ORDER A. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on May 6, 1982, and the members of the Committee present being Ronald L. McVicker, Chairman, Jerry Williams and Richard L. Skalstad. B. PROPOSAL The sponsor, Irvin Water District #6, is requesting approval of a zone reclassifi- cation, File No. ZE-152-81 , Agricultural to Restricted Industrial, with no pro- posed development at this time. C. FINDINGS OF FACT 1 . That the existing land use in the area is residential and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Urban/Industrial development. 3. That the existing zoning of the property described in the application is Agricultural . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or, uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the pro- posed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor dis- approval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to he in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 1 File No. ZE-152-81 • D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL a) COUNTY PLANNING DEPARTMENT 1 . All current standards of the Restricted Industrial Zone, as amended, and Airport Overlay Zone, shall be complied with in the development of this site. 2. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine illumination to the area with full considera- tion to adjacent properties). 3. The specific development plan including interior circulation and park- ing will be submitted for Zoning Administrator review and approval prior to issuance of building permits. Any development shall be site-screened or buffered from residential areas to the north and east of the site. 4. Signs for this project shall conform to standards as set forth in Section 4.09.125 Signs. 5. Applicant shall comply with '208' recommendations concerning storm- water runoff and provide necessary landscaping for runoff. 6. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commis- sioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 7. Pursuant to the provisions of Chapter .43.21C RCW, the SEPA Guide- lines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the official file: written comments and/or public testimony contain information regarding assess- ment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. b). COUNTY ENGINEERING DEPARTMENT 1 . Access permits shall be obtained from the Spokane County Engineer prior to the issuance of a building permit or any use of the property. 2. Applicant shall improve BolAwdish Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width access standard. 3. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. • 2 . The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 5. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 6. All required improvements shall conform to the current State of Wash- ington Standard Specifications for Road and Bridge Construction, and other applicable county standards and/or adopted resolutions pertain- ing to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. c) COUNTY UTILITIES DEPARTMENT 1 . Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to' RCW, Chapter 36.94, as amended. The owner, his heirs and suc- cessors shall further agree not to oppose or protest any legal assessments for any utility local improvement district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3. Any water service for this project shall be provided in accord- ance with the Coordinated Water System Plan for Spokane County. 4. Each unit shall be double plumbed for connection to future area- wide collection system. • d) COUNTY HEALTH DISTRICT 1 . Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. • 2. Water service shall be coordinated through the Director' of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 3 File No. ZE-152-81 d) COUNTY HEALTH DISTRICT (continued) 4. Disposal of sewage effluent beneath paved• surfaces is currently prohibited. 5. Irvin Water District Well #2 shall have a 150' buffer zone sur- rounding it. No sewage disposal shall be allowed within this zone. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1 . The site is located in Fire District #1 . 2. A plan for emergency equipment access is required to be sub- mitted prior to any land development. 3. Recommend approval with condition that prior to development of this property that an engineered water distribution system plan shall be submitted to the Spokane County Department of Building and Safety. This distribution plan shall include water main size, flows, locations, fire hydrant type and locations, water storage tanks size, and location and design criteria. f) COUNTY AIR POLLUTION CONTROL AUTHORITY 1 . GENERAL INFORMATION APPLICANT: IRVIN WATER DISTRICT #6 STATUS OF APPLICANT: Owner (Ty Wick, representative) REQUESTED ZONING: Restricted Industrial EXISTING ZONING: Agricultural (established in 1942) PROPOSED USE: New water pumping office and maintenance shop is proposed. PROJECT LOCATION: This site fronts Bowdish Road and is generally located approximately 700 feet south of Jackson Avenue. II . SITE PLAN INFORMATION SITE SIZE: Approximately .66 acres SITE CHARACTERISTICS: The site is somewhat rocky and flat, and except for an existing pump house, is vacant. NEIGHBORHOOD CHARACTER: As with the site, the surrounding area is generally vacant, large lot ownerships previously in agricultural produc- tion. AGRICULTURAL SUMMARY: Within an area committed to URBAN land use. ZONING: North Agricultural, established, 1942 East Residential Manufactured Home, established, 1969 West Agricultural, established, 1942 South Agricultural, established, 1942 LAND USE: Site Vacant, except for a small pump house North Vacant, residential building East Manufactured homes, residential area West Vacant South Vacant, single lot residential al ZONE• RECLASSIFICATION NUMBER: ZE-152-81 • II . SITE PLAN INFORMATION (continued) 1981 COMPREHENSIVE PLAN DESIGNATION: URBAN/INDUSTRIAL NUMBER OF EXISTING BUILDINGS: 1 NUMBER OF BUILDINGS PROPOSED: No Site Plan III . BACKGROUND/ANALYSIS A. COMPREHENSIVE PLAN - The proposal is located on the boundary line between an Urban and an Industrial category. As such the proposal is consistent and appropriate with the Plan. However, since the rezone proposal rests adjacent to a residential development, future industrial development plans should include buffering tech- niques appropriate for the development. B. SITE CONSIDERATIONS - Probably the most important factors of the site that warrant consideration are the surrounding industrial development activities to the West and the residential activities to the North and West. Existing industrial activities west of the site sug- gest such a proposal is conducive to the area. Yet the residential activity immediately adjacent to the proposal suggests need for ade- quate buffering between existing residential activity and the proposal. Potential traffic problems may exist with this proposal, depending upon specific site development plans. The residential traffic and future industrial traffic could create need for traffic facility improve- ment. The site is located within the designated conical airfield overlay near Felts Field. C. HISTORY OF OTHER LAND USE ACTIONS - Rezoning actions have occurred over the past ten (10) years in the areas north and west of the proposal. Most of the rezone actions taken north of the proposal have been from Agricultural to "R-1" residential zones. An area located to the northeast of the proposal was rezoned from Agricultural to Multiple Family Suburban (MFS) in 1978. The area west of the proposal on the other hand has been rezoned from "Agricultural" to "Restricted Industrial" in 1972 and 1978. The proposal site falls be- tween these zoning and development activities. D. CONCLUSION - The requested zoning is consistent with the Com- prehensive Plan and development activities to the West. The compati- bility of the zone change with land use to the north and east could be greatly increased by the use of buffering techniques and careful site planning.
