25-121.00JointPersonnelRecoveryAgency&The336TrainingGroupMOU# 2s- €21 MEMORANDUM OF UNDERSTANDING BETWEEN THE JOINT PERSONNEL RECOVERY AGENCY, THE 336 TRAINING GROUP, AND THE CITY OF SPOKANE VALLEY FOR REALISTIC MILITARY TRAINING WITHIN THE SPOKANE VALLEY CITY LIMITS This is a Memorandum of Understanding (MOU) between the Joint Personnel Recovery Agency (JRPA), the 336 Training Group (TRG), and the City of Spokane Valley (City). When referred to collectively, the JPRA, the TRG and the City are referred to as the "Parties'. WHEREAS, JPRA operates under the direction of the Chairman of the Joint Chiefs of Staff and TRG operates Linder the direction of the Secretary of the Air Force, both entities providing crucial military training in survival, evasion, resistance and escape, which are mission critical skills that enable students to achieve survival and mission success; and WHEREAS, an important component of this training includes urban navigation and recovery activities which require field experience and training; and WHEREAS, the City is a noncharter code city with authority and jurisdiction to regulate activities on its public property and the public rights -of -way within its boundaries; and WHEREAS, the City provides law enforcement services through the Spokane Valley Police Department within its boundaries; and WHEREAS, the Parties wish to provide a framework for cooperation and communication between the Parties and wish to enter into this Memorandum of Understanding, NOW THEREFORE, the Parties agree as follows. Section 1. Communication of Schedule and Mission: TRG and JPRA both agree to contact the Chief of Police or his/tier designee each year (at the contact information set forth below) at least 64 days ahead of any class or event that will be conducted within the boundaries of the City. The purpose of this contact is to arrange a meeting with representatives of these offices on the following: 1. The training date or dates for activities during the year, including information about the nature of the training to be provided, time or times of the training; the general area proposed for the training and other information deemed necessary by any of the Parties; 2. Address all concerns that may be identified by any of the representatives of the officials attending the meeting, including any special event permits that may be required for activities in City parks occurring after normal hours of operation. The Chief may request follow-up with additional City staff, including the City Parks and Recreation Director to discuss such issues; and MOU: JOINT PERSONNEL RECOVERY AGENCY (JPRA) AND SPOKANE VALLEY I Page 1 of 4 3. Other issues that may be identified regarding the training and/or communication of events/activities. Coordination for Each Training Session: In addition to the communication and coordination identified in Section 1, the Parties agree and understand that detailed communication in advance of each specific training session is important. 1. JPRA and TRG both agree that at least 21 days prior to each scheduled session, in addition to communicating with the Chief of Police or his/her designee, it will additionally provide notice to and, if requested, attend a meeting or meetings with representatives of the City identified below: Spokane Valley Police Dept. Nature of obligation of the Parties to each other: The Parties are entering into this MOU to articulate the commitment to communicate with each other and coordinate their activities. Other than this contract and coordination, neither party makes any other express obligations to the other. MOU: JOINT PERSONNEL RECOVERY AGENCY (JPRA) AND SPOKANE VALLEY I Page 2 of 4 2. Funds and Manpower: This MOU does not provide or anticipate the sharing of manpower, or exchange of funds and makes no commitment of funds or resources. No provision in this MOU will be interpreted to require obligation or payment of funds. 3. Modification of MOU: This MOU may only be modified by written agreement of the authorized representatives of each of the parties. 4. Disputes. Any disputes relating to this MOU will first be resolved by consultation between the Parties. If such consultation does not result in an agreed resolution, then the matter may be submitted to a Unites States District Court in the State of Washington subject to any applicable law, legally valid Executive Order, or legally valid DOD issuance. 5. Termination of MOU: This MOU may be terminated in writing at will by any of the parties. The termination will be effective at the later of actual receipt by the other party or five (5) days after deposited in the United States Postal Service system. 6. Transferability. This MOU is not transferable except with the written consent of the Parties. 7. Entire Understanding. It is expressly understood and agreed that this MOU embodies the entire understanding between the Parties regarding the MOU's subject matter, thereby superseding all prior understandings of the Parties with respect to such subject matter. 8. MOU: JOINT PERSONNEL RECOVERY AGENCY (JPRA) AND SPOKANE VALLEY I Page 3 of 4 9. Effective Date: This MOU takes effect on the date after the last party executes the MOU. 10. Expiration Date: The MOU is in effect for three (3) years from its effective date, unless either terminated under the terms of this MOU, or extended by mutual agreement of the Parties. 11. No Third -Party Beneficiaries. Nothing in this MOU, express or implied, is intended to give to, or will be construed to confer upon, any person or entity not a party any remedy or claim under or by reason of this MOU and this MOU will be for the sole and exclusive benefit of the Parties.
