ZE-34-61 - AGRICULTURAL TO RESTRICTED INDUSTRIAL - CONSIDERATION OF
DEVELOPMENT PLAN: PEARSON
Planning Commission Recommendation: Approve to Restricted Industrial Zone,
subject to the following conditions:
A. Conditions:
1. The advertised property shall be developed in substantial conformance
with the approved "development plan" on file with the application.
2. Installation to Spokane County standards of curb, and paving to
existing oil along Park Road; i.e., the east boundary of the develop-
ment proposal.
3. Installation of fire hydrants in accordance with the requirements of
the Valley Fire Marshal.
4. 'All areas used for parking or circulation shall be paved or maintained
with a dust -controlling surface.
Background:
In 1961, the Solar Natural Gas Company, Inc'., requested that Tract 2, except
the East 140' be zoned Restricted Industrial, and the East 140' of Tracts 1 and
2 be zoned Commercial. Because of neighborhood concern to the extension of
Commercial and Industrial zoning to Park Road, the Planning Commission and
subsequently the Board of County Commissioners denied the Commercial
request for the East 140' of Tracts 1 and 2. Because of the neighborhood's
concern for the eventual utilization of the proposed industrial area, the Board
of County Commissioners on November 7, 1961, imposed the following
conditions on the Restricted Industrial segment of the application:
"1) The Board of County Commissioners recognizes that there are substantially
residential dwellings in the immediate area to the east of the property in
question and, therefore, gives conditional approval to the zone change for
a period of one yearto December 1, 1964
2) Prior to the official order changing the Zoning Map, the applicant shall
submit to the County Planning Commission for their consideration and
review a specific land use proposal for the property in question. The
Planning Commission shall review such proposed use to assure that
such use will not be detrimental to adjacent and surrounding properties
by reason of dust, smoke, odor, noise, or traffic congestion."

The present developer, Mr. Roy T. Pearson, submitted to the Planning
Commission for review, a proposal for a building material supply - hardware
store complex. Because of the wording of the Board of County Commissioners'
findings and order, the matter was returned to the Planning Commission for
review.
B. Reasons:
1. After reviewing the submitted development plan, the Planning
Commission is of the opinion that the proposed use would "not be
detrimental to adjacent and surrounding properties by reason of
smoke, odor, noise, or traffic congestion". (The traffic flow would
be oriented toward Park Road, a major arterial.)
2. The subject property is on the edge of a developing residential
district. The Planning Commission is of the opinion that the proposed
use will help serve as a buffer area between the Yardley industrial
district and the residential neighborhood to the east of Park Road.
2. Properties to the north, west, and south of the advertised parcel
are zoned in industrial classifications.
