This information session will focus on how councilmembers, through their actions, may member of WCIA. Mr. Roscoe will also provide information concerning the role of Council, and that of the City Manager, in our form of government. Admin Report: Collective Bargaining Agreement - City Employees, Local 270V - John Whitehead Mr. Whitehead presented the collective bargaining agreement and reviewed some of the agreements that were reached between the parties. Mr. Whitehead also noted that it was agreed to by employees and will be a three year contract agreement. Council discussed previous agreements and that there was willingness with both sides to work together and that council appreciates our city staff. Councilmember Merkel requested verification that there was no built in COLA or automatic raises for staff. Mr. Whitehead stated that was correct and that was not in the contract. GOVERNING LEGISLATION: SVMC 22.110 PREVIOUS COUNCIL ACTION TAKEN: Council last amended the City’s sign code provisions , SVMC 22.110, in 2020 (Ordinance No. 20- 001). The last amendment to SVMC 22.110.020, the specific sign code section that is the subject of this administrative report, was in 2013 (Ordinance No. 13-010). On January 21, 2025, Council received and administrative report to review draft amendments to SVMC 22.110.020. BACKGROUND: The City’s sign code is SVMC 22.110 (hereinafter “Sign Code”). Over the last decade, the United States Supreme Court has issued decisions that modify how the First Amendment of the United States Constitution is interpreted and applied to the regulation of signs. The City Attorney’s Office is in the process of reviewing all aspects of the Sign Code to identify and recommend code text amendments consistent with current Supreme Court precedent. The first Sign Code regulation identified for revision pertains to signs placed within the City’s rights-of- way. As currently written, the Sign Code prohibits placement of signs with the City’s rights-of-way except “official signs and except bus benches placed pursuant to an agreement with the City.” See SVMC 22.110.020(E). However, municipal-owned unimproved or green spaces (hereafter “green spaces”) along city streets and sidewalks are regarded as traditional public forums for speech, and the City’s practice has been to not take enforcement action against “unofficial signs” (for example, signs supporting political candidates or ballot measures) placed in the green spaces within the City’s rights-of-way to the extent such signs do not impede the public’s use of the rights-of-way or otherwise violate time, place, and manner restrictions identified in the Sign Code and other applicable law. Per the Supreme Court’s holdings in Reed v. Gilbert, 135 S.Ct. 2218 (2015), and Austin v. Reagan National Advertising of Austin, LLC, 142 S.Ct. 1464 (2022), the City’s regulations of non-commercial signs must be content-neutral. Accordingly, if the City is to allow any non-commercial signs (for example, political campaign signs) within the right-of-way green spaces, then it must allow other non-commercial signage to exist within the right-of-way unless the City can establish it has a compelling government interest that can only be served by excluding non-political signs from said spaces while still allowing political signs. Reasonable content-neutral time, place, and manner restrictions may nonetheless be imposed on signs within the rights-of-way. The draft code text amendments were first presented for Council’s consideration at the January 21, 2025, Council meeting. The City Attorney’s Office also received comments from the Valleyfest organization – a local non-profit organization that coordinates community events within the City. Enclosed with this report is a proposed ordinance amending SVMC 22.110.020. The highlighted portions of the attached ordinance denote (a) changes made to the proposed amendment language where Council provided definitive guidance, (b) topics on which staff requests Council provide further direction on what, if any, modifications they prefer, and (c) changes made to facilitate community events for which the City has issued a special event permit to non-profit organization applicants. The amendments in the attached ordinance allow non- commercial signs to be temporarily placed within the greenspaces along City rights-of-way subject to reasonable time, place and manner restrictions, which restrictions are intended to promote the City’s interest in protecting public safety and the aesthetic integrity of the City’s rights-of-way. Public Hearing Required: Because the sign code is part of the development code, a public hearing must be held regarding the proposed amendment after publishing 15 notice thereof in advance of the public hearing. See SVMC 17.80.150. This hearing can be held by either the Council or the Planning Commission. Due to the fact this sign code amendment pertains only to regulating signage within City-owned rights-of-way, Council has already provided input on the amendment language, and the public will be able to voice their opinions on the amendments at a hearing, staff do not foresee any determinant to the public or government process were Council, rather than the Planning Commission, to conduct the public hearing. OPTIONS: Discuss and (1) schedule a hearing before the Council regarding adoption of Ordinance 25- 001, or (2) direct the Planning Commission hold a public hearing regarding adoption of Ordinance 25-001, or (3) take further action as Council deems appropriate. RECOMMENDED ACTION OR MOTION: I move Council to assume responsibility for and hold a public hearing to consider adoption of Ordinance 25-001 after publishing notice 15 days in advance of the hearing and advance Ordinance 25-001 to second reading. Amending SVMC 22.110.020. SVMC 22.110.020, titled “Prohibited Signs” is hereby amended as follows: SVMC 22.110.020 Prohibited signs. The following signs are prohibited: A. Signs which by coloring, shape, wording or location resemble or conflict with traffic control signs or devices; B. Signs that create a safety hazard for pedestrian or vehicular traffic; C. Flashing signs; D. Portable signs; except A-frame signs and reader boards specifically allowed pursuant to SVMC 22.110.050(A) and (E); E. Signs located within the public right-of-way, except official signs and except bus benches placed pursuant to an agreement with the City;Signs located within any public right-of-way, except for the following: 1. Official traffic signs and official government signs serving a legitimate public interest, such as those notifying the public of laws and/or traffic hazards, government services, or the location of public facilities; 2. Signs that (a) either identify the location of and parking for a community event open to the general public for which the City has issued a special event permit to a non-profit organization and are located next to the event/parking location, or are not an attempt or effort to gain business, and (b) are located solely within green spaces or unimproved portions of a right-of- way that abut that portion of the right-of-way used for vehicular, bicycle, and/or pedestrian traffic, provided the sign(s): i.Are not attached to or located within any part of a traffic control device. Traffic control devices include but are not limited to (i) traffic signs (such as speed limit signs, stop signs, yield signs, one-way signs, etc.),(ii) traffic signals; (iii) traffic islands or medians which separate lanes of traffic, and (iv) any part of a roundabout. ii. Are no more than 48 inches wide and placed such that the distance between the top of the sign and the ground directly underneath the sign is no more than 60 inches. iii. Are not permanently affixed to the land or any structure on the land, and do not alter any structure or improvement within the right-of-way. iv. Do not completely or partially impede any vehicle, bicycle, pedestrian or other mode of travel on any improved or unimproved roadway, walkway, or bicycle lane. v. Are not located within 20 feet of any traffic control device. vi. Are not located within any clearview triangle as that term is defined in SVMC 22.70.030. vii. Are not located on or within any stormwater facility, including but not limited to swales. viii. Are not located on any portion of a right-of-way that abuts City-owned facilities and/or property, including but not limited to City Hall, CenterPlace, the Spokane Valley Police Department Precinct, and City parks except in accordance with the terms of a validly issued special event permit. ix. Unless a validly issued special event permit provides otherwise, are (1) removed from the right-of-way within the sooner of either 14 calendar days after the event, if any, to which the sign pertains, or 240 days after initial placement, and (2) not again placed within any right-of-way until after 120 consecutive days have expired after removal. x. Are smooth and free of nails, tacks and wires. xi. Contain the owner’s name and either a current phone number, email or physical mailing address at which the owner regularly receives phone calls, email, or first-class mail from the United States Postal Service. This information does not need to be conspicuously placed on the front of the sign, but must be located on the sign in large enough print that it can be identified after reasonably inspection. F. Signs attached to or placed on a vehicle or trailer parked on public or private property; provided, that this provision shall not be construed as prohibiting the identification of a business or its product on a vehicle operating during the normal course of business; G. Signs obstructing visibility within any clearview triangle as established in Chapter 22.70 SVMC; H. Billboards except when permitted as provided in SVMC22.110.130; I. February 4, 2025 Administrative Report on Local Solid Waste Financial Assistance (LSWFA) Grant, 2025-2027 Biennium BACKGROUND: To help offset costs for solid waste management, the State of Washington provides both competitive and non-competitive grants as funding allows. Each biennium, the Washington Legislature authorizes a financial assistance program under the Model Toxics Control Act (MTCA) through the Local Solid Waste Financial Assistance (LSWFA) Grant to 1) support local solid and hazardous waste planning and implementation, and 2) to enforce rules and regulations governing solid waste handling. Moneys in the model toxics control operating account may only be used to carry out the purposes of the MTCA chapter, which includes financial assistance for local programs and plans, including local solid waste financial assistance. LSWFA Grant funding for cities like Spokane Valley may be used for planning and implementation (and not enforcement) which includes tasks such as: Local solid and hazardous waste plan development and maintenance Local solid and hazardous waste plan implementation including - o Moderate risk waste programs: collecting and disposing of household hazardous waste o Waste reduction and recycling programs: education and outreach, contamination reduction o Organics programs: education and outreach to encourage compost diversion from garbage, compost procurement reporting The Department of Ecology (Ecology) administers the LSWFA Grant and allocates funding to eligible jurisdictions that apply for the grant budget. Eligible independent cities, such as Spokane Valley, receive a per capita allocation. This grant is non- competitive, is reimbursement-based, and requires a 25% match. The LSWFA Grant allocation available to Spokane Valley has historically ranged between $100- 200K. For the 2025-2027 Bienniumstate share allocation is $158,576. Due to limited staffing and the reporting and monitoring requirements, the City has historically not applied for its LSWFA Grant allocation. However, in recent years City staffing has shifted to include greater capacity for grant management and experience in both reporting and compliance. During negotiations with Sunshine, the City identified that the solid waste-related grants may provide opportunities to offset costs for certain services that could result in decreases in rates paid by ratepayers and/or provide additional services that are beneficial to residents. The LSWFA Grant application for the 2025-2027 Biennium is due February 12, 2025. Staff provided information and received Council consensus to return for a motion consideration. There are several issues for City Council to consider for this grant, including (1) reimbursement and funding match issues, (2) potential projects, and (3) timing. Reimbursement and Funding Match Issues. First, the LSWFA Grant is a reimbursement- based grant and there is a required City-match for the funding. Grantees receive 75% of total eligible costs and are directly responsible for the remaining 25% of costs. Under the current contract with Sunshine, the City does not pay for any costs or services directly. Thus, an amendment would be necessary if Sunshine provided grant-funded projects and the City would be required to pay for certain grant-eligible costs in order to receive grant reimbursement. Further, because the grant has a required match, the City would be responsible for 25% of the total costs. Given the available allocation of approximately $160,000, this means that over the next two years the City would be required to fund $50,000 to receive the $160,000. City staff have had preliminary conversations with Sunshine about possible amendments to allow the City to receive the grant funds. One example that has been discussed would be for the City to pay for certain grant-eligible costs, such as moderate risk waste disposal costs, from funds within the Solid Waste Fund 106 and seek reimbursement for up to 75% of the total costs. In return, Sunshine would reduce gate rates to ratepayers based on the total amount received. More discussion with Sunshine would be required to determine the total savings to ratepayers, long- term financial impact for such a plan, as well as other options that might be desired by Council. Potential Projects. On February 4, 2025, Council heard an administrative report on the LSWFA Grant. Projects that were discussed under the LSWFA Grant include: Lithium-ion battery storage: establishing a separate temporary storage area while the batteries are waiting to be recycled. The strategy requires specialized equipment and dedicated personnel hours to accomplish. Special battery collection events: partner with community stakeholders to host offsite special collection events twice a year to encourage proper disposal of lithium-ion batteries. Events would be hosted at central locations to promote use, visibility, and awareness. Food waste prevention events/activities: partner with community stakeholders to host offsite special collection events twice a year to demonstrate food waste prevention strategies and demonstrate proper disposal. Events would be hosted at existing activities to promote participation, visibility, and awareness. Homeless encampment response: The City has taken a multi-pronged approach to addressing homelessness including consistent enforcement, investment in services, and clean-up efforts and provides an expanded resource for maintaining public rights-of-way. City would define the recipient of the waste at the Transfer Station. Timing. LSWFA grant applications are due by February 12, 2025, at 5 p.m. While there are still many details that would need to be worked out to ultimately receive the funds, including potential contract amendments, applying for the LSWFA Grant does not lock the City into having to expend any funds. First, applications can be made broadly for a variety of possible projects. Secondly, there is no penalty or mandate to expend funds. If the City applies for funds but does not spend any money or seek any re then distributed back to Spokane County or other agencies that need additional funds. Thus, while the application deadline is very tight, there is still time throughout the spring to determine a final course of action on whether to use the funds or give them back to Ecology. Finally, this grant is on a two-year cycle, and so the next opportunity to apply will be in 2027. If Council authorizes the LSWFA Grant submission, staff will return at a later date to discuss specifics of the project options to get Council direction on its desired specific use of the funding. The well, which is very shallow, requires monthly water quality monitoring and does not produce the required flows to sustain current and future park facilities, and lacks adequate fire flows. The initial plan for providing a sustainable water source to the park included a new water main to be located under the Sullivan Road bridge across the Spokane River. However, this water main would have conveyed water from Consolidated Irrigation District to the park. The park is in the Trentwood Irrigation District’s (Trentwood) long-term water service area. In 2016, discussions between the City and Trentwood took place regarding extending a water main from north of the Union Pacific Railroad (UPRR) tracks to Sullivan Park. A parcel is located between the UPRR property and Sullivan Park. The City entered into an agreement with WSDOT to purchase this parcel in 2019. A Department of Ecology (DOE) mandated environmental cleanup delayed the purchase of the WSDOT parcel until it was deemed clean by DOE in 2025. Purchase of the property was finalized subsequently. In 2018 discussions with Trentwood and the Department of Commerce (DOC), the most efficient way to deliver the project was for the City to complete the project through agreements with Trentwood. As a first step in receiving water service from Trentwood, the park and former WSDOT parcels have been annexed into Trentwood’s water service area. In 2021, the City entered into an Interlocal Agreement with Trentwood to design and construct the waterline. The design was completed in 2022. This design was used to secure a UPRR Pipeline Crossing Agreement in 2023. The City is working with UPRR on a Supplemental Agreement for construction in 2025. In 2020, the City of Spokane Valley received a $130,000 appropriation from the Washington State Legislature. The DOC agreement cannot be executed until the necessary property rights are acquired and the City commits the funds for the design and construction of the waterline. DOC will relinquish with grant funds if the City does not spend them by June 30, 2025. The most recent cost estimate for the entire project is $1,175,000. Currently, the project has a funding shortfall of $636,000 due to cost escalations during the property clean up timeline. The current estimate includes a $150,000 contingency in the event large boulders are encountered while boring under the UPRR tracks. Below is a summary of the current project funding. BACKGROUND: The City of Spokane Valley participates in the Spokane County urban consortium for the HUD Entitlement Funds including the Community Development Block Grant, the Home Investment Partnership Program (HOME) and the Emergency Solutions Grants (ESG). Each year the Federal Department of Housing and Urban Development provides HUD entitlement funding to Spokane County. In 2023, the City entered into a new cooperation agreement (attached) that increased the City’s set-aside for CDBG, HOME and ESG based on its share of Consortium population. In previous agreements, the City did not have a set-aside for the HOME and ESG funds. Spokane County issued a Request for Proposals (RFP) for the use of HUD entitlement funds for the program year 2025, as well as several other funding sources for which the City does not have an entitlement. Proposals were due on January 15, 2025. BACKGROUND: The City of Spokane Valley must complete the Comprehensive Plan Periodic Update by June 30, 2026. The State of Washington through Department of Commerce has provided grant funding to assist in the update. A consultant team led by Community Attributes Inc (CAI) was selected through a Request For Qualifications (RFQ) process that included review of submitted material and interviews. A RFQ was issued, and all responses were reviewed for applicable experience and skills. Interviews were held and the CAI consultant team was selected. In addition to having compiled a consultant team familiar with the State processes and requirements, they brought an understanding of the Spokane Valley. In 2016 CAI facilitated the Periodic Comprehensive Plan Update for Spokane Valley. A Scope of Work was developed to address the required update, comply with State mandates, and incorporate local values and plan improvements. Grants are being used to fund consultant services Comprehensive Plan and implementing Development Regulations in the Spokane Valley Municipal Code (SVMC). The City is mandated by state law, RCW 36.70A.130, to review and revise the Comprehensive Plan and Development Regulations every 10 years. This mandated review is otherwise known as the Periodic Update. The purpose of the Periodic Update is to ensure that the Comprehensive Plan and Development Regulations are compliant with state law, particularly as it relates to land use and planning. In 2022 and 2023 the Washington State Legislature made significant changes to the Growth housing affordable to all income levels. This significantly strengthened the previous goal, which was to encourage affordable housing. The amended law directed the Department of Commerce to project future housing needs for jurisdictions by income bracket and made significant updates to how jurisdictions are to plan for housing in their comprehensive plans. These new changes to the housing element include: Planning for sufficient land capacity for housing needs, including all economic segments of the population (moderate, low, very low and extremely low income, as well as emergency housing and permanent supportive housing). RCA Motion Consideration for Commerce Grants Page 1 of 2 Providing moderate density housing options within Urban Growth Areas (UGAs), including but not limited to duplexes, triplexes and townhomes. Making adequate provisions for housing for existing and projected needs for all economic segments of the community, including documenting programs and actions needed to achieve housing availability. Identifying racially disparate impacts, displacement and exclusion in housing policies and regulations, and beginning to undo those impacts; and identifying areas at higher risk of displacement and establishing anti-displacement policies. The amended law also requires local jurisdictions to develop and adopt a new Climate Element. This new element includes two sub-elements to address climate resilience and greenhouse gas emissions. It should be noted that the Washington State Legislature has essentially created a top-down approach to local comprehensive planning where the State is dictating policy and development regulations local governments shall adopt. Prior to the recent legislative changes, the state established broad goals allowing local governments the flexibility to mold their comprehensive plans and development regulations specific to the local Through this periodic update the intent will be to meet the requirements of GMA while tailoring the Comprehensive Plan as much as possible to protect the character of our community. Unfortunately, there are many requirements that must be adhered to for the City to have a compliant Comprehensive Plan and supporting development regulations. A robust public participation process will be implemented throughout this update. BACKGROUND: Assistance Program has set aside state funds for cities, counties, and tribal governments to develop high quality active transportation plans that better position agencies to compete for funding programs like the Safe Routes to School Program and the Pedestrian-Bicycle Program. WSDOT identified the City of Spokane Valley as one of 10 agencies that have been invited to participate. Participation in this exercise is available through invitation-only from WSDOT. It is estimated that Spokane Valley is eligible to receive between $50,000 and $150,000 of state grant funds. There is no local match required. The City must notify WSDOT of its intent to participate by February 26, 2025. There are multiple factors to consider should the City choose to participate: 1. cycle and pedestrian components that identify long-range plans for bicycle and pedestrian facilities (i.e. sidewalks, bike lanes, pathways, etc.). The plans will need to be updated as part of the Comprehensive Plan update. This WSDOT funding opportunity will support the update of these Comprehensive Plan elements. 2. Transportation Element requires additional traffic volume data be obtained to complete the level of service analysis required by the necessary updates. These costs are not eligible for use by the previously secured grant funds for Comprehensive Plan development. a. Active Transportation Plan to include traffic volume collection. GOVERNING LEGISLATION: SVMC 24.40.020(A)(3) adopting Washington State Energy Code (Chapter 51-11R WAC); WAC 51-11R-40610; Initiative 2066; RCW 19.27A.020 PREVIOUS COUNCIL ACTION TAKEN: Council adopted Title 24 of the Spokane Valley Municipal Code in 2007 (Ordinance No. 07-010), which included adoption of the Washington State Energy Code, Chapter 51-11 WAC. In 2021, Council amended Title 24 SVMC to align the language with the adoption of the International Energy Conservation Code (Ordinance No. 21-005). BACKGROUND: RCW 19.27A.020 authorizes the state building code council (“SBCC”) to adopt rules to be known as the Washington State Energy Code (“WSEC”) as part of the state building code. The City is required to implement the WSEC and therefore adopted it via SVMC 24.40.020(A)(3). Energy Equalization Credits (“EECs”) are part of the Washington state residential energy code outlined in Chapter 51-11R WAC. EECs are spread across multiple categories, including heat sources, and builders are required to hit a minimum number of EECs to meet code. In the context of this discussion, EECs serve to balance the carbon emissions associated with different fuel types used for heating sources in residential buildings and are intended to encourage builders to enhance energy efficiency. The WSEC was amended last year and went into effect on March 15, 2024. The amendment included new requirements for earning EECs. Specifically, section R406 now requires that each new single-family home built in Washington reach a higher minimum amount of EECs based on its size and penalizes the use of combustion heating equipment (natural gas) as the primary heating source. Most importantly, Table R406.2 now allows zero credits for the use of natural gas and allows up to three credits for electric heat sources. Therefore, builders who implement electric heat sources can reach the minimum amount of EECs more easily. In response, State Initiative 2066 (“I-2066”) was placed on 2024 Washington ballots and was approved by the voters. I-2066 prohibits local governments from restricting access to natural gas and directly preempts regulations that penalize, discourage, or disincentivizes the use of natural gas – ie. Table R406.2. I-2066 became effective law on December 5, 2024, pursuant to Article II, section 1d of the Washington State Constitution, and essentially preempts the updated EEC allocations in Table R406.2. The legislature recently revised RCW 19.27A.020 to comply with I-2066. RCW 19.27A.020(3) specifically states that the WSEC cannot prohibit, penalize, or discourage the use of gas. The SBCC has yet to amend the WSEC to comply with I-2066. Therefore, the WSEC currently conflicts with both the RCW and I-2066. I-2066 may be challenged by opponents of the measure and/or the SBCC may amend sections of the WSEC that conflict with I-2066 and RCW 19.27A.020(3). However, until final action is taken either way, there is a stark conflict and the City is bound by both. Therefore, the City must decide whether to follow the WSEC or comply with I-2066. Pierce County and Grant County have taken the latter approach and implemented interim policies that modify Table R406.2 while remaining compliant with the remaining provisions of the WSEC. Such an approach aligns with the will of the voters, complies with RCW 19.27A.020(3), and limits the potential for suit against the City by its citizens for damages. There is risk in adopting provisions that conflict with the WSEC. However, the chance and magnitude of risk in not following I-2066/RCW 19.27A.020(3) is substantially greater than deviating from the WSEC. This is because, though it is possible that the State could file suit to compel enforcement of the WSEC as currently written, any homebuilder is a potential claimant, and each homebuilder claimant could seek potential monetary damages for violations of I-2066. Moreover, given that I-2066 is also effective law and effectively incorporated into the Revised Code of Washington, it is unlikely that the State would attempt or be successful in any attempt to force local governments to comply with WSEC energy code provisions that contradict statutory law. The risk associated with ignoring the will of the people is much higher. Next Steps. If Council desires to comply with I-2066 rather than the current non-compliant version of the WSEC, there are two primary steps that would occur. First, upon Council consensus, staff would consider and provide an administrative interpretation to apply Table R406.2 of the WSEC as set forth below and consistent with I-2066 and RCW 19.27A.020(3). Normally, a public hearing is required for such action and is conducted by the Planning Commission. However, City Council may assume responsibility for conducting the public hearing and consider the ordinance immediately. Thus, upon Council consensus to assume responsibility for the public hearing and to consider an ordinance to amend the Spokane Valley Municipal Code consistent with I-2066 and RCW 19.27A.020(3), staff would notice a public hearing for City Council and bring back an ordinance amending SVMC 24.40.020(A)(3) to ensure compliance with I- 2066 and RCW 19.27A.020(3). These changes will allow the City to comply with I-2066 and RCW 19.27A.020(3) until such time as the SBCC amends the WSEC. OPTIONS: Consensus to (1) have the City Manager take such immediate action necessary to bring City enforcement and administration of the WSEC into compliance with I-2066 and RCW 19.27A.020(3); (2) bring back an ordinance adopting changes to the Spokane Valley Municipal Code to be in compliance with I-2066 and RCW 19.27A.020(3); and (3) assume responsibility and conduct a public hearing on such ordinance; or take further action as Council deems appropriate. BE IT ENACTED BY THE PEOPLE OF THE STATE OF WASHINGTON: NEW SECTION. Sec. 1. (1) The people find that having access to natural gas enhances the safety, welfare, and standard of living of all people in Washington. The people further find that preserving Washington's gas infrastructure and systems will promote energy choice, security, independence, and resilience throughout the state. Natural gas is a convenient and important necessity because it: Serves as a backup source of energy during emergencies; provides consumers with more options for heating, sanitation, cooking and food preparation, and other household activities, helping to control their costs; and sustains essential businesses, such as restaurants. (2) Unfortunately, due to recent policy and corporate decisions, the people's ability to make choices about their energy sources is at risk. Therefore, the people determine that access to gas and gas appliances must be preserved for Washington homes and businesses, by strengthening utilities' obligation to provide natural gas to customers who want it, and by preventing regulatory actions that will limit access to gas. Code Rev/ML:eab 1 I-4903.1/24 Sec. 2. RCW 80.28.110 and 2024 c 348 s 6 are each amended to read as follows: (1) Every gas company, electrical company, wastewater company, or water company, engaged in the sale and distribution of gas, electricity, or water, or the provision of wastewater company services, shall, upon reasonable notice, furnish to all persons and corporations who may apply therefor and be reasonably entitled thereto, suitable facilities for furnishing and furnish all available gas, electricity, wastewater company services, and water as demanded, except that: (((1))) (a) A water company may not furnish water contrary to the provisions of water system plans approved under chapter 43.20 or 70A.100 RCW; (((2))) (b) wastewater companies may not provide services contrary to the approved general sewer plan; and (((3))) (c) exclusively upon petition of a gas company, and subject to the commission's approval, a gas company's obligation to serve gas to customers that have access to the gas company's thermal energy network may be met by providing thermal energy through a thermal energy network. (2) Every gas company or large combination utility shall provide natural gas to all persons and corporations in their service area or territory that demand, apply for, and are reasonably entitled to receive, natural gas under this section, even if other energy services or energy sources may be available. Sec. 3. RCW 35.92.050 and 2022 c 292 s 405 are each amended to read as follows: (1) A city or town may also construct, condemn and purchase, purchase, acquire, add to, alter, maintain, and operate works, plants, facilities for the purpose of furnishing the city or town and its inhabitants, and any other persons, with gas, electricity, green electrolytic hydrogen as defined in RCW 54.04.190, renewable hydrogen as defined in RCW 54.04.190, and other means of power and facilities for lighting, including streetlights as an integral utility service incorporated within general rates, heating, fuel, Code Rev/ML:eab 2 I-4903.1/24 and power purposes, public and private, with full authority to regulate and control the use, distribution, and price thereof, together with the right to handle and sell or lease, any meters, lamps, motors, transformers, and equipment or accessories of any kind, necessary and convenient for the use, distribution, and sale thereof; authorize the construction of such plant or plants by others for the same purpose, and purchase gas, electricity, or power from either within or without the city or town for its own use and for the purpose of selling to its inhabitants and to other persons doing business within the city or town and regulate and control the use and price thereof. (2) A city or town that furnishes natural gas shall provide natural gas to those inhabitants that demand, apply for, and are reasonably entitled to receive, natural gas under this section, even if other energy services or energy sources may be available. Sec. 4. RCW 80.28.425 and 2024 c 351 s 18 are each amended to read as follows: (1) Beginning January 1, 2022, every general rate case filing of a gas or electrical company must include a proposal for a multiyear rate plan as provided in this chapter. The commission may, by order after an adjudicative proceeding as provided by chapter 34.05 RCW, approve, approve with conditions, or reject, a multiyear rate plan proposal made by a gas or electrical company or an alternative proposal made by one or more parties, or any combination thereof. The commission's consideration of a proposal for a multiyear rate plan is subject to the same standards applicable to other rate filings made under this title, including the public interest and fair, just, reasonable, and sufficient rates. In determining the public interest, the commission may consider such factors including, but not limited to, environmental health and greenhouse gas emissions reductions, health and safety concerns, economic development, and equity, to the extent such factors affect the Code Rev/ML:eab 3 I-4903.1/24 rates, services, and practices of a gas or electrical company regulated by the commission. (2) The commission may approve, disapprove, or approve with modifications any proposal to recover from ratepayers up to five percent of the total revenue requirement approved by the commission for each year of a multiyear rate plan for tariffs that reduce the energy burden of low-income residential customers including, but not limited to: (a) Bill assistance programs; or (b) one or more special rates. For any multiyear rate plan approved under this section resulting in a rate increase, the commission must approve an increase in the amount of low-income bill assistance to take effect in each year of the rate plan where there is a rate increase. At a minimum, the amount of such low-income assistance increase must be equal to double the percentage increase, if any, in the residential base rates approved for each year of the rate plan. The commission may approve a larger increase to low-income bill assistance based on an appropriate record. (3)(a) If it approves a multiyear rate plan, the commission shall separately approve rates for each of the initial rate year, the second rate year and, if applicable, the third rate year, and the fourth rate year. (b) The commission shall ascertain and determine the fair value for rate-making purposes of the property of any gas or electrical company that is or will be used and useful under RCW 80.04.250 for service in this state by or during each rate year of the multiyear rate plan. For the initial rate year, the commission shall, at a minimum, ascertain and determine the fair value for rate-making purposes of the property of any gas or electrical company that is used and useful for service in this state as of the rate effective date. The commission may order refunds to customers if property expected to be used and useful by the rate effective date when the commission approves a multiyear rate plan is in fact not used and useful by such a date. Code Rev/ML:eab 4 I-4903.1/24 (c) The commission shall ascertain and determine the revenues and operating expenses for rate-making purposes of any gas or electrical company for each rate year of the multiyear rate plan. (d) In ascertaining and determining the fair value of property of a gas or electrical company pursuant to (b) of this subsection and projecting the revenues and operating expenses of a gas or electrical company pursuant to (c) of this subsection, the commission may use any standard, formula, method, or theory of valuation reasonably calculated to arrive at fair, just, reasonable, and sufficient rates. (e) If the commission approves a multiyear rate plan with a duration of three or four years, then the electrical company must update its power costs as of the rate effective date of the third rate year. The proceeding to update the electrical company's power costs is subject to the same standards that apply to other rate filings made under this title. (4) Subject to subsection (5) of this section, the commission may by order establish terms, conditions, and procedures for a multiyear rate plan and ensure that rates remain fair, just, reasonable, and sufficient during the course of the plan. (5) Notwithstanding subsection (4) of this section, a gas or electrical company is bound by the terms of the multiyear rate plan approved by the commission for each of the initial rate year and the second rate year. A gas or electrical company may file a new multiyear rate plan in accordance with this section for the third rate year and fourth rate year, if any, of a multiyear rate plan. (6) If the annual commission basis report for a gas or electrical company demonstrates that the reported rate of return on rate base of the company for the 12-month period ending as of the end of the period for which the annual commission basis report is filed is more than .5 percent higher than the rate of return authorized by the commission in the multiyear rate plan for such a company, the company shall defer all revenues that are in excess of .5 percent higher than the rate of return authorized by the Code Rev/ML:eab 5 I-4903.1/24 commission for refunds to customers or another determination by the commission in a subsequent adjudicative proceeding. If a multistate electrical company with fewer than 250,000 customers in Washington files a multiyear rate plan that provides for no increases in base rates in consecutive years beyond the initial rate year, the commission shall waive the requirements of this subsection provided that such a waiver results in just and reasonable rates. (7) The commission must, in approving a multiyear rate plan, determine a set of performance measures that will be used to assess a gas or electrical company operating under a multiyear rate plan. These performance measures may be based on proposals made by the gas or electrical company in its initial application, by any other party to the proceeding in its response to the company's filing, or in the testimony and evidence admitted in the proceeding. In developing performance measures, incentives, and penalty mechanisms, the commission may consider factors including, but not limited to, lowest reasonable cost planning, affordability, increases in energy burden, cost of service, customer satisfaction and engagement, service reliability, clean energy or renewable procurement, conservation acquisition, demand side management expansion, rate stability, timely execution of competitive procurement practices, attainment of state energy and emissions reduction policies, rapid integration of renewable energy resources, and fair compensation of utility employees. (8) Nothing in this section precludes any gas or electrical company from making filings required or permitted by the commission. (9) The commission shall align, to the extent practical, the timing of approval of a multiyear rate plan of an electrical company submitted pursuant to this section with the clean energy implementation plan of the electrical company filed pursuant to RCW 19.405.060. (10) The provisions of this section may not be construed to limit the existing rate-making authority of the commission. Code Rev/ML:eab 6 I-4903.1/24 (11) The commission may require a large combination utility as defined in RCW 80.--.--- (section 2, chapter 351, Laws of 2024) to incorporate the requirements of this section into an integrated system plan established under RCW 80.--.--- (section 3, chapter 351, Laws of 2024). (12) The commission shall not approve, or approve with conditions, a multiyear rate plan that requires or incentivizes a gas company or large combination utility to terminate natural gas service to customers. (13) The commission shall not approve, or approve with conditions, a multiyear rate plan that authorizes a gas company or large combination utility to require a customer to involuntarily switch fuel use either by restricting access to natural gas service or by implementing planning requirements that would make access to natural gas service cost-prohibitive. Sec. 5. RCW 80.--.--- and 2024 c 351 s 3 are each amended to read as follows: (1) The legislature finds that large combination utilities are subject to a range of reporting and planning requirements as part of the clean energy transition. The legislature further finds that current natural gas integrated resource plans under development might not yield optimal results for timely and cost-effective decarbonization. To reduce regulatory barriers, achieve equitable and transparent outcomes, and integrate planning requirements, the commission may consolidate a large combination utility's planning requirements for both gas and electric operations, including consolidation into a single integrated system plan that is approved by the commission. (2)(a) By July 1, 2025, the commission shall complete a rule- making proceeding to implement consolidated planning requirements for gas and electric services for large combination utilities that may include plans required under: (i) RCW 19.280.030; (ii) RCW 19.285.040; (iii) RCW 19.405.060; (iv) RCW 80.28.380; (v) RCW Code Rev/ML:eab 7 I-4903.1/24 80.28.365; (vi) RCW 80.28.425; and (vii) RCW 80.28.130. The commission may extend the rule-making proceeding for 90 days for good cause shown. The large combination utilities' filing deadline required in subsection (4) of this section will be extended commensurate to the rule-making extension period set by the commission. Subsequent planning requirements for future integrated system plans must be fulfilled on a timeline set by the commission. Large combination utilities that file integrated system plans are no longer required to file separate plans that are required in an integrated system plan. The statutorily required contents of any plan consolidated into an integrated system plan must be met by the integrated system plan. (b) In its order adopting rules or issuing a policy statement approving the consolidation of planning requirements, the commission shall include a compliance checklist and any additional guidance that is necessary to assist the large combination utility in meeting the minimum requirements of all relevant statutes and rules. (3) Upon request by a large combination utility, the commission may issue an order extending the filing and reporting requirements of a large combination utility under RCW 19.405.060 and 19.280.030, and requiring the large combination utility to file an integrated system plan pursuant to subsection (4) of this section if the commission finds that the large combination utility has made public a work plan that demonstrates reasonable progress toward meeting the standards under RCW 19.405.040(1) and 19.405.050(1) and achieving equity goals. The commission's approval of an extension of filing and reporting requirements does not relieve the large combination utility from the obligation to demonstrate progress towards meeting the standards under RCW 19.405.040(1) and 19.405.050(1) and the interim targets approved in its most recent clean energy implementation plan. Commission approval of an extension under this section fulfills the large combination ((utilities)) utility's statutory filing deadlines under RCW 19.405.060(1). Code Rev/ML:eab 8 I-4903.1/24 (4) By January 1, 2027, and on a timeline set by the commission thereafter, large combination utilities shall file an integrated system plan demonstrating how the large combination utilities' plans are consistent with the requirements of this chapter and any rules and guidance adopted by the commission, and which: (a) Achieve the obligations of all plans consolidated into the integrated system plan; (b) Provide a range of forecasts, for at least the next 20 years, of projected customer demand that takes into account econometric data and addresses changes in the number, type, and efficiency of customer usage; (c) Include scenarios that achieve emissions reductions for both gas and electric operations equal to at least their proportional share of emissions reductions required under RCW 70A.45.020; (d) Include scenarios with emissions reduction targets for both gas and electric operations for each emissions reduction period that account for the interactions between gas and electric systems; (e) Achieve two percent of electric load annually with conservation and energy efficiency resources, unless the commission finds that a higher target is cost-effective. However, the commission may accept a lower level of achievement if it determines that the requirement in this subsection (4)(e) is neither technically nor commercially feasible during the applicable emissions reduction period; (f) Assess commercially available conservation and efficiency resources, including demand response and load management, to achieve the conservation and energy efficiency requirements in (e) of this subsection, and as informed by the assessment for conservation potential under RCW 19.285.040 for the planning horizon consistent with (b) of this subsection. Such an assessment may include, as appropriate, opportunities for development of combined heat and power as an energy and capacity resource, demand response and load management programs, and currently employed and new policies and programs needed to obtain the conservation and efficiency resources. Code Rev/ML:eab 9 I-4903.1/24 The value of recoverable waste heat resulting from combined heat and power must be reflected in analyses of cost-effectiveness under this subsection; (g) Achieve annual demand response and demand flexibility equal to or greater than 10 percent of winter and summer peak electric demand, unless the commission finds that a higher target is cost- effective. However, the commission may accept a lower level of achievement if it determines that the requirement in this subsection (4)(g) is neither technically nor commercially feasible during the applicable emissions reduction period; (h) ((Achieve all cost-effective electrification of end uses currently served by natural gas identified through an assessment of alternatives to known and planned gas infrastructure projects, including nonpipeline alternatives, rebates and incentives, and geographically targeted electrification; (i))) Include low-income electrification programs that must: (i) Include rebates and incentives to low-income customers and customers experiencing high energy burden for the deployment of high-efficiency electric-only heat pumps in homes and buildings currently heating with wood, oil, propane, electric resistance, or gas; (ii) Provide demonstrated material benefits to low-income participants including, but not limited to, decreased energy burden, the addition of air conditioning, and backup heat sources using natural gas or energy storage systems, if necessary to protect health and safety in areas with frequent outages, or improved indoor air quality; (iii) Enroll customers in energy assistance programs or provide bill assistance; (iv) ((Provide dedicated funding for electrification readiness; (v))) Include low-income customer protections to mitigate energy burden, if electrification measures will increase a low-income participant's energy burden; and Code Rev/ML:eab 10 I-4903.1/24 (((vi))) (v) Coordinate with community-based organizations in the ((gas or electrical company's)) large combination utility's service territory including, but not limited to, grantees of the department of commerce, community action agencies, and community- based nonprofit organizations, to remove barriers and effectively serve low-income customers; (((j))) (i) Accept as proof of eligibility for energy assistance enrollment in any means-tested public benefit, or low-income energy assistance program, for which eligibility does not exceed the low- income definition set by the commission pursuant to RCW 19.405.020; (((k) Assess the potential for geographically targeted electrification including, but not limited to, in overburdened communities, on gas plant that is fully depreciated or gas plant that is included in a proposal for geographically targeted electrification that requires accelerating depreciation pursuant to RCW 80.--.---(1) (section 7(1), chapter 351, Laws of 2024) for the gas plant subject to such electrification proposal; (l))) (j) Assess commercially available supply side resources, including a comparison of the benefits and risks of purchasing electricity or gas or building new resources; (((m) Assess nonpipeline alternatives, including geographically targeted electrification and demand response, as an alternative to replacing aging gas infrastructure or expanded gas capacity. Assessments must involve, at a minimum: (i) Identifying all known and planned gas infrastructure projects, including those without a fully defined scope or cost estimate, for at least the 10 years following the filing; (ii) Estimating programmatic expenses of maintaining that portion of the gas system for at least the 10 years following the filing; and (iii) Ranking all gas pipeline segments for their suitability for nonpipeline alternatives; (n))) (k) Assess distributed energy resources that meets the requirements of RCW 19.280.100; Code Rev/ML:eab 11 I-4903.1/24 (((o))) (l) Provide an assessment and 20-year forecast of the availability of and requirements for regional supply side resource and delivery system capacity to provide and deliver electricity and gas to the large combination utility's customers and to meet, as applicable, the requirements of chapter 19.405 RCW and the state's greenhouse gas emissions reduction limits in RCW 70A.45.020. The delivery system assessment must identify the large combination utility's expected needs to acquire new long-term firm rights, develop new, or expand or upgrade existing, delivery system facilities consistent with the requirements of this section and reliability standards and take into account opportunities to make more effective use of existing delivery facility capacity through improved delivery system operating practices, conservation and efficiency resources, distributed energy resources, demand response, grid modernization, nonwires solutions, and other programs if applicable; (((p))) (m) Assess methods, commercially available technologies, or facilities for integrating renewable resources and nonemitting electric generation including, but not limited to, battery storage and pumped storage, and addressing overgeneration events, if applicable to the large combination utility's resource portfolio; (((q))) (n) Provide a comparative evaluation of supply side resources, delivery system resources, and conservation and efficiency resources using lowest reasonable cost as a criterion; (((r))) (o) Include a determination of resource adequacy metrics for the integrated system plan consistent with the forecasts; (((s))) (p) Forecast distributed energy resources that may be installed by the large combination utility's customers and an assessment of their effect on the large combination utility's load and operations; (((t))) (q) Identify an appropriate resource adequacy requirement and measurement metric consistent with prudent utility practice in implementing RCW 19.405.030 through 19.405.050; Code Rev/ML:eab 12 I-4903.1/24 (((u))) (r) Integrate demand forecasts, resource evaluations, and resource adequacy requirements into a long-range assessment describing the mix of supply side resources and conservation and efficiency resources that will meet current and projected needs, including mitigating overgeneration events and implementing RCW 19.405.030 through 19.405.050, at the lowest reasonable cost and risk to the large combination utility and its customers, while maintaining and protecting the safety, reliable operation, and balancing of the energy system of the large combination utility; (((v))) (s) Include an assessment, informed by the cumulative impact analysis conducted under RCW 19.405.140, of: Energy and nonenergy benefits and the avoidance and reductions of burdens to vulnerable populations and highly impacted communities; long-term and short-term public health and environmental benefits, costs, and risks; and energy security and risk; (((w))) (t) Include a 10-year clean energy action plan for implementing RCW 19.405.030 through 19.405.050 at the lowest reasonable cost, and at an acceptable resource adequacy standard; (((x))) (u) Include an analysis of how the integrated system plan accounts for: (i) Model load forecast scenarios that consider the anticipated levels of zero emissions vehicle use in a large combination utility's service area, including anticipated levels of zero emissions vehicle use in the large combination utility's service area provided in RCW 47.01.520, if feasible; (ii) Analysis, research, findings, recommendations, actions, and any other relevant information found in the electrification of transportation plans submitted under RCW 80.28.365; and (iii) Assumed use case forecasts and the associated energy impacts, which may use the forecasts generated by the mapping and forecasting tool created in RCW 47.01.520; (((y))) (v) Establish that the large combination utility has: (i) Consigned to auction for the benefit of ratepayers the minimum required number of allowances allocated to the large Code Rev/ML:eab 13 I-4903.1/24 combination utility for the applicable compliance period pursuant to RCW 70A.65.130, consistent with the climate commitment act, chapter 70A.65 RCW, and rules adopted pursuant to the climate commitment act; and (ii) Prioritized, to the maximum extent permissible under the climate commitment act, chapter 70A.65 RCW, revenues derived from the auction of allowances allocated to the utility for the applicable compliance period pursuant to RCW 70A.65.130, first to programs that eliminate the cost burden for low-income ratepayers, such as bill assistance, or nonvolumetric credits on ratepayer utility bills, ((or electrification programs,)) and second to ((electrification)) programs benefiting residential and small commercial customers; (((z))) (w) Propose an action plan outlining the specific actions to be taken by the large combination utility in implementing the integrated system plan following submission; and (((aa))) (x) Report on the large combination utility's progress towards implementing the recommendations contained in its previously filed integrated system plan. (5) ((In evaluating the lowest reasonable cost of decarbonization measures included in an integrated system plan, large combination utilities must apply a risk reduction premium that must account for the applicable allowance ceiling price approved by the department of ecology pursuant to the climate commitment act, chapter 70A.65 RCW. For the purpose of this chapter, the risk reduction premium is necessary to ensure that a large combination utility is making appropriate long-term investments to mitigate against the allowance and fuel price risks to customers of the large combination utility. (6))) The clean energy action plan must: (a) Identify and be informed by the large combination utility's 10-year cost-effective conservation potential assessment as determined under RCW 19.285.040, if applicable; (b) Establish a resource adequacy requirement; Code Rev/ML:eab 14 I-4903.1/24 (c) Identify the potential cost-effective demand response and load management programs that may be acquired; (d) Identify renewable resources, nonemitting electric generation, and distributed energy resources that may be acquired and evaluate how each identified resource may be expected to contribute to meeting the large combination utility's resource adequacy requirement; (e) Identify any need to develop new, or expand or upgrade existing, bulk transmission and distribution facilities and document existing and planned efforts by the large combination utility to make more effective use of existing transmission capacity and secure additional transmission capacity consistent with the requirements of subsection (4)(((o))) (l) of this section; and (f) Identify the nature and possible extent to which the large combination utility may need to rely on alternative compliance options under RCW 19.405.040(1)(b), if appropriate. (((7))) (6) A large combination utility shall consider the social cost of greenhouse gas emissions, as determined by the commission pursuant to RCW 80.28.405, when developing integrated system plans and clean energy action plans. A large combination utility must incorporate the social cost of greenhouse gas emissions as a cost adder when: (a) Evaluating and selecting conservation policies, programs, and targets; (b) Developing integrated system plans and clean energy action plans; and (c) Evaluating and selecting intermediate term and long-term resource options. (((8))) (7) Plans developed under this section must be updated on a regular basis, on intervals approved by the commission. (((9))) (8)(a) To maximize transparency, the commission may require a large combination utility to make the utility's data input files available in a native format. Each large combination utility shall publish its final plan either as part of an annual report or Code Rev/ML:eab 15 I-4903.1/24 as a separate document available to the public. The report may be in an electronic form. (b) Nothing in this subsection limits the protection of records containing commercial information under RCW 80.04.095. (((10))) (9) The commission shall establish by rule a cost test for emissions reduction measures achieved by large combination utilities to comply with state clean energy and climate policies. The cost test must be used by large combination utilities under this chapter for the purpose of determining the lowest reasonable cost of decarbonization and low-income electrification measures in integrated system plans, at the portfolio level, and for any other purpose determined by the commission by rule. (((11))) (10) The commission must approve, reject, or approve with conditions an integrated system plan within 12 months of the filing of such an integrated system plan. The commission may for good cause shown extend the time by 90 days for a decision on an integrated system plan filed on or before January 1, 2027, as such date is extended pursuant to subsection (2)(a) of this section. (((12))) (11) In determining whether to approve the integrated system plan, reject the integrated system plan, or approve the integrated system plan with conditions, the commission must evaluate whether the plan is in the public interest, and includes the following: (a) The equitable distribution and prioritization of energy benefits and reduction of burdens to vulnerable populations, highly impacted communities, and overburdened communities; (b) Long-term and short-term public health, economic, and environmental benefits and the reduction of costs and risks; (c) Health and safety concerns; (d) Economic development; (e) Equity; (f) Energy security and resiliency; (g) Whether the integrated system plan: Code Rev/ML:eab 16 I-4903.1/24 (i) Would achieve a proportional share of reductions in greenhouse gas emissions for each emissions reduction period on the gas and electric systems; (ii) Would achieve the energy efficiency and demand response targets in subsection (4)(e) and (g) of this section; (iii) ((Would achieve cost-effective electrification of end uses as required by subsection (4)(h) of this section; (iv))) Results in a reasonable cost to customers, and projects the rate impacts of specific actions, programs, and investments on customers; (((v))) (iv) Would maintain system reliability and reduces long- term costs and risks to customers; (((vi))) (v) Would lead to new construction career opportunities ((and prioritizes a transition of natural gas and electricity utility)) for workers to perform work on construction and maintenance of new and existing renewable energy infrastructure; and (((vii))) (vi) Describes specific actions that the large combination utility plans to take to achieve the requirements of the integrated system plan. (12) The commission shall not approve, or approve with conditions, an integrated system plan that requires or incentivizes a large combination utility to terminate natural gas service to customers. (13) The commission shall not approve, or approve with conditions, an integrated system plan that authorizes a large combination utility to require a customer to involuntarily switch fuel use either by restricting access to natural gas service or by implementing planning requirements that would make access to natural gas service cost-prohibitive. Sec. 6. RCW 19.27A.020 and 2018 c 207 s 7 are each amended to read as follows: Code Rev/ML:eab 17 I-4903.1/24 (1) The state building code council in the department of enterprise services shall adopt rules to be known as the Washington state energy code as part of the state building code. (2) The council shall follow the legislature's standards set forth in this section to adopt rules to be known as the Washington state energy code. The Washington state energy code shall be designed to: (a) Construct increasingly energy efficient homes and buildings ((that help achieve the broader goal of building zero fossil-fuel greenhouse gas emission homes and buildings)) by the year 2031; (b) Require new buildings to meet a certain level of energy efficiency, but allow flexibility in building design, construction, and heating equipment efficiencies within that framework; and (c) Allow space heating equipment efficiency to offset or substitute for building envelope thermal performance. (3) The Washington state energy code may not in any way prohibit, penalize, or discourage the use of gas for any form of heating, or for uses related to any appliance or equipment, in any building. (4) The Washington state energy code shall take into account regional climatic conditions. One climate zone includes: Adams, Asotin, Benton, Chelan, Columbia, Douglas, Ferry, Franklin, Garfield, Grant, Kittitas, Klickitat, Lincoln, Okanogan, Pend Oreille, Skamania, Spokane, Stevens, Walla Walla, Whitman, and Yakima counties. The other climate zone includes all other counties not listed in this subsection (((3))) (4). The assignment of a county to a climate zone may not be changed by adoption of a model code or rule. Nothing in this section prohibits the council from adopting the same rules or standards for each climate zone. (((4))) (5) The Washington state energy code for residential buildings shall be the 2006 edition of the Washington state energy code, or as amended by rule by the council. Code Rev/ML:eab 18 I-4903.1/24 (((5))) (6) The minimum state energy code for new nonresidential buildings shall be the Washington state energy code, 2006 edition, or as amended by the council by rule. (((6))) (7)(a) Except as provided in (b) of this subsection, the Washington state energy code for residential structures shall preempt the residential energy code of each city, town, and county in the state of Washington. (b) The state energy code for residential structures does not preempt a city, town, or county's energy code for residential structures which exceeds the requirements of the state energy code and which was adopted by the city, town, or county prior to March 1, 1990. Such cities, towns, or counties may not subsequently amend their energy code for residential structures to exceed the requirements adopted prior to March 1, 1990. (((7))) (8) The state building code council shall consult with the department of enterprise services as provided in RCW 34.05.310 prior to publication of proposed rules. The director of the department of enterprise services shall recommend to the state building code council any changes necessary to conform the proposed rules to the requirements of this section. (((8))) (9) The state building code council shall evaluate and consider adoption of the international energy conservation code in Washington state in place of the existing state energy code. (((9))) (10) The definitions in RCW 19.27A.140 apply throughout this section. Sec. 7. RCW 19.27A.025 and 2024 c 170 s 4 are each amended to read as follows: (1) The minimum state energy code for new and renovated nonresidential buildings, as specified in this chapter, shall be the Washington state energy code, 1986 edition, as amended. The state building code council may, by rule adopted pursuant to chapter 34.05 RCW, RCW 19.27.031, and RCW 19.27.---, 19.27.---, and 19.27.--- Code Rev/ML:eab 19 I-4903.1/24 (sections 6, 7, and 8, chapter 170, Laws of 2024), amend that code's requirements for new nonresidential buildings provided that: (a) Such amendments increase the energy efficiency of typical newly constructed nonresidential buildings; and (b) Any new measures, standards, or requirements adopted must be technically feasible, commercially available, and developed to yield the lowest overall cost to the building owner and occupant while meeting the energy reduction goals established under RCW 19.27A.160. (2) In considering amendments to the state energy code for nonresidential buildings, the state building code council shall establish and consult with a technical advisory group in accordance with RCW 19.27.--- (section 7, chapter 170, Laws of 2024) including representatives of appropriate state agencies, local governments, general contractors, building owners and managers, design professionals, utilities, and other interested and affected parties. (3) Decisions to amend the Washington state energy code for new nonresidential buildings shall be made prior to December 15th of any year and shall not take effect before the end of the regular legislative session in the next year. Any disputed provisions within an amendment presented to the legislature shall be approved by the legislature before going into effect. A disputed provision is one which was adopted by the state building code council with less than a two-thirds vote of the voting members. Substantial amendments to the code shall be adopted no more frequently than every three years except as allowed in RCW 19.27.031 and RCW 19.27.--- (section 6, chapter 170, Laws of 2024). (4) When amending a code under this section, the state building code council shall not in any way prohibit, penalize, or discourage the use of gas for any form of heating, or for uses related to any appliance or equipment, in any building. Sec. 8. RCW 19.27A.045 and 2024 c 170 s 5 are each amended to read as follows: Code Rev/ML:eab 20 I-4903.1/24 (1) The state building code council shall maintain the state energy code for residential structures in a status which is consistent with the state's interest as set forth in section 1, chapter 2, Laws of 1990. In maintaining the Washington state energy code for residential structures, beginning in 1996 the council shall review the Washington state energy code every three years. After January 1, 1996, by rule adopted pursuant to chapter 34.05 RCW, RCW 19.27.031, and RCW 19.27.---, 19.27.---, and 19.27.--- (sections 6, 7, and 8, chapter 170, Laws of 2024), the council may amend any provisions of the Washington state energy code to increase the energy efficiency of newly constructed residential buildings. Decisions to amend the Washington state energy code for residential structures shall be made prior to December 1st of any year and shall not take effect before the end of the regular legislative session in the next year. (2) When amending a code under this section, the state building code council shall not in any way prohibit, penalize, or discourage the use of gas for any form of heating, or for uses related to any appliance or equipment, in any building. A new section is added to chapter 35.21 RCW to read as follows: A city or town shall not in any way prohibit, penalize, or discourage the use of gas for any form of heating, or for uses related to any appliance or equipment, in any building. The alley was dedicated by the Corbin Addition to Greenacres Plat recorded July 31, 1923, along with a small sliver of land dedicated by deed (AFN#369325B). The right-of-way has not been improved to street standards. The portion requesting to be vacated has been paved and functions primarily as access serving the adjacent property owners. The area is indistinguishable from the surrounding commercial parking lot and it appears that buildings may have been constructed in the right-of-way. The remaining portion of the alleyway extending to Greenacres Road is gravel. The total area requested to be vacated is estimated to be 4,068 square feet. The alleyway right-of-way requested to be vacated is adjacent to parcels 55184.1510, 55184.1509, 55184.1521, and 55184.1522. Property owned by Don and Edith Corson abuts approximately 87% of the right-of-way requested to be vacated. Property owned by Robert Carroll abuts approximately 13% of the right-of-way requested to be vacated.
