It has come to my attention that the permit is only for an interior
rernodel and not for all the cross-hatched areas marked "New

ZE-13-63 - PROPOSED ZONE CHANGE } AGRICULTURAL TO AGRICULTURAL SUBURBAN
(Between Evergreen and Sullivan Road, more precisely bordering on Adams Road
between Sth Avenue and the Chicago, Niilwaukee and St. Paul R. R, uacks located
in what .the Planning Commission has designated as the Adams Neiqhborhood as
developed in their park and recreation and school plans for the area. Proposal was
from residents of the area wlshing to upgrade from Aqricultural to Agricultural Suburban. )
CH:ARLES M. RtCE of Rice Packing Company (residence - E. 16610 Valley Way).
We have gone to considerable expense in irnproving the grounds occupied by our stock
barn. These expenses include the erection of a goad stock-tight fence around the feed lot,
the bringing in of water, power and lights from the Vera Irrigation District, the gradinq and
surfacing of the lot to provide proper drainage and footing, the installinq of a new self-feeding
and water system.. Now there are certain people in this area who are complaininq about this
feed lot and who are attempting to instlgate certain zoning restrictions in the general area.
All of these people must have been aware of these activities and improvements. Yet
while they are in progres s, none of them came to us to make a complaint. We were doinq
nothinq except what was right out in the open. Obviously we do not wish to create a menace
in Lhe neiqhborhood, and it was not our intention to feed cattle durinq the summer months in
this location. -
We have kept the lot decently clean and as of right now we would invite alI of you Lo
Vske a personal inspection now or any time. As for odors that might be caused by livestock,
there are suitable sprays on the mnrket which might be used. We have no intenti on of enlarg-
inq the lot. We couldn't any way because there i s no additional land for it. Mr. Sodorff
was at the Iot after it was improved, and at that time I told him that it was not our intention
to bother or annoy anyone .

If this area is zoned, where does it all stop? Won't others try to zone other places in
this aqricultural valley, this valley to which families have moved from the city in order for
their children to have more freedom of movement and whers they might have some livestock and
qardens ? Are some in this area planning on using reciprocity on us ? .
Another reason for our purchasing this barn was for the storage of hay.. It will hald
approximately 150 tons but was not bought for )ust storaqe alone. It was our intent to feed cattle also. AL the time of purchase Mr. Marcus did not tell us that it was being sold for hay
storage only. Had this been a condition of sale, we would not have completed the transaction.
I have come here today to face you, man to man. I have never been by nature to work
behind anyone's back. I feel that if you had come to me in the same manner that we could
have lroned out any difficulties that might have arisen in a friendly manaer without any hard.
feeling. This kind of a problem is by no means a new one. Where civilization coniinue s to
wrap itself around the producQt of ineat and oiher foods that are being grown and produced for
you and your families and then complains about the farmer or producer being in the area.
I would like to thank a11 of you people far being here and expressing your opinions on
this matter. I would also like to thank you for allowing me to exprass mine. Just a minute -
I have a piece here that might be of some interest to you people. This comes from California.
Now California is having the same trouble that we are havinq here in this country. "Air Wick
for Feed Lot The Atizona feed lot is shown receivinq an application of deodorant by
special helicopter designed to spray new GS-17, deodorizing chemical. The scene is the
McElhaney Cattle Company of Tempe. Goodyear farms and other Artzona feeders are experi- menting with the new spray or deodorant, in effect South problems, wrapping itself around the
cattle business and complaining about the odor.
I have this to say about our neighbors. We have never been a menace to anybody nor
tried to. Now, I moved those cattle. out of there the first of this month. We never intended

. , ~ to feed cattle there durinq the hot summer months. But I will tell you one condition that did
exist. They had the Health Officer out ther9e. He came out and I showed it to him. It was
ratning - you know we had a lot of rain the first of May, and I said jusi as soon as we can qet
In there arui clean up this lot. To start with I rocked these alleyways with fine rock so there
would nat be any mud, and then I put about 8 or 10 inches of shavings to pack the rock down
because cattle walking on it - just fresh rock put in - and it wouldn't pack dawn. So I put those shavinqs in there goad and deep and of course, the rain came and the shavinqs and
manure together made quite a smell. We will admit that, but we went in and cleaned up the
lot just as soon as it dried up enough so that we could, and I told the Health Officer when
he was out there, )ust as soon as we could get in there and clean it. up we would, and it was
cleaned up a month ago. Then we cleaned it up agaln. We tovk Lhe cattle out. Tha lot is
clean as a hound's tooth, and I invite any of you in to inspect it and see if we are causing a
m.enace to the netghborhood. We do not want to. cause a menace to any of you, aad we are not
going to but as long as we keep that decently clean - if they zone that, the first thing they are
going to do is they are going to come up and say we will zone your feed lot.
Now, we have a feed lot at home. The neighbors live next to us and we always keep
those lots decently clean and we live there ourselves. But I don't want to be a menace to
the neighbarhood and we ate not going tqbut I say that if we allow one place to zone - the.
school vue will admit is across ths street from us.We put in a good fence and a good gate
and keep it locked, and if the chtldren get over in there, af course, that is the schoolb
responsibility.. We didn't put up a cheap fence; we spent about $1, 500 after we bought the
place to fix it up so that it would be decent and somethi.ng that wouldn't be a menace Lo the
nrei.ghbothood . . .
POUNDER - Should this be zoned, it woutd not stop you with your operation that !s already
there. . RICE, - Well, I don't see how it could.There was cattle fed there before. Ther+e was cattle

fed there since Mr. Marcus took it over. Of course, I will say this much. We probably won't
feed too much grain cattle there but we might feed some stock cattle; and of course, stock
cattle when you are just feeding hay, you are not going to get the snaell you would from grain..
Because you know good strong gradn is just. like a chfcken yard;, it is qoing to, smell if you .
don't keep it cleaned up.. But that is one- -reason we didn't have it cleaned up, and_ Lhese.
people next doar, of course, they figure that is: against their property and if they wanted to '
sall it, they couldn't sell it but I don't think there woisld be anything wrong if it is kept clean.
We are not a dirty type peopla; we have inspection at our plant all the time. We have an
inspector every week and we are under strict state inspection.
POUNDER - The purpose of zon#ng is to see that it dces not go any further.
RICE - We don't intend to go any further. I assure you of that because wa bought 100 x 349 /
I think that Ia the dimension, Mr. Marcus, because that is all we have and Lhat is all we
intend to have. It is a good place for us to store hay and where the catta.e feed it is all on concrete, and where we rocked the lot and where the cattl.e run down the lower lot, we have
it all rocked wfth thts mica rock out here and we can keep it clean. That is the reason we
fi,xed it that way. But this smell they got was from the shavinqs and manure; of course when
you take anything and stack it up about a foot deep and then hot weather came along and alI
this maisture, it couldn't help but smell because the shavings are gaing to smell some. Of
course we didn't think so much about that when we put it in there, but !t did create an odar
and we are not denying it but it woa't happen any more because we have that rock patted
down now and we can keep it cleaned out. I thank you for your timA.
CHAFFINS - Is it your intent to use this GS-17 application?
RICE - We will use any spray that is necessary. This summer Lhere will be no cattJe in
there. There wiU be no fly menace because it is all cleaned up. We spray our own Iots at
home for flie s. Of course, if we were putting cattle in there we would spray it for odor.

Califorria is having a 10# of trouble and thay are right on the ledge of Lvs Artgeles anci Sacra-
mentv. I visited a lot of 'iose lots down there and visited thosa bays, and they say thay are
havfng prvblems. They say they have it. whipped because they can spray It and keep down the
odor. Qf course, they hav+a thousands af catt1e whesre we may have 50 or 60. We wouldn`t

As far as vur being a menaae to the neighborhood, I hope those pevple wiU consider if
we are goiang to have► goad beef ~we have ta have some place tv feed them and we feed the
best. We think var~e a7re anyway. We see it in all good cattle, and we feed good clean feed.

HUGGINS - Not at all, unless there is a change in the use of the property.
RICE - Another thing - we grow cattle as wellas feed them. We don't Just buy Lhese cattle
out of a biq cattle and take them down there right out of an auction yard or something and feed
them. We grow these cattle - not on this site. We have probably 100 acres in grass land
that, we grow cattle on. We are in the agricultural business. We have over. 100 acres -
160 acres Lo be axact - in the Veta district that we use as pasture, and we don't menace any-
body with weeds either. You take a lot of these places; they have a lot of noacious weeds on
them - they never clean up their places or anythinq. We have kept the weeds down on our
property continuously because wa put in grasa to keep them dowa. VIIe irrigate all of it.
We are nat out there to be a menace to our nreiqhboihaod. This Iady says she can't
sleep. She suraly can sleep now because there is no odor around there at all, and we wLU
gvarantee them we will have no odor. around there for that matter. 1 am not tn favoF of up-
gtading the zoninq of that district. If they do, !,t 1s going to hapgen in ever.y othes place.
They are going to be !n here every month or so ar somethinq is going to happen. They are
qoing to upgrade !t and what is to keep them from coming up there and trying to upgrade our
`.property when we have 20 acres right there on the highway and quite a lot around that Sheuey
Lake, 1Nhat's going to keep them frora upqrading it all over if we allow it in one place, what's
going to keep them from going to another place and daing it?
