Byrne, Mrs. Rawlings, Messrs. Main, Quigley and Thomas were in attendance and constituted a quorum, and WHEREAS, the Spokane County Planning Commission fully considered the testi- mony given, the environmental review, and all other evidence presented, recommends to the Board of County Commissioners the following: 1. Copies of the revised draft of the Short Plat Ordinance were distributed to members of the Commission. Comments have been received from the public on the context of the Ordinance, and the Commission will make a decision at its hearing on January 20th. 2. The Staff presented a progress report on citizen participation in the various Advisory Council meetings. A new publication, "Insight ", was distributed to the members, giving an up -to -date announcement of forthcoming events and general information of public interest. 3. It was the consensus of opinion among the Commission that future hearings would commence at 8:30 a.m. for Commission business, and the general public hearing would follow at 9:00 a.m. These specific times would be followed for the remainder of 1978. 4. Reference was made to the previously discussod item of interim zoning; however the Staff has not received any directives from the Board of County Commis- sioners as to its status at the present timo, 5. Reference was made to the study being conducted by R. W. Beck and Co. of Seattle on an Interim policy on the sewage question. A preliminary report has been prepared, and the Board of County Commissioners is scheduled to receive the final data shortly. 6. It was reiterated that the 5 -Mile group had prposed to choose a new plan in approximately two weeks to replace the alternatives which hsve been taking the study group almost two years to prepare. 7. It was directed that a letter to the County Utilities Department and the Health District be drafted showing the Planning Commission concerns in regards to the `Nest Plains Water situation. -1- 8.. ZE- 112 -76 AGRICULTURAL TO RESTRICTED INDUSTRIAL: INDUSTRIAL DEVELOPMENT COMPANY. That the zone reclassification upgrade be approved to the Restricted Industrial Zone Classification (File Number ZE- 112 -76), subject to the Staff's findings, dated January 13, 1978 with the changes as follows: Omit all of 8 A and the third sentence in 8B of the Staff's recommended conditions. (Motion by Mr. Thomas seconded by Mr. Culgley. Vote was 4 yes and 1 no.) It was suggested to the sponsor that he seek annexation into a water district. 9. It was the concensus of the Commission that the Staff make a report In six months on design standards.to the Commission. 10. ZW- 140 -77, AGRICULTURAL TO RESTRICTED INDUSTRIAL: CHOPOT. That the zone reclassification upgrade be denied. (Mr. Main moved, Mrs. Byrne seconded. The vote was 5 yes and 1 no.) 11. ZE- 188 -77, AGRICULTURAL TO COMMERCIAL OR FREEWAY COMMERCIAL: BLAC That the zone reclassification upgrade be approved to the Freeway Commercial zone Classification (File Number ZE- 188 -77), subject to the Staff's findings, dated January 13, 1978 with the added condition that an adequate sewerage disposal system be approved by the County Health Authorities and and any other necessary agencies prior to the issuance of any building permits. Also the existing landscaping is to be continued to include this proposal. 12. ZW- 108A -77, AGRICULTUAL TO FREEWAY COMMERCIAL: CCX. That the zone reclassification upgrade be approved the the Freeway Commercial Zone Classification (File Number 04- 108A -77), subject to the Staff's findings, dated January 13, 1978. (Mr. Quigley moved and Mr. Main seconded. Vote was 5 yes and 1 no.) 13. There was a motion by Mrs. Rawlings and seconded by Mrs. Byrne on a request an overview study of the Vest Plains Area. Note was unanimous.) 14. ZN- 109 -77, AGRICULTURAL TO MINING C7, SS II, S & F CONSTRUCTION CO. That the zone reclassification upgrade be continued to such time as we deter- mine conditions to be Imposed for the rehabilitation of this area. That the Planning Staff in cooperation with the proposer develop a rehabilitation plan for discussion at a future meeting called by the commission, public meeting. That the rehabilitation plan Involve soil replacement, grass planting, tree and vegetation replacement. That the proposed area be reduced by 500 feet at a minimum at the north end. SUMMARY: The applicant's proposal Is compatible with adjacent land uses to the east, west and the south, but incompatible with the established residential uses to the north and to the east fronting Indiana Ave; is consistent with previous Planning Commission Zone reclassifications; is consistent with the Regional Comprehensive Plan; has or can provide adequate provisions for circulation, sewage disposal, water and fire protection. II. GENERAL INFORMATION: A . Existing Land Use - Site - Single Family Residence, the balance of the site is. vacant. To the north - Single family residential uses; pasture north of Indiana Avenue. To the south - Spokane Valley Freeway, I -90 To the east - Single family residential and mobile home uses fronting Indiana Avenue; pasture; warehouse. To the west - Spalding Auto Wrecking Yard B.. Comprehensive Plan ' Proposal is consistent with the Regional Comprehensive Plan. - 1 - ZE- 112 -76 - Agricultural to Restricted Industrial Explanation: The Regional Comprehensive Plan indicates the general area west of Pines Road and east of Spalding Wrecking Yard between the Spokane Valley Freeway and the Spokane International Railway tracks as being appropriate for industrial uses. III. SPECIAL INFORMATION: A. Circulation Frontage Type ADT Indiana Avenue Access Road N/A Graveled B. Sewage Disposal This project is located In an area with soils classified by the Soil Conservation Service as suitable for installation of Individual on -site sewage disposal systems. The area is, however, located over the Spokane Aquifer. A study is currently under way to determine the degree to which subsurface disposal of sewage treatment effluent may pollute the Aquifer. There is very little probability that this project in itself will have more than a slight impact on the Aquifer. However, taken in conjunction with the overall urbanization of the area, some other sewage disposal method will most likely be required In the future. From an environmental health viewpoint the project appears feasible. C. Water Availability through - Site is not located within a water district service area. at present; Public well is a possibility. D. Fire Protection Fire Mains - Not Available Fire Hydrants - Not Available E. Staff Environmental Review Condiuded that a declaration of Non- SLgnificance be issued. IV. CONDITIONS: The Planning Department Staff feels the following conditions would be appropriate if the proposal is approved. -lA - ZE- 112 -76 - Agricultural to Restricted Industrial 1. Dedication of the north fifteen (15) feet of the advertised property along Indiana Avenue for right -of =.way purposes. 2. Improvement of Indiana Avenue along the project perimeter to Spokane County Engineering standards. Improvements shall include curbs, drainage control and thirty (30) feet of paving. 3. Dedication of the east twenty (20) feet of the advertised property along Woodward for right -of -way purposes. NOTE: The Spokane County Engineer has recommended that Woodard Road be widened and improved or vacated; Applicant can make a request for the vacation of Woodard Road. 4.. Dedication of a twenty (20) foot radius at the northeast comer of the advertised property (southwest comer of Indiana and Woodard Road) . NOTE: This dedication not required if Woodard Road is vacated. 5. Improvement of Woodard Road along the project perimeter of Spokane County Engineering standards. Improvements shall include curbs, drainage control and thirty (30) feet,of paving. NOTE: This dedication not required if Woodard Road is vacated. 6. Approval of access by the Spokane County Engineer's Office prior to release of building permits for the project. 7. A revised development plan for the site shall be approved by the Spokane County Zoning Administrator prior to finalization of ZE- 112 -76. The revised plan shall show the relocation of proposed structures such that compliance with the Spokane County Zoning Ordinance and required setbacks can be demonstrated. 8., Approval of the following by the Zoning Administrator prior to appli- cation for building permits. A- Elevation drawings of the proposed structures indfcattng st=cbton- materiaks- and- extertor'ftntsh— Such - drawings shall attempt to provide an attractive exposure to the freeway. B. A lighting and signing plan of the subject property. The property shall be lighted in a manner which will not produce glare on adjoining properties and on the Spokane Valley Freeway. @n .premise- signs - shall -be- place -flat against the - buildings- and -shall only - advertise products- or- servtces are - available -on -the Q pr�emises -1B- ZE- 112 -76 - Acxricultural to Restricted Industrial C: A specific landscape plan, planting schedule, and provisions for maintenance, for the project shall be approved by the Spokane County Zoning Administrator prior to release of building permits. NOTE: such plan shall provide an attractive exposure to the Spokane Valley Freeway. 9. The applicant shall provide a performance bond to cover the cost of the required landscaping prior to release of building permits. 10. An on -site storm - drainage system shall be approved by the Spokane County Engineer's Office prior to release of building permits for the project. 11. Installation of fire mains and hydrants in accordance with the require- ments of the District Fire Chief. 12. Sewage disposal and water service shall be approved by the Spokane County Health District prior to release of building permits. 13.
