Zoning Adjustor Decision: Approved for the following reasons and subject
to the following condition.
A. Reasons:
1. This proposal, in the opinion of the Zoning Adjustor, is in
technical violation of the ordinance and not the intent thereof.
The intent of the ordinance seems clearly to assure the provision
of adequate off - street loading and parking area. This proposal,
while covering a loading area, will not decrease the ground
area available for loading.
2. The granting of the variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in the vicinity and zone in which subject property is situated.
B. Conditions:
1. The variance permit to cover 47.4 percent of the site area is
granted provided that the east end of the loading area remains
permanently open.
