That the individuals and parties named herein as having an interest in the above described property or project
agree to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of the Spokane County Code. The fees will be based on actual salary costs incurred
by Spokane County for project reviews and / or inspections plus a ten percent administrative charge, and will be billed monthly as accrued. Any billing amounts due,
including any expenses incurred in the collection of an overdue account, must be paid
prior to the County's acceptance of the project for filing. If a project is approved and/or
filed with a ba(ance still owing, the unpaid balance shall be paid within 30 days of the
invoice date. 2. The undersigned agrees that these fees are due and payable uron receipt of the billing as
specified above. -
3. Any invoices not paid within 30 days of the invoice date will be considered delinqueot.
If any outstanding balance on the account for this project is not paid within 30 days of
the invoice date, no further reviews of the project documents will be conducted until the
entire account balance is paid. Any balance on the account for this project not paid
within 65 days of the invoice date may result in legal action or the initiation of other
collection procedures, including referral to a collection agency. The Sponsor will be
liable for any and all expenses incurred by the County for the collection of overdue
accounts.

In accordancc with the Washington Stxte Environmental Policy Act (SEPA) WAC 197-11-310 a threshold determination is requircd to be issucd by the
Division of Buildings (DOB). An environmenttil checklist needs to be prepared and submilted to asist the DOB in making the threshold delermination
for circulation to agcncies of jurisdiction.
Permits cannot be issued until after the issuance of a threshold determination & a 15-day public comment period.
PROJECT OVERVIEW
The applicant proposes to build a two-story addition for the light storage of non-combustible auto par[s. Second tloor will be less
than 3000 square feet. No paint will be stored in this addition. There will be a tolal of three paint booths (UL approved natural gas
fired). This addition will connect two existing buildings and will be used as a detailing area and a hand car wash area. Site is
connected to sewer. New sandtrap and drywell with a solid lid will be installed. A 6" water line is being installed along the south
side of the proposed for the paint booths.

II. BACKGROUND ANALYSIS (continued) 5) NEIGHBORNOOD CONSIDERATION.S: Some single family uses continue to
exist in close proximity to Sprague Avenue and Bowdish Road. This
situation will tend to change with pressure from continued
non-residential development.
The site is adjacent to both Bowdish Road and Riverside Avenue.
Bowdish Road is currently two lanes, expanding to four at Sprague
Avenue, with curbing and sidewalks. Frontage along Bowdish Road is
very narrow; approximately 118 feet. Depth of lot and frontage along
Riverside Avenue is approximately 332 feet. Riverside Avenue is
currently a-very narrow right of way, with minimal gravel
improvements, which dead-ends without a turn-around. At present, it
provides access to four single family residences and an office; all
immediately north of this proposal.
III. SITE ANALYSIS
1) SITE CHARACTERISTICS AND CONSIDERATIONS: Because of the current
improvements on Riverside Avenue and proposed access by the
applicant, the County Engineer has recommended at least a 5-foot
'dedication with additional improvements. The degree of improvements
to be determined later. The resulting narrow roadway will require
signing to prohibit parking in the right of way and noting a
dead-end.
2) AGRICULTURAL SUMMARY: Major Commercial under the Comprehensive Plan
not intended for agricultural protection.

BUFFERING TECHNIUUES: A six-foot sight-obscuring fence is proposed
along the entire south and east property lines. Landscape treatments
proposed for all areas not constructed or paved over. Recommend
dense landscape screen or sight-obscuring fence along north property
line. Office use of site is an intensity transition from major
retail uses found along Sprague Avenue.

should not adversely affect building location or required setback.

IV. CONCLUSION: The proposal can be conditioned to be consistent with the
Comprehensive Plan and past land use actions. Use limited to office type
activities, caused by limited parking, provides for use and intensity
transition. Necessary dedication for road improvements may cause some
on-site design problems associated with the use as proposed. .

l. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building_ permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscu red or impaired. The original landscape
concept contained on the site plan, reviewed by the Hearing
Examiner Committee, shall be installed and maintained and shall
include the six (6) foot sight-obscuring fence along the south
and east property lines.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations mus*
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.

8. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs. 9. Applicant shall comply with '208' recomnendations concerning
stormwater runoff and provide necessary landscaping for runoff.
10. Any division of land for the purpose of sale, lease or transfer,
shall comply with kCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
11. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C,080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this*
application, and prior to any on-site improvements.
12. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at leastfifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
f i ndi ng i s hereby made that no. probabl e si gni f i cant adve rse
impacts upon the physical environ ment are anticipated as a
resul t of the proj ect; and a fi nal decl arati on of
non-significance is hereby to be issued.
13. That a dense landscape sc reen or minimum 4-foot high

b) COUNTY ENGINEERING DEPARThIENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate 5 feet on Riverside Avenue for ri ght-of-way pri or to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
3. Other specific improvements: Applicant shall improve Riverside
Avenue in a manner consistent with the Typical Roadway Section
approved by the County Enginee r. Riverside Avenue shall be
signed for no parking.

4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan f or the entire project prior to the issuance of any
bui 1 di ng permi t on the property.
6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County ~ngineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles. 7. The word "applicant" shall'include the owner or owners of the
property, his heirs; assigns, and successors.
8. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
9. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater
hianagement in effect at the date of construction, unless
otherwi se approved by the County Engi neer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended and are
applicable to this proposal.

l. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Nealth
District and is further conditioned and subject to specific
application approval and issuance of permits by the Nealth
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
County to pl ace thei r name ( s) on a peti ti on for the formati on of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owne r(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owne r(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
' objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94. 3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each dwelling unit shall be double-plumbed for connection to
future areawide collection systems.
d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Nealth District prior

2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible .

numbers shall contrast with their background.
4. Trash enclosures shall not be located adjacent to combustible
construction or unde rneath windows or nonprotected eaves.
f) WATER PURYEYOR

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
l. Air pollution regulations require that dust emissions during .

suspension of activity*during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.

4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using

They have a septic tank filter field lYmitation of sla.ght with possxble
contamination of groundwater. The soil, based on textural classifa.cation
is Type Z .
f. GeologYCally, the soils are glacxo.fluvial deposits. These geological
str.uctures generally yield moderate to very large amounts of water.
Data from wel.ls in the area shows they are from 50` to 240' deep and
have static water levels varying fxom 40' to 172' below the surface.
The Modern Flectrxc Water Company has indicated that it can supply
domestic use water foz the project upon completion of agreements with
the proponent.

The sponsor, James A. Wolff, is reyuesting approvai or a zone
reclassification, File No. ZE-67-84, Agricultural Suburban to Commercial,
for the purpose of developing an Office/Retail Building.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial and
offices. 2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial development. -
3. That the existing zoning of the property described in the application
is Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and

lU. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Comnittee:
a) The requested zone reclassification is in a transitional area;
and, therefore, landscaping and fencing requirements may be
modified in consideration of future land use.
b) That the applicant has designed the project to maximize the size
of building, which in turn limits the use to offices based on
parking requirements.
c) That in light of the above, it is realistic to limit the size of
the advertising sign to that of the Local Business Zone.
d} The Hearing Examiner Committee understands the transitional
character of this area; and, therefore, recommends to the Zoning

Sensitive Area Overlay Zone of the Spokane County Zoning
Urdinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
8. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
9. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
10. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
11. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-.1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.

a) COUNTY PLANNING DEPARTMENT (continued)
12. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant,adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environment are anticipated as a
result of the project; and a final declaration of
non-significance is hereby to be issued.
13. That a dense landscape screen or miriimum 4-foot high
sight-obscuring fence be provided along the north property line
adjacent to the kiverside Avenue right of way.
14. Fencing is required along the north, east and south property
lines. Said fencing requirement may be removed at such time as
adjacent zoning would be changed to a non-residential zone.
Also, landscaping along the east and south property lines may
not be necessary when adjacent zoning becomes non-residential.
b) COUNTY ENGINEERING DEPARThiENT
Prior To The Issuance Of A Buildinq Permit:
1. Applicant shall dedicate 5 feet on Riverside Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
3. Uther specific improvements: Applicant shall improve Riverside
Avenue in a manner consistent wiih the Typical Roadway Section
approved by the County Engineer. Riverside Avenue shall be
signed for no parking.
4. Applicant shall submit for approval by the Spokane County
. E:ngineer road, drainage, and access plans prior to the issuance
of a building permit on the,property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
p1 an for the enti re project pri or to the i ssuance of any
building permit on the property.

b) COUNTY ENGINEERING DEPARI'MENT (continued)
6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parkiny stalls shall be in
accordance with standard traffic engineering practices. Naving
or surfaci ng as approved by the County Engi neer, wi 11 be
required for any portion of the project which is to be occupied
or traveled by vehicles.
7. The word "app'iicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
5. Al 1 requi red improvements shal 1 conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended and are
applicable to this proposal. -
c) COUNTY UTILITIES DEPARTMENT
l. Nursuant to Board ofi County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
Uistrict and is further conditioned and subject to specific
application approval and issuance of permits by the hea7th
Uistrict.

2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36,94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULIU by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
Caunty, as amended.
4. Each dwelling unit shall be double-plumbed for connection to
future areawide collection systems.
d) COl1NTY HEALTH DISTkYCT l. ti combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authori zed.
4. Water servi ce shal 1 be cocrdi nai.ed through the Di rector of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Uepartment of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

e) COUNTY BUILDING AND SAFETY DEPAkThiENT
1. The site is located in Fire District # l.
2. The existing fire hydrant at the southeast corner of Bowdish and
ftiverside will be required to be'changed to a three port hydrant
(two hose connections, of 2-112 inch diameter each, and one
pumper connection).
3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
4. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
f) WATER NURVEYUR
l. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUt3TY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
-suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracki ng or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will' likely result during the
- construction phase of the project and f rom motor vehicles using
the site following completion of the project and f rom occupants
of the proposed project.
5. All air pollution regulations must be met.

CALL TO ORDER: The meeting was called to order at approximately
10:00 a.m. by the Division of Buildings Code Compliance Coordinator,
Tom Davis, with the following in attendance.

SCOPE/PROJECT DESCRIPTION:
I. General Overview - The owner Art Fried is proposing the
construction of a 2,000 square foot storage building. The proposed
will be used for the storage of wrecked vehicles that are not being
worked on at the time. The proposed will eliminate outside storage
of vehicles.
SUMMARY OF DEPARTMENTAL REOUIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. Review of the project has been completed by Lorne
Lakshas. Please contact Ms. Lakshas for any questions
regarding the proposal.
2. The proposed is located in a B-3 zone.
3. Please submit a revised site plan to scale
illustrating the entire boundaries of the property,
parking, the square foot and usage of the existing and
proposed buildings, setbacks from the property lines,
Riverside Avenue, the location of the door on the

proposed, and indicate that all traveled surfaces are to ~
be paved.
4. All conditions of Zone Change ZE-67-84 must be met.
5. A minimum of 17 parking stalls are required, only 15
parking stalls are shown on the site plan.
B. Permit Release Requirements
1. Please submit a revised site plan as described above
for review and approval.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirement
1. Comments were given to the applicant and the Division
of Buildings by Bob Turner.
2. Please submit a drainage plan for the site that is in
compliance with Spokane County Guidelines for Stormwater
Management. If less than 3,000 square feet of new asphalt
is installed no new 208 drainage areas will be required.
3. The proposed will have a metal roof therefore, all
roof drainage may go directly into a drywell.
4. All traveled areas are required to be paved as per the
requirements of Zone Change ZE-67-84.
5. An Agreement to Pay Fees was given to the applicant
during the meeting. The agreement is to be signed by the
owner and returned to the Division of Engineering & Roads.
Plan review will not be completed until this document is
executed.
B. Permit Release Requirements
1. If the amount of paving installed is 3,000 square feet
or more a drainage plan as described above shall be
submitted for review and approval.
2. Please submit a copy of the Agreement to Pay Fees
signed by the owner.

' III. Health District (456-6040)
A. Discussion/Requirements
l. The existing building is connected to the public sewer
system.
2. Please submit a critical materials list to the
Division of Buildings for review.
3. The applicant stated that there will be no floor
drains in the proposed.
4. The water purveyor for the proposed is Modern Electric
Water Company (456-8000).
B. Permit Release Requirements
l. The Health District will release their portion of the
building permit once the permit has been applied for.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire flow for the proposed project is 2,000 g.p.m.
2. The existing fire hydrants located near the site are
adequate.
3. A lock (Knox) box eniry system for f ire department
personnel access is required to be installed.
V. Division of Buildings (456-3675)
A. Discussion/Requirements
l. Plan review has been completed on the site plan only
and a letter was sent to the applicant by Jun Mascardo.
2. A one hour wall is required on the south side of the
proposed building close to the property line. Also, the
existing garage on the west side of the proposed building
shall have a one-hour wall and parapet on the south side
wall close to the property line.
3. Please submit shop drawings for the manufactured
trusses for review and approval prior to construction.

4. The proposed shall meet the minimum ventilation •
requirements for buildings used for storing or handling
automobiles operating under their own power.
5. Please submit calculations for the bearing wood studs
that are over 10 feet in height.
6. The minimum footing depth shall be three feet below
grade.
7. Anchor bolts shall be embedded in concrete a total of
nine inches.
8. Please submit a lighting layout plan for review and
approval.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during the meeting and other items from
the plan review letter needs to be submitted for review
and approval.
APPLICANT'S COMMENTS/ACRNOALEDGEMENT:
The applicant acknowledged that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should be
notif ied within one day of your receipt of these minutes.
To site plans as required by any or all of the above-listed
departments shall be submitted to the Division of Buildings who will
then distribute accordingly to those departments.
ADJOURNMENT: There being no further business, Tom Davis thanked the
applicant and the departments for their participation and reminded
all that he should be contacted if there are any unforeseen problems
which may arise.
The meeting was adjourned at approximately 10:40 a.m.

A. INTk(JDUCTIUN
This matter having come before the Zoning Hearing Examiner Committee on
November l, 1984, and the members of the Committee present being
Kenneth Kennedy, Chairman, F. Lynn Tennican and Richard L. Skalstad.
B. PRGPOSHL
The sponsor, James A. Wolff, is reyuesting approval of a zone
reclassification, File luo. lE-61-84, Agricultural Suburban to Commercial,
for tlie purpose of developing an Uffice/ketail Building.
C. F 1tvDINGS UF FtiC1
l. That the existing land use in the area is residential, commercial and
of f i ces.
2. That the Comprehensive Plan designates this area as appropriate for
P,iaj or Commerci al devel opment.
:s, lhat the existing zoning of the property described in the application
is Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Folicy
act) have been compl ied wi th, and the Commi ttee concurs wi th tlie
beclaration ot Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed "Lone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.

area.

lU. The hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are ad(iitional findings of fact considered by the
Hearing Examiner Comittee:
a) The requested zone reclassification is in a transitional area;
and, therefore, landscaping and fencing requirements may be
modified in consideration of future land use.
b) lhat the applicant has designed the project to maximize the size
of building, which in turn limits the use to offices based on
parking requirements.
c) That in light of the above, it is realistic to limit the size of
the advertising sign to that of the Local Business Lone.
d) The Nearing Examiner Committee understands the transitional
character of this area; and, therefore, recommends to the Zoning
Administrator that at such time as adjacent zoning to this site
changes to non-residential, a reconsideration ofi the need for
fences and lan(iscaping be given for this project.

l, kpproval by the Zoniny Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and provisions for
naintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired. The original landscape
concept contained on the site plan, reviewed by the Hearing
Examiner Committee, shall be installed and maintained and shall
include the six (6) foot sight-obscuring fence along the south
and east property lines.

3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
4. Direct light f rom any exterior area lighting fixture shall not
extend over the property boundary.
5. The specific development plan will be submitted for Planning
Uepartment review and approval prior to issuance of building
permi ts.
6. Al1 current standards of the Corimercial Zone, as amenoed, shall
be complied with in the development of this site.
7, l'hat the project is subject to Section 4.16k.050, the Aquifer
Sensi ti ve Area Uverl ay Zone of the Spokane County Zoni ng
Urdinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and sto rmwater runoff.
6. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
9. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
lU. Any division of land f or the purpose of sale, lease or transfer,
shall comply with kCW 58-17 and the Spokane County Platting
Ordinances prior to issuance ofi building permits.
11. That the provisions of SEPH's IvOTICE GF ACTIGN pursuant to
Chapter 43.21C.Ub0 RCW and the Board of Spokane County
Commissioners Resolution #17-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.

12. Pursuant to the provisions ofi Chapter 43.21C RCW, the SEPA
Guidelines (WAC 157-10) and the Spokane County tnvironmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environment are anticipated as a
result of the project; and a final oeclaration of
non-significance is hereby to be issued.
1~. lhat a dense landscape screen or mir,imum 4-foot high
sigtit-obscuriny fence be provided a1ong the north property line
adjacent to the kiverside kvenue right of way.
14. Fenci-ng is required alonq the north, east and south property
lines. Said fencing requirenient may be removed at such time as
adjacent zoning would be changed to a non-residential zone.
Also, landscaping along the east and south property lines may
not be necessary when adjacent zoning becomes non-residential.
b ) CGUNTY ENGINEERIIvG UEPAkTHEN1
Prior To The Issuance Gf A Building Permit:
l, kpplicant shall dedicate 5 feet on kiverside Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County koad System shall be
obtained from the Spokane County Engineer.
3. Gther specific improvements: Applicant shall improve Riverside
Avenue in a manner consistent with the Typical Roadway Section
approved by the County Engi neer. Ri versi de Avenue shal 1 be
signed for no parking.

Enyineer road, drainage, and access plans prior to the issuance
of a building permit on the property.

6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parkiny stalls shall be in
accordance with standard traffic engineering practices. I'aving
or surfacing as approved by the County Enyineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
7. The word "appl i cant" shal 1 i ncl ude the owner or owr~ers of the
property, his heirs, assigns, and successors.
b. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
5. A11 requi red improvements shal 1 conform to tlie current State of
Washington Standard Specifications for koad and Bridge
(.onstruction, and other applicable County standards andlor
adopted resolutions pertaining to Road Stanaards and Stormwater
Plianayement in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections ana drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592- as amended and are
applicable to this proposal.
c) COUNTY UTILITIES DEPARTPviENT
l. Nursuant to board of County Commissioners Resolution No.
80-041b, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Nealth
Uistrict and is further conditioned and subject to specific
appl i cati on approval and i ssuance of permi ts by ttie Heal th
Uistric t.

2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 whicri the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULIU by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. F'kOVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULIU by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each dwelling unit shall be double-plumbed for connection to
future areawide collection systems.
d) CUUNTY hEALTh GISTk1CI
l. k combined surf ace water and sewage disposal detailed plan shall
be approvea by the County Engineer and the health District prior
to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Uirector of
Utilities, Spokane County.
s. Subject to specific application approval and issuance of permits
by the Fiealth Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Uepartment of
Social and healtn Services.
6. Use ofi private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibitea.

e) COUNTY BUILDING ANG SAFETY DEPAkTMENT
l. The site is located in Fire District 1.
2. The existing fire hydrant at the southeast corner of Bowdish and
kiverside will be reguired to be changed to a three port hydrant
(two hose connections, of 2-1/2 inch diameter each, and one
pumper connec tion).
3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road f ronting the property. Said
numbers shall contrast with their background.
4. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
f ) ItikTER PURVEYUR
1. Water Purveyor i s Modern E1 ectri c Water Company, and they wi 11
supply the site with adequate water for domestic, fire and
irrigation uses.
g) CGUNTY AIR POLLUTION CONTROL AUTNORITY
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions f rom the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpavea surfaces onto paved surfaces. If tracki ng or
spills occur on paved surfaces, measures must be taken
irrunediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. Al1 air pollution regulations must be met.
