VE-1-64MINUTES, JANUARY 6, 1964 ZONING ADJUSTOR VARIANCE 1. VE -1-64 Site Covera e Variance Zoning Adjustor Decision: Approve by reason of the following findings: a. There was no weight of evidence presented at the hearing demonstrating that the granting of the variance would result in a situation materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. An opinion was advanced by opponents that the site coverage in excess of the ordinance requirements would so reduce available off-street parking apace as to create traffic congestion and hazard on surrounding streets. Uncontested evidence was advanced by the applicants to show that they now have off-street parking space in excess of their needs and in excess of the Zoning Ordinance requirements. It was asserted by objectors that employees now park along the streets and that this constitutes a problem. The Zoning Adjustor notes, however, that adequate unused off - street parking space is available, that on- street parking is not prohibited along these streets, and that if a problem exists or develops, the County Engineer's office might recommend posting of the street against parking. Other assertions by objectors were to the point that the ordinance should be strictly observed simply because it is the law. b. The applicants assert by testimony that the proposed expansion is necessary to the continued operation of their business.. They point out that it has been necessary to acquire their present site from several owners, that such parcels were often small,having been platted originally for residential use, and that it is impossible for them to acquire additional property immediately, although they will continue to attempt to acquire additional property. They point out that their expansion plans mould only exceed the ordinance requirements by four per cent and that it was simply impossible in the past to foresee their property needs to the exact extent. They assert that a significant delay in their construction that would result if they had to attempt to buy additional land mould cause serious disruption of their business. c. The Zoning Adjustor concludes that no detrimental effect upon surrounding properties or the general welfare would result from the proposed expansion. The applicants proposal complies with the purpose of the ordinance to provide adequate space for efficient functioning of the plant, and for adequate off-street parking. The amount of the requested variance is so alight as to not interfere with this purpose while the potential damage to the applicant of the denial of his expansion is great„ The Zoning Adjustor is of the opinion that none of the public purposes contemplated by the ordinance would be served by requiring strict conformance in this instance.
