ROLL CALL: City Clerk Patterson called roll; all Councilmembers were present except Councilmember
Yaeger. It was moved by Deputy Mayor Hattenburg, seconded and unanimously agreed to excuse
Councilmember Yaeger.
APPROVAL OF AGENDA It was moved by Deputy Mayor Hattenburg, seconded and unanimously
agreed to approve the agenda.

Mayor Haley read the proclamation for National American Indian Heritage Month and the DAR ladies
accepted the proclamation.
GENERAL PUBLIC COMMENT OPPORTUNITY: After Mayor Haley explained the process, she
invited public comment. Mr. John Harding, Spokane Valley provided comments on various topics.
ACTION ITEM:
1. Public Hearing: 2024 Budget Amendment Chelsie Walls
Mayor Haley opened the public hearing at 6:14p.m. Ms. Walls provided details on the 2024 budget
development and an overview of the funds that would require a budget amendment. Ms. Walls also detailed
the amounts for the proposed thirteen funds that would require the amendments and that any changes were
highlighted in blue in the packet documents. Mayor Haley called for public comments. John Harding,
Spokane Valley provided comment. During council discussion Councilmember Higgins poised a point of

order and Mayor Haley asked to speak to the point. Councilmember Higgins stated that Councilmember
Merkel was in error of his assertions, the way it is being portrayed is not how it happened so please cease
and desist and stop campaigning. Councilmember Merkel poised a point of order and Mayor Haley noted
that she needed to speak to the first point of order raised. Mayor Haley agreed with Councilmember Higgins
and then asked Councilmember Merkel to speak to the point. Councilmember Merkel stated that if
Councilmember Higgins wishes to counter his points and that Councilmember Higgins point of order is out
of order because he is just making speeches. Councilmember Higgins called for a point of clarification and
er was not even legal. Mayor Haley stated that she did not
know where you would find that point of order and then ruled against Councilmember Merkel. City Manager
Hohman clarified the information regarding the investigations pertaining to Councilmember Merkel.
Councilmember Merkel called for a point of order during the City Managers clarifications. Mayor Haley
noted that he cannot point of order the city manager and stated that he needed to follow decorum during the
meeting. Mayor Haley closed the public hearing at 6:27p.m.
2. Ordinance 24-014: First Reading, 2024 Budget Amendment Chelsie Walls
After City Clerk Patterson read the Ordinance title, it was moved by Deputy Mayor Hattenburg and seconded
to advance Ordinance #24-014 amending the 2024 Budget to a second reading. Ms. Walls stated that she
did not have any additional details aside from the first presentation and would take questions. Vote by
acclamation: in favor: Mayor Haley, Deputy Mayor Hattenburg, Councilmembers Padden, Higgins and
Wick. Opposed: Councilmember Merkel. Motion carried.
3. Ordinance 24-015: First Reading, 2025 Budget Chelsie Walls
After City Clerk Patterson read the Ordinance title, it was moved by Deputy Mayor Hattenburg and seconded
to advance Ordinance #24-015 adopting the 2025 Budget to a second reading. Ms. Walls provided updated
information on the 2025 budget and stated that it would be back in front of council for additional review and
adoption on November 19th. Ms. Walls went on to provide details on the overall expenditures in the
recurring and nonrecurring funds and went over funding in some of the larger funds. Councilmember Merkel
proposed an amendment to the motion and stated the he would like to move that looking at the General Fund
expenditures that for the city council line item we remove $30,000, for the city manager line item we remove
$58,000 from the budget, for the Deputy City Manager line item we remove $100,000 from the budget, for
the City Attorney line item we remove $162,325 from the budget, for the city services admin line item we
remove $171,000 from the budget, from the facilities admin line item we remove $113,000 from the budget,
from the city hall line item $3,000, from CenterPlace line item $100,000, from the police campus line item
$20,000, from the Balfour line item $48,500, from the other general facilities line item $22,000, from the
finance line item $100,000, from the general government line item $641,200, from the IT line item $102,000,
from the HR line item $121,000, from the Public Works line item $150,000, from the Public Works
Engineering line item $250,000, from the building line item $355,000, from the Planning line item $277,000,
from the Economic Development line item $432,000, from the Parks and Recreation Admin line item

for hiring police. Mayor Haley stated that there was a motion and with no second on the motion, the motion
dies. Councilmember Merkel spoke about a survey published by GSI that he said showed that over 73% of
Spokane Valley residents feel that hiring police should be an immediate issue. Councilmember Higgins
poised a point of order and Mayor Haley asked him to speak to the point. Councilmember Higgins stated
that we cannot hire the 10 officers now and we are trying and we just went through an iteration of the whole
budget and why do you keep doing this? Councilmember Merkel poised a point of clarification and asked
enough of these meetings to understand what it means and that our Police Chief could explain what trying
to get into this evening. Vote by acclamation: in favor: Mayor Haley, Deputy Mayor Hattenburg,
Councilmembers Padden, Higgins and Wick. Opposed: Councilmember Merkel. Motion carried.
4. Motion Consideration: Holiday City Closure John Whitehead
It was moved by Deputy Mayor Hattenburg and seconded to authorize the closure of City Hall and

CenterPlace at noon Wednesday, November 27, 2024; and the entire day on Tuesday, December 24, 2024;
to allow staff time to prepare and travel for their Thanksgiving and Christmas Holidays.Mr. Whitehead
provided details and explained to council the request for staff to have additional time off. Mayor Haley
called for public comment. Michael Kelly, Spokane Valley provided comment. Vote by acclamation: in
favor: Unanimous. Opposed: None. Motion carried.
5. Motion Consideration: Public Defender Caseload Standards Erik Lamb
It was moved by Deputy Mayor Hattenburg and seconded to
related to the proposed changes to the standards for indigent defense and finalize the same for sending to
the Washington State Supreme Court. Deputy City Manager Lamb provided details on the letter for the
caseload standards and noted that he incorporated the changes brought up at the meeting last week into the
new draft of the letter. Mayor Haley asked for public comment. John Harding, Spokane Valley provided
comment. Vote by acclamation: in favor: Unanimous. Opposed: None. Motion carried.
NON-ACTION ITEMS
6. Admin Report: TPA: Spokane Sports & 116 & West proposals Lesli Brassfield
Ms. Brassfield provided details on the 2025 TPA budget and work plan. Currently the proposal from 116 &
West was for a budget of 1,275,000 that was approved on Sept 10th. Ms. Brassfield reviewed the five-year
plan of 116 & West with enhancing tourism through destination marketing with the Discover the Valley
brand. Ms. Brassfield then reviewed the budget and details for Spokane Sports as well and requested
consensus to return at a later meeting with a motion consideration. Councilmember Merkel questioned if
there were any other bids solicited, and Ms. Brassfield noted that these are contract renewals and there was
not any solicitation for new bids or contracts. Council briefly discussed the upcoming cross country course
and the work that Spokane Sports had already done for promoting the course. Council provided consensus
to return at a later meeting with a motion consideration on the contract renewals.
7. Admin Report: Homeless Program Update Eric Robison, Deputy Pratt
Mr. Robison reviewed the background of the homeless outreach team and the program that was initiated in
2021. He also reviewed the outreach services with Frontier Behavioral Health for the services as well. Mr.
Robison also spoke about the trends and challenges that they face within our community. Deputy Pratt
reviewed the program data and outcomes. Mr. Robison and Deputy Pratt also provided additional details on
the data that is collected through the city app that is used and what is done with that information to help
better serve the homeless individuals. Council discussed the data, funding for the programs that are offered
and the number of those assisted with resources.
8. Admin Report: STA ILA for fiber use Kelly Konkright
Mr. Konkright provided details on the interlocal agreement (ILA) with STA and a background on the
previous ILA that was in place for the use of fiber facilities that the city owns. Council questioned if the city
would potentially need to use that fiber in the future especially with the upcoming camera discussions. Mr.
Konkright noted that he did not believe that our IT manager had any concerns about the use of the fiber but
would confirm that and report back at a future meeting. Council provided consensus to return at a later
meeting with a motion consideration for the ILA.
GENERAL PUBLIC COMMENT OPPORTUNITY: Mayor Haley stated that the general public
comment rules still apply and called for public comments; no comments were offered.
COUNCIL COMMENTS
Councilmember Merkel spoke about the GSI information on survey results and spoke to the potential results
being geared towards the City of Spokane Valley specifically and spoke to the public safety results.
Councilmember Merkel spoke about the budget concerns and that there is a failure to address some of the
most important concerns. Councilmember Merkel also spoke about comments made by the City Manager
and stated he is a special kind of politician that does not need to be voted in or need your approval. A point

of order was raised by Councilmember Higgins. Mayo Haley asked to speak to the point and Councilmember
Higgins stated that he has constant amazement that he chooses these times to go against the city manager
and that he is campaigning. Mayor Haley agreed and moved on to comments from other Councilmembers.
Councilmember Wick provided additional information on the GSI survey and stated that the survey was of
all Spokane county residents and GSI could not break out Spokane Valley information specifically and that
a lot of the conclusions and results of the survey are based on downtown Spokane. The survey doesn't
represent the valley well and was not specific to our community.
Councilmember Higgins
of people is this being stretched and chances are good that those numbers were low.
Councilmember Padden stated the Councilmember Merkel does a lot of paraphrasing and does not provide
factual information. She also noted that everything now is in the hands of the hearing examiner now that the
hearing has happened and provided a quote from Councilmember Merkel that was in the newspaper.
Councilmember Padden noted that funds and city resources have been used as Councilmember Merkel has
violated of the rules in multiple investigations.
Councilmember Hattenburg stated that Councilmember Merkel is criticizing the staff and needs to stop. We
are recruiting police, and we have a balanced budget and our staff does well. We get a lot of positive response
from citizens on the good work we are doing.
Mayor Haley stated that the GSI survey questions were city centric and based on downtown Spokane.
Councilmember Merkel comes up with budget ideas to just cut and that doesn't work. The public records act
has nothing to do with what was said and he needs to produce the documents as requested.
CITY MANAGER COMMENTS
Mr. Hohman noted that Councilmember Merkel visited the street shop interrupted the staff working on
seasonal prep. He asked that he not continue interrupt staff and if he would like to make an appointment that
he could email the City Manager to do so. Mr. Hohman went on the congratulate Spokane County on the
Bigelow Gulch project ribbon cutting today and that it was a great event and a big project and over 20 years
to complete and the City of Spokane Valley is happy to see it completed and excited to travel the new road.

It was moved by Deputy Mayor Hattenburg and seconded to approve and authorize the City Manager to
fiber as identified in the agreement. Mr. Konkright provided an overview of the ILA and noted that he had
spoken with our IT Manager and felt that allowing STA to use the fiber would not interfere with the potential

2. Admin Report: Valley Viewer Application Demonstration Mike Basinger, Matt Reeves
Mr. Basinger provided an introduction to the program and explained the need for the application and the
services it would provide to the users. Mr. Reeves provided details on how the program works and provided a
demonstration video. He also explained that The Valley Viewer is an external mapping application for the
public to use as a GIS program at no cost to the citizens to use and that the program is available at any time
online. Council discussed the links on the program, where and when the information is updated.
3. Admin Report: Public Property Camping Regulations Update - John Bottelli, Kelly Konkright
Mr. Bottelli and Mr. Konkright provided an update to the public property camping regulations and reviewed
the need to update the SVMC chapters on park regulations and regulating public camping. Mr. Konkright
where park parking lots fall within the code and what the violations would be. Consensus was provided to
bring back the item as an Ordinance first reading at a later date.
4. Admin Report: Continuity of Operations Plan (COOP) Update Virginia Clough
Ms. Clough introduced Mark Conrad with Spokane County Emergency Management and noted that she met
with council about a month ago and went over the changes that were made to the plan at the request of council.
Ms. Clough explained that with the changes were implemented to the COOP and that beginning next year she
would start on a more comprehensive Emergency Operations Plan (EOP) to address some of the additional
details that were not part of the COOP. Council discussed the changes and provided consensus to return at a
later date with a motion consideration.

5. Expenditures Related to Councilmember Merkel
GENERAL PUBLIC COMMENT OPPORTUNITY: General public comment rules apply. After Mayor
Haley explained the process once more, she invited public comment; no comments were offered.
COUNCIL COMMENTS:
Councilmember Merkel commented on the report regarding the expenses the city has paid relating
Councilmember Merkel and that he believes it was nothing less than a tax payer reduced hit job on him and
that it just lists how much money was spent was just trying to attack him.
Councilmember Wick spoke about the NLC City Summit event that he will be attending.
Councilmember Higgins commented that the LTAC met the previous day and that they are recommending the
approval of $2.5 million for the cross course at Flora Park.
Councilmember Padden spoke about the appeal hearing that Councilmember Merkel requested and she spoke
about clearing the air for Councilmember Merkel claiming to be a victim. She provided details of the hearing
and that the hearing was at the request of Councilmember Merkel.
Councilmember Yaeger spoke about Councilmember Merkels expenses that have been spent and could have
gone to other resources within our community.
Deputy Mayor Hattenburg noted that he had comments but will just agree with Councilmembers Padden and
Yaeger and added that this all could have avoided if Councilmember Merkel would have acted appropriately.
Mayor Haley spoke about public records requested and that by not providing them to the requestor, it is putting
the city at risk for potential litigation and large fines associated with records that are not provided.
CITY MANAGER COMMENTS:
City Manager Hohman addressed some of the public comments from earlier in the meeting and noted that the
city attorney is a representative of the city and the entity of the city and does not represent individual city
council members. He is to represent the city as a whole and assist with reducing the risk to the city. Mr. Hohman

spoke more about the risk the city is facing due to the pattern of behavior by Councilmember Merkel and his
incivility and continuing the risk by not following the Governance Manual or State Law. Mr. Hohman spoke
about the lost productivity of the city employees and the additional costs incurred due to the risks and issues
Councilmember Merkel has caused. Mr. Hohman highlighted the fact that this could all be changed
immediately by complying with the law and producing the records requested.
Mr. Hohman closed with a highlight and noted that the city was awarded a grant from the Department of
Commerce for nearly $260,000 for the retrofits at CenterPlace.

and Grant Guinn to LTAC for a two year term, Jean Kindem to the Aging & Long-Term Care of Eastern
Washington Board for a three year term, Jenny McClenathen to the Spokane Housing Authority Board for
a five year term, and Jessica Glasson to the TPA Commission for a two year term with all terms beginning
January 1, 2025. Mayor Haley explained that there is still a TPA open position as there was not an
application submitted for that open position. She also explained the process for her review of the applications

2. Motion Consideration: Board Appointments Mayor Haley
It was moved by Deputy Mayor Hattenburg and seconded to confirm the Mayoral appointments of
Councilmembers to the committees and boards as listed on the January 7, 2025 Request for Council Action
form. Mayor Haley explained that she chose to keep the same representatives on the boards and as previously
authorized, Councilmember Merkel was removed from any board(s) he was representing or listed as an
alternate on. Councilmember Yaeger will replace Councilmember Merkel on the Opioid Abatement
Committee (OAC). Mayor Haley invited public comment; no comments were offered. Vote by acclamation:

3. Motion Consideration: Lodging Tax Funding Allocation Sarah Farr
It was moved by Deputy Mayor Hattenburg and seconded to move to make the following allocation of
Lodging Tax funds for calendar year 2025 from Fund #105 from the 2% tax: Spokane Valley HUB - Events
and Tourism up to $147,000; 21st USA West Square Dance Convention - Square Dance Convention up
to $30,000; Spokane Regional Sports Commission - Sports Request up to $35,000; JAKT Foundation -
Crave! Event 2025 up to $50,000; Washington State Quilters - Quilt Show Expansion up to $25,000;
Spokane Valley Summer Theatre Marketing up to $35,000; Spokane Valley Heritage Museum -
Marketing Campaign up to $27,268; CNC Productions, LLC - Inland Northwest RV Show & Sale up to
$11,000; Spokane Corvette Club - Glass on Grass up to $15,00; Cody Productions, Inc - Spokane
Motorcycle Show & Sale $11,000; and the Spokane Co Fair & Expo Center - Interstate Fair Marketing
and Safety - $6,732. And a transfer of the remainder of actual lodging tax collections in the amount of
$500,000 to be moved into the 1.3% Lodging Tax Fund #104. Ms. Farr provided details on the tax and what
the city projects for 2025. She also explained how those funds are received and how the city allocates those
funds to applicants and the transfer of funding from fund 105 to fund 104. Mayor Haley invited public

carried.
It was moved by Deputy Mayor Hattenburg and seconded to allocate $2,500,000 of Lodging Tax funds from
Fund #104 from the 1.3% tax to the design, construction, and other associated costs of the City of Spokane
Valley and Spokane Sports Cross Country Course Project as presented in its 2025 lodging tax application.
Ms. Farr once again explained the use of the funds and how the city received the funds. Mayor Haley invited
public comment; no comments were offered. Vote by acclamation: in favor: Unanimous. Opposed: None.

4. Motion Consideration: Determining positions for 10 authorized police officers - Erik Lamb, Chief Ellis
It was moved by Deputy Mayor Hattenburg and seconded to approve the following dedicated positions as
part of the authorized ten additional positions and authorize staff to finalize and execute an amendment to

Lieutenant. Mr. Lamb provided background on the approval of the 10 officers and additional details on how
it was determined where the deputies should placed. Chief Ellis gave an overview on supervision and

management positions and how that would roll out. Mr. Lamb also reviewed the evaluation that was
presented in Nov. 2023and the phased approach to adding officers has been implemented to date. A staffing
report was provided to show current details on where the city is with the approval of 10 officers and hiring
status. Mr. Lamb and Chief Ellis both spoke to the need to remodel specific areas of the precinct in order to
allow for the new positions in the current phase of hiring. The improvements to the precinct would allow the
city to complete and evaluate the space needs assessment for a new facility while still utilizing the current
space with more organization. Council discussed funding, the current jail cell situation at the precinct and
the need to continue options for the next phase of officers. Mayor Haley invited public comment. Mr. John
Harding, Spokane Valley provided comment. Vote by acclamation: in favor: Unanimous. Opposed: None.

5. Admin Report: Economic Forecast Presentation Mike Basinger, Grant Forsyth
Mr. Basinger provided an introduction of Dr. Forsyth, Chief Economist at Avista. Dr. Forsyth detailed the
policy risk considerations that will start in 2025 that included US trade policy, US immigration policy and
US Fiscal policy. Dr. Forsyth also reviewed the GDP growth and CPI inflation with charting, the Fed forward
guidance on interest rates, employment growth, residential units permitted, and regional taxable sales
growth. Council thanked Dr. Forsyth for in depth presentation and were looking forward to having him back
for an update at a later meeting.
Mayor Haley called for a recess at 7:50pm for 10 minutes and that the meeting would resume at 8:00pm.
6. Admin Report: Potential Grant Opportunity: Raise Grant - Adam Jackson
Mr. Jackson presented a PowerPoint presentation that provided details on what Rebuilding American
Infrastructure with Sustainability and Equity (RAISE) is and how it works within WSDOT, the grant funding
details, grant application considerations for the Sullivan Rd and Trent Interchange, and funding breakdown
for the proposed project. Council discussed the funding involved with the grant and noted that this was a
large project with the recent completion of the Bigelow Gulch project that feeds traffic to that local area and
that a project of that size takes years to gather funding and move it forward. Council provided consensus to
bring the grant application forward for a motion consideration at a later meeting.
7. Admin Report: Potential Grant Opportunity Clean Building Performance Gloria Mantz
Ms. Mantz explained the Clean Building Performance Grant (CBPG) and provided details for the grant
application and that the funds would be used for new chillers for CenterPlace. She stated that the grant does
not require a match for funding purposes. Council provided consensus to return with a motion consideration
at a later meeting for the grant application.
GENERAL PUBLIC COMMENT OPPORTUNITY: Mayor Haley stated that the general public
comment rules still apply and called for public comments. Mr. John Harding, Spokane Valley provided
comment.
COUNCIL COMMENTS
Councilmember Merkel provided comments welcoming a new officer, spoke about yesterday being a one
of the most awful days for the city as there was a carjacking, a murder and a vehicle accident that
Councilmember Merkel said was due to a timing issue with the lights.
Councilmember Wick spoke about the projects for transportation and their importance, state agencies that
we should include in our conversations about the projects and talk to them about our other projects as well
for legislative session.
Councilmember Padden stated that all of council took the oath of office today and spoke about
Councilmember Merkel and his need to follow the rules and remember that oath.
Deputy Mayor Hattenburg spoke about the Sullivan project and that the on and off ramps are close to not
meeting inspections as well, not just the bridge area.

Mr.Hohman noted not just a matter of the bridge,it is the width, the ramps and an overall collective

Mr. Hohman stated that he wanted to end on good news and noted that the city hired a new Public Works
Director, Mr. Robert Blegen

It was moved by Deputy Mayor Hattenburg, seconded and unanimously agreed to adjourn into executive

State and Local Fiscal Recovery Funds (“CLFR”) and allocated $350 billion to these accounts to assist state
and local governments in meeting pandemic response needs and rebuilding the economy. The City of
Spokane Valley received approximately $16 million in CLFR funding.
One of the categories of allowable uses is to replace lost revenue as a result of the pandemic. The United
States Treasury has provided a formula and guidance on how to calculate lost revenue. Based on the
formula, the City calculated that the ARPA funds received may be used for any governmental service to
replace lost revenue. The City has primarily used these funds towards its ongoing law enforcement contract
costs. As a result of replacing that money, the City has identified it will have a corresponding amount of
general fund revenue available for use by City Council towards other projects or community needs.
On December 13, 2022, City Council approved a contract to award Innovia Foundation $1,000,000 towards
its LaunchNW initiative to provide assistance to youth at various levels to increase the number of youth
attending post-secondary education, vocational/trade education, or training. The assistance comes in many
forms, including scholarships, family engagement coordinators, and mentors to assist families and students
to receive and understand resources available to them.
Innovia has created the LaunchNW initiative through a variety of funding sources which covers the
following:
Development of a financial model to determine the size and scope of a last-dollar, tuition only
scholarship program
Formation of community leadership councils
Operational support (finalizing agreements with educational institutions, technical assistance,
communication, and donor development)
Wraparound services and supports enhancement within the current system of providers for
students and families in participating districts
The funding provided by the City supports these areas and the grant agreement runs through the end of
2026. Allowable costs are paid on a reimbursement basis and additionally, Innovia provides quarterly status
update reports on the progress of the program.

services. On May 16, 2023, Council approved an allocation of $471,729 to SNAP for the construction of
a 60-unit affordable senior housing project called Broadway Senior Housing (BSH). BSH will consist of
a four-story, corridor loaded building with two elevators, providing 57 one-bedroom units and three two-
bedroom units. The project will provide permanent rental housing and supportive services to seniors with
incomes at or below 60% of the area median household income. Additionally, seniors will be provided
with rent subsidy in most of the units and only pay 30% of their gross adjusted income in rent.
The grant agreement outlines the project scope, affordability requirements, supportive services to be
provided at the facility, and the timeline for the completion and occupancy of the senior home units. The
agreement also provides for reporting of program performance metrics including the total number of
income qualified seniors housed at the facility, demographic information, and supportive services
provided at the facility. The terms of this agreement ensure that the City grant funding will continue to be
used to serve the community over the life of the home units.

awards to five organizations. Volunteers of America (VOA) was awarded up to $500,000 to aid in the
construction of its Crosswalk 2.0 Teen Shelter. Crosswalk is an expanded service model that includes an
emergency shelter for youth aged 16-20. With the facility’s proximity to Spokane Community College,
Crosswalk 2.0 will also include college dorms for the youth who are engaged in Spokane Community
College’s career readiness degree and running start programs. On-site programming will continue to
support the youth with stabilizing services including case managers, teachers, health care workers, and
counselors. The program will serve a fundamental government purpose by providing community benefits
in support of the poor or infirm.
The grant funding represents approximately 3% of the overall project budget and will continue to serve
12% or more of Spokane Valley youth.
The grant agreement with VOA outlines the project scope and timeline and provides quarterly reporting
of those served and program performance metrics through the expiration of the agreement in December
2030. The terms of the agreement ensure that the City grant funding will continue to be used to serve the
community over the life of the facility. The project’s construction is currently over 30% complete and
VOA anticipates facility completion to occur Fall 2025.

acquisition for the future development of affordable housing units to expand the Homeownership
Program in the City of Spokane Valley. Habitat has since acquired four (4) lots within the City. These
will be residentially zoned R-3 and R-4 and be used to develop seven (7) units of housing that are
affordable to households with incomes at or below 80% area median income (AMI). Habitat will focus
their efforts on building high-quality, affordable homes, maximizing each lot to build multiple units.
Homebuyers must complete the homeownership program, including pre-purchase education, credit &
budget management and closing procedures to qualify for Habitat’s program and purchase a home.
The grant agreement outlines the project scope, property and affordability requirements, and the timeline
for the purchases and occupancy of the home units. The agreement also provides for reporting of program
performance metrics including recorded statutory warranty deeds, demographics on the homebuyer, and
an activity report of Beneficiary Information by the household. The term of this agreement ensures that
the City grant funding will continue to be used to serve the community over the life of the home units.

March 3, 2020 - Motion Consideration on approval of 2020 Legislative Agenda
BACKGROUND:
The Washington State Legislature has referred House Bill 1256 (HB1256) to Committee (1/13/25).
HB1256 is an Act relating to products manufactured in the United States for the purpose of public
works projects; amending RCW 39.04.010; adding new sections to chapter 39.04 RCW; and
creating a new section. HB1256 would require that manufactured products procured by the City
of Spokane Valley with state funds exceeding $500,000 are domestically produced, or
predominantly domestically produced depending on product and manufacturing method. The
material requirements appear to closely match the Federal Build America Buy America Act (BABA
November 15, 2021) which established a domestic content procurement preference for all
Federally funded infrastructure projects.
In the City’s adopted 2020 Legislative Agenda, a policy change request was requested for the
Buy America Act. The policy change indicated that the city supported the intent of the Buy America
Act, however the change being requested related to the onerous tracking requirements
associated with the act. Similarly, if passed, HB 1256 has the potential to impact construction
projects by increasing a portion of material costs, delaying material procurement, and requiring
additional staff time dedicated to material documentation. These impacts are similar to those seen
on federally funded projects. Individual project impacts will vary based on the specific materials
and projects scopes.
To examine current cost implications, staff made calls to suppliers requesting quotes of
domestically supplied materials versus materials without the same domestic requirements. In
some cases, domestic materials were found to be more expensive, ranging from near the same
price to double the price. However, the Federal BABA Act has been in place since 2021 resulting
in more manufacturers producing and more suppliers stocking and selling domestic products.
HB1256 does allow for a waiver for costs to the overall contract in excess of 25% so there is some
action the City can take in extreme cases, but budget impacts to projects of even 5%, 10% or
24% would be a significant cumulative cost to the program.
Waiver requirements proposed in the bill are more locally controlled than the waiver processes
for Federal Funds and appear to provide latitude for the executive head of a municipality to
determine:
1) Meeting the requirements would be inconsistent the public interest
2) Such materials and products are not produced in the United States in sufficient or
reasonably available quantities and of satisfactory quality
3) Inclusion of domestically produced material will increase the cost of the overall project
contract by more than 25%
However, prior to approving a waiver, the bill requires that is posted and given a 30-day public
comment period before a determination can be made. The determination and associated
justification must be posted to the city website. Unlike the Buy America Act or BABA Act, the bill
fails to cover a small quantities exception or de minimis incorporation of foreign materials. As
currently written, any small quantities of foreign materials would require a waiver.
An analysis of commonly used materials in the City construction projects yielded procurement
time delays for some domestic materials such as water valve boxes, pipe components, and light
poles. Depending on domestic supply issues impacted by unknowns such as hurricanes, fires,
floods etc., domestic supply can also be impacted during the course of a project but a remedy
appears to be available in the above mentioned 2) above.
