CONCLUSIONS AND ORDER INTRODUCTION This matter has come before the Hearing Examiner Committee on April 22, 1993. The members of the Committee present are Lunell Haught, Chairperson, Jan Reuter and Jane Myers. PROPOSAL The sponsor, Glenn Burdick, requests approval of a review of site plan as required by County File, ZE-95A-84, in the Regional business (B-3) zone and within the Aquifer Sensitive Area Overlay (ASA) zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of and adjacent to Sprague Avenue, approximately 50 feet west of Conklin Road, within the SW 1/4 of Section 13, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. The Planning Department has recommended that the proposed use and site plan be approved subject to conditions. 3. The existing land use(s) in the area are commercial and residential. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Major Commercial. The Major Commercial category is for the purpose of establishing commercial use directly related to major thoroughways. 6. The existing zoning does implement and conform to the Comprehensive Plan. 7: The Arterial Road Plan designates Sprague Avenue as a Principal Arterial, with a recommended right of way width of 130 feet. 8. The existing zoning of the property described in the application is Regional Business (B-3), previously established as Commercial zoning in 1984 and reclassified to Regional Business (B-3) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. HEC Order for ZE-95A=84 Page 2 11. The owners of adjacent lands expressed approval of the proposed use. Owners of adjacent property testified that development of the site would improve the area. 12. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 13. The Committee additionally finds/concludes: a. That strict compliance with the Planning Department conditions of approval will ensure that proper buffering and landscape is installed. b. That any additional review of the future expansion portion of the site will be administrative. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors -in -interest. 2. The following Conditions of Approval apply to the real property described below: The East 1/7 the of the West 7/10th and the West half of the East 3/l0th of Tract 32 of Vera, as per Plat thereof recorded in Volume "O" of Plats, page 30, except the North 30 feet thereof; and except that portion conveyed to the State of Washington by deed dated March 13, 1937, Recorded in Volume 471 of deeds, page 52d; Situate in the County of Spokane, State of Washington. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Regional Business (B-3) zone and the Aquifer Sensitive Area (ASA) Overlay zone(s) as amended. 2. Strict compliance with every condition of approval is required in the development of this site. Administrative review is authorized, but no administrative deviations are permitted. Any proposed modification must be presented to the Hearing Body for review and approval. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 4. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: HEC Order for ZE-95A-84 Page 3 The parcel of property, legally described as [ ] is the subject of. a land use action by a Spokane County Hearing Body or Administrative Official on April 22, 1993 imposing a variety of special development conditions. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 6. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 7. The applicant shall demonstrate to the satisfaction of the Spokane County Planning Department that the existing primary residences have been removed from the subject property and the applicant shall also demonstrate to the satisfaction of the Spokane County Planning Department that the accessory structures are located outside the portion of property under review at this time and are wholly located within the boundary of the future expansion area. 8. The applicant shall comply with all conditions of 7F-95-84 that are not otherwise addressed through this public hearing review. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior To Issuance Of A Building Permit Or Use Of The Property As Proposed: 1. Access permits for approaches.to the county road system shall be obtained from the Spokane County Engineer. 2. The applicant shall submit for approval by the Spokane County Engineer, drainage and access plans. 3. Access to Main Avenue shall be prohibited until such time as specifically authorized by the Spokane County Engineer. 4. There may exist utilities, either underground or overhead; affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 5. The applicant shall comply with all other conditions of approval of IF-95-84 as approved and these added conditions of approval if this site review is approved. HEC Order for /1-95A-84 Page 4 SPOKANE COUNTY DIVISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 4. Each unit shall be double -plumbed for connection to future area wide collection systems. SPOKANE COUNTY HEALTH DISTRICT 1 A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any on -site sewage disposal permit or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval and issuance of permits by the health officer, the use of (an) individual on -site sewage disposal system(s) may be authorized. 7. Use of private wells and water systems is prohibited. 8. If the existing on -site sewage systems are not to be used for the new building then they must be properly abandoned. HEC Order for ZE-95A-84 Page 5 SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage of design/development in order to be informed of code requirements administered/enforced by the department, e.g., State Building Code Act regulations, such as requirements for fire hydrant/flow, fire apparatus access roads, street address assignment, banier-free regulations, energy code regulations and general coordination with other aspects of project implementation. 2. The issuance of a building permit by the Department of Buildings is required. WATER PURVEYOR NOT AVAILABLE AT TIME OF HEARING SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction -related activities. 3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application for Approval be submitted to and approved by our agency prior to the construction, installation or establishment of an air pollution source. 6. All solid fuel heating devices must comply with local, state, and federal rules and regulations. Johnson, is requesting approval of a zone reclassification, File No. ZE-95-84, Agricultural and Residential Office to Restricted Industrial and Commercial, for the purpose of developing a Contractor's Office and Storage Yard - (No Site Plan). C. FINDINGS OF FACT 1. That the existing land use in the area is residential, commercial, and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing zoning of the property described in the application is Agricultural and Residential Office. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non -Significance. 5. The following are additional findings of fact considered by the Hearing Examiner Committee: a) The Commercial Zone can accommodate the proposed uses; therefore, in regards to the immediate use, it was not necessary to consider the Restricted Industrial portions of the combined rezone request. The Committee further notes that existing Restricted Industrial Zones are found only south of Sprague Avenue to the old railroad right of way. None are located north of Sprague Avenue. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) That compliance with conditions imposed for the contractor's storage yard will help protect and provide safety to the neighborhood immediately. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6 The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 8. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 9. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 1U. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on -site sewage system may be authorized. 6 ZONE RECLASSIFICATION NO. ZE-95-84 d) COUNTY HEALTH DISTRICT (continued) 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per minute for each fire hydrant) and meeting the requirements in Chapter 10.04 of the Uniform Fire Code is required prior to construction of the water service. All required fire protection facilities shall be installed and made serviceable prior to and during the time of construction. 3. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. 4. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 5. A land use permit will be required for each structure. 6. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) should be paved and kept clean. 4. SCAPCA Regulation I, Article V requires that a Notice of Construction and Application for Approval De submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. 5. The County Engineer has not required any additional dedication or future acquisition area through this land use action. C . Site Characteristics: The site is flat and covered with native grasses, deciduous trees and some shrubbery. There are also two single-family dwellings on the site as well as two accessory structures. The applicant will be required to make adequate provisions as to removing or relocating the existing structures as part of the Planning Department conditions of approval. D . Neighborhood Characteristics: The surrounding neighborhood adjacent to Sprague is generally used for commercial use. There is a used car lot that is located on the northwest corner of Sprague and Conklin Street, directly east of the proposal. Single-family residences are located along Conklin Street, and border most of the site along the northeastern property line. A single-family dwelling and accessory structures are located adjacent to the property on the west property line and the unimproved right-of-way of Main Avenue borders the site to the north. E. Zoning Analysis: Proposal: North: South: Develop property for use as a general warehouse and retail business in accordance with the development standards of the Regional Business (B-3) zone and County File /1-.-95-84. Urban Residential-3.5 (UR-3.5), established in 1991, previously classified as Agricultural.(ZE-60-42) Regional Business (B-3) and Light Industrial (1-2) established in 1991, previously classified as Commercial and Restricted. A used car lot is located adjacent the proposal on the east and a mini -storage business is on the south side of Sprague across from the site. The land farther south is vacant and undeveloped. Commercial activity increases farther west of the proposal. Site: The existing land use is two vacant single-family dwellings and accessory structures. The proposed land uses are general retail and warehouse. North: There is an existing unimproved right-of-way (Main Avenue) along the northern boundary of the proposal. The land north of this right- of-way is vacant and covered with native grasses and bnish. Most of the parcels northeast of the site are 1/2 acre to 2 acres in size. South: The land.south of the site contains a single-family dwelling on the southwest corner of Conklin and Sprague. The rest of the area south of the proposal is largely undeveloped and vacant: East There are existing residential and business uses located along Sprague Avenue east of the site. A used car lot and single-family dwellings border the east propertyline of the site. The residential lots range in size from 10,000 to 15,000 square feet. West: Single-family dwellings and small scale businesses are located along Sprague to the west of the site. The parcels to the west along Sprague are approximately 3/4 acre to 1 1/2 acre in size. G . Circulation: The site has direct access to Sprague Avenue and the site plan submitted for review shows two existing approaches to the site. All internal travel lanes and parking stalls will be paved. Directional arrows will be used to facilitate internal circulation. H . Design: 1. Site Plan Data Proposed Site Plan: The site plan submitted for review includes only the southern portion of the parcel. Response: The site plan submitted for review illustrates a 6-foot high sight obscuring fence along the east and north property lines. Any future development of the northern portion of the site will require adherence to the standards of the Zoning Code. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed use is in accord with the Zoning Code and Major Commercial category of the Comprehensive Plan. The site plan and conditions of approval ensure that proper buffering techniques will be installed to increase compatibility with adjacent uses. Nearly all land south of Sprague, to the abandoned Milwaukee Railroad Right of Way, is zoned Commercial or Restricted Industrial. 4) LAND USE: Site Two Residential Structures and Construction/Material Storage North Vacant and Single Family East Single Family, Car Sales, and Vacant South Single Family, Vacant, and Lumber Sales West Single Family and Vacant 5) NEIGHBORHOOD CONSIDERATIONS: The area, especially along the north side of Sprague, is in transition to non-residential uses. Houses are found along both sides of Conklin Road; four of these dwellings adjoining the proposal on the east. Sprague Avenue is currently four lanes without curbing or sidewalks. A fifteen foot dedication is required along Sprague. Required improvements to both Sprague and Main Avenue delayed to an RID/CRP. ete ZONE RECLASSIFICATION N0. ZE-95-84 III. SITE ANALYSIS 1) SITE CHARACTERISTICS AND CONSIDERATIONS: The parcel extends from Sprague Avenue north to unimproved Main Avenue. Two existing structures are used as rentals and offices. The existing storage of construction equipment and materials is in violation of Residential Office and Agricultural zoning standards. 2) AGRICULTURAL SUMMARY: Major Commercial not intended for agricultural protection. 3) SITE PLAN INFORMATION: SITE SIZE: note: Approximately 2.3 Acres The applicant has not submitted a Site Plan with this rezone application. The intended use, stated in the application, is for a contractor's office and storage yard. Restricted Industrial zoning is requested on the South 300 feet of the parcel, with the remainder, north to Main Avenue, proposed as Commercial. BUFFERING TECHNIQUES: Without a site plan, no techniques have been proposed. Under the existing storage use that is proposed to continue, suggest that a buffer be provided immediately to the residential uses along the east and north. Other landscape treatments to be required at building permit stage and can be reviewed administratively. OTHER SITE PLAN CONSIDERATIONS: In light of Comprehensive Plan language regarding industrial uses in the Major Commercial category, it may be advisable to publicly review site plans prior to any building permit release on future structures. IV. CONCLUSION: Both proposed zones for the parcel, Restricted Industrial and TSTEITZTiT, will allow the existing contractor's office and storage to remain. Immediate buffering to residential uses are recommended. The Comprehensive Plan suggests that industrial uses be light intensity, designed to complement commercial uses, and be conditioned to ensure compatibility. Without a site plan, those contingencies are hard to accomplish. Public hearing site plan review of a specific proposal may be necessary. 14 ZONE RECLASSIFICATION NO. ZE-95-84 V. RECOMMENDED AGENCY CONDITIONS, IF APPROVED: (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. Direct light from any exterior area lighting -fixture shall not extend over the property boundary. 4. All current standards of the Restricted Industrial Zone, as amended, shall be complied with in the development of the South 300 feet of this site. 5. All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site, EXCEPT for the South 300 feet. 6. That the project is subject to Section 4.16A.050, the Aquifer Sensitive Area Overlay Zone of the Spokane County Zoning Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 17 ZONE RECLASSIFICATION N0. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on -site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 9. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 10. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 11. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners'Resolution No. 80-1592 as amended, and a re applicable to this proposal. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The project shall be conditioned with the performance criteria of Section 4.16A.050 of the Zoning Ordinance for this action as well, as all future uses. d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall_be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on -site sewage system may be authorized. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 4, ZONE RECLASSIFICATION NO. ZE-95-84 e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per minute for each fire hydrant) and meeting the requirements in Chapter 10.04 of the Uniform Fire Code is required prior to construction of the water service. All required fire protection facilities shall be installed and made serviceable prior to and during the time of construction. 3. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with. their background. 4. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 5. A land use permit will be required for each structure. Reclassification of an existing building shall require an application for change of occupancy permit and subsequent inspection for approval. Due to the sensitive storage requirements over the Aquifer, and this site lies within the Waste Water Management Area, we feel that some language should address the possible storage of flammable or critical materials within these structures. f) WATER PURVEYOR 1. Water Purveyor is Vera Irrigation District #15, and they will supply the site with adequate water for domestic, fire and irrigation uses. g) ZONE RECLASSIFICATION NO. ZE-95-84 COUNTY AIR POLLUTION CONTROL AUTHORITY 1 Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3.
