I. FINDINGS OF FACT
a) Zone Classification:
1. North - Residential Mobile Home . 1970
2. West - Residential Mobile Home, 1971
3. South - Agricultural Suburban, 1971
4. East - Residential Mobile Home, 1970
b) Land Use:
1. Site - Mobile Horne and Single Family Residence
2. North - Single Family Residence
3. West - Single Family Residence
4. South - Vacant land and Single Family Residence
5. East - Vacant land and Single Family Residence
c) Regional Comprehensive Plan - 1968
The Plan Map has designated this area appropriate for residential development.
II. SPECIFIC INFORMATION
a) County Enaineer's Office:
The County Engineer's Office has requested the following be considered if the
rezone is approved:
NOTE: All required improvements shall be built to meet or exceed minimum
County construction standards.
1. Applicant shall construct cement concrete curb, five foot wide sidewalk

2. A plicant shall obtain approval for on and off -site drainage & access
plans before issuance of building permits.
b) Spokane County Health District:
The applicant shall comply with rules and regulations of the Health District
in providing for adequate sewage disposal.. All necessary Health District
permits shall be obtained prior to building permit issuance.

c) Fire Protection
Mains and hydrants to be installed, in accordance with the Spokane County
Fire Marshal's requirements.
d) Environmental Review
The Staff recommends that a Final Declaration of Non - Significance be signed
by the Board of County Commissioners.
III. CONDITIONS:
If the Planning Commission approves this request, the following conditions should
be considered:
a) Compliance with all requests stated under Specific Information above.
b) The applicant shall develop subject property generally in accordance within
the concept presented to the Planning Commission. Minor variations when
approved by the Zoning Administrator will be permitted , including, but not
limited to the following changes: Building location, building materials, land-
scape plans, and general allowable uses of the permitted zone. All variations
must conform to regulations set forth in the Spokane County Zoning Ordinance.
The original intent of the development plans shall be maintained.
c) A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to building
permit issuance.
d) That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 R.C.W.
and the Board of County Commissioners' Resolution #77 -1392 be accomplished
by the applicant within thirty (30) days of formal action by the Board, as instruc-
ted by the Planning Department Staff.
e) Interior driveways and parking areas shall be paved.
f) That, if after one year from the date of the Planning Commission's action, the
applicant has not received final adoption of the zone change, the application
is void.

FINDINGS AND ORDER REGARDING ZONING M AP PROPOSAL, Z&
RESIDENTIAL MOBILE HOME TO RESIDENTIAL OFFICE: SPENCER
WHEREAS, The Spokane County Zoning Hearing Examiner Committee
did, after public hearing on October 20, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map be changed from the
existing Residential Mobile Home classification to the Residential Office
classification on property described as follows:
The North 100 feet of Lot 2, Block 2 of Caroline Addition in
Section 23, Township 25 N., Range 43, E.W.M., Spokane
County, Washington.
and,
WHEREAS, The Board having conducted its own public hearing on
December 4, 1978, at the request of Larry Dusek, West 1025 Indiana Avenue,
Spokane, WA, et al, to present evidence and testimony in favor and opposition
to the application, and
WHEREAS, At said hearing opportunity was afforded those favoring
and those opposing the above — described Zoning Map proposal, and the Board of
County Commissioners of Spokane County having fully considered the testimony
given, the records, and minutes of the Zoning Hearing Examiner Committee and all
other evidence presented and having personally acquainted themselves with the
site and vicinity in question, does hereby find:
1) That we concur with the Zoning Hearing Examiner Committee's
recommendations as contained in their minutes of
October 20, 1978, and that we find the reasons expressed by
the Zoning Hearing Examiner Committee to be sufficient and
controlling.
2) That the Board of County Commissioners upholds the recommen—
dation of the Spokane County Zoning Hearing Examiner Committee
for approval, subject to the findings and conditions set forth in
the Zoning Hearing Examiner Committee minutes of October 20,
1978.
3) The Board of County Commissioners also concurred in the
Planning staff's recommendation that a Final Declaration of
Non — Significance be i ssued.
