BINDING SITE PLAN No. 9
DECISION
That the "Preliminary Binding Site Plan of Record" is hereby APPROVED by
Spokane County Planning Department, as lead agency, for three (3) years to
November 1, 1987, pursuant to the below conditions.
That divisions of land for sale, lease, or transfer of property within this
Binding Site Plan shall hereinafter be accomplished through the Binding Site
Plan process and is considered "Exempt" from the subdivision provisions of
Spokane County and Washington State subdivision regulations.
All APPEALS of this decision shall be submitted to Spokane County Planning
Department within ten (10) calendar days of this Decision date, being
September 7, 1984.

CONDITIONS
1. That a Binding Site Plan shall be filed for public record with the Spokane
County Auditor, as approved by County Planning Department, prior to
issuing any building permits.
2. That the Binding Site Plan boundary shall be surveyed by a Washington
State licensed surveyor. The surveyed legal description shall be included
in the dedication of said final plan to define the property being "bound"
to the binding site plan process.
3. To initiate the process to record the Binding Site Plan copies of the
"DRAFT" Binding Site Plan (without signatures) will be submitted to
Spokane County Planning Department for coordination and review by all
applicable Departments and agencies. Note: Other materials are also
required.
4. That a current "Certificate of Title" for the binding site plan property
prepared by a Title Company in Washington State shall be provided to
County Planning Department prior to submitting the DRAFT Binding Site
Plan. The certificate shall include the surveyed legal description of the
Binding Site Plan property.
._._,:9 5. That the County Planning Department will assign the "Title" or "Name" for
the Binding Site Plan and each subsequent ownership will be assigned a
"parcel /tract" sequential code as the abbreviated title for the surveyed
legal description of each ownership and said title and ownership codes
will be shown on all plans and maps filed on public record with the County
Auditor.
6. Appropriate utility easements shall be indicated on the Draft of the
Binding Site Plan for distribution by the sponsor /applicant to the utility
companies, County Engineer, and Spokane County Health District. Written
approval of the easements by the utility companies must be received by the
County Planning Department prior to the submittal of the DRAFT Binding
Site Plan. This is to assure overall site easements and utility services
as can be determined prior to review of individual "tract(s) ".
7. The sponsor shall present evidence that the Binding Site Plan lies within
the recorded service area of the water system proposed to serve the
Binding Site Plan. The sponsor shall submit a plan or documentation for
water facilities adequate for domestic use, irrigation use and fire
protection use and said water plan shall be approved by the water
supplier. Said water plan must have been approved by the fire protection

district, the appropriate health authorities and Spokane County Buildings
& Safety Department (Fire Marshal). The health authorities, water
supplier (purveyor), fire protection district, and Spokane County (Fire
Marshal), will certify, prior to the issuance of a building permit, on the
face of said water plan that the plan is in conformance with their
requirements and will adequately satisfy their respective needs. Said
water plan and certification will be drafted on a transparency suitable
for reproduction. Both shall be submitted with the DRAFT Binding Site
Plan.
8. Water service shall be by an existing public water supply when approved by
the Regional Engineer (Spokane), State Department of Social & Health
Services.
Once the Binding Site Plan is filed as public record, all building
permit -site development plans and /or Draft Records -of- Survey shall be
reviewed for compliance with the Binding Site Plan conditions of approval
and all the current County regulations prior to issuing any building
permit. The above review will be initiated through the County Planning
Department and must receive County Planning Department approval before
recording said record -of- survey or any building permit is issued.
10. That all building permit -site development plans and associated
record -of- survey shall be reviewed to.assure:
that the proposal complies with the conditions of approval and
current County regulations and ordinances, and
b. that the proposal assures extension of utilities and access to the
adjacent property (both in and outside of the Binding Site Plan), and
C. that the "remaining portion" (that portion of the Binding Site Plan
not part of said site development plan or said survey) has the
ability to be developed pursuant (a.) and (b.) above.
11. That specific Binding Site Plan dedicatorX language may be added to assure
proper notification /warning to potential 'tract" owner(s) of conditions
and /or requirements associated with the "tract" property.
THAT THE BINDING SITE PLAN DEDICATION SHALL CONTAIN A STATEMENT THAT
REFERENCES THE FOLLOWING CONDITIONS TO BE RECORDED WITH THE AUDITOR IN
CONJUNCTION WITH THIS BINDING SITE PLAN: (Note: do not include the condition
numbers).
12. DEDICATION

13. "Warning ": Spokane County has not reviewed or approved individual
building sites, individual site access, individual drainage, individual
water, individual sewer availability or other individual utility
improvements for any portion of the Binding Site Plan designated as
"parcel ". Spokane County has not determined that future building sites
comply with the Spokane County Zoning Ordinance or other developmental
rules or regulations applicable to site development. Spokane County in
recording the Binding Site Plan makes no guarantees as to the performance
of required improvement. This Binding Site Plan does, however, disclose
to future buyers the conditions and guidelines by which future divisions
of property and building permits shall be subject to. Obligations for
conformance to said reviewing agencies' requirements and conditions
imposed by this Binding Site Plan where not specifically defined by
conditions attached to this Binding Site Plan are not in any case the
responsibility of Spokane County.
NOTE: WASHINGTON LAWS, 1981, Chapter 292, Sec. 2, provides in
material part:
That the binding site plan and all of its requirements shall be
legally enforceable on the purchaser or other person acquiring
ownership of the lot, parcel, tract; AND PROVIDED FURTHER, That sale
or transfer of such lot, parcel or tract in violation of binding site
plan approval, shall be considered a violation of Chapter 58.17 RCW
and shall be restrained by injunctive action and be illegal as
provided in Chapter 58.17 RCW; and ..."
14. That the owner or owners, his heirs, assigns, and successors, of property
within this Binding Site Plan agree to provide necessary easements across
their property for extenpion of utilities and /or vehicular access to
adjacent property (both within and outside the Final Binding Site Plan),
as approved by the County Planning Department.
15. That any division of land for purposes of sale, lease or transfer by the
owner or owners, his heirs, assigns, and successors, of property within
this Binding Site Plan shall, prior to completion of said transfer of
ownership, be reviewed and granted approval by the County Planning
Department Director or his designee, Said approval is to assure
compliance with the condition of approval, the provisions of the County
Binding Site Plan Ordinance, and current applicable local and state
regulations.
16. That any division of land within the Binding Site Plan shall be surveyed
by a Washinton State licensed surveyor and filed for public record prior
to sale, lease or transfer of said division.
NOTE: It is suggested that the sponsor or applicant coordinate and
review the intended survey with Spokane County Planning
Department prior to commencing or completing said survey.
17. That all surveys for division of land within the Binding Site Plan shall
include a "binding" reference to the dedication of Binding Site Plan No. 9
and shall identify the surveyed property as "Tract" - (with the next
sequential alphabetical letter) and identify the remaining portion as
"Parcel" - (with the next sequential numerical number), as approved by the
County Planning Department.
18. That each survey for said division of land shall require the surveyor to
submit to the County Planning Department a current Assessor map showing
the surveyed division and outlining the "remaining portion" in red along
with a written legal description for remaining "Parcel." "Remaining
portion" is that part of the Binding Site Plan that has not been assigned
a "Tract" letter code through previous surveys.
19. That no building permit shall be issued without that property having a
legal description of Binding Site Plan No.9 "Tract" - (number), which
indicates a record -of- survey has been filed for said property.

20. That the provisions and conditions of approval of Board of County
Commissioners Resolution #77 -492 regarding ZE- 89 -76C shall apply until
amended.
21. That the provisions of Spokane County Ordinances that are current at the
time of "Building Permit - Site Development Plan" review shall be
applicable.
22. That all building permits within this Binding Site Plan shall be required
to have lead agency approval from the County Planning Department for the
building permit - "site development plan" compliance with the conditions
of approval and all other applicable County regulations prior to issuing
said permit.
NOTE: It is suggested that the sponsor or applicant coordinate and
preview said plan with the County Planning Department prior to
commencing or completing work on the building permit - "site
development plan."
23. That each building permit - site development plan review shall assure that
the "remaining portion" or Binding Site Plan No. 9 "Parcel" - (letter)
does retain the ability to be developed pursuant the conditions of
approval and current regulations and standards (such as access, utilities,
setbacks, and others).
24. Specific utility locations or easements shall be approved by the utility
company and shall be detgrmined in conjunction with the issuance of a
building permit for construction on any division within the Bionding Site
Plan, prior to issuing a building permit for said site development plan.
25. That prior to the issuance of a building permit, the applicant shall:
a. The sponsor shall improve Flora Road in a manner consistent with
Spokane County typical roadwaz "Section No. 1" minimum paving width
of "Access Standard" for any tract" adjacent Flora Road.
b. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purpose is the
formation of a Road Improvement District (RID) for said improvement
pursuant to RCW 36.88, as amended. Spokane County will not
participate in the cost of these improvements.
C. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. Spokane County will not prticipate in the
cost of these improvements.
d. Submit for approval by the County Engineer and Spokane County Health
District a detailed combined on -site sewage system plan and surface
water disposal plan for each "tract ".
e. Submit a parking and traffic circulation plan to the Spokane County
Engineer for review and approval. The design, location and
arrangement of parking stalls shall be in accordance with standard
traffic engineering practices. Paving or surfacing, as approved by
the County Engineer, will be required for any portion of the project
which is to be occupied or travelled by vehicles.
f. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Construction,
and other applicable county standards and or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at
the date of construction, unless otherwise approved by the County
Engineer.

25. g. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
Resolution No. 80 -1592 as amended.
h. That private road maintenance and access agreement(s) shall be
required and filed for public record with the County Auditor when
vehicular access across adjacent property is required, prior to
issuing a building permit.
i. That access permits are required for driveway approaches to the
County Road System shall be obtained from Spokane County Engineers.
26. The word "applicant" shall include the owner(s) of the property, his
heirs, assigns, and successors.
27. That the applicant must comply with roadway standards, typical roadway
sections and drainage plan requirements that are found in Spokane County
Road Standards 1981 and Spokane Copunty Guidelines for Stormwater
Management , either as amended.
28. That the owner or owners, his heirs, assigns, and successors, of any
"Tract" within this Binding Site Plan is responsible for installing any
water system and fire protection devices pursuant the Binding Site Plan
approved "Water Plan" prior to issuance of any building permit, unless
other separate contracts) / agreement(s) have assigned that responsibility
to another party. Spokane County will not be responsible for installing
such improvements.
29. That prior, to issuing a building permit evidence shall be submitted by the
building permit applicant to the County Planning Department that fire
protection and domestic water is available to serve and protect the
individual "Tract" and its improvements, which includes approval from the
water district /purveyor, the Fire District and the County Building &
Safety Department (Fire Marshal) and appropriate health authorities.
30. Approval of emergency vehicle access shall be required by the Spokane
County Building & Safety Department (Fire Marshal) and applicable Fire
District prior to issuance of a building permit.
31. That landscaping and /or screening will be required adjacent Flora Road
right -of -way as approved by Spokane County Planning Department and as
determined through proposed building permit site plan review, where the
purpose of said improvements is to assure permanent aesthetic improvements
necessary to prevent "unsightly view" from said road with the intent of
maintaining "pleasing aesthetic view from the road." That any adjacent
tract of the Binding Site Plan will be required to have made said
improvements in conjunction with issuance of a building permit or required
to bond for said improvements.
32. The applicant shall provide a performance bond to cover the cost of the
required landscaping and /or screening prior to release of building permits.
33. "That subject property shall be lighted in a manner which will not produce
undue glare on adjoining residential properties, and onto County roadways."
34. Pursuant to the Board of County Commissioners Resolution No. 80 -0418, the
use of on -site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District. Subject to amended section 10.1.156 of Spokane County
Generalized Comprehensive Plan (Res. 83 -0421) and any future amendments.

35. The owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of a ULID by petition
method pursuant to RCW 36.94 which the petition includes the Owner(s)
property and further not to object by the signing of a protest petition
against the formation of a ULID by resolution method pursuant to RCW
Chapter 36.94 which includes the Onwer(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from objection
to any assessment(s) on the property as a result of improvements called
for in conjunction with the formation of a ULID by either petition or
resolution method under RCW Chapter 36.94.
36. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
37. Each structure with sewer facilities shall be double plumbed for
connection to future area -wide collections systems.
38. "Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individual on -site sewage system may be
authorized.
39. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
40. That all building permit - site development plans shall be part of the
Binding Site Plan. Any further changes to the improvements of the site
development of said plan must comply with the Spokane County Binding Site
Plan Ordinance and its approval review process. Any such changes without
said compliance shall constitute a violation of RCW 58.17.
41. The use of private wells and private water systems are prohibited.
42. That prior to recording any "tract ", the sponsor /applicant shall
demonstrate to the satisfaction of the Spokane County Health District that
suitable sites for on -site sewage disposal systems are available on the
"tract ".

WHEREAS, pursuant to the provisions of the Revised Code of Washington
Section 36.32.120(6) the Board of County Commissioners of Spokane County has
the care of County property and the management of County funds and business;
and
WHEREAS, pursuant to the provisions of Washington Laws RCW 58.17.020(7)
and 58.17.030(4), divisions of land into lots or tracts classified for
industrial or commercial use are exempt from the platting requirements when
the governing bodies of the city, town or county has approved the binding site
plan for the use of the land in accordance with the local regulations; and
WHEREAS, pursuant to the above cited statutory sections, Ed Schimmels
submitted an application for a binding site plan in conjunction with a project
known as Binding Site Plan #9 - Tract A, and
WHEREAS, the Spokane County Planning Department, upon receipt of the
binding site plan, had the same reviewed by agencies having jurisdiction; and
WHEREAS, the Spokane County Planning Department recommended to the Board
of County Commissioners of Spokane County that pursuant to the provisions of.
Chapter 43.21C RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County
Environmental Ordinance (SCEO), no SEPA checklist was required of this.
application as the official file and comments received indicate no adverse
impacts to the physical environment; a finding is hereby made that no
potentially significant adverse impacts upon the physical environment are
anticipated as a result of the Binding Site Plan; and
WHEREAS, the Spokane County Planning Director advised the Board of County
Commissioners of Spokane County that all agencies having jurisdiction who had
reviewed Binding Site Plan #9 - Tract A had recommended the Board's approval
of the same subject to certain conditions as shown on said Binding Site Plan
conditions and dedication.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Spokane County that the Board does hereby approve Binding Site Plan #9 = Tract
A, as submitted by the applicant, and as authorized under Washington Laws,
1981, Chapter 293.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Spokane
County that in approving Binding Site Plan #9 - Tract A, the Board of County
Commissioners of Sokane County does hereby adopt and make a condition of such
approval, the conditions as shown on Binding Site Plan #9 and the requirements
of the Spokane County Health District.
BE IT FURTHER RESOLVED that Chairman of the Board of County Commissioners
is hereby authorized to sign the Binding Site Plan #9 document.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Spokane
County that in approving said binding site plan, the Board hereby makes the
following findings of fact:
1. That pursuant to Washington Laws RCW 58.17.020(7) and 58.17.030(4) as
well as RCW 36.17, the Board of County Commissioners of Spokane
County had jurisdiction to approve said Tract A of the Binding Site
Plan
2. That all.agencies in its jurisdiction have recommended that the
County Commissioners approve said binding site plan subject to
certain conditions which conditions are shown on said Binding Site
Plan #9 and requirements of the Spokane County Health District.
