DRAINAGE EASEMENT
IN THE MATTER OF Appleway Blvd,Project File No. STV-2021-0001,
KNOW ALL MEN BY THESE PRESENTS,that the Spokane Housing Authority, a public body
corporate organized pursuant to chapter 35.82 RCW ("Grantor(s)"),for and in consideration of mutual
benefits,the receipt of which is hereby acknowledged,and the conditions of the street vacation in the City
of Spokane Valley Ordinance No.22-002, warrants and conveys to City of Spokane Valley,a municipal
corporation of the State of Washington,("Grantee(s)"), a DRAINAGE EASEMENT for constructing,
installing,operating,maintaining,repairing,replacing,and removing of drainage facilities and
appurtenances,and all other uses or purposes associated with the storage, conveyance,and infiltration of
stormwater drainage and/or runoff, over,upon,and across the following described real property, situated
in the City of Spokane Valley, Spokane County, State of Washington,to-wit:
See full legal description at Exhibit 1,and depiction of easement area at Exhibit 2,both of which are
attached hereto and incorporated herein by this reference.
The Grantee agrees to having complete and total responsibility for the construction of all related drainage
facilities located within this Easement,per the accepted civil and drainage plans on file in the office of the
Grantee's Engineering Division,including but not limited to all drainage facilities necessary to convey,
direct or route the stormwater and/or runoff to said drainage facility or facilities. The Grantee hereby
agrees to having complete and total responsibility for the perpetual maintenance of the facilities located
within this Easement.
The Grantor(s)and their successors in interest reserves the right to use and enjoy that property which is
the subject of this easement for purposes which will not interfere with the Grantee's full enjoyment of the

rights hereby granted;provided,the Grantor(s)shall not erect or construct any building or other structure
or drill on the easement or diminish or substantially add to the ground cover over the easement without
the express written permission of the Grantee. Should Grantor's use of the easement area reserved herein
cause damage to Grantee's property or infrastructure,whether existing now or in the future,Grantor
agrees to make such repairs,or reimburse the Grantee for the cost of such repairs.
The Grantor shall,at its sole expense, defend,indemnify,and hold harmless Grantee and its officers,
agents, and employees,from any and all claims,actions, suits,liability,loss,costs,attorney's fees, costs
of litigation, expenses,injuries,and damages of any nature whatsoever relating to or arising out of
Grantor's wrongful or negligent acts,errors,or omissions in the performance of any activities on the
easement area.
This Easement and the agreements and duties provided for herein shall run with the land and shall be
binding on and shall inure to the benefit of the parties referenced herein,their heirs,successors and
assigns. No modification of the boundaries of this Easement can be made without prior approval of the
Grantee.

LEGAL DESCRIPTION
STORM DRAINAGE EASEMENT
A parcel of land for a storm drainage easement, being a portion of Tract 225 of the plat of
Opportunity, as filed in Spokane County in Book'K' of plats at page 20, situate in the Northwest
quarter of the Northeast quarter of Section 20,Township 25 North, Range 44 East,of the
Willamette Meridian, and being a portion of the existing right of way of Appleway Avenue, as
shown on right of way plans for County Road Project 2396,page 10, dated October 10, 2002,
more particularly described as follows:
COMMENCING at the Northwest corner of that certain parcel of land shown as "Parcel B" as
shown upon that Record of Survey filed in Book 150 of Surveys, at page 65, records of Spokane
County,Washington. Said point of commencement being station 141+34.97, 86.00 feet right of
centerline,per said county right of way plans;
thence North 0°02'27" East along an extension of the West line of said"Parcel B", a distance of
32.00 feet,to station 141+35.13, 54.00 feet right;
thence along a line parallel with and 54.00 feet Southerly of the centerline of Appleway Avenue
as depicted on said county right of way plans, said line being parallel with and 32.00 feet
Northerly of the existing South right of way line of said Appleway Avenue,North 89°45'25"
East a distance of 161.05 feet to station 142+96.18, 54.00 feet right of said centerline and the
POINT OF BEGINNING of this description and easement;
