The Spokane County Planning Department has completed a review of the above referenced
project. The following information must be submitted in order for this office to proceed
with our review to deternune compliance of the project with all applicable Planning
Department standards and conditions. Please submit all revised information to the
Department of Buildings for circulation of the information to all implementing
departments.
A. The proposal shall meet all conditions of the above mentioned land use actions. The
Administrative Interpretation (AIE-13-93), approved a modification to the original
professional office complex by allowing ten (10) double occupancy and twenty (20) single
occupancy units for elderly residents as shown on a submitted site plan. This proposal
requests thirty two (32) additional units on a significantly different site plan. In order for
this proposal to proceed as shown on the submitted site plan, an additional Administrative
Interpretation will have to be executed along with proper notification of surrounding
property owners and a twenty (20) day appeal period. Please contact Steve Horobiowski,
Current Planning Administrator, at (509) 456-2245 regarding a possible Administrative
Interpretation.
B. The two involved parcels need to be aggregated into one parcel through a Certificate of
Exemprion. Forms are available at the Planning Department portion af the Building Permit
Center. T'he applicant shall provide a copy of the Certificate of Exemprion as well as a copy of the
completed Segregation Form from the Assessor's Office to the Planning Department.
C. A revised site plan shall be submitted indicating the following:
1. The proper legal description of the parcel (after aggregation).
2. Clearly identify, label and dimension all property lines and the centerline of
Vercler Road.
3. Clearly illustrate and dimension building setbacks to all property lines and the
centerline of Vercler Road.
4. Provide calculations verifying no more than sixty-five percent (65%) of the site
is covered by building foot print.
5. Note building height in feet and stories. Include a note identifying basements
andlor mezzanines.

Maximum height of buildings and structures within the UR-22 zone shall be fifty
(50) feet.
6. The required number of parking stalls for the proposal has not been determined.
The Planning Department will evaluate the project and get back to the applicant with
the number of required parking stalls.
Off-street parking requirements will be based on the following ratios:
a. Retirement/elderly apartmenrs: One (1) space per dwelling unit; OR one (1)
space per three (3) dwelling units when a deed restriction is filed against the
property limiting use of the site to retirement/elderly housing.
b. All other parking ratios depending on the specific uses within the building.
7. Note the paving of all parking areas and traveled areas as required by code.
8. Dimension a typical off-street parlang stall and all rravel surfaces as per Zone
Code Standaxds. (See Handout)
9. Locate and describe all traffic control devices (painted parking stalls on asphalt,
directional arrows at points of ingress/egress, wheel stops, curbing, etc.)
10. Locate all detached and attached signage on the site plan, if any is proposed.
Submit elevation drawings of all signage, including dimensions, copy on the face
of signs and a note of gross area per face of sign for review with code standards.
Applicant does have the oprion of receiving sign permit approval through a separate
review.
11. Illustrate fencing (existing and proposed). Note the height and type of fencing.
Fences within residential zones shall not exceed six feet in height along internal
property lines. Fences are limited to three feet in height if sight-obscuring and four
feet in height if non-sight-obscuring when located within any front andJor flanking
street yard.
12. No exterior storage is permitted within the UR-22 zone.
13. If any outdoor trash or refuse containers are proposed to serve this mulrifamily
dwelling project or office, these areas shall be screened on all sides from public
view by a minimum five and one-half (S 1/2)-foot high wall or fence.
Please note the outdoor refuse storage area on the revised site plan and note the
height and type of enclosure proposed.
14. The Zoning Code of Spokane County requires all utility hardware to be placed
underground or to be screened from view with a decorative block wall or
landscaping. Said screening shall be as high as the highest portion of the
equipment and shall be permanently maintained.
Note the utility hardware will be placed underground or the rype and height of
screening proposed.
15. If parldng lot lighting is proposed, the lights shall be constructed, shielded and
used so as not to illuminate directly or create glare visible from adjacent properties
or public rights-of-way.
Locate the exterior lighting fixtures and illustrate the d.irection of illumination.

16. The proposal shall meet all requirements of Section 14.706 the Aquifer
Sensitive Area (ASA) Overlay zone.
Any proposal or development of condominiums, mobile home parks, mulrifamily
dwellings and/or offices in the UR-22 zone that generates one thousand (1,000) Average
Weekday Vehicle Trip Ends shall have its owner or representative negotiate in good faith
with the Spokane Transit Authority for the possible provision of facilities that would
enhance the provision of public transit.
D. A detailed landscape plan shall be submitted indicaring the following:
l. A twenty (20)-foot-wide strip of Type III landscaping is required along Vercler
Road.
Note the location, size and rype of species at the time of installation so that the
definition of a Type III landscape strip is met. .
Definition of a Type III landscape strip indicates a mix of evergreens and deciduous
plantings including living trees, shrubs and ground covers. Plantings of shrubs
and ground covers shall be chosen and spaced to result in a covering of the
landscape strip within three (3) years. Shrubs shall be of a type that do not exceed
a height at maturity of approximately three (3) to four (4) feet. Deciduous trees
shall have a trunk diameter of one and three quarter (1 3/4) inches at the time of
planting and be spaced so as to result in touching of branches after ten (10) years of
normal growth or approximately every thirty (30) feet on center. Evergreen trees
shall be a minimum of four (4) feet tall at the time of planting and space so as to
result in a space between trees approximately equal to the mature spread of the tree
used.
2. A ten (10)-foot-wide strip of Type I landscaping is required along all property
lines abutting UR-22 zoned properties when abutting a public or institutional use.
The proposed addition abuts UR-22 zoned property on the north and east.
Note the location, size and rype of species at the rime of installation so that the .
definition of a Type I landscape strip is meL
Type I landscaping shall generally consist of a mix of predominantly evergreen
plantings, including living trees, shrubs and ground covers. Evergreen trees shall
be a minimum neight of four (4) feet at time of planting. Piantings snall be chosen
and spaced so as to grow together within three (3) years in a manner that is
sufficient to obscure sight through the barrier. The entire planting strip shall be
landscaped; however, those plantings used to achieve the sight-obscuring screen
shall cover at least (5) feet of the width of the strip, and shall be located farthest
from the property line. Existing vegetation may be incorporated into the landscape
design as set forth in Secrion 14.806.080 and shall be considered acceptable in lieu
of new plantings, provided that it contributes to achieving the intent of this section.
3. The minimum landscaping requirements of the Code are required to be met for
the parking area. A minimum of 10 percent of the parking area is to be landscaped
such that all parlcing stalls are located within 60 feet of a landscape feature
consisting of 32 square feet in area.

This landscaping shall be located between parking stalls, at ends of parlcing
columns or between stalls and the property line. Landscaping located between a
parking lot and a recreational area or building will not satisfy these conditions.
As per Section 14.802.220(7) parking lot landscape features shall include liberal
landscaping including combinations of such materials as trees, ornamental shrubs,
gravel, river rock, driftwood, rockeries or lawn, provided that these materials are
approved by the County Engineer in relarionship to stonnwater disposal methods
within the '208' Aquifer Sensitive Area.
4. Where off-street parking stalls abut residentially zoned properties along internal
property lines, a minimum six foot high screening device, or a five (5)-foot-wide
planting area with Type I or Type II shall be installed.
Please, locate the screening device and/or landscape strip as per code standards.
5. Illustrate and call out the 6-inch-high protective curbing around all landscaped
areas adjacent to parking lots and travel surfaces.
b. Note an approved automatic irrigation system will be installed to maintain the
plantings.

FINDINGS AND URDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
July 1, 1987, and the members of the Committee present being Phillip J.
Harri s, Chai rman, and Gary Anderberg and John ►n'. Skadan.
6. PROPOSAL
The sponsor, Dr. Greg Doering, is reauesting approval of a zone
reclassification, File No. ZE-29-87, f rom Agricultural Suburban to Urban
Residential-22 {UR-22} Zone, for the purpose of developing a retirement
center and professional offices.
C. FINDINGS OF FACT
1. That the existing land use in the area is single family residences,
new construction, offices, parking, hospital, and open area.
2. That the Comprehensive Plan designates this area as appropriate for
Urban deve] opment.
3. That the existing Zoning of the property described in the application
i s Agricul turai Suburban (establ i shed 1955).
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of iVon-Significance.
5. That the proper 1 egai requi rements for adverti sement of the Agenda
Item have been fulfilled.
6. That tne land in this area is suitable for the proposed use, or uses
wi thi n the proposed Zone Cl assi fi cati on,
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed disappraval of the
proposed use. Specific concerns were that the approval be
conditioned, as was the preliminary plat on this site (pE-1294-79 and
ZE-77-79), for only office use. Additionaliy, there was concern over

the location of the two easterly most parking spaces, for the
boarding house, approximately 10 feet from the east property 1ine.
The Hearing Examiner Committee feels that situations have change
signifiCantly since 1979 to the point that prohibiting residential
uses would not be appropriate. In regards to the parking stall
location, it is noted that a n foot tall barrier and at least
landscaping is required between the stalls and the property line.
The applicant is encouraged to further mitigate this situation, if
possible, with the Zoning Administrator prior to release of building
pe rmi ts.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) The Comprehensive Plan's Urban category supports the development
of high density residential and non-residential uses provided
site location is appropriate and measures are taken to insure
compatibility witn adjacent potentially incompatible land uses.
b) The proposed design concept provides an acceptable land use
transition south along Vercler Road from office to residential
use.
c) The proposed site development plan indicates planned measures to
insure compatibility along the east and south property line in
the form of fencing and landscaping. That buffering will be
reviewed for compliance with the Spokane County Zoning Code
standards at the time of building permit review. The standards
of the Spokane County Zoning Code should also provide adequate
buffering for the northerly portion of the property which will
be developed for future professional offices.
d) The existing land use and zoning pattern has established this
area as a medical, office, and higher density residential area.

8. Applicant shall dedicate 10 feet on Vercler Road for
right-of-way prior to any use of the property.
9. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of
Vercler Road which is to be adjacent to the proposed
developrnent. This will require the addition of approximately 12
to 14 feet asphalt, curp and sidewalk.
c) COUNTY UTILITIES DEPARTMENT
SPELIAL:
l. Make connection to Valley Sewer.
d) COUNTY NEALTH OISTRICT
STANDARD:
l. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be by-an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
3. Water service shall be coordinated through the Director of
Utilities, Spokane County.
SPECIAL:
4. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to sale.
Use of individual on-site sewage disposal systems shall not be
authorized.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
STANDARD:
l. The site is located in Fire District #l.
2. In accordance with Section 301 of the Uniform Building Code, all
5uildings and structures including mobile homes and fences over
six feet in height requires the issuance of a building permit by
the Depa rtment of Building and Safety.

3. Fire hydrants for commercial and industrial buildings shall be
located so that no portion of the building exterior is more than
175 feet f rom the hydrant.
4. Specific location of hydrants shall be determined by the fire
district.
5. Commercial dumpsters and containers with an individual capacity
of 1.5 cubic yards or greater shall not be stored or placed
witnin five feet of combustible walls, openings or combustible
roof eave lines.
o. Depending on the extent of existing water mains and hydrant
locations, fire hydrants which meet the minimum fire flow
requirements as enumerated in Chapter o, Title 3 of the Spokane
County Code, may be required to be installed prior to any
construction.
7. The applicant shall provide verification from the Fire District
to the Department of Building and Safety that provisions have
been made for adequate fire protection prior to the release of
building permits.
f) WATER PURVEYOR
1. Water Purveyor i s i+lodern El ectri c'vJater Company, and they wi 11
supply the site with adequate water for domestic, fire and
irrigation uses once specific arrangements are made with the
district.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
STANDARD:
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions f rom
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.

The Spokane Counry Planning Department has been requested (see enclosed) to interpret a
condition of approval (AIE-13-93) regarding propert}r located along the east side of Vercler
and approaimately 7(}0 feet south of Mission Avenue.
The site was approved for the Urban Residential-22 (UR-22) zoning by the Spokane
County Hearing Examiner Committee, on July l, 1987 to allow a retirement center and
professional offices. The Find.inbs of Fact indicate that this is the proposal bein'cr
approved, but the committee did not limit or condiaon the site to require that only
professional offices be permitted on the northern portion of the site. In fact, as a condition
of approval they stated: "The applicant shal1 develop subject property generally in
accordance within the concept presented to the Hearing Examiner Committee. Variations
when approved by the Zoning Administrator will be pernlitted, included, but not limited to
the following changes: Building location, landscape plans, and general allowable uses of
the nermitted zone. (emphasis added).
The Planning Department has received a request (see enclosed) to modify the approved :
professional off'ice complea by allowing ten (10) double occupancy and twenty single
occupancy units retirement center for elderly residents.
This letter does hereby authorize the requested modification as described above and
depicted on the enclosed site plan.

7'his letrer is regarding seeking Adminisrrative Planning approval to expand the facility
of Brighton Court at 1308 North Vercler. The expansion would be comprised of ren double
occupancy and n•venr}- single occupancy units. The uniCs would be huilt on parcel
numUer 45152.1014 and would be attached to the existing facilit}-. 1vit11 2.335 acres on site,
31 new units ar'e allowed under existing UR-22 zonin.g.
The Spokane Counn, Hearing Examiner Committee Findinas and Order (reference Zone
Change file number ZE-29-8 i) indicates that the northern portion of rhe property would
he developed for professional offices. This however, is not consisrent Nvith Br.ighton
Courts expansion plans based on rhe need for more asszsted care units for a rapidly
g.t-owing elderiy population. We are hereby requesting an admiiustrative interpretation
on the Findings of Fact and Conditions to allow the expansion of Brighton Court on rhe
northern porrion of this site.
We ar Brighton Court believe for the following reasons the besc use of the northern
portion of rhe land would be for our proposed faciliry expansion:
1. The above mentioned Finding of Fact is not Conditioned to nreclude develooin2 this
tvne of scructure on the northern portion of the land parcel. ln fact, the Standard~
Conditions and Contingencies states Chat, "variations...... wil1 be nernutted in '
aeneral allowable uses of the permitted zone." The proposed development is a use
nermitr.ed in the UR-22 Zone Classification. Also, the Finding of Fact states rhat,
"the land in this area is suitable for the -oronosed use. or uses within the pror)osed
Zone Ciassitication. -
2. The proposed one-story addition to Brighton Court would be less obtrusive than a
professional office buildi.ng because it would be constructed in the same attractive
rraditional stvle as the existing building, providing more continuiry to the
neighborhood. A professional office building would be a diFferen i style, will require
another sight obscuring fence to be placed between the two buildings and would
have more than twice as much parking space as Brighton Court would requi.re.
In conrrast to a typical apartment building, Bz7.ghton Gourt has much fewer and
very quiet residents, who eat in a common din.ing room and do not venture
outdoors very often, resulting in much less traffic and noise. There are usually
no residents that drive or own a vehicle, and aC any given time there are usually
fewer than ten employee vehicles present. It is expected that rhe added units will
require an increase of only three employees during any one shift. Also, there will
be far fewer residents living at Brighton Court rhan would be allowed to live in a
rypical apartment bu.ilding.

5. A six-foor obscure cedar fence and a 20 fooC NNide strip of T~~pe II landscapin~ ~~~dll
be construcred along the east properr'y line to provide a buffer between Brighron
Gourt- and its residential neibhbors. On Che norCh side Type II landscaping wil( bE
placed along an existina obscure chain-link fence. On the wese side Type zIl
landscaping \,\rill be placed to provide as a buffer to the street.
6. Because the conficyuration of Brighron Court, and the proposed additaon is so
faznily orienred, its value ro rhe community is high. ln addition to providin; a
much needed communinj serlice as an assisted care facility, it's layour and its
central va11ey location also provides an excelleut setting for importazat outside
contact and >>isitaCion. Children of rhe elderlv are currenrl;, lookinb for safe
livinb arrangements of this typc which provide their parents with respcct and
independence, and }%er are well tak-en care of with their physical neEds met.

ex.isting site as well as the proposed addibon.
