' Subject: Field Inspections for Building Permits Date: April 17, 1995 Jim, It has come to the attention of the Engineering Department that the site at N. 1520 Pines (Divines Auto) is not being constructedlinspected as per the approved site/drainage plan. The Engineering Department is under the assumption that the Building Codes Department inspects the projects during construction and any deviation from the plan is forwarded to the Engineers for approval. This site included a future acquisition area which is set aside for purchase by the County. By not adhering to the site plan, the entire site seems to be elevated 3-4 feet above approved grade. This grade difference is going to cost a great deal to redesign the site when the acquisition area is taken to improve Mission for traffic impacts. Pines Ref No. B94172 Parcel No: 45152.0708+ Review Pre App The County Engineering Department has completed a review of the above referenced project. The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: 1. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. B) The subject property is affected by the "Findings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE 36-94 C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. You must submit road and drainage plans for street improvements. These must be prepared by an engineer. Plans must be prepared for the following streets: a. Mission Ave. Typical Roadway Section #1 b. Pines Ave. Typical Roadway Section #1 All required construction (sidewalk/curbing/pavement) within the Public Road Right of Way is to be completed prior to the release of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Required plans are to be submitted prior to estimating the amount of the financial guaranty or permit release. 2. As an alternative to the required road improvements t ~ Page 2 the County will accept an RID/CRP agreement "Notice to Public No. 6" on the property. r3. Applicant shall dedicate 2 feet on Mission ave for ~ right of way. 4. Please submit a copy of a recorded property deed from the Auditors office for the subject property. Upon receipt of the deed our staff will prepare the right of way deed and/or the RID/CRP agreement. 5. Approach permits must be obtained, after a site plan has been approved, and before the issuance of a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Mission Ave: Applicant shall reconstruct the curb and sidewalk aat the existing curb cuts at the time of building permit. b. Pines Rd. Contact WSDOT D) Insufficient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. 2. Drainage plan as specified. 3. Other information: a. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. It is illegal to back out onto the Right of Way. b. The Washington State Department of Transportation appears to be agency of jurisdiction on this project and should therefore have their own signature block on the permit. I c. The County Arterial Road Plan identifies Mission Ave as a Minor arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the ~ required right-of-way dedication, a strip of property 8 feet in width along the Mission frontage shall be set aside in reserve. I This property may be acquired by Spokane County at the time ' arterial improvements are made to Mission. E) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the improvement. F) The owner of the property or the authorized representative must complete and sign Spokane County , Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Office. Plan review will not be completed until this document is executed. This r . Page 3 document is attached to these comments. Please return the completed Agreement to your contact person at the Engineers Department. G) See comments on the attached check print. Please return the check print to your contact person at County Engineering. The applicant or their representative is responsible for including each item that is marked "Required By This Project" in their submittal in accordance with the checklist descriptions. Each item submitted that is to meet the checklist shall be checked off by the applicant or their representative. Submittals which do not conform to the above requirements will be returned for further items with no review being accomplished. This will prolong the review process. If changes occur in the requirements for the project because of further conversations with Spokane County representatives, please attach a note explaining the agreed upon change in requirements. When the applicants' submittal is finally approved, the Engineers department will release their portion of the Building Permit. When this is done it will be apparent that there is a serious problem with the areas provided for Swale A and Swale B. Swale C's area is also reduced, but not as dramatically. Ridge lines and drainage basins need to be re-figured, based on the elevations shown. This will necessitate a re-calculation of required swale areas. Please show flow arrows for runoff. It is suggested that the elevations on the fueling pad be re- figured to prevent runoff from flowing across the pad. If the design remains the same, the elevations at which the runoff flows onto and off the pad need to be shown. The slope on this slab may also need to be examined. A detail of the swale inlet structure needs to be shown on the plans. Need to show precise location and orientation of swale inlet structures on the plans. The calculations for the size and number of drywells need to be included. A bond in the amount of $2,000.00 will be required for the reconstruction of the sidewalks along Maxwell Avenue and Mission Avenue. A property deed is required if the applicant decides to proceed with a Road Improvement District Agreement. This is an agreement to not protest the formation of a Road Improvement District. This document is required in lieu of making necessary roadway improvements. A deed is also necessary if right-of-way is required. SPOKANE COUNTY HEARING EXAMINER COMMTTTEE FINDINGS OF FACT, CONCLUSIONS AND ORDER ~ ~2, . 1094 INTRODUCTION ~ t ~i~,~crit~, This matter has come before the Hearing Examiner Committee on A'~gu~t ~1994 continued from the August 18, 1994 Hearing Examiner Committee. The members of the Committee present are: Harry Gibbons, Chair, Marshall Tomsick (absent) and Frank Yuse. PROPOSAL The sponsor, Ardith Divine, requests approval of a Zone Reclassification, ZE-36-94, from Urban Residential-3.5 (UR-3.5), Neighborhood Business (B-1), and Regional Business (B-3) to Regional Business (B-3) for auto repair, car wash, service station, impound yard, and those uses allowed in the Regional Business (B-3) zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located at the southeast corner of the intersecaon of Pines Road (State Route 27) and Mission Avenue in the NW 1/4 of Section 15, Township 25 North, Range 44 EWM, Spokane County, Washi-ngton. 2. The Committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area include professional offices, commercial uses and a hospital. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Urban and Major Commercial which may be considered a transitional area. Transitional areas which are between two (2) or more Comprehensive Plan land uses categories may comply with either of the land use categones dependent upon the decision makers' site specific approval. The Urban category is intended to provide opportuniry for development of a"citylike" environment which includes vanous land uses and the Major Commercial category is intended to provide the opportunity for development of commercial uses, specifically community and regional shopping centers, commercial and office uses directly related to major throughways. 6. The proposed Regional Business (B-3) zone does implement and conform to the Comprehensive Plan. 7. The Spokane County Arterial Road Plan identifies Mission Avenue as a Minor Arterial with an existing right-of-way width of 60 feet and a planned right-of-way width of 80 feet. In order to implement the Arterial Road Plan, the Spokane County Engineer is requesting that a strip of property 10 feet in width along Mission Avenue be set aside as Future Acquisition Area (FAA). Maxwell Avenue ~ f ' . is a local access street and is not designated as an arterial. Pines Road (State Route 27) is a state highway controlled by the Washington State Deparnnent of Transportation (WSDOT). 8. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), Neighborhood Business (B-1) and Regional Business (B-3) previously established as Agricultural Suburban (AS), Local Business (LB) and Commercial (C) zoning in 1955, 1980 and 1981 respecrively (ZE-99-55, ZE- 64-80C, ZE-147-81C) and redesignated to Urban Residential-3.5 (UR-3.5), Neighborhood Business (B-1) and Regional Business (B-3) on 7anuary 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. The proposal does conform to the requirements of the proposed Regional Business (B-3) zone. 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. 11. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accord.ingly, the proposed zone reclassification is justified. Specifically, changed conditions include the designation of Mission Avenue as an arterial and the establishment of commercial uses along the Pines Road corridor. 13. The proposed use will not be detrimental to the public health, safery, morals or welfare especially in light of the condirions recommended by the reviewing agencies. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: Lots 6, 7, 8, and 9, Block 1 of Mission View Addirion, Spokane County, Washington. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Regional Business (B-3) zone and Aquifer Sensirive Area (ASA) Qverlay Zones, as amended. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Planning Director/designee, may be pernutted, including, but not limited to building locarion, landscape plans and general allowable uses of the permitted zone. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building pernuts. 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impa.ired. 5. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 6. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Tide Notice shall be released, in full or in part, by the Planning Department The notice should be recorded within the same rime fra.me as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisirion area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Mission Avenue. NOTE: The County Engineer has required 2 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interun uses. 7. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special condiaons imposed as a result of approval of a land use action. This Tide Notice shall serve as public notice of the condirions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project, and individual service will be provided to each lot. Use of individual on-site sewage disposal systems shall not be authorized. 5. Use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISIQN OF BUILDINGS 1. The applicant shall contact the Division of Build.ings at the earliest possible stage in order to be infonned of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include: addressing; fue apparatus access roads; fire hydrant/flow; approved water systems; building accessibility; construction type; occupancy classification; exiting; exterior wall protection; and energy code regularions. (Note: The Division of Buildings reserves the right to confirm the actual address at the time of building pennit.) HEC Qrder for ZE-36-94 Page 5 . SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and enussions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related acrivities. 3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parlcing areas, access roads) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article V, requires that a Norice of Construction and Application for Approval be submitted to and approved by our agency prior to the construction, installation or establishment of an air pollurion source. This includes gasoline retail facilities. 6. Chapter 173-491 WAC requires that gasoline dispensing facilities with an annual throughput of 360,000 gallons or greater or new facilities with nominal storage capacity of greater than 10,000 gallons must install Stage I Vapor Recovery Equipment by December 31, 1993 or upon construction or upgrade to the facility. In addition, Chapter 173-400 WAC requires all new air pollution sources to use best available control technology to control emissions. For gasoline stations this may involve the installadon of Stage II plumbing and possibly complete Stage II systems. 7. SCAPCA Regulation I, Article IV requires registration with this agency. 8. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.) 9. Demolition and renovarion projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX. Intent to Demolish forms are available at the SCAPCA office. 10. Some objecrionable odors will li.kely result from this project SCAPCA's regulations state that effecrive control apparatus and measures must be used to reduce odors to a minimum. 11. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits by the Nealth Officer, the use of an individual on-site sewage system may be authorized. 4.
