AGENDA ITEM TITLE: Resolution No. 25-008 adopting a policy on acceptable City security camera
use
GOVERNING LEGISLATION:
PREVIOUS COUNCIL ACTION TAKEN: Council approved use of ARPA related funds to purchase
and install cameras in City parks on February 25, 2025.
BACKGROUND:
The City has operated and maintained several cameras at various City facilities, including City Hall and
CenterPlace for security purposes for several years. Pursuant to delegated authority, the City Manager has
approved an administrative policy and procedure for operation of such security cameras and use of the
security camera video.
In addition, on February 25, 2025, City Council gave approval to use $350,000 ARPA-related funds for a
pilot project to install security cameras at City parks. As part of that approval, City Council indicated a
desire to discuss and adopt a policy for the operation and use of City security cameras and recorded video
footage.
Staff worked with the Public Safety Committee to get feedback on the necessary items for a camera use
policy. Proposed Resolution No. 25-008 is provided for City Council review and consideration based on
that input.
The primary directives for Resolution No. 25-008 include (1) security cameras shall be placed so as to limit
views of adjacent properties; (2) security cameras shall be used for public safety and security purposes; (3)
traffic cameras may be used for traffic management purposes; (4) the City shall keep a record of users who
access the cameras; (5) footage shall not be provided to third parties except as required for installation and
maintenance, for the public safety and security purposes included in the Resolution, and as required by law;
(6) and the City retains the footage for 30 days, unless needed for an investigation or other purpose where
the footage needs to be kept for a longer period of time.
OPTIONS: Move to pass Resolution No. 25-008 adopting a security camera use policy; or take other
action deemed appropriate.

RESOLUTION No. 25-008
A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE
COUNTY, WASHINGTON, IDENTIFYING THE ALLOWABLE USES AND
RETENTION FOR CITY SECURITY VIDEO RECORDS, AND OTHER
MATTERS RELATING THERETO.
WHEREAS, the City Council (Council) of the City of Spokane Valley (City) is dedicated to
providing a safe, secure, and thriving community for all residents and ensuring that public areas are safe
and secure for public use, all while recognizing and respecting the rights of individuals to their own private
matters, even while in those public spaces; and
WHEREAS, in order to provide a safe, secure, and thriving community and safe and secure public
spaces, the City utilizes and will utilize security cameras at its City facilities and City parks; and
WHEREAS, the Council desires to balance the needs of the City and the public in providing and
promoting public safety at its facilities through the use of security cameras with the privacy interests of
individuals by identifying how such security cameras will be used and the retention limits for security video
recordings.
NOW, THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington as follows:
Section 1. Allowable Use of Security Cameras and Security Video Recordings. Security
cameras and security camera video recordings in and at City facilities and City parks shall only be used for
the following purposes and in the following manner:
A. Security cameras shall be placed in such a manner as to limit views of adjacent private
properties as feasible.
B. Security cameras and security camera video recordings at City facilities (other than traffic
cameras) and City parks shall be used by the City solely for public safety and security purposes.
For purposes of this Resolution, "public safety and security purposes" includes, but is not
limited to, those purposes (1) that deter crime, protect individuals using City facilities and City
parks from criminal acts, threats, violence, drugs, harassment, or similar activities, (2) for use
by first responders to respond to emergencies, (3) for use by local, state, and federal law
enforcement agencies and prosecutors for criminal investigation, prosecution, and similar valid
law enforcement purposes, (4) for civil claims by the City or to respond to and address
misconduct that does not result in criminal charges, (5) for valid City investigations and claims
regarding damage, graffiti, or vandalism to City facilities, City parks, and other City fixtures
or equipment, including for purposes of reporting such damage to appropriate law enforcement
agencies, City departments, staff, or contractors for clean-up, repair, or replacement, (6)
reporting to the City's insurance carrier for necessary claims, (7) for responding to claims
against the City, and (8) for responding to allegations of employee or elected official
misconduct. Security camera video feeds may be linked to real time viewing software for
public safety and security purposes.
C. Traffic cameras primary use is to manage traffic and so such cameras may be used for valid
traffic management purposes as well as for public safety and security purposes.
D. Nothing herein shall prevent the City from accessing video feeds as part of installation and
maintenance of the security cameras.
E. A record of all users who access security cameras and security cameras video recordings shall
be kept, whether automatically through video management software or otherwise.
Resolution 25-008 Regarding Use of Security Cameras
F. Security video recordings shall not be provided to any third parry except (1) as part of any
required software or similar contract as part of the installation and maintenance of such
cameras, (2) as required to ensure public safety and security purposes pursuant to Section 1(B)
above, or (3) as may be otherwise required pursuant to law or lawful court order.
Section 2. Security Video Recording Retention.
A. Except as otherwise provided herein, security camera video recordings shall be stored and
retained for 30 days as required for the City to meet its obligations under chapter 40.14 RCW
and the State's adopted "Local Government Common Records Retention Schedule". In the
event that an event captured on a security camera video recording is needed for an active law
enforcement investigation, for an insurance claim by the City, or for a civil claim by the City,
the City shall place the necessary video in separate secure storage appropriate for the media.
Recordings used for investigation purposes shall be retained for the same time period as other
investigative records.
B. Security camera video recording shall be kept in a secure manner appropriate to the media and
may only be accessed by authorized staff for the purposes set forth in this Resolution.
Section 3. Severability. If any section, sentence, clause or phrase of this Resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this
Resolution.
Section 4. Effective Date. This resolution shall be effective immediately upon passage and
signatures hereto.

AGENDA ITEM TITLE: Proposed Resolution 25-009 which declares as surplus furniture and
equipment that is inoperable, obsolete, or in excess of our needs.
GOVERNING LEGISLATION: Spokane Valley Municipal Code 3.49.020 - Disposition of City
property
PREVIOUS COUNCIL ACTION TAKEN:
BACKGROUND: This follows an Information Item that was delivered to Council at April 22, 2025,
Council meeting. Since that time, the City has accumulated two vehicles and a variety of
equipment that has reached the point of being inoperable, obsolete or excess to our current
operating needs. The equipment primarily includes items such as servers, iPhones, printers,
computer monitors, miscellaneous office equipment, and banquet chairs.
A draft Resolution to declare this property surplus is attached to this RCA. If the Resolution is
approved by Council, the City Manager will be authorized to dispose of the surplus personal
property pursuant to SVMC 3.49.020(B)as follows:
1. The City Manager may dispose of surplus personal property by public auction, bid or other
method of sale on terms deemed to be in the best interest of the City.
2. Surplus personal property which is unsellable because of obsolescence, wear and tear, or
other reasons may be dismantled, if necessary, and sold as scrap.
Our goal is to dispose of the surplus items by selling what we can and discarding what we cannot,
in a manner that minimizes the use of City resources.
OPTIONS: Move to approve Resolution 25-009 declaring as surplus certain personal property of
the City or other action as appropriate.
RECOMMENDED ACTION OR MOTION: Move to approve Resolution 25-009 declaring as
surplus certain personal property of the City.

A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, DECLARING CERTAIN REAL AND PERSONAL PROPERTY
OF THE CITY SURPLUS TO THE NEEDS OF THE CITY, AUTHORIZING
DISPOSAL OF THE SAME, AND OTHER MATTERS RELATED THERETO.
WHEREAS, Spokane Valley Municipal Code (SVMC) 3.49.020(A) requires that real and
personal property be declared surplus by the Spokane Valley City Council prior to its disposal; and
WHEREAS, the criteria for a declaration that the property is surplus to the needs of the City are
set forth in SVMC 3.49.020(A), and includes that the City has or anticipates no practical, efficient, or
appropriate use for the property; and
WHEREAS, upon such a declaration passed by resolution of the Spokane Valley City Council,
the City Manager is authorized to sell surplus real property pursuant to SVMC 3.49.020(B); and
WHEREAS, City department directors have been notified of the surplus nature of this property,
and no department has any desire to acquire or use the proposed surplus property; and
WHEREAS, since the previous declaration of surplus items on March 5, 2024, the City would like
to dispose of these items that are unneeded or not useful to the City.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington as follows:
Section 1. Authorization to dispose of surplus property. The City Manager is authorized to dispose
of the surplus personal property identified in Exhibit 1 of this Resolution pursuant to SVMC 3.49.020(B):
Sale of Property. Following passage of a resolution declaring City property surplus, City property
shall be sold or disposed of in accordance with the following:
1. The city manager may dispose of surplus personal property by public auction, bid, or
other method of sale on terms deemed to be in the best interests of the City.
2. Surplus personal property which is unsellable because of obsolescence, wear and tear,
or other reasons may be dismantled, if necessary, and sold as scrap.
Section 2. Effective Date. This Resolution shall be effective upon adoption.

BACKGROUND:
On April 15, 2025, Council approved Ordinance 25-004 which provides for a Public Safety Sales Tax
of One-Tenth of One Percent (0.1%) Ballot Measure to be placed on the August 5, 2025 Election
Ballot. This ballot measure allows for a pro and con statement t
RCW 29A.32.280 states that the jurisdiction will appoint committees of no more than three persons
going to the voters. The City Clerk published a request for volunteers for each committee on March

21 and 28. The application deadline was originally April 8, but was re-published on April 18 and

the application deadline was extended to April 24 at 10:00 a.m. to allow for additional applications.
The City Clerk received three timely applications for the Pro Committee and One timely application
for the Con Committee. The City Clerk reviewed the applications and verified that the applicants
reside in Spokane Valley. Applicants will be provided instructions for the statements and submittal
deadlines.

public hearing date before the Planning Commission for March 27, 2025.
BACKGROUND:
Don and Edith Corson have requested the vacation of the alley segment as described above. The Corson’s
are in the process of developing the Regal Care Center which will consist of two community residential
support and treatment facilities and a building with offices and a gymnasium for the residents. The right-
of-way would be incorporated into the development if the request were to be granted.
The street segment requested to be vacated abuts property owned by Don and Edith Corson and Robert
Carroll. The alley extends from Appleway Avenue. and connects with Greenacres Road. The alley was
dedicated by the Corbin Addition to Greenacres Plat recorded July 31, 1923, along with a small sliver of
land dedicated by deed on January 22, 1956 (AFN#369325B). The alley is approximately 7’ wider (27’)
at the location it intersects with Appleway Avenue. The right-of-way has not been improved to street
standards. The portion requesting to be vacated is paved but functions primarily as access serving the
adjacent properties. The area is indistinguishable from the surrounding commercial parking lot, and it
appears that buildings have been constructed in the right-of-way. The remaining portion of the alley
extending to Greenacres Road is gravel. The total area requested to be vacated is estimated to be 4,042 sq.
ft.
At the time of application, the alley right-of-way requested to be vacated was adjacent to parcels
55184.1510, 55184.1509, 55184.1521, and 55184.1522. The parcel numbers have changed as BLA-
2024-0026 was completed and recorded with the Spokane County Auditors office on April 3, 2025, to
reconfigure the parcels for the proposed development. The amount of property owned by the adjacent
properties did not change as a result of the BLA. Property owned by Robert Carroll abuts approximately
13% of the right-of-way requested to be vacated. Property owned by Corson’s, the applicant, abuts
approximately 87% of the right-of-way requested to be vacated.
The Planning Commission conducted a study session on March 13, 2025, and a public hearing on March
27, 2025. Following public testimony and deliberations, the Planning Commission voted 7-0 to
recommend approval of STV-2025-0001. The findings and recommendations were approved by the
Planning Commission on April 10, 2025.

SVMC 22.140.040 provides that City Council must consider the Planning Commission’s findings,
conditions and/or limitations as appropriate to preserve the public use or benefit, the division of the
vacated right-of-way among abutting property owners, and whether to require compensation for the right-
of-way and when it is to be paid.
Division of Vacated Right-of-Way to Abutting Property Owners:
Half width of the right-of-way dedicated by the Corbin Addition to Greenacres Plat shall be granted to the
adjacent property owners, and the 183 sf area granted by deed shall be returned to parcel number
55184.1521 where it originated from, unless one property owner provides a signed and notarized
document forfeiting the right to acquire the right-of-way after it is vacated and authorizing it to go to the
other property owner. Utility/access easements across the properties will be required to provide access
and maintenance of the existing water, electric and gas utilities.
Compensation for Right-of-Way:
Council adopted Resolution 22-020 to provide a policy on how to require compensation for the vacated
right-of-way. An analysis is conducted consistent with Resolution 22-020 to determine the estimated
appraised value of the vacated property. The information is typically provided in the administrative
report. However, since BLA-2024-0026 was recorded with the Spokane County Auditor’s office on April
3, 2025, the assessed valuation has not been completed by the County offices consistent with the new
parcel boundaries. The information will be provided at the next Council meeting.
OPTIONS: Consensus to proceed with a first ordinance reading as proposed; or take other action
deemed appropriate.
RECOMMENDED ACTION: Consensus to proceed with a first ordinance reading at the May 6, 2025,
Council meeting.

BACKGROUND:
On February 25, 2025, City Council approved Resolution No. 25-002 to set the public hearing date
with the Planning Commission on March 27, 2025.
Don and Edith Corson have requested to vacate a segment of an unnamed alley extending north
from Appleway as described above. The alley extends north from Appleway and curves east to a
point where it intersects with Greenacres Road. Only the first 185’ of the alley extending north
from Appleway is requested to be vacated. The alley is approximately 27’ at the point it intersects

with Appleway and narrows to 20’ in width as it extends north. The area is paved but does not
meet any street standards. The area does not have curb, gutter or sidewalk and is indistinguishable
from the surrounding commercial parking lot and business operation. The total area requested to be
vacated is estimated to be 4,042 square feet.
The alley right-of-way requested to be vacated is adjacent to parcels 55184.1509, 55184.1510, and
55184.1521(owned by Don and Edith Corson) and 55184.1522 (owned by Robert Carroll). Mr.
Carroll is not a signator on the application, but the Corson’s have an agreement with Mr. Carroll
acknowledging that he will receive ½ width of the right-of-way abutting his property.
The alley was dedicatedby the Corbin Addition to Greenacres Plat recorded on July 31, 1923,
along with a small sliver of land dedicated by deed on January 22, 1956(AFN #369325B).
Pursuant to RCW 35.79.040 the property within the limits so vacated shall belong to the abutting
property owners one-half each. In this case, the area dedicated by AFN #369325B was deeded
from parcel number 55184.1521. This would be the exception to this rule, and the 183 square feet
described in the deed would be returned to the parcel it originated from.
The abutting properties are currently developed with an automobile sales use (Greenacres Auto
Sales) and an eating establishment (CB Quenchers Bar and Grill). The auto sales use utilizes all
parcels owned by the Corson’s for operations. The bar and grill operates on Mr. Carroll’s property
(parcel #55184.1522). It appears that some of the structures were constructed within the right-of-
way. According to the Spokane County Assessor records, the buildings on the Corson’s property
and Mr. Carroll’s property were constructed in 1963 and 1959 respectively. Mr. Carroll’s property
also has a fenced in area and gazebo located in the right-of-way. Properties to the north include
residential uses accessed by Cowley Avenue; properties lying east and west are commercial and all
take access from Appleway Avenue, a principal arterial.
The immediate area framed by Long Road, Appleway Avenue, Greenacres Road and Cowley
Avenue is zoned Corridor Mixed Use (CMU), with areas north of Cowley Avenue zoned R-3,
Single Family Residential. The alley at Appleway Avenue functions as a driveway for Greenacres
Auto Sales. The access does not appear as a street as the access was constructed to a commercial
driveway standard at the time that full improvements were constructed along Appleway Avenue.
The connectivity of the alley was compromised when the buildings were constructed. The
buildings encroached into the alley blocking travel from Appleway to Greenacres. Water, electric,
and gas are in the right-of-way and can be adequately preserved with easements.
As part of the submittal requirements, petitions for street vacations are required to provide a
written narrative describing the reasons for the proposed street vacation. The Corson’s are in the
process of consolidating four of their parcels into two parcels, while developing the site with two
residential health services buildings, and a gymnasium/office building. The fifth parcel lies on the
south side of the alley and cannot be included in the consolidation unless the right-of-way is
vacated (See Exhibit 3- BLA-2024-0026). The project is proposed in two phases that will require a
Boundary Line Adjustment (BLA), a Conditional Use Permit (CUP) and various building and
development permits. The site has been designed such that the project may move forward even if
the street vacation request is not granted (See Exhibit 4 – Regal Care Center Site Plan). The
Hearing Examiner is the decision maker for the CUP while the other permits are reviewed and

issued administratively. The Planning Commission and City Council will not be decision makers
on any components of the project other than the street vacation request.

II. S TAFF A NALYSIS OF S TREET V ACATION P ROPOSAL
A. C OMPLIANCE WITH SVMC 22.140.030
In its consideration of the proposed vacation of the street, the planning commission shall make its
recommendation to City Council based on, SVMC 22.140.030, the criteria listed below. The
criteria are listed in bold followed by staff findings in regular text.
Findings:
1. Whether a change of use or vacation of the street or alley will better serve the public?
The alley currently operates as a driveway to the existing Auto Sales use. The portion of alley
extending north from Appleway Avenue is paved but not to any street standards. The
remaining portion of the alley extending northeast is not paved. The alley is not useable to the
public as buildings have been constructed within the right-of-way impeding traffic from
traveling from Appleway to connect with Greenacres. Vacating the right-of-way would return
the property to the adjacent private property owners to be legally used for development. This
would return property to the tax rolls and free the city from potential liability from conditions
that may arise in the dedicated right-of-way.
2. Whether the street or alley is no longer required for public use or public access?
The portion of the alley requested to be vacated is currently used for access to the existing Auto
Sales business located on Corson’s property that includes all five properties. It does not provide
access to other properties or connectivity between Appleway Avenue and Greenacres Road
since it is impassable. It is noted that the Auto Sales site is made up of 5 separate parcels.
Parcel number 55184.1809 only has access off the alley, and parcel 55184.1511 is land locked.
BLA-2024-0026 will consolidate the four parcels west of the alley to two parcels. Parcel A will
have direct access from Appleway Avenue and parcel B will have access off the existing alley.
If the alley is vacated Parcel B will not have access. Parcel #55184.1521, lying on the east side
of the alley, cannot be included in the BLA as lots cannot be bisected by right-of-way. The lot
can be consolidated with Parcel B ensuring that all properties have access to Appleway Avenue.
As noted on the site plan, Parcel #55184.1521 is intended to provide parking for the Regal Care
Center project and functions as a portion of the site.

CB Quenchers, located on Mr. Carroll’s property, would still have alley access to the rear of the
building by entering the alley from Greenacres. CB Quenchers currently has direct access from
Appleway Avenue. No other properties would be directly affected by vacating the 185’ segment
of alley as they would all retain access from Appleway Avenue.
The site plan for the Regal Care Project indicates that if the street vacation request is granted
that parcel #55184.1521 will be used as a seamless portion of the healthcare complex to provide
parking. Vacating the right-of-way eliminates the bisection of the complex by right-of-way and
allows Regal Care Center to incorporate the entire area effectively into the design.This would
eliminatedesign constraints such as prohibiting vehicles on commercial property from backing
out onto public right-of-way and setback requirements.
Water, gas, and electric lines exist throughout the right-of-way. Existing sewer and cable lines
are located outside of the right-of-way and not affected by request. Consolidated Irrigation
District #19 (water) and Avista (gas and electric) have requestedan access and maintenance
easement. Their continued service needs are met if an easement is provided.
3. Whether the substitution of a new and different public way would be more useful to the
public?
There is no substitution being proposed as part of the vacation. The City’s review has
determined there is no need for a new or different public way. The right-of-way is unusable to
the public due to the encroachment of the buildings. It is currently being used by the adjacent
property owner to serve the existing business. Vacating the right-of-way would return the
property to the tax rolls and remove the maintenance responsibility from the City. So long as
access easements are retained for existing utilities, the public interest is served.
4. Whether conditions may change in the future to provide a greater use or need than
presently exists?
The property is zoned Corridor Mixed Use which allows for a variety of commercial, service
and residential uses. The current property owner owns 5 parcels and is in the process of
consolidating the parcels to facilitate on-site development of a residential health services
complex. Vacating the right-of-way eliminates the bisection of the site allowing the parcels to
be consolidated to eliminate property lines and associated setbacks. If the Regal Care Project is
not constructed then the zoning allows the parcels to develop more intensely. If the street
vacation were granted, and the abutting properties were consolidated this may increase potential
for larger and more efficient development projects.
Parcel #55184.1510 and 55184.1521, both owned by the Corsons, have direct access to
Appleway Avenue. As discussed above, parcel #55184.1509 only has access via the alley and
parcel #55184.1511 has no access. Both parcels areincluded in BLA-2024-0026 that would
combine parcel’s 551984.1552, 55184.1510, and 55184.1511 and 55184.1509 into 2 parcels
that take access either from Appleway Avenue or the alley. The consolidation of Parcel B
within BLA-2024-0026 and parcel #55184.1521 ensures that all lots have access.
The adjacent parcels #55184.1505 and #55184.1524) have access via the alley, which will still
be available from Greenacres Road. It is worth noting that both parcels are owned by Mr.

Carroll, along with parcel # 55184.1523. None of Mr. Carroll’s parcels will be landlocked if the
street vacation is granted. All other parcels in the immediate area would either have access via
Appleway Avenue or Cowley Avenue.
Since the alley is not useable, vacating the right-of-way will have no impact on traffic patterns
or on persons attempting to access properties on Appleway Avenue, Cowley Avenue or
Greenacres Road. The connectivity of the alley was compromised when the buildings were
constructed.
Whether objections to the proposed vacation are made by owners of private property
(exclusive of petitioners) abutting the street or alley or other governmental agencies or
members of the general public?
Notice of the public hearing was made by posting written notice on the City’s web page and at
City Hall; publishing notice in the Spokane Valley Herald, posting both ends of the right-of-
way to be vacated, and a direct mailing to property owners adjacent to the proposed vacations.
To date, no objections by the public or governmental agencies have been received.
Conclusions:
The findings confirm criteria set forth in SVMC 22.140.030 have been met.
B. C OMPLIANCE WITH T ITLE 21 SVMC – E NVIRONMENTAL C ONTROLS
The Planning Division has reviewed the proposed project and has determined that the project is
categorically exempt pursuant to WAC 197-11-800(2)(i) and SVMC 21.20.040 from
environmental review under the provisions of the State Environmental Policy Act (SEPA).
III. P UBLIC C OMMENTS
Findings:
A Notice of Public Hearing sign wasposted on March 7, 2025 near the intersection of the alley
and Appleway Avenue, and at the terminating point of the alley area proposed to be vacated.
Notices were posted on the City of Spokane Valley web page. The public hearing notice was
mailed to all owners adjacent to the area proposed to be vacated on March 7, 2025.. Lastly, the
notice was published in the Spokane Valley Herald on March 7, 2025 and March 14, 2025.
No public comments were received following the notice of public hearing posted, emailed, and
mailed on March 7, 2025.
Conclusion(s):
The City has met the noticing requirements for street vacations as required in SVMC
22.140.020(F)

Findings:
The application was routed to jurisdictional agencies, utilities, and public districts for review and
comment.
Avista has gasand electric service lines in the alley, and Consolidated Irrigation District #19 has a
6” watermain lying within a dedicated Bureau of Reclamation easement. Easements are requested
by each agency for the purposes of maintenance and access.
The Fire Department indicated that the vacation would not impact fire access to the existing
structures and noted that all fire requirements for future development would be conditioned on the
future commercial permits. The Fire Department had no specific requirements related to the
vacation request.
City of Spokane Valley (COSV) Development Engineering and Stormwater Departments had no
specific comment or conditions for the street vacation request. COSV Traffic Engineering noted
that a BLA should be required to ensure parcels 55184.1511 and 55184.1509 would have access if
the alley were to be vacated. BLA-2024-0026 is under review to consolidate the 4 lots into 2 lots
which establish new Parcel B with access off the alley (See Exhibit 3). If the alley were vacated
than new Parcel B would be landlocked unless consolidated with the triangular parcel (parcel
#55184.1521) located on the south side of the parcel or consolidated with Parcel A.
Other agencies, including City Departments, indicated they had no issue with the street vacation.
Conclusion(s):
Staff conclude that jurisdictional agencies, utilities, and public districts have no concerns regarding
the proposed street vacation of the 185’ long segment of the alley, so long as all properties have
access, and utility easements are established to provide for access and maintenance. The street
vacation request recommendation has been conditioned accordingly to address the concerns.

V. O VERALL C ONCLUSIONS AND F INDINGS
Staff conclude that STV-2025-0001 as proposed is consistent, or will be made consistent,through
the recommended conditions of approval based on the approval criteria stated herein.
R ECOMMENDATION:
Approve the request to vacate the 20’ X 185’ segment of Appleway Avenue adjacent to parcels
55184.1509, 55184.1510, 55184.1521 and 55184.1522 subject to the following:
1. All conditions of the street vacation (STV-2025-0001) shall be completed within 1 year
following the effective date of approval by the City Council, unless otherwise approved by the
City Manager or designee who may grant a one-time extension of 1 additional year if it is
determined that good faith efforts have been undertaken.
2. The vacated property shall be transferred ½ width to each of the property owners of the abutting
parcels located on the unnamed alley (55184.1509, 55184.1510, 55184.1521 and 55184.1522)
with the exception that the deeded area as described in AFN 369325B shall be transferred
entirely to parcel number 55184.1521. The property distribution shall be shown on the record
of survey created and recorded with Spokane County Auditor’s Office pursuant to condition7.
Such property shall become part of each abutting parcel. Unless, if one abutting property owner
wants the full right-of-way, then a signed and notarized document from the owner forfeiting the
right to acquire the right-of-way after its vacated and authorizing it to go to the other property
owner shall be provided.
3. A boundary line elimination shall be included in the record of survey that results in the
consolidation of Parcel B of BLA-2024-0026 and parcel #55184.1521, or some other
consolidation of the property i.e. consolidation of Parcel A and B, ensuring that the new parcel
has access to Appleway Avenue.
4. The adjacent property owner(s) shall purchase from the City the public right of way to be
vacated consistent with Resolution 22-020. The exact cost of purchase shall be determined by
the final square footage of the area to be vacated according to the record of survey.
5. The applicant shall establish an easement acceptable to Avista for gas and electric services
located in the alley. The easement shall be recorded and the recording number referenced on
the record of survey.
6. The applicant shall coordinate with Consolidated Irrigation District #19 to establish an easement
to preserve access within the alley to the existing 6” watermain located in the Bureau of
Reclamation Easement. The easement and recording number shall be shown on the record of
survey.
7. Following the City Council’s passage of the Ordinance approving the street vacation, a record
of survey of the area to be vacated, prepared by a registered surveyor in the State of
Washington, including an exact metes and bounds legal description, and specifying any and all
applicable easements for construction, repair and maintenance of existing and future utilities

and services, shall be completed.
8. All direct and indirect costs of the title transfer of the vacated street from public to private
ownership, including but not limited to, title company charges, copying fees, and recording fees,
shall be paid by the proponent. The City shall not, and does not, assume any financial
responsibility for any direct or indirect costs for the transfer of title.
9.The Corridor Mixed Use zoning district designation of the properties adjoining the street to be
vacated shall be automatically extended to the center of such vacation, and all area included in
the vacation shall then and henceforth be subject to all regulations of the districts. The adopting
Ordinance shall specify this zoning district extension inclusive of the applicable zoning district
designations.
10. The record of survey and certified copy of the Ordinance shall be recorded by the City in the
office of the Spokane County Auditor.
11. All conditions of City Council authorization shall be fully satisfied prior to any transfer of title
by the City.

AGENDA ITEM TITLE: Proposed 2025 Budget Amendment.
GOVERNING LEGISLATION: In order for the City to amend an adopted budget, State law
requires the Council to approve an ordinance that appropriates additional funds.
PREVIOUS COUNCIL ACTION TAKEN: The Council last took formal action on the 2025 Budget
when it was adopted on November 19, 2024.
BACKGROUND: Since the initial adoption of the 2025 Budget on November 19, 2024, a number
of events have transpired that necessitate a 2025 Budget amendment. The proposed budget
amendments include:
#001 - General Fund
Revenues reflect an increase of $1,669,200, including:
$187,000 in increased Right of Way Permit fees that were approved by Council through the
passage of the Fee Resolution on April 15, 2025. Increased fees will offset the cost of hiring
th
an additional Right of Way Inspector position as was approved by Council on April 15 as
well.
$482,200 related to various energy efficiency and clean building grants received by the City
in 2025. Council approved the grant applications late in 2024.
$1,000,000 related to the Connection Housing to Infrastructure Program (CHIP) grant
received by the City. Council approved the grant application in late 2024, and the City has
an agreement with the Spokane Housing Authority to passthrough the grant funds to them
for their Appleway Development Project.
Provide additional appropriations (expenditures) of $1,941,764 comprised of:
$350,000 increase in contract attorney services in the City Council Department to cover
current estimated legal costs associated with Councilmember Merkel.
$223,200 decrease in salaries, payroll taxes and benefits in the Public Safety Department to
help offset legal costs related to Councilmember Merkel in the City Council Department.
$130,000 decrease in law enforcement vehicle replacements in the Public Safety Department
to help offset legal costs related to Councilmember Merkel in the City Council Department.
This represents a reduction of two vehicles being purchased as replacements for current aging
patrol vehicles.
$158,064 increase in the Engineering Department related to hiring an additional Right of Way
Inspector position that was approved by Council at the April 15, 2025 Council meeting. This
cost increase is offset by increased Right of Way Permit fees as discussed above.
$482,200 increase in costs for work related to the energy efficiency and clean building grants
received by the City.
$1,000,000 increase for passthrough costs to the Spokane Housing Authority related to the
CHIP grant as discussed above.
$304,700 increase in capital software costs related to the replacement of the City’s financial
management software. The 2022 Budget originally included $1,000,000 for this purpose.
However, the timing of the project is spread over various years into 2025. This amendment
spreads the $1,000,000 budgeted forward into the appropriate period.

#101 – Street O&M Fund
Revenues reflect a decrease of $985,000 in transfers in from the Transportation Benefit District
Fund #111 due to updated estimated vehicle license fees in 2025. Actual revenues were much
lower than previously estimated due to an error in the Department Licensing systems that
provided inaccurate vehicle counts for the City.
Expenditures have a net change of $0, due to a $25,000 decrease to bridge repair and
maintenance services and a corresponding $25,000 increase in transfers out to the Street Capital
Projects Fund #303 related to the Thorpe Bridge Project.
#104 – Hotel/Motel Tax – Tourism Facilities Fund
Increase in revenues of $500,000 for transfers in from the Hotel/Motel Tax Fund #105. This
increase reflects a Council motion on January 7, 2025, as part of the lodging tax grant process
for the 2025 awards.
Increase in expenditures of $2,500,000 in transfers out to the Economic Development Capital
Projects Fund #316 for the Cross Country Course project. This was approved by Council motion
on January 7, 2025.
#105 – Hotel / Motel Tax Fund
Net decrease of $0 in expenditures comprised of an increase in transfers out to the Hotel / Motel
Tax – Tourism Facilities Fund #104 of $500,000 and a decrease of $500,000 in tourism promotion
costs as was approved during the lodging tax process at the January 7, 2025 Council meeting.
#106 – Solid Waste Fund
Revenues and expenditures increase by $158,600 for the Local Solid Waste Financial Assistance
(LSWFA) grant received by the City and the related program costs. Council approved applying
for the grant at the February 11, 2025 Council meeting.
#109 – Tourism Promotion Area Fund
Expenditures increase by $475,000 to adjust for available budget based on actual 2024 revenues
and expenditures.
#111 – Transporation Benefit District Fund
Revenues and expenditures are proposed to decrease by $985,000. This amount includes
estimated vehicle license fees as well as a transfer out to the Street O&M Fund #101 for use on
street maintenance expenditures. See comments under Fund #101 above regarding the reason
for the decrease.
#302 – REET 3 Capital Projects Fund
Expenditures increase by $505,000 in transfers out to the Street Capital Projects Fund #303 for
the Thorpe Bridge Project.
#303 – Street Capital Projects Fund
Revenues and expenditures increase by $530,000 to add the Thorpe Bridge Project. Funding is
provided by a transfer in of $25,000 from the Street Fund #101 and of $505,000 from the REET
2 Capital Projects Fund #302.
#309 – Park Capital Projects Fund
Revenues and expenditures increase by $1,790,400 to add the Sullivan Water Line Project.
Funding is provided by a transfer in of $914,900 from the Capital Reserve Fund #312, grant
proceeds of $126,100, and of $749,400 in cost sharing contributions from Kemira. The bid for this
project was approved by Council at the April 22, 2025 Council meeting.

#312 – Capital Reserve Fund
Expenditures are increased by $1,674,500 including $759,600 for the amount still owing for the
purchase of the WSDOT property adjacent to Sullivan Park and $914,900 in transfers out to the
Park Capital Projects Fund #309 for the Sullivan Water Line Project.
#316 – Economic Development Capital Projects Fund
Revenues increase by $2,500,000 for the Cross Country Course Project being funded by a
transfer in from the Hotel/Motel Tax – Tourism Facilities Fund #104 as approved by Council at
the January 7, 2025 Council Meeting.
Expenditures increase by $4,709,535 representing the remaining unexpended budget of the
Cross Country Course Project.
#503 – Public Safety Equipment Replacement Fund
Expenditures increase by $650,000 for the purchase of 10 new vehicles for the new officer
positions that were approved in the 2025 as Phase I of the police staffing implementation.
The 2024 Budget amendment also includes a change to the Employee Position Classification
Monthly Salary Schedule to reflect repurposing of a Grade 14 Facilities Building Inspector position
to a Grade 14 Facilities Manager position.
The 2025 Budget amendment reflects the changes noted above and will affect 13 funds resulting
in total revenue increases of $5,178,200 and expenditure increases of $13,949,799. Of these
increases, $3,459,900 reflect transfers between City Funds.

BACKGROUND:
In 2022 Council heard a report from City Administration about CenterPlace Operations and had
discussion on whether to investigate the possibility of contracted third-party operator.
Council provided direction to the Administration to gather more information and further evaluate
CenterPlace operations and potential alternative approaches for management of the facility.
Building on the City’s Tourism Plan, which identified CenterPlace among the City’s tourism-
related assets, Johnson Consulting, Inc. was engaged to conduct an operational review and
analysis of CenterPlace.
Staff will provide an overview of the Johnson Study findings and provide an update on current
CenterPlace operations.

BACKGROUND: The Spokane Housing Authority (“SHA”) is in the process of issuing its
Revenue Bonds, Series 2025 (the “Bonds”) in an amount not to exceed $35,000,000 to finance
acquisition, construction, and equipping of 240 units of multifamily affordable housing to be
located at 9910 E. Appleway Boulevard, Spokane Valley.
Project Details:
The 240-unit project will serve workforce/family households that earn 60% of the area median
income (AMI), which is $58,740 per year for a family of four. AMI varies depending on the size of
the household. SHA will be the owner and operator of the property, while the Inland Group with
serve as the developer and general contractor. This type of public/private partnership has the
benefit of helping to deliver more units at a lower cost per unit than a traditional housing project
developed by a nonprofit on its own.
As part of the project, SHA will be developing a childcare facility to serve area families. Affordable,
quality childcare is needed for working families, which is the target audience for the Appleway
project. SHA will own the building and contract with a third-party operator to provide affordable
childcare services to low-income families.
Pursuant to Section 147(f) of the Internal Revenue Code, the jurisdiction(s) in which the projects
are located must provide approval of the issuance of the Bonds. Such approval is solely to meet
the requirements of the Internal Revenue Code in order for the Bonds to be issued. City approval
does not obligate the City with any financial responsibility for the Bonds, nor does the City incur
any financial liability for SHA’s repayment of the Bonds.
SHA conducted a required public hearing on issuing these revenue bonds on April 28, 2025 at
the SHA Board meeting. A summary of public comment received will be provided to Council on
May 6, 2025. SHA will have a representative available to discuss the project in further detail and
to answer any City Council questions at Council’s Mat 6, 2025 meeting.

RESOLUTION NO. 25-010
A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE
COUNTY, WASHINGTON, APPROVING THE ISSUANCE BY THE
SPOKANE HOUSING AUTHORITY OF ITS MULTIFAMILY REVENUE
NOTE (ORCHARD VISTA APARTMENTSPROJECT), SERIES 2025;
AND PROVIDING FOR OTHER MATTERS PROPERLY RELATING
THERETO.
WHEREAS, the City of Spokane Valley, Washington (the “City”) is a noncharter code
city duly organized and existing under and by virtue of the Constitution and the laws of the State
of Washington; and
WHEREAS, the Spokane Housing Authority (the “Authority”), a public body corporate
and politic of the State of Washington, intends to issue its Multifamily Revenue Note (Orchard
Vista Apartments Project), Series 2025 (the “Note”), in the principal amount of not to exceed
$35,000,000 and to loan the proceeds thereof to SHA Appleway LLLP, a Washington limited
liability limited partnership (the “Borrower”), of which the Authority is a general partner, in
connection with the acquisition, construction and equipping of 240-unit multifamily apartment
complex to be located at 9910 E Appleway Boulevard, Spokane Valley, Washington 99206 (the
“Project”), and the payment of issuance costs with respect to the Note; and
WHEREAS, a public hearing was held by the Authority pursuant to the requirements of
Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), with respect to
the Project and the plan of finance with respect to the Note on April 28, 2025, in Spokane,
Washington, following timely notice being published on the Authority’s website; and
WHEREAS, the City Council hasreceived a written summary of any public testimony
from the hearing with respect to the Project and the plan of finance with respect to the Note; and
WHEREAS, the City Council is the elected legislative body of the City with respect to
the approval of the Note for purposes of Section 147(f)(2)(A)(ii) of the Code.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED as
follows:
Section 1. Pursuant to the request of the Authority, the City Council hereby approves
the plan of finance for the issuance by the Authority of the Note, the proceeds of which will be
loaned to the Borrower to finance the Project located in the City of Spokane Valley.
This approval is intended to comply with the requirements of Section 147(f)(2)(A)(ii) of
the Code in order to permit the issuance of the Note. In providing this approval, the City shall
take no financial responsibility and incur no financial liability with respect to the Authority’s
issuance or repayment of the Note.
DRAFT
Section 2.This resolution shall take effect immediately upon its passage and
approval.
