VE-36-63ZONING ADJUSTOR OF SPOKANE COUNTY FINDINGS AND ORDER REGARDING CONDITIONAL USE PERMIT CUE -61 =63 AND VARIANCE VE..36 -63 WHEREAS, Application has been presented to the Zoning Adjustor of Spokane County by W. L. Garceau, "a contractor acting as agent for the Quiki Box Man- featuring Company, requesting that a conditional use permit be granted to allow two storage sheds, 24 feet by 24 feet and 50 feet by 32 feet, to be built extending across a zone boundary into an Agricultural Suburban Zone; and also requesting that a variance be granted allowing construction of a storage shed on a flanking street property line and also allowing construction of a loading dock and a storage shed within five feet of a flanking street property line (the Zoning Ordinance requires a 20 foot building setback along a flanking street). All such buildings to be located as shorn on a plot plan submitted as part of the application on property described as follows: Lots 1, 2, 3, and "4 of Block 2 of Bates Addition to Valley View Addition in Section 18, Township 25 N., Range 45, E.W.M., Spokane County, Washington. WHEREAS, The Zoning Adjustor of Spokane County did hold a public hearing after due notice on Tuesday, November 12, 1963. and MINUTES, NOVEMBER 12, 1963 WHEREAS, At said hearing opportunity was afforded those favoring and those opposing said application, and the Zoning Adjustor having fully considered the official records, evidence and testimony given and having made a personal inspection of the property in question does hereby finds 1. That the Iota in question are of unisual size and shape for industrial property, said lots being the same size and shape as other lots in the Bates Addition which are used for residential purposes. 2. That because of the small size of said lots relative to industrial property generally, the owner is under severe hardship in trying to utilize the property for industrial purposes if he must observe all setbacks strictly. 3. That the proposed variances along the flanking streets, Boone and Sharp, would not result in reduced area available for off - street parking since such area is now unusable for off- street parking due to blocked access to Boone Avenue by an irrigation ditch and railroad spur and due to blocked access to Sharp Avenue at the building location by a fence required in an earlier Zoning Adjustor action (VE- 1 -60). Continued on next page 4. That the proposed variances would not result in increased traffic congestion along Sharp and Boone Avenues because access points to the property would not be changed by the proposed construction. 5. That the proposed construction of lumber storage buildings straddling the zoning boundary and extending into Iot 4 would not appreciably alter the effect of the operation upon adjoining properties due to the fact that a sight - obscuring fence exists along the west boundary of Lot 4 that screens Lot 4 from the property to the west. In fact the provision of more storage space should enable the applicant to keep the plant's yard area in a neater condition. In the Zoning Adjustor's opinion it would be therefore unreasonable to deny the expansion across the zone boundary that artificially divides the property. NOW, THERBFORE, The Zoning Adjustor of Spokane County does hereby approve the conditional use permit and variances as requested by the Quiki Box Man- ufacturing Company. The approval is subject to the following conditions. Conditions: 1. That the north wall of the structure proposed for construction along Sharp Avenue be a solid structure permitting no direct access to Sharp Avenue. 2. That the requirements for fencing of the property established in VE -1 -60 and on file in this office continue in force and effect, and that the existing fence be put immediately into good repair, and that said fence be painted as soon as weather permits, but not later than May 1, 1996 3. That the property directly east of the plant site across Barker Road and leased by the Quiki Box Company be cleared of lumber and other scrap material and that such property be used instead only for off - street parking of employees* cars. 4. That the management of Quiki Box Manufacturing Company take appropriate measures to instruct and insure that the company's employees do not park on Sharp, Boone, or Barker Roads.
