HUGGINS, Zgai rig Adjustor HGA mn Yours truly June 12, 1964 Mr. Charles L. Huggins Office of the Spokane County Zoning Adjustor c/o Spokane County Planning Commission Spokane County Court House Spokane, Washington Dear Mr. Huggins: This letter is in protest to the application for the construction of a five foot fence along Evergreen Road on Section 27, Township 25N., Range 44, E.W.N. Lot 8, Block 5, Mountain View 4th Addition by Mr. Wilbur W. Winter. H. G. Anderson S. 2409 Evergreen Veradale, Washington Tracts 210, 225, 226, 241 of Vera are my property and are located directly across the road from Mr. Winter's lot. My plans in the future are to plot this acreage and I feel a five foot fence along Ever- green Road would be detrimental to the future devel- opment of this property - especially those lots which would face this fence on Evergreen. According to the County Ordinance fences along any street can only be four feet high. This is an e- ffective and protective ordinance for all property owners. I see no reason for a change. Last year a neighbor across from my residence was building a six foot fence along Evergreen; however, the County Ordinance prohibited him from building it higher than four feet on the street side. I am sorry that I am unable to personally attend this public hearing; however, on June 22nd I will be en- route to Alaska. Please accept this as my formal protest. MINUTES, JUNE 22, 1964 ZONING ADJUSTOR VARIANCE 2. VE- 20 -64, Fence Height Zoning Adjustor Decision: Approved for the following reason and subject to the following condition. A. Reason: 1. Because of special circumstances applicable to subject property, namely a double frontage lot with the rear yard exposed to an arterial street, the strict application of the Zoning Ordinance would deprive subject property of rights and privileges enjoyed by other properties in the vicinity and under identical zone classification. Specifically the strict application of the ordinance would deprive subject property of the right to construct a fence adequate for privacy within the rear yard. 2. The granting of the variance, subject to the condition below, will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated. B. Condition: 1. The fence must be setback at least 2 feet from the property line on Evergreen Road. Shrubs or other landscaping must be used outside the fence to remove the blank effect of the fence. C. General Data: 1. Location: Section 27, Township 25 N., Range 44, E.W.M.
