KNOW ALL MEN BY THESE PRESENTS, that the Grantor(s) GNM GROUP LLC, for and in
consideration of mutual benefits, the receipt of which is hereby acknowledged, warrants and conveys to
the City of Spokane Valley, a municipal corporation of State of Washington, a RIGHT OF WAY DEED
over the following described real property, situated in the City of Spokane Valley, Spokane County, State
of Washington, to -wit:
THAT PORTION OF LOT 11 OF THE FINAL PLAT OF MOFFITT'S SUBDIVISION OF BLOCK 151
OPPORTUNITY AS RECORDED IN BOOK "T" OF PLAT, PAGE 11, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS;
COMMENCING AT THE INTERSECTION OF SKIPWORTH ROAD AND SPRAGUE AVENUE;
THENCE N00°13'04"E ALONG THE CENTERLINE OF MOFFITT ROAD, 226.20 FEET; THENCE
S89051'47"W, 20.00 FEET TO THE NORTHEAST CORNER OF SAID LOT 11 AND POINT OF
BEGINNING; THENCE S89°51'47"W ALONG THE NORTH LINE OF SAID LOT 11, 2.40 FEET;
THENCE S00013'04"W, 138.50 FEET TO THE BEGINNING OF A CURVE CONCAVE TO THE
WEST WITH A RADIUS OF 12.50 FEET; THENCE ALONG SAID CURVE THROUGH A
CENTRAL ANGLE OF 38006'29", AN ARC DISTANCE OF 8.31 FEET TO THE SOUTH LINE OF
SAID BLOCK 11; THENCE N89052'37"E ALONG SAID LINE, 5.06 FEET TO THE EAST LINE OF
SAID LOT 11; THENCE N00°13'04"E ALONG SAID LINE, 146.20 FEET TO THE POINT OF
BEGINNING.
CONTAINING 357 SQUARE FEET, MORE OR LESS.
The City of Spokane Valley, as a part of the consideration hereof, does hereby agree as a
covenant running with the land that in the event facilities are constructed, maintained, or
otherwise operated on the property described in this Right of Way Deed for a purpose for which
a U.S. Department of Transportation activity, facility, or program is extended or for another
purpose involving the provision of similar services or benefits, the City of Spokane Valley will
maintain and operate such facilities and services in compliance with all requirements imposed by
all current laws, rules and regulations such that no person on the grounds of race, color, or
national origin, will be excluded from participation in, denied the benefits of, or be otherwise
subjected to discrimination in the use of said facilities.
TO HAVE AND TO HOLD the same, unto the said City of Spokane Valley for the purposes of a public
road forever.
