a. Study Session: STV-2025-0001 —Regal Care Street Vacation
Senior Planner Lori Barlow gave a staff presentation. She stated that the City received a privately
initiated street vacation application from Edith and Don Corson. The request is to vacate the south
20' X 185' of an unnamed alleyway extending north from Appleway Avenue and lying east of Long
Road and west of Greenacres Road.
Ms. Barlow explained that the right-of-way (ROW) has not been improved to street standards. The
portion requesting to be vacated has been paved and functions primarily as access serving the
adjacent property owners. The area is indistinguishable from the surrounding commercial parking lot,
and it appears that buildings may have been constructed in the ROW. The remaining portion of the
alleyway extending to Greenacres Road is gravel. The total area requested to be vacated is estimated
to be 4,068 sq. ft.
Ms. Barlow stated that the reason the applicant has requested the vacation is because they have a new
commercial project proposed for the site. They hope to build a coordinated commercial development
which will consolidate five parcels and include two phases of development. The development is
proposed to include a gymnasium with offices, an Enhanced Services Facility, and an Intensive
Behavioral Health Services facility. The applicant will be subject to three different land use actions
(that will not be heard by the Planning Commission or City Council). These include a Boundary
Line Adjustment (BLA) to consolidate the properties into two (to be determined administratively by
staff, a Conditional Use Permit (CUP) to get approval for one of the uses proposed on the site (to be
heard by the Hearing Examiner) and obtain all pertinent building and development permits. She
noted that the proposed site plan could still be developed even if the street vacation was not granted
by the City.
Ms. Barlow said that the preliminary staff review has determined that all affected properties would
still have access to their properties off of Appleway Avenue. Appleway Avenue is an arterial road
that has full street improvements that can accommodate transportation needs in the area. The
property that is served off Appleway would continue to have access and the property off Cowley
Avenue and Greenacres Road would also continue to maintain their access. There is one parcel that
is currently landlocked and that will be resolved through the BLA process.
Ms. Barlow said that the City has received comments from five agencies regarding the request.
Spokane County Sewer, Lumen, and Spokane Valley Fire Department all commented that they have
no objections to the request. Consolidated Irrigation District commented that they have a 6"
watermain located in the Bureau of Reclamation Easement and they would like the easement to be
retained. Avista commented that they have gas and electric lines located in the ROW and would like
an easement.
Ms. Barlow stated that the Public Hearing for the street vacation will be held on March 27, 2025.
Commissioner Kelly asked the process for granting the vacated property to the applicant. Ms.
Barlow answered that the Ordinance passed by the City Council will be recorded by the County and
the Ordinance will transfer the property from public ownership to private. Once the ROW is
transferred to the property owners, the parcels increase in size, and the new parcel footage is subject

with Appleway and narrows to 20' in width as it extends north. The area is paved but does not
meet any street standards. The area does not have curb, gutter or sidewalk and is indistinguishable
from the surrounding commercial parking lot and business operation. The total area requested to be
vacated is estimated to be 4,042 square feet.
The alley right-of-way requested to be vacated is adjacent to parcels 55184.1509, 55184.1510, and
55184.1521 (owned by Don and Edith Corson) and 55184.1522 (owned by Robert Carroll). Mr.
Carroll is not a signator on the application, but the Corson's have an agreement with Mr. Carroll
acknowledging that he will receive ''/z width of the right-of-way abutting his property.
The alley was dedicated by the Corbin Addition to Greenacres Plat recorded on July 31, 1923,
along with a small sliver of land dedicated by deed on January 22, 1956(AFN #369325B).
Pursuant to RCW 35.79.040 the property within the limits so vacated shall belong to the abutting
property owners one-half each. In this case, the area dedicated by AFN #369325B was deeded
from parcel number 55184.1521. This would be the exception to this rule, and the 183 square feet
described in the deed would be returned to the parcel it originated from.
The abutting properties are currently developed with an automobile sales use (Greenacres Auto
Sales) and an eating establishment (CB Quenchers Bar and Grill). The auto sales use utilizes all
parcels owned by the Corson's for operations. The bar and grill operates on Mr. Carroll's property
(parcel 955184.1522). It appears that some of the structures were constructed within the right-of-
way. According to the Spokane County Assessor records, the buildings on the Corson's property
and Mr. Carroll's property were constructed in 1963 and 1959 respectively. Mr. Carroll's property
also has a fenced in area and gazebo located in the right-of-way. Properties to the north include
residential uses accessed by Cowley Avenue; properties lying east and west are commercial and all
take access from Appleway Avenue, a principal arterial.
The immediate area framed by Long Road, Appleway Avenue, Greenacres Road and Cowley
Avenue is zoned Corridor Mixed Use (CMU), with areas north of Cowley Avenue zoned R-3,
Single Family Residential. The alley at Appleway Avenue functions as a driveway for Greenacres
Auto Sales. The access does not appear as a street as the access was constructed to a commercial
driveway standard at the time that full improvements were constructed along Appleway Avenue.
The connectivity of the alley was compromised when the buildings were constructed. The
buildings encroached into the alley blocking travel from Appleway to Greenacres. Water, electric,
and gas are in the right-of-way and can be adequately preserved with easements.
As part of the submittal requirements, petitions for street vacations are required to provide a
written narrative describing the reasons for the proposed street vacation. The Corson's are in the
process of consolidating four of their parcels into two parcels, while developing the site with two
residential health services buildings, and a gymnasium/office building. The fifth parcel lies on the
south side of the alley and cannot be included in the consolidation unless the right-of-way is
vacated (See Exhibit 3- BLA-2024-0026). The project is proposed in two phases that will require a

CB Quenchers, located on Mr. Carroll's property, would still have alley access to the rear of the
building by entering the alley from Greenacres. CB Quenchers currently has direct access from
Appleway Avenue. No other properties would be directly affected by vacating the 185' segment
of alley as they would all retain access from Appleway Avenue.
The site plan for the Regal Care Project indicates that if the street vacation request is granted
that parcel #55184.1521 will be used as a seamless portion of the healthcare complex to provide
parking. Vacating the right-of-way eliminates the bisection of the complex by right-of-way and
allows Regal Care Center to incorporate the entire area effectively into the design. This would
eliminate design constraints such as prohibiting vehicles on commercial property from backing
out onto public right-of-way and setback requirements.
Water, gas, and electric lines exist throughout the right-of-way. Existing sewer and cable lines
are located outside of the right-of-way and not affected by request. Consolidated Irrigation
District #19 (water) and Avista (gas and electric) have requested an access and maintenance
easement. Their continued service needs are met if an easement is provided.
3. Whether the substitution of a new and different public way would be more useful to the
public?
There is no substitution being proposed as part of the vacation. The City's review has
determined there is no need for a new or different public way. The right-of-way is unusable to
the public due to the encroachment of the buildings. It is currently being used by the adjacent
property owner to serve the existing business. Vacating the right-of-way would return the
property to the tax rolls and remove the maintenance responsibility from the City. So long as
access easements are retained for existing utilities, the public interest is served.
4. Whether conditions may change in the future to provide a greater use or need than
presently exists?
The property is zoned Corridor Mixed Use which allows for a variety of commercial, service
and residential uses. The current property owner owns 5 parcels and is in the process of
consolidating the parcels to facilitate on -site development of a residential health services
complex. Vacating the right-of-way eliminates the bisection of the site allowing the parcels to
be consolidated to eliminate property lines and associated setbacks. If the Regal Care Project is
not constructed than the zoning allows the parcels to develop more intensely. If the street
vacation were granted, and the abutting properties were consolidated this may increase potential
for larger and more efficient development projects.
Parcel #55184.1510 and 55184.1521, both owned by the Corsons, have direct access to
Appleway Avenue. As discussed above, parcel #55184.1509 only has access via the alley and
parcel #55184.1511 has no access. Both parcels are included in BLA-2024-0026 that would
combine parcel's 551984.1552, 55184,1510, and 55184.1511 and 55184.1509 into 2 parcels
that take access either from Appleway Avenue or the alley. The consolidation of Parcel B
within BLA-2024-0026 and parcel 955184.1521 ensures that all lots have access.
The adjacent parcels #55184.1505 and #55184.1524) have access via the alley, which will still
be available from Greenacres Road. It is worth noting that both parcels are owned by Mr.

The application was routed to jurisdictional agencies, utilities, and public districts for review and
comment.
Avista has gas and electric service lines in the alley, and Consolidated Irrigation District #19 has a
6" watermain lying within a dedicated Bureau of Reclamation easement. Easements are requested
by each agency for the purposes of maintenance and access.
The Fire Department indicated that the vacation would not impact fire access to the existing
structures and noted that all fire requirements for future development would be conditioned on the
future commercial permits. The Fire Department had no specific requirements related to the
vacation request.
City of Spokane Valley (COSV) Development Engineering and Stormwater Departments had no
specific comment or conditions for the street vacation request. COSV Traffic Engineering noted
that a BLA should be required to ensure parcels 55184.1511 and 55184.1509 would have access if
the alley were to be vacated. BLA-2024-0026 is under review to consolidate the 4 lots into 2 lots
which establish new Parcel B with access off the alley (See Exhibit 3). If the alley were vacated
than new Parcel B would be landlocked unless consolidated with the triangular parcel (parcel
#55184.1521) located on the south side of the parcel or consolidated with Parcel A.
Other agencies, including City Departments, indicated they had no issue with the street vacation.
Conclusion(s):
Staff conclude that jurisdictional agencies, utilities, and public districts have no concerns regarding
the proposed street vacation of the 185' long segment of the alley, so long as all properties have
access, and utility easements are established to provide for access and maintenance. The street
vacation request recommendation has been conditioned accordingly to address the concerns.

Summary of Request
This Street Vacation Application is for the proposed vacation of a segment of alley public
right-of-way (ROW) only. This alley segment is located between parcels proposed for a
coordinated commercial site development of Spokane County Parcels APN# 55184.1552,
.1521, .1511, .1510, & .1509 known as Regal Care. To complete the projects there will be a
boundary line adjustment, a conditional use permit, new building construction and this
street vacation.
The alley segment is 20' wide with an additional sliver area of alley added by deed
(369325B) near where the alley intersects with E. Appleway Avenue west of APN#
55184.1521. The total area proposed to be vacated is 4,042 sq. ft. (3,859 sq. ft of platted
ROW and 183 sq. ft. of ROW per deed).
There are existing utilities in the area proposed for vacation. It is proposed that an
easement is reserved over the area vacated for utilities.
II. Required Material
All required Material for a Street Vacation Application is provided in this application packet
as outlined in this Narrative.
A completed Street Vacation Application form and fee has been provided. The application
form included signatures and authorization for agent representation.
Materials submitted with this application include those required for Notice of Application:
Certifications, Assessor's Map, property profiles, and stamped addressed envelopes.
Materials also include written correspondence from utility purveyors.
A vicinity map is provided in the form of the Spokane County Assessor's half section map
with the alley located between the lots within the area labeled as the site.
An existing record of survey (by others) is provided since a new record of survey is not
available. Thus, a Right -Of -Way Vacation Exhibit is also provided which shows the
segments of alley proposed for vacation, and abutting properties, streets, and alleys within
100 feet on all sides of the proposed vacation.
Finally, there is no known available evidence of existing easements, allowances, or
reservations pertaining to the alley proposed forvacation. The plat and deed that
respectively created the alley segments in question are both available in the public record.

Applicant's Response:
The use or need for this ROW will not be affected in the future by the vacation, in that
vehicles will be able to use private driveways to access the street network, and utilities
will enjoy continued benefit of this area in the reserved utility easement over the area
being vacated.

Applicant's Response:
Yes, there will be an easement retained or reserved over the area of vacation to
maintain the utilities within the ROW as they currently are used. The purveyor of sewer
services has no infrastructure in the area proposed to be vacated. The utility purveyors
involved in this area of vacation are as follows:

d. Gas—Avista
6. DOES THE RIGHT-OF-WAY INCLUDE STORMWATER DRAINAGE FACILITIES (SPECIFY)?
Applicant's Response:
No existing stormwater drainage facilities are included in the ROW proposed to be
vacated. New stormwaterfacilities will be installed as part of the new Regal Care
commercial development adjacent and will be housed on private property.
IV. Conclusion
This application for a proposed vacation of alley segments is accompanied by all of the
required submittal requirements. It includes a plan to reserve an easement for utilities
through the vacated area. This narrative addresses the criteria and demonstrates it is
reasonable and prudent to approve this request. The Applicant respectfully requests
approval and offers to provide any clarifying information needed to obtain it, should
anything else be needed upon review bythe approval authority.

The Spokane Vailey Fire Department has completed a review for the above referenced project and takes no exception to
the proposed street vacation:
1. Proposed street vacation does not impact existing fire access to structures located at 18111 & 18115 E.
Appleway Ave.
2. All specific fire department requirements for future development of parcels 55184.1510 and 55184.1509 shall be
conditioned of future commercial permits.
3. As a matter of observation, there appears to be existing development and or parts of existing structures within
the current ROW that is proposed to be vacated.
a. The existing building and building projections at 18111 EAppleway Ave appears to extend into the
existing ROW.
b. There appears to be a paved outdoor patio area with possible gazebo and fencing north of the building
at 18115 E. Appleway Ave.
