profit corporation, for and in consideration of TEN AND NO/100 ($10.00) DOLLARS, and
4 4 other valuable consideration,conveys and grants unto the City of Spokane Valley,a municipal

corporation of the State of Washington, and its assigns, Grantee, under the imminent threat
of the Grantee's exercise of its right of Eminent Domain,the right,privilege and easement over,
upon, and across the hereinafter described lands for the purpose of constructing improvements
in the needed right of way.

Said lands being situated in Spokane County, State of Washington, and described in
Exhibit A and B, attached hereto, and made a part hereof.
The term of this Temporary Easement shall commence on the date of acceptance of this
Temporary Easement by Grantee and shall terminate on November 1, 2026, hereinafter the
"Term". In the event that any real or personal property or improvements belonging to Grantor,
or any utilities,located within or outside the Easement Area are damaged as a result of Grantee's
presence on the property, the Grantee shall repair said damage within 30 days of damage or
upon Grantor's request.
