INTRODUCTION This matter having come before the Examiner Committee on March 5, 1981 , and the members of the Committee present being Jane Myers, Chairperson, Eldon Thomas and Ron McVicker. B. PROPOSAL The sponsor, Kenneth G. Redlin, is requesting approval of a zone reclassification, File No. ZE-1-81 , Agricultural to Local Business and Commercial for the purpose of developing a self-service car wash with no proposal for the remaining area. C. FINDINGS OF FACT 1 . That the existing land use in the area is residential, church, commercial and undeveloped. 2. That the Comprehensive Plan designates this area as appropriate for commer- cial development. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the pro- posed rezone is justified. 8. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL a) COUNTY PLANNING DEPARTMENT 1 . Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for main- tenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning Administrator will be permit- ted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the develop- ment plans shall be maintained. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. The specific development plan will be submitted for Hearing Examiner Committee review and approval prior to issuance of building permits for the area reclassified as Local Business. 6. All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site. 7. Landscaping shall be provided for this site, in conformance with Stand- ards as identified in Section 4.07A.120 Landscaping. 8. '. Applicant shall comply with '208' recommendations concerning storm- water runoff and provide necessary landscaping for runoff. 9. Applicant shall comply with all agency's regulations as amended prior to issuance of building permits. 10. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution 1#77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 11 . Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide- lines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and/or public testimony contain information regarding assess- ment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the pro- ject; and a final declaration of non-significance is hereby to be issued. 2 File No. ZE-1-81 • b) COUNTY ENGINEERING DEPARTMENT IDApplicant shall dedicate 25 feet on Sullivan Road for right-of-way prior to any use of the property. 2. Applicant shall construct a paved and delineated access approach(s) to meet the existing pavement on Sullivan Road. 3. Applicant shall construct cement concrete curb and sidewalk and pave 10 feet to the existing pavement adjacent to the property on Sullivan Road. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5. The applicant shall submit for approval by the Spokane County En- gineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrange- ment of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. The word "applicant" shall include the owner or owners of the prop- erty, his heirs, assigns, and successors. 8. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and partici- pating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 9. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 10. All required improvements shall conform to the current State of Wash- ington Standard Specifications for Road and Bridge Construction, and other applicable county standards in effect at the date of construction, unless otherwise approved by the. County Engineer. c) COUNTY UTILITIES DEPARTMENT 1 . Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 3 File No. ZE-1-81 • • 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The owner, his heirs and successors shall further agree not to oppose or protest any legal assessments for any utility local improve- ment district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County. d) COUNTY HEALTH DISTRICT 1 . Findings: a) This project lies over the Spokane Aquifer. b) It is within Critical Water Supply Service Area 143 and within the service area of Vera Irrigation District. Groundwater resources appear adequate to support development at this density. c) The project is inside the 201 Sewer Study Area Zone 3 and at the boundary of Primary Sanitary Sewer Area recommended in the "208" Study. The method of sewage disposal is subject to approv- al of the Director of Utilities pursuant to County Resolution 80-0418 adopted March 24, 1980. The topography and soils in the area are generally suitable for use of individual on-site sewage systems. The lot is not of the proper dimensions to permit use of both an individual well and sewage system. 2. Recommendations: a) Water service must be coordinated through the Director of Utilities, Spokane County. b) Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. c) The use of individual wells is not authorized. d) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. e) Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. f) A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health Officer prior to the issuance of any building permit for this lot. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1 . The site is located in Fire District 441 . 2. Recommend approval with condition that prior to development of this property that an engineered water distribution system plan shall be submitted to the Spokane County Department of Building and Safety. This distribution plan shall include water main size, flows, locations, fire hydrant type and locations, water storage tanks size, and location and design criteria. 4 File No. ZE-1-81 • f) WATER PURVEYOR 1 . Purveyor is Vera Irrigation Water District, and they will supply the site with adequate water for domestic, fire and irrigation uses. E. BACKGROUND/ANALYSIS The 1981 Comprehensive Plan Map designates this area as Commercial and the proposed use is compatible with the Plan and surrounding areas. The applicant has indicated a car wash is needed in the area and would be compatible with proposed Local Business uses. The Commercial Zoning is necessary for the car wash because this use is not permitted in the Local Business Zone. The remaining area requested to be zoned Local Business is not to be developed at this time. Therefore, before the Local Business area is developed, a specific development plan will be submitted for Hearing Examiner Committee review and approval prior to issuance of building permits. IV. AGENCIES RECOMMENDED CONDITIONS a) COUNTY PLANNING DEPARTMENT 1 . Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Adminis- trator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accord- ance within the concept presented to the Hearing Examiner Committee. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. Sullivan road shall be improved in a manner consistent with the approved typical cross section for Sullivan Road which is attached and made a part of the record. The improvements shall extend southerly from the north property line of the proposal to Sprague Avenue. The construction of sidewalk along the frontage of the development is also required. These requirements shall include the left turn channelization, and the two way left turn lane. DEVELOPMENT RECOMMENDATIONS The Planning Department recommends that this proposal be landscaped in accordance with ZE-27-89 with regards to width and type landscaping and also the width of the 208 area. This will be achieved at the permit review stage of development. IV. SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. However, the applicant has agreed to specific mitigating measures which should minimize or eliminate the probable significant adverse impacts. Therefore a Mingo.ed Determination of Nonsignificance ("MDNS") has been issued. The specific mitigating measures include: The "DNS" was circulated to 7 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends March 19, 1991 and was'advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. V. PLANNING DEPARTMENT SUMMARY The addition of this property to the existing Community Business (B-2) will be beneficial to the public as well as the applicant. This will create a linealuniform landscaping strip and provide a better aesthetic buffer for properties to the north. The Planning Department recommends approval as conditioned.
