcel of land. Staff, therefore, recommends approval of this request, only subject to the following conditions. IV. AGENCIES RECOMMENDED CONDITIONS a) COUNTY PLANNING DEPARTMENT 1. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Admini- strator shall be submitted with a performance bond for the project prior to release of building permits. ZONE RECLASSIFICATION NUMBER: ZE-56-81 a) COUNTY PLANNING DEPARTMENT (continued) 3. All current standards of the Multiple Family Suburban Zone, as amended, shall be complied with in the development of this site. 4. The applicant shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 5. Applicant shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 6. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and/or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. 8. A short plat for the property separating the commercial use on the south from the proposed multi-family use to the north and in compliance with the Spokane County Short Plat Ordinance will be completed and approved before a building permit is issued. 9. Building shown on the Site Plan will be rearranged to comply with all setback requirements outlined in the Spokane County Zoning Ordinance. 10. A 30 foot easement from Trent Road to the proposal will be provided for purposes of access to the apartment units. 11 . Nine (9) parking spaces each 180 square feet in area will be arranged and marked on a site plan in order to accommodate vehicles having business with the commercial lot south of the said parcel. Said site plan shall be submitted to the Planning Department staff for approval prior to issuance of building permits. 12. A six (6) foot sight-obscuring barrier or other approved land- scaping objects shall be provided along portions of the south and western sides of this proposal (which will not affect access) to provide future residents of the proposal a buffer from exist- ing and potential commercial uses and from traffic occurring along Trent Road. Such a buffer should be designed to bring the proposal in conformance to the Comprehensive Plan. • • • ZONE RECLASSIFICATION NUMBER: ZE-56-81 b) COUNTY ENGINEERING DEPARTMENT 1. Access permits and improvements to SR-290 (Trent Road) must be approved by the Washington Department of Transportation. 2. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accord- ance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 4. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The owner, his heirs and suc- cessors shall further agree not to oppose or protest any legal assessments for any utility local improvement district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3. Any water service for this project shall be provided in accord- ance with the Coordinated Water System Plan for Spokane County. d) COUNTY HEALTH DISTRICT 1 . Water service must be coordinated through the Director of Utilities, Spokane County. 2. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 03 • ZONE RECLASSIFICATION NUMBER: ZE-56-81 d) COUNTY HEALTH DISTRICT (continued) 3. Use of private wells and water systems is prohibited. 4. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 5. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. As of June 1, 1981 , a moratorium has been placed on the practice of installing sub- surface sewage disposal systems under paving. 6. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1 . The site is located in Fire District #1 . 2. Mains and hydrants need to be installed in accordance with the Spokane County Department of Building and Safety. Access plans for firefighting equipment around the building shall be approved prior to building permit issuance. 3. Reclassification of an existing building shall require an application for change of occupancy permit and subsequent inspection for approval. f) WATER PURVEYOR 1 . The proposal lies within the boundary of Trentwood Irrigation District #3 who has indicated they are capable of handling water needs for the proposal. INTRODUCTION This matter having come before the Examiner Committee on September 10, 1981 , and the members of the Committee present being Kathleen Carstens, Chair- person, Eldon Thomas and Jerry Williams. B. PROPOSAL The sponsor, Douglas Lloyd, is requesting approval of a zone reclassification, File No. ZE-56-81 , Agricultural and Commercial to Multiple Family Suburban, for the purpose of developing nine multiple family units. • C. FINDINGS OF FACT 1 . That the existing land use in the area is residential, commercial, agricul- tural, and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing zoning of the property described in the application is Agricultural and Commercial . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non=Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6.
