Gentlemen:
On April 8, 1982, the Zoning Hearing Examiner Committee met at 9;00 A.M. to consider
nine new zone reclassification applications and two reconsideration of conditions
applications. Members present: Mr, McVicker, Chairman; Mrs. Carstens, and
Mr. Skalstad.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on April 26, 1982. Agenda items
Nos. 1 through 3 were heard on April 8, 1982, and the balance on April 9 , 1982, due
to insufficient time. All Findings and Order for both hearings were signed on
April 15, 1982.
1 ) ZW-240-79, Agricultural to Restricted Industrial : The Carstens Company
(Continued from February 4, 1982)
Location: Generally located adjacent to and west of Craig Road and adjacent
to and south of McFarlane Road. Section 34-25-41 .
Proposal : No Site Plan at this time.
Action: Approval . (Vote: 2 - 1 )
2) ZW-2-82, Agricultural to Restricted Industrial : Carter and Welsh
Location: Generally located adjacent to and west of Garfield Road, approxi-

Egon: Generally located adjacent to and north of Broadway Avenue,

Action: Denial . (Vote: 2 - 1 ) The neighborhood is substantially rural
in character, and the Zoning Hearing Examiner Committee felt the

THIS MATTER, Being the consideration of the Board of County Commissioners
of Spokane County, hereinafter referred to as the "Board" of an appeal of
Spokane County Zoning Hearing Examiner Committee Decision of April 8, 1982,
denying a rezone for the purpose of establishing a mini-warehouse storage "
facility hereinafter referred to as the "Proposal" , and the Board of County
Commissioners of Spokane County having held a public hearing on June 8, 1982
and having fully considered all testimony and exhibits presented thereat, and
further having individually visited the site and vicinity in question, and
having rendered a decision 'on the 22nd day of June, 1982, unanimously DENYING
said proposal does hereby make the following:
FINDINGS OF FACT
1 . That the proposal is generally located adjacent to and north of
Broadway approximately 620 feet west of Flora Road.
2. That the neighborhood is substantially rural in character and is
predominantely residential in use.
3. That a church and weight-lifting gym are also in the vicinity.
4. That the Spokane County Comprehensive Plan adopted in 1981 designates
this general area as Suburban.
5. That the Suburban land use category suggests commercial development
to provide neighborhood services.

6. That the proposed mini-storage warehouse is not such a neighborhood
service.
7. That the applicant has not shown sufficient changed conditions since
the original zoning of the property in 1942 to warrant a rezone at this time.
8. That the proper legal requirements for public notice of this appeal
have been fulfilled.-

9. That the proposal would not be consistent with surrounding land
I: use classifications nor in accord with the Comprehensive Plan.
10. That the use would generate increased traffic in the vicinity over
a roadway system not necessarily developed for such traffic.
11 . The visual effects of the proposal would appear incompatible with
;, surrounding land uses.
FROM THE FOREGOING FINDINGS , after considering all testimony and exhibits
' at the Board's public hearing , a review of the Planning Department Staff Report
dated April 8, 1982 including the Environmental Checklist, the Board hereby
DENIES the proposal .

A. INTRODUCTION
This matter having come before the Examiner Committee on April 8, 1982, and
the members of the Committee present being Ronald L. McVicker, Chairman,
Kathleen M. Carstens and Richard Skalstad.
B . PROPOSAL
The sponsor, Vance Phipps, is requesting approval of a zone reclassification,
File No. ZE-76-81 , Agricultural to Commercial, for the purpose of developing
Mini-Storage Units. •
C. FINDINGS OF FACT
1 . That the existing land use in the area is residential, church, Freeway, and
undeveloped.
2. That the Comprehensive Plan designates this area as appropriate for
Suburban development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. The following are additional findings of fact considered by the Hearing
Examiner Committee:
a) The neighborhood is substantially rural in character, and the Zoning
Hearing Examiner Committee felt the proposed commercial activity would
not be compatible with the existing residences and current lifestyle.
7. The proposed use did not appear consistent with the current Comprehensive
