The original Agreement states that it was for one year, with three optional one-year terms possible if the parties mutually agree to exercise the options each year. This is the first of three possible option years that can be exercised and runs through December 31, 2026. The City would like to exercise the 2026 option year of the Agreement. The Compensation as outlined in the attachment to this letter titled "2026 Landscape Proposal", includes the labor and material cost negotiated for 2026 and shall not exceed $26,082.47. This attachment shall replace the proposed fees, price, and costs of the original agreement and any amendments thereto. The history of the annual renewals, including dollar amounts, is set forth as follows: Original contract amount .............................. $17,940.49 (plus applicable sales tax) Amendment No. 1 (add'1 services) ...................$ 7,133.35 2026 Renewal..............................................$26,082.47 (plus applicable sales tax) All of the other contract provisions contained in the original Agreement shall remain in place and remain unchanged in exercising this option year. If you are in agreement with exercising the 2026 option year, please sign below to acknowledge the receipt and concurrence to perform the 2026 option year. Please return two copies to the City for execution, along with current insurance information. A fully executed original copy will be mailed to you for your files. By signing this letter agreement, you agree to waive any argument that the original Agreement expired, and agree to be bound by all terms therein which are not specifically modified by this letter.
