WASHINGTON IN THE MATTER OF APPROVING THE ) BINDING SITE PLAN FOR BINDING ) R E S O L U T I O N SITE PLAN NO. 7 - TRACT 2 ) WHEREAS, pursuant to the provisions of the Revised Code of Washington Section 36.32.120(6) the Board of County Commissioners of Spokane County has the care of County property and the management of County funds and business; and WHEREAS, pursuant to the provisions of Washington Laws RCW 58.17.020(7) and 58.17.030(4), divisions of land into lots or tracts classified for in- dustrial or commercial use are exempt from the platting requirements when the governing bodies of the city, town or county.has approved the binding site plan for the use of the land in accordance with the local regulations; and WHEREAS, pursuant to the above cited statutory sections," G.G. Schneider and Robert Henry Black submitted an application for a binding site plan in conjunction with a project known as Binding Site Plan #7 — Tract 2; and WHEREAS, the Spokane County Planning Department, upon receipt of the binding site plan, had the same reviewed by agencies having jurisdiction; and WHEREAS, the Spokane County Planning Department recommended to the Board of County Commissioners of Spokane County that pursuant to the provisions of Chapter 43.21C.RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), no SEPA checklist was required of this appli- cation as the official file and comments received indicate no adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the Binding Site Plan; and WHEREAS, the Spokane County Planning Director advised the Board of County Commissioners of Spokane County that all agencies having jurisdiction,who had reviewed Binding Site Plan #7 - Tract 2, had recommended the Board's approval of the same, subject to certain conditions as shown on said Binding Site Plan document. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Spokane County that the Board does hereby approve Binding Site Plan #7 - Tract 2, as submitted by the applicant, and as authorized under Washington Laws, 1981 Chapter 293. BE IT FURTHER RESOLVED by the Board of County Commissioners of Spokane County that in approving Binding Site Plan #7 - Tract 2, the Board of County Commissioners of Spokane County does hereby adopt and make a condition of such approval, the conditions of approval entitled "Conditions" as shown on Binding Site Plan #7 document as amended for Tract 2. BE IT FURTHER RESOLVED that Chairman of the Board of County Commissioners is hereby authorized to sign the Binding Site Plan #7 - Tract 2 Document. BE IT FURTHER RESOLVED by the Board of County Commissioners of Spokane County that in approving said binding site plan, the Board hereby makes the following findings of fact: 1. That pursuant to Washington Laws RCW 58.17.020(7) and 58.17.030(4) as well as RCW 36.17, the Board of County Commissioners of Spokane County has jurisdiction to approve Tract 2 of the Binding Site Plan. 85 0163 Resolution - Binding Site Plan #7 - Tract 2 2. That all agencies in its jurisdiction have recommended that the County Commissioners approve the binding site plan subject to certain con- ditions as shown on said Binding Site Plan #7 as amended and incorporated herein for Tract 2. 3.
