That the individual.s and parties named herein as having an
interest in the above described property or project agree to the
following: 1. Reimburse Spokane County for•project review and inspection
fees as specified in Board of County Commissioner's
Resolution 80-1592 attachment C, as amended. The fees will
be based on actual salary costs incurred by Spokane County
for project reviews and / or inspections plus a ten percent
administrative charge, and will be billed monthly as
accrued.
2. The undersigned agrees that these fees are due and payable
upon receipt of the billing as specified above. The
monthly bil•ling-should be sent-to the attention of:

Dear Mr. Rosier:
We received your May 9, 1990 letter to Jim Manson today expressing
certain concerns stated in the minutes of the above-referenced
meeting. The following reflects those concerns and should be
considered amendments to the minutes:
1) Change a portion of the language in the first paragraph under
"Scope/Project Description" to read:

2) Clarification of Item No. 4's intent under the Planning*

Your minutes make it sound like Mr. Har(r)ington
suggested a method and that I was not going to do it that
way. All I was trying to do was make it clear that when
the "dust settled" we would have two separate parcels
with a common ownership and the parcels bound by a
reciprocal easement.."
3) Add a word to Item No. 2 under the Health District's
"Discussion/Requirements" to more properly read:

SCOPE/PROJECT DESCRIPTION:
I. General Overview - In 1981 the subject property was rezoned to
Commercial. SEPA requirements were completed at'the time of the
rezone. In October of 1986 the Southland Corporation purchased this
property in anticipation of constructing a 7-11 Convenience Store.
Southland, whose plans had never formed for the convenience store,
sold the land to Mr. Rosier and Mr. Ficken, two parties in a recently formed limited partnership. Currently the partnership owns four adjoining parcels of land.
Negotiations are being made on one other adjoining parcel and once
complete, the five lots will be combined into two separate parcels.
One lot will be used as a"pad" site, and the other is for today's
discussion on the construction of a 12,000 to 16,000 square foot
shell building for future leased retail space. As a note, an
estimate of the pad building's area will be 41000 to 6;000 square
f eet . . Once- permit conditions are known, and construction drawings,
site plans, and the street profile for Maxwell and Mission have
been submitted for review and approval, the applicants expressed

that construction would begin as soon as the permit can be issued.
There were also questions and some discussion on the possibility of
obtaining a fast track or early start perinit.
Si:fMMARY OF DEPARTMENTAL REpUIREMENTS :
• ~
I. Planning Department (456-2205)
A. Discussion/Requirements
1. A copy of the Findings and Order for Zone Change
ZE-79-81 was offered to the applicant at the meeting. _
2. Parking requirements for a 21,470 square foot
building in the commercial zone will be 108 parking stalls,
calculated at 1 space for every 200 square'feet of gross floor
area. Currently shown on the site plan is 109 stalls: In
order to be able to provide two-way traffic in the parking
area, 22 feet is required from the back of one stall to the
front of the adjacent stall. 3. The zoning ordinance states that if more than 20
parking spaces is required, 10 percent of the parking area
must be devoted to landscaping; with each space within 60 feet
of a landscape feature consisting of at least 32 square feet
in area. The 208 area is excluded from the calculated area
area.
4. John Harrington stated that the simplest and fastest
method of aggregating the five parcels would be through a
minor lot line adjustment. The applicant stated he was aware
of this option, but prefers to create two separate parcels.
~ 5. One off-street loading area is required to be
included in projects between 10,000 to 20,000 square feet in
area. An area of more than 20,000 square feet would require
two off-street loading areas.
II. Engineering Department (456-3600)
A. Discussion/Requirements
1. A copy of written comments was given to the
applicant and Building and Safety by Scott Egger.
2. Drainage glans and calculations is required to be
subinitted for the proposal.
3. In addition, road plans must be submitted for review
and approval and must indicate curbing, gutters, streets and

sidewalks, along with a copy of the deed to the property for
attachment to an RID/CRP Agreement (the applicant stated they
have already taken care of the latter).
4. Approach permits are required for both Mission
Avenue and Maxwell.
5. An Agreement to Pay Fees must be filled out and
returned to the Engineering Department for their review of the .
project. Also, should the applicant want to obtain a permit
throuqh fast track approval, there is an option of getting a
priority review status through the Engineering Department by
fillinq out a Priority Fee Agreement which enables such
projects to be reviewed ahead of other pending projects,
however the cost is double the standard fee.
6. The applicant may want to contact Jerry. Sims of the
Engineering Department regarding a bond for road improvements
in order to obtain an early release of the building permit.
III. Health District (456-6040)
A. Discussion/Requirements
l. Should any food vendors lease part or all of--the
retail space, a set of construction drawings will need to be .
submitted to the Health District for review and approval. 2. The project will connected to the public sewer and
therefore no Health District requirements for septic system
and drainfield are appropriate.
3. The District's files indicate previous buildings
located on the property indicate the presence of an unknown
number of septic systems. Those systems will need to be
pumped and filled with pea gravel (the applicant stated this
has already been' accomplished and that ULID's have already
been paid).
4. When leasing each portion of the building, a
critical materials review form will need to be filled out by
the tenants through the Building and Safety Department.
5. When the owners make application for a permit, the
- Health District will be able to release their portion if there
. is no deviation from today's plans for construction and
occupancy. . .

Attached are the two easements we discussed over the phone yesterday.
Robert Rosier would like to know the answers to the following questions:
1. Can he delete the indemnity paragraph on the County prepared
easement? This paragraph is on the back, and has been noted "delete?".
2. Can he add to the County prepared easement the paragraph so noted
in the Randall & Danskin, P.S. prepared easements? Once again, this
paragraph has been so noted on the document entitled "GRANTS OF
EASEMENTS".
3. Can he change the South four feet of Parcel 2 to the South three
feet of parcel 2? We concur with this change.

To The Above Individuals:
When I met in H1ay of 1990 with Spokane County Engineering to
present the site plan for the subject property, I was informed that I
would be required as a condition of the building permit to perform, at
my cost, certain public works improvements. These improvements are
curbing, gutter, sidewalks, dry wells and paving - all of which are not
on my land but are on county right-of-way and will be owned by Spokane
County. Furthermore, the County required that the work that I must
perform, pay for, and give to the County must not conflict with any
utilities in their right-of-way. It became clear to me after, some
field measurements that Modern Electric's Powerlines and U.S. Wests
telephone closures (vaults) were located in, the County's*right-of-tivay,
in conflict with the County's demands of the project.
On June 6, 1990 I submitted a design deviation to Spokane County
Engineers requesting that the utilities remain as currently located and
that the sidewalk remains as designed and simply have the poles (and
closures) come up through the sidewalk. My rationale for this was the
several recent projects in the valley, the most current that I'm aware
of is S. 210 Sullivan, where the power pole is dead center in the middle
of the sidewalk. The subject situation had the poles towards the inside
of the sidewalk allowing four feet of clearance between the curb and
outside of the pole. For Mission Street, the Design Deviation was
denied.
I went to Modern Electric and U.S. West shortly after to get the
utilities moved. Within two weeks Modern had their poles moved back.

U.S. West said they needed to get permission from the State Highway
Department, because they must enter into a vault located in State
Highway 12 (Pines Road) in order to move the closures along Mission.
The State apparently has denied access.
This leaves me in a terrible dilemma. The County requires me to
do something which has not been required in other projects. And a
Utility Company is denied access by a State Agency to perform required
work.
What's more, the county required a$16,500 Assignment of cash from
me and won't release the funds until I have all the work complete::
I have delayed the curb and sidewalk contractor several times. At
this writing they are so busy, that if we don't build now, I won't get
the project done•this year. As I write,we have nearly $800,000 in cash
committed to this project and I have tenants awaiting leases, but I am
unable to proceed to completion or guarantee occupancy. I
I simply must move ahead. So beginning, September 17, 1990, I
will do all the sidewalk and curb work possible leaving out those
sections where closures are located. When I am done with that, I must
proceed with paving and landscaping. I will request a release of the
assignment funds, and hope that someone who has a lot more patience and
sophistication than I to resolve this situation. I will do everything I

We have been contacted by Mr. Robert Rosier of Commercial Real
Estate Services to relocate our above ground facilities along the
southwest corner of Mission Ave. and Pines Road. Mr. Rosier has
indicated to us that Spokane County will not issue a building
permit to develop this property unless a new curb and gutter line
is established consistent with future plans to widen Mission.
Our above ground facilities are located in that strip between the
existing property line and the proposed curb and gutter. Access
to these cables for reroute must be made by means of a small un-
derground vault sitting in the intersection on Pines.
This vault, 3 1/2' wide by 7 1/2' long, placed in 1955 has far
exceeded it's capacity as well as service life. Cables have been
"pulled" straight across the opening when conduit collapsed
duzing excavation for a nearby sewer project. This congestion
makes it physically impossible for our workman to access the
vault for routine maintenance, emergency service restoration as
well as the reroute necessary for Mr. Rosier.
Our plans to correct this situation would be to place a larger
vault over the top of the existing one. We have extensively
sought other solutions but find no viable alternatives.
Pines Road, under your jurisdiction as Highway 27, was repaved
approximately 5 years ago, currently at mid-cycle for that op-
eration.
we ask that you please consider our request for permit to do this
work a soon as possible. we feel this problem falls in the cat-
egory of special circumstances and leaves us in a precarious
position to maintain current service.

The Easement granted to Spokane County and its authorized agents and/or assigns, is
for the sole purpose of construction, installation, operations, maintenance and
repair of public utilities, signs and road rfiaintenance within said Easement.

The Grantor(s) hereby releases Spokane County, and all'its officers, employees, and
agents and/or assigns from any responsibility of liability for any damage
whatsoever including inverse condemnation by or to any and all persons or property
arising out of or in any way incident to or attributable to the construction,
installation, operations, maintenance and repair of public utilities, signs and
road maintenance within said Easement.
This Easement also grants to Spokane County and its authorized agents and/or
assigns the rights of ingress and egress to, over and from said Easement for the
construction, installation, operations, maintenance and repair of public utilities,
signs and road maintenance installed or in the future installed in the Easement
area.
The Easement described hereinabove is to and shall run with the land. No
modificati'on of the boundaries of said Easement can be made without the prior
" approval of Spokane County.

FINDINGS AND ORDER
A. INTROOUCTIQN
This matter having come before the Examiner Committee on September 10, 1981,
and the members of the Committee present being Kathfeen Carstens, Chair-
person, Eldon Thomas, and Jerry Williams.
B. PROPOSAL
The sponsors, Darroil Waller and Robert Lyons, are requesting approval of a
zone reclassification, File No. ZE-79-81, Agricultural Suburban to Commercial,
for the purpose of continuing auto service and repair. C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial, Freeway,
and vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major -
Commercial development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been comp{ied with, and the Committee concurs with the Declaration of
Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled, '
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed disapproval of the proposed
use.
10. The Hearing Examiner Committee f+nds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.

issued.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANN I NG DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of such
lighting. (Such plan shall attempt to confine illumination to the
area with full consideration to adjacent properties).
2. A 6-foot sight-obscuring barrier shall be provided along the western
line of this proposal to provide a buffer for the existing residential
. use located immediately west of this site.
3. A specific landscape plan, planting schedule and provisions for main-
tenance acceptable to the Spokane County Zoning Administrator shall
be submitted with a performance bond for the project prior to release
of building permits.
4. Applicant shall comply with 1208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.
5. The applicant shall comply with RCW 58-17 and the Spokane County
Platting Ordinances prior to issuance of building permits.
6. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements. .
7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, written
comments and/or public testimony contain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final declaration of non-significance is hereby to be
issued.
8. All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site.
b) COUNTY ENGINEERING DEPARTMENT
1. Applicant shall dedicate a 20 foot radius on Mission Avenue and SR-27
(Pines) prior to any use of the property.
2. Access permits and improvements to SR-27 must be approved by the
Washington Departrnent of Transportation.

3. Applicent shali construci cement concrete curb and sidewalk and pave
to the existing pavement adjacent to the property on Mission Avenue
and Maxwel! Avenue.
4. Applicant shall submit for approvai by the Spokane County Engineer
road, drainage, and access plans prior -to the issuance of a buiiding
permit on the property.
5. The appiicant shail submit for approval by the Spokane County_
Engineer and the Spokane County Health Oistrict a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project prior to the issuance of any building permit on the
p roperty .
6. A parking pian and traffic circulation pfan shall be submitted and
approved by the Spokane County Engineer prior te the issuance of a
building permit on the property. The design, location, and arrange-
ment of parking stalls shall be in accordance with standard traffic
engineering practices. Paving or surfacing as approved by the
County Engineer, will be required for any portion of the project which
is to be occupied or traveled by vehicles.
7. The ward "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. As an atter-native method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a Caunty Road Project (CRP) to
the extent of the required road improvement. Spokane County •
will not participate in tfie cost of these improvements. 9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
14. All required improvements shalt conform to the current State of
Washington Standard Specifications for Road and 8ridge
Construction, and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless other-
~ wise approved by the County Engineer.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use_ of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all, rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District.

c) COUNTY UTI LITI ES DEPARTMENT (continued)
2. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legal assessments for any utility local im-
provement district (ULlD) established pursuant to RCW Chapter 36.94,
as amended.
3. Any water service for this project shall be provided in accordance with -
the Coordinated Water System Plan far Spokane County.
d) COUNTY HEALTH DISTRICT
1. Water service must be coordinated through the Director of Utilities,
Spokane County.
2. Water service shall be by an existing pubtic water supply
when approved by the Regional Engineer (Spokane), State
Department of Social and Health Services. 3. Use of private wells and water systems is prohibited.-
4. Sewage disposal method shall be as authoriied by the Director of
Utilities, Spokane County.
5. Subject to specific application approval and issuance of permits by the

Health Officer, the use of an individual on-site sewage disposal system
may be authorized. As of June 1, 1981, a moratorium has been placed
on the practice of installing subsurface sewage disposal systems under
pavi ng . .
6. A combined surface water and sewage disposat detailed plan shall be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
e) COUNTY BUILDING AND SAFETY DEPARTMENT

petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW.. Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legai assessments for any utiliiy local im-
provement district (ULIO) established pursuant to RCW Chapter 36.94,
as amended.
3. Any water service for this project shall be provided in accordance with _
the Coordinated Water System Plan for Spokane County.
d) COUNTY HEALTH DISTRICT
1. Water service must be coordinated through the Oirector of Utilities,
Spokane County.
2. Water service shall be by an existing public water supply
when approved by the Regionai Engineer (Spokane), State
Department of Social and Health Services.
3. Use of private wells and water systems is prohibited.- ,
4. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
5. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individual on-site sewage disposal system
may be authoriied. As of June 1, 1981, a moratorium has been placed
on the practice of installing subsurface sewage disposal systems under
paving. -
6. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
