Acting Chairman Robert McKinley called the regular meeting to order at 6:00 p.m. The meeting was held in person and via ZOOM meetings. The Commissioners and staff stood for the Pledge Of Allegiance. II. ADMINISTRATIVE REPORT: Planning Manager Steve Roberge reported that a public hearing will be held at the February 13, 2025, Planning Commission meeting regarding CTA-2024-0002 — Right -of -Way (ROW) Permits. He also informed the Commission that the Department of Commerce will be doing an educational presentation on housing at the next February 13th meeting and a session on climate at the February 27th meeting. Training: Public Records Act and Open Public Meetings Act Deputy City Attorney Tony Beattie gave the annual public records and open public meetings training to attending Planning Commissioners and staff. c. Discussion: 2025 Periodic Comprehensive Plan Update Schedule Planning Manager Steve Roberge explained that the City is statutorily required to perform the Periodic Comprehensive Plan update by June 30th, 2026. The statute requires that the City update the Comprehensive Plan and the Development Regulations (including the Critical Areas Code). Mr. Roberge explained that the update will need to comply with new legislation that has been passed into law by the State of Washington, but it is also a time to look at the overlaying vision laid out in the Comprehensive Plan to see if it still applies and what changes need to be made for the future. Mr. Roberge stated that the State has provided a checklist outlining all of the things that have changed in legislation since the last update is sixty pages long. The two most significant areas of change are regarding housing and climate. Regarding climate, they have added a new chapter that will need to be adopted into the Comprehensive Plan and there are very specific guidelines laid out by the State that will need to be followed. Mr. Roberge said that the State has provided some funding for these updates, so the City is in the process of hiring a consultant to assist with the update. He explained that the City hopes to have the contract presented to the Council for approval in a couple of weeks and have a detailed work plan for staff and the Planning Commission by March. IX. BACKGROUND: The purpose of right-of-way permits is to prevent unlicensed obstruction and use of the right-of-way that impedes the traveling public, and to ensure applicants bear the responsibility for damage caused by their activity. Pursuant to chapters 17.80 and 22.130 SVMC, the City of Spokane Valley has treated right-of-way permits as Type I land use permits. However, in reality, right-of-way permits are distinct from other permits listed in table Table 17.80-1 as they are for management of the City's rights -of -way, easements, and other public properties held in trust by the City for the public. Further, pursuant to SVMC 17.80.040(A)(1), arguments have been made that certain entities, while clearly impeding the traveling public, are conducting normal maintenance or repair, for which no right-of-way permit may be required. Because of this, and other potential confusion with this subsection, the City is recommending removing the exemption for normal repair and maintenance. In total, CTA 2024-0002 would repeal SVMC 22.130.100 in its entirety, and make other minor language changes to chapters 22.130, and 17.80 SVMC. City Council will consider adopting chapter 9.50 SVMC for right-of-way permits in conjunction with Planning Commission's recommendation related to CTA 2024-0002. Putting right-of-way permits in Title 9 related to Vehicles and Traffic makes more sense for the public at large. Chapter 9.50 SVMC would replace the repealed SVMC 22.130.100 and provide a clearer path for enforcement of right-of-way permits through utilization of the nuisance procedure. PROPOSAL DESCRIPTION: A city -initiated code text amendment (CTA) amending chapters 22.130, and 17.80 SVMC, relating to regulating use of rights -of -way and other matters related thereto. APPROVAL CRITERIA: Spokane Valley Comprehensive Plan, SVMC 17.80.150, and 19.30.040. SUMMARY OF CONCLUSIONS: CTA-2024-0002 is consistent with the criteria for review and approval, and consistent with the goals and policies of the Comprehensive Plan. The following table summarizes the procedural steps for the proposal. Procedural Action Date Published Notice of Public Hearing: January 24, 2025 Department of Commerce 60-day Notice of Intent to Adopt Amendment January 6, 2025 Right-of-way Permits The city requires right-of-way permits for temporary uses of the right-of-way to ensure any impediments to the traveling public are minimized and require the applicant to bear the responsibility for the temporary obstruction and use. In the past, right-of-way permits have been recognized as Type I land use permits. However, right-of-way permits are not approvals to utilize the applicant -owned or managed land. Instead, they are requests for a license with necessary and reasonable conditions to temporarily impede the normal flow of the traveling public in rights -of -way, easements, and other public properties held in trust by the City for the general public. This City -initiated text amendment removes SVMC 22.130.100, dealing with right-of-way permits, in its entirety from chapter 22.130 SVMC. Relatedly, it also makes minor language changes to chapters 22.130 and 17.80 SVMC. Should the Planning Commission recommend approval of CTA-2024-0002, Staff will bring forward a separate ordinance to City Council that adopts right-of-way permitting procedures in Title Staff Report and Recommendation CTA-2024-0002 9 SVMC "Vehicles and Traffic." The intent is to provide clarity to which procedures, and enforcement mechanisms apply to right-of-way permits. A. FINDINGS AND CONCLUSIONS SPECIFIC TO THE MUNICIPAL CODE TEXT AMENDMENT 1. Compliance with Title 17 SVMC (General Provisions) of the Spokane Valley Municipal Code a. Findings: SVMC 17.80.150(F) identifies the approval criteria for an amendment to Titles 17-27 SVMC. The City may approve a Municipal Code Text amendment if it finds that: i. The proposed text amendment is consistent with the applicable provisions of the Comprehensive Plan: Staff Analysis: The proposed amendment is supported by the Comprehensive Plan and is consistent with the following Comprehensive goals and policies: ED-G6 Maintain a positive business climate that strives for flexibility, predictability, and stability. U-G1 Coordinate with utility providers to balance cost-effectiveness with environmental protection, aesthetic impact, public safety, and public health. T-G3 Strive to reduce the number of serious injury/fatality collisions to zero. T-P2 Consider neighborhood traffic and livability conditions and address potential adverse impacts of public and private projects during the planning, designing, permitting, and construction phases. T-P4 Support voluntary efforts to beautify local and regional transportation corridors. ii. The proposed amendment bears a substantial relation to public health, safety, welfare, and protection of the environment: Staff Analysis: The proposed amendment bears substantial relation to public health, safety, welfare, and protection of the environment. Unless exempt, right-of-way permits are required for any person or company performing work or engaging in activity within City ROW. These permits require certain conditions for the public safety and welfare including traffic control plans, insurance, and adherence to pavement cut policies. Relocating right-of-way permit procedures to Title 9 SVMC "Vehicles and Traffic" ultimately ensures these regulations are catalogued appropriately, and that right-of-way permit procedures and requirements are not confused with the procedures and requirements of Type I land use and development permits. The City will continue to provide superior and efficient service to the public by processing these permits within days of receipt. b. Conclusion(s): The proposed text amendment is consistent with the approval criteria contained in the SVMC 17.80.150(F). Page 2 of 3 Staff Report and Recommendation CTA-2024-0002 2. Finding and Conclusions Specific to Public Comments a. Findings: The Notice of Public Hearing was published in the newspaper on January 24, 2025 and January 31, 2025. Additionally, the notice was posted to the City's website and added to the weekly public notices e-letter. No comments have been received as of the date of this report. b. All new development approvals and permits as set in Chapter 17.80 SVMC, unless exempt pursuant to SVMC 17.80.040, shall comply with Chapter 22.130 SVMC. 22.130.030 Authority to develop and administer standards. The city manager or designee shall develop and administer the Spokane Valley street standards (SVMC 22.130.040) and require development projects to provide transportation improvements, dedicate right-of-way and border easements. These improvements will be required to achieve the purpose of Chapter 22.130 SVMC and goals of the currently adopted Comprehensive Plan. 22.130.040 Street standards. Pursuant to RCW 35A.11.020 and 35A.12.140, the City adopts, by reference, the City street standards, and as they may be amended from time to time. The city clerk shall maintain a copy on file. 22.130.050 Manual on Uniform Traffic Control Devices. The Washington Manual on Uniform Traffic Control Devices (MUTCD), and as it may be amended from time to time, is hereby adopted by reference. 22.130.060 Development project and permit review process. Following submittal of a completed application pursuant to Chapter 17.80 SVMC, the project shall be reviewed to determine compliance with all applicable regulations and standards. Additional material and/or analysis may be required to demonstrate compliance. 22.130.070 Required improvements. A. The last few years have seen the passage of State legislation consequential to local land use planning. In addition, the City of the Spokane Valley is required to update our Comprehensive Plan by June 30, 2026 (RCW 36.70A.130). The first presentation on February I I" will focus on housing and the next meeting, Feb 271 will focus on the new climate requirements. At the meeting, Feb 13', housing will be broken into two segments, the first will be centered on the Comprehensive Plan Housing Element (chapter).
