SCOPFJPROJECT DESCRIP'TION:
I. General Overview - The owner, Philip Rudy, is proposing to erect a temporary structure to
be used for retail sales of fruit and other goods. Mobile food stands are also proposed. A
temporary portable gazebo type structure currently exists on the site. The owner is proposing
to proceed with the project only on a temporary/short term basis at this time. He will then
re-evaluate the success of the operation before making a determination to continue on a long
term basis. Mr. Votaw of Wall Street Produce is a project tenant, licensed by the Washington
State Department of Agriculture to sell farm produce. He will be assisting the owner in the
development of the site. The intent is to sublet temporary shelters to other vendors.

SUMMARY OF DEPARTMENTAL RF;OUIREMENTS:
1. Planning Department (456-2205) - Francine Shaw (contact), Lorne Lakshas
A. Discussion Items
1. The proposed is located in a B-3 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel numbers 45173-1506, 1507, and 1525.
3. Please aggregate the three (3) parcels into one (1) parcel through a Certificate
of Exernption. This can be accomplished administratively through the Planning
Department. Setbacks will apply whether improvements are temporary or
permanent.
4. The setback from Sprague Avenue for any structure is 65 feet from centerline
or 35 feet from the property line, whichever is greater. The second option will
most likely apply in this case. Please illustrate the setbacks on the revised site
plans.
5. Any permanent structures will require additional requirements including but
not limited to paving and landscaping. A five foot wide strip of Type III
landscaping will be required along Sprague and Willow for any permanent
structures.
The Planning Department can issue, through an administrative action, a
Temporary Use Permit for a period of six (6) months. A public hearing would
not be required, although there are conditions which wi11 have to be met. These
conditions will be discussed with the applicant when he applies for the
Temporary Use Permit.
6. The parking is not paved. Approval must be obtained from the Spokane
County Air Pollution Control Authority to waive the paving requirement.
7. Please submit signage plans illustrating the height and dimensions of the
proposed signs.
B. Permit Release Requirements
l. Please submit a revised site plan illustrating signs and setbacks for review and
approval. ~
2. Please submit a Certificate of Exemption.
3. Please obtain a Temporary Use Permit.
II. Spokane County Air Pollution Control Authority (456-4727) - Kelle Vigeland
A. Discussion Items
1. Comments were given to the Department of Buildings by Kelle Vigeland and
were presented at the conference by Tom Davis who summarized the following:

- Proposed must meet all air polluti(yn regulations, including those dealing
with dust emissions during construction and excavation projects.
- All traveled surfaces are required to be paved.
- Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces.
B. Permit Release Requirements
1. Please obtain a waiver on the paving requirement if no paving is proposed.
III. Division of Engineering & Roads (456-3600) - Bob Turner
A. Discussion Items
1. Comments were given to the applicant and the Department of Buildings by
Bob Turner and are attached to the applicant's copy of these minutes.
2. Please submit a drainage plan for the site that is in compliance with Spokane
County Guidelines for Stormwater Management for any permanent structures
and/or paving. A full determination of this requirement cannot be made until
Spokane County Air Pollution Control Authority has determined if a waiver will
be allowed for the paving requirement.
3. Please submit road and drainage plans prepared by an engineer for road
improvements to Willow Road. Willow Road shall be improved to Typical
Roadway Section No. 1, Access Standard. All required road construction shall
be completed prior to permit issuance or a bond in an amount estimated by the
County Engineer to cover the cost of construction shall be submitted. The
applicant was advised to submit the road and drainage plans as soon as possible
so that permit issuance would not be delayed.
Due to the temporary nature of the proposed, the applicant may submit a bond to
cover the cost of the road improvements. If proposed decides not to proceed to a
permanent use, then the bond would be returned after all structures are removed.
4. Approach permits shall be obtained for new driveway approaches along
Willow Road, although a determination as to if this requirement will be
mandatory due to the temporary use of the site has not been made.

5. All traveled surfaces are required to be paved, unless a waiver is obtained
from SCAPCA.
6. An Agreement to Pay Fees was given to the applicant during the meeting.
The agreement is to be signed by the owner and returned to the Division of
Engineering & Roads. Plan review will not be completed until this document is
executed.
B. Permit Release Requirements
1. Please submit a drainage plan as described above for review and approval.

3. Please submit a copy of the Agreement to Pay Fees signed by the owner.
IW. Heal.th District (324-1577) - Daryl Way
A. Discussion Items
1. The water purveyor for the proposed is Modern Electric Water Company
(928-4540). Please contact the water purveyor to review requirements for back
flow preventers.
A 1951 permit identifies the water purveyor as Modern and a 1957 permit
identifies the water purveyor as Dishman.
2. Produce sold in the raw state is exempt from permitting requirements through
the Washington State legislature, unless the produce is prepared into a food
product. If the applicant rents to a retail food vendor, then the Health District
would have requirements that would have to be complied with.
Renting space to a Iicensed mobile foad service facility would be allowable. It
was stressed to the applicant that the responsible party for any problems is the
property owner.
3. The Washington State Department of Labor and Industries governs sanitation
in the work place.
4. The Health District requires that restrooms be located within. 200 feet from a
food vendor space and that a written agreement must be obtained for the use of
the restrooms. No portable restrooms are allowed for food vendors.
5. Licensed mobile food vendors are required to have available sanitized water,
waste water, and a base station.
6. For uses other than food vending, the Health District allows the use of
portable restrooms for temporary short-term use permits.
7. Please submit information regarding the disposition of refuge from the site.
B. Permit Release Requirements ,
1. The Health District is ready to release their gortion of the temporary building
permit.
V. Fire District No. 1(928-2462) - Clyde Wisenor
A. Discussion Items
1. Camments were given to the Department of Buildings by Eric Olson and
presented at the conference by Tom Davis.
2. Please maintain the site clear of litter so as to avoid a fire hazard.

3. If proposed does proceed to a permanent use, other requirements will need to

B. Permit Release Requirements
1. The Fire District is ready to release their portion of the temporary building
permit.
VI. Department of Buildings (456-3675) - Bobby Stone
A. Discussion Items
1. Plan review has been completed on the site plan only by Bobby Stone.
2. The proposed building is being classified as a B-2, Type VN construction.
3. The proposed shall meet the minimum requirement of the Regulations for
Barrier Free Facilities. Proposed should also comply with the provisions of the
American Disabilities Act. The Department of buildings will not be requiring
compliance with this act until it is adopted as part of the Washington State
Barrier Free Regulations, which is not expected to occur until July, 1992. For
information about the Americans with Disabilities Act, call 1-800-435-7232.
4. Structural calculations should be submitted to justify the adequacy of the
structural system (including foundation) for seismic, wind, dead, snow and live
loads. (UBC Chapter 23) These calculations are required for any structure
irregardless if it is a temporary structure. The applicant was told that what is
existing on the site will not meet this requirement. Tents do exist that are
designed to comply with this requirement. If fabric is utilized as roofing, it must
be a fire rated fabric.
5. Restrooms for employees must be provided on the site. Portable restrooms
will meet this requirement.
6. Fire extinguishers are required to be located on the site not to exceed a 75
foot travel distance.
7. Questions were raised as to allowing the existing operation to continue while
the above stated County Department's requirements are being met. The applicant
was told that as long as the owner is mitigating the hazard, the Department of
Buildings would allow the continued use of the site. No additional construction
of buildings will be allowed on the site until structural calculations are provided
to the Department of Buildings.
8. The front page (cover sheet) of the construction drawings shall contain, at a
minimum, the professional stamp with an orieinal dated signature. This cover
sheet shall include the building address, legal description and index of pages
being submitted under the professional stamp.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the items discussed during the
meeting and other items from the plan review letter needs to be submitted for
review and approval.

The County Engineering Department has completed a review of
the above ref erenced proj ect . The f ol lowing ' inf ormation must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site. .
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale. 5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.

B) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Willow, Typical Roadway Section No. 1, Access
Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. Approach permits must be obtained from the County
Engineering Department for driveway approaches to

The road plans for the above referenced project have been reviewed and found to
meet County requirements except for the following exception - illustrate the right-of-
way width on your cross-section.
Please submit a mylar with engineer's stamp and developer's approval. A bond for
the improvements is also required. The amount of the bond should be $7,800. I have

Kevin McMulkin of Simpson Engineers has submitted the final road plans for the
improvements to Willow Road. !n order to finalize this project and before a permit
can be taken out for the work in the County right-of -way, a bond for $7,800 is
required.
I have enclosed copies of the pre-approved bond forms for your use. You may use
one of these or prepare your own. If you chose to use a form other than one of
these, it will have to be reviewed by our legal staff which will resuit in at least a
two week delay.

Proposed temporary structurE is constructed of 4"x4"x8` treated posts.
Verticle members are placed in concrete deck block. Horizontial members are
attached at the sides of the tops of the verticle posts with Simpson
type anchors secured with 1 3/4" construction screws.

The County Engineering Department has completed a review of
the above referenced project. The f ol lowing 'information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
. contained within the site. ,
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale. 5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.

B) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Willow, Typical Roadway Section No. 1, Access
Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. Approach permits must be obtained from the County
Engineering Department for driveway approaches to
the following streets: .
a. Willow

C) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Road plans for Willow.
2. Drainage plan as specified.
3. Other information:
a. All traveled surfaces must be paved.
D) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
E) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Oftice. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.
