To help you recall the matter this was a zone change application which originally requested part of the subject property be rezoned restricted industrial and part multi- family. After the original zone change application was made, the staff prepared conditions for approval which included sidewalks around the multi- family portion of the application. It is this particular condition I am addressing. Upon final approval of the zone change at the appeal stage, the County Commissioners rezoned the entire parcel restricted industrial without the existence of a new site plan. Consequently, the conditions for road improvement were never changed to account for the change in use that occurred. I am preparing to hire an engineer to draft the road engineering plan at this time. I am requesting that your office give written approval to develop the roads per the conditions stated in the Commissioners Resolution (attached) with the exception of the condition requiring sidewalks around that portion of the site which was originally proposed for multi- family use in view of the fact that the use was changed to restricted industrial. During a conversation you and I had on January 24, 1980, you indicated the sidewalk requirements would be waived on Buckeye but you were unsure at the time about the necessity for sidewalk on University. I agree that in the future a sidewalk may be desirable on University. However, I don't feel that an island of sidewalk today leading nowhere would have any - value. Is there a way I can eliminate that require- ment for the present but agree to install the sidewalk when more activity develops in the neighborhood and the sidewalk can then be tied into that development.
