HomeMy WebLinkAbout23-242.02 Senske Lawn and Tree Care - Landscape Maintenance Linear Parks & RoadwaysCONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND Senske Lawn and Tree Care Spokane Valley Contract # 23-242.02 For good and valuable consideration, the legal sufficiency of which is hereby acknowledged, City and the Contractor mutually agree as follows: 1. Purpose: This Amendment is for the Contract for Landscape Maintenance of Linear Parks and Roadways by and between the Parties, executed by the Parties on December 29, 2023, and which terminates on December 31, 2026. Said contract is referred to as the "Original Contract" and its terms are hereby incorporated by reference. 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Amendment Provisions: The Original Contract is subject to the following amended provisions, which are enumerated below and further reflected in Appendix "A". All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract, including any previous amendments thereto. (1) Increase original contract amount by the allowed CPI-U increase of 3%, equal to $14,326.35 pre-tax. (2) Update SP-1 Appendix A and B to incorporate one new RLS area added to the scope of work as shown in Exhibits 1 to Appendix A of this Amendment: this added area increases the contract amount by an additional $4,900.00. (3) Add Special Provision for water conservation. 4. Compensation Amendment History: This is Amendment _2 of the Original Contract. Pursuant to section 1.19 of the Special Provisions, the total compensation for 2026 is increased by $14,326.35 to take into account the CPI-U of 3%. Further, pursuant to Paragraph 4 (Compensation) of the Original Contract, the City's request for additional quantities of service as reflected in this Appendix"A"section 2 below and as outlined by Exhibit 1 to this Amendment,compensation for 2026 shall be increased by an additional$4,900.00. The total compensation to be paid to the Contractor for 2026 shall be$496,771.15 plus applicable sales tax. 2. Additional Quantities of Service. Per 1.16.1 and 1.16.2 of the Special Provisions, exhibit 1 to this Appendix"A", are incorporated herein by this reference. Exhibit 1 to this Appendix"A"details the additional quantities of service for Roadway Landscape Maintenance (RLS). Additionally, Appendices A & B in Section 8 of the Special Provisions of the Original Contract are amended as shown in Exhibit 2 to this Appendix"A"to reflect this additional service area. The RLS location in Exhibit 1,which is taxable,is described below: Exhibit 1. Barker Road Shared Use Path, from Spokane River to Trent. The City requests weed spraying of the gravel next and adjacent to the asphalt trail. This work was accomplished last year as force account and is now incorporated into the 2026 contract amendment.Total area for 2026 weed spraying=approximately 30,000 SF. $4,900.00 adjustment in 2026. 3. Additional Special Provision. The Special Provisions of the Original Contract are hereby amended to include the following language under a new subsection 2.8.1 called WATER CONSERVATION: 2.8.1 WATER CONSERVATION: As instructed by, and coordinated with City Staff,the Contractor shall utilize and implement water management techniques and best practices to minimize water consumption.Contractor shall not be held liable for turf damage that occurs due to water conservation efforts as instructed.
