REASONS:

2. The difficulty requiring a variance is not the result of an illegal act upon
the part of the applicant.
3. The difficulty requiring a variance is not the result of personal conditions
of the applicant.
4. The difficulty requiring a variance is due to unique circumstances related to
the property in question and is not the general condition of the surrounding
and adjacent properties.
CONDITIONS:
1. The variance is granted to October 1, 1962 and if the applicant has not secured
a building permit by such date, the variance permit shall become null and void.
2. The fence shall not exceed s. height o. seven (7) feet.
3. The fence shall not be constructed closer than. 25 feet to the intersection of
Lake Road and Broadway Avenue.

WHEP.EAB, Potition3 have been presented to the Spokane County
Planning Commission by Mr. R. Seim, representing and Vice- President of the
Solar Natural Gas Company, Inc., requesting that the Zoning Map and certain
properties be changed from the existing. Agricultural zone classification to
Commercial, iostrlcted Industrial, and Manufacturing zone classifications on
certain properties generally located to the southwest of the intersection of
Trent Road and Park Rand, Spokane County, Washington, more particularly
described as follows.

Tracts 1 and 2 of O'Connor's Five Acre Tracts, except that
portion of Tract 1 presently zoned Manufacturing, all in
Section 12, Township 25 N., Range 49, E.W.M. in Spokane
County, Washington.

WHEREAS, The Spokane County Planning Comn:lssion at its regular
meeting and public hearing an July 27. 1961, postponed action on said appli-
cation pending personal inspection of the property In question by members of
the Planning Commission and preparation of zoning plans on and adjacent to
the property in question,
and,
WHEREAS, The Spokane County Planning Commission at its regular
mooting and public heating on September 26, 1961, did formally act upon such
petition and did formally recommend to the Hoard of County Commissioners of
Spokane County that certain portions of the requested zone change be denied
and certain portions approved, mom particularly described as follows;
The east 140 feat of Tracts 1 and 2 of O`Connor'° rive Acre
Tracts be denied from Agricultural to Commercial zone
classification,
The south 50 foot of Tract 1, except the east 140 feet be denied
from Agricultural to Manufacturing zone classification.
The south 50 feet of Tract 1. all of Tract 2 except the east 140
feet be approved from Agricultural to Restricted Industrial
zone classification.
WHEREAS, An appeal on the recommendation of the Spokane County
Planning Commission was filed on October 13. 1961, by Joseph S. Arsenault
of E. 7513 Indiana, by M. A. Johnson, his attorney,
and,
"WHEREAS, The Board of County Commissioners of Spokane County did,
on October 31, 1961, hold a public hearing on the appeal of the recommenda-
tion of the Spokane County Planning Commission of requested rezoning of said
property.
WHEREAS, M said hearing, opportunity was afforded those favoring
and we opposing said proposed ions change, and the Board of County
Commissioners of Spokane County having fully considered the testimony given,
the official records and minutes of the Spokane County Planning Commission,
correspondence, and all evidence, and having made personal inspection of the
property in question by all members of tho Board on November 6, 1961, and
having fully investigated the matter does hereby find:
1. That the property in question is generally located to the
southwest of the Intersection of Trent Road and Park Road.
The only manor before the Board of County Commissioners
for their consideration Is the question of the Agricultural to Restricted Industrial
zoning. Tins question of the storage of inflammable fuel, proposed Agricultural
to Manufacturing, and proposed Agricultural to Commercial zone classifications
is not considered In this appeal.
3. The enlisting zoning to the north of the property in question
la Manufacturing, to the south is Agricultural, to the west is Restricted
I ndustrial, and to the east le Agricultural Suburban. and Multiple family Suburban.
4. That eydotlng land uses adjacent to the property in question
consist of a railroad to the north, single fatally dwellings to the east, vacant
land to the west, and scattered single family dwellings and a public school to
the south.

5. The property under consideration for a zone change from
Agricultural to Restricted Industrial Is about acme.
6. The property in question was zoned Agricultural on
September 23, 1940.
NOW, TREREFORE, The Board of County Commissioners ers of Spokane
County does hereby •concur in the recommendation of the Spokane County
Planning Commission, denies the appeal of joseph. S. Arsenault and hereby
approves the petition of the Solar Natural Gas Company. Inc., to change the
Zoning Map from the Agricultural zone classification to the Restricted Industrial
Zone classification on the following described property for the following reasons
and cublect to the following conditions, all in the public interest and general
welfare:
Agricultural to Restricted Industrial: All of Tracts 1 and 2 except
the presently. zoned Manufacturing and the east 140 feet, of
O'Connc's Five Acre, Tracts in Section -l2, Township 25 N.,
Range 43, E.W.M., Spokane County, Washington.

applicant shrill submit to the County Planning Conunlseion for their concidera-
tion and review a specific land use proposal for the property in question.
