BSP -15 -86 ) CONCLUSION AND DECISION THIS MATTER, an application from Max Spalding has been received and decided upon, pursuant to Spokane County Binding Site Plan policies and R.C.W. 58.17.020 (7) on the 1st day of July, 1986. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. FINDINGS OF FACT AND CONCLUSION 1; The proposal is to divide approximately 21.2 acres into 18 lots for the development of industrial sites: 2: The proposal is located north of and adjacent to Montgomery Drive and west of and adjacent to Woodruff Road in Section 8, Township 25N, Range 44 E.W.M., Spokane County, Washington. 3: The current zoning of the property is Restricted Industrial. The proposed lot sizes, frontage and intended uses are allowed within this zone. 4. The Spokane County Comprehensive Plan designates this area as Industrial. The density and uses proposed are in accord with this planning category. 5. That in consideration of the recommended conditions and Spokane County development standards, the proposal is not detrimental to the public health, safety and general welfare. 6. That the project is not exempt from environmental review under the State Environmental Policy Act. (A Declaraton of Non - Significance was issued on June 3, 1986 and circulated to 4 agencies for review and comment. There has not been a recommendation for a more detailed environmental review)— — 7. That individual review of building locations and other requirements will be established when building permits are sought for on the individual lots. DECISION Based upon the above noted Findings of Fact, Short Plat Application BSP -15 -86 is hereby APPROVED subject to conditions which shall be complied with by the applicant and /or sponsor prior to finalization. DATED THIS � DAY OF 1986. Spokane Coy Subdivision Administrator :y CONDITIONS OF APPROVAL FOR BSP -15 -86 PLANNING DEPARTMENT 1. That the preliminary Binding Site Plan be given conditional approval to July 1, 1989. The Subdivision Administrator may administratively approve a request for a one year extension of time if the sponsor submits a written request forty -five (45) days prior to the above expiration date. A request for an Extension of Time may subject the proposal to new conditions required by reviewing agencies. 2. That the Binding Site Plan be designed as indicated on the preliminary drawing of record and /or attached sheets as noted. 3. That the binding site plan provide for right -of -way width for streets as indicated on the preliminary Binding Site Plan of record. 4. That appropriate street names be indicated. 5. That appropriate utility easements be indicated on copies of the approved binding site plan for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final binding site plan. 6. That a certificate of title be furnished the Planning Department prior to the filing of the final binding site plan. 7. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of County Commissioners Resolution #77 -1392 be accomplished by the project applicant within thirty (30) days of formal action by the Administrator on or before the filing of the final binding site plan, as instructed by the Planning Department. 8. That a survey be required prior to the filing of a final Binding Site Plan. 9. That individual parking, landscaping and other site improvements required by the Spokane County Zoning regulations will be established when development requests are made for the individual lots. 10. That a plan for water facilities adequate for domestic service and fire protection be approved by the water supplier, fire protection district, Spokane County Building & Safety Department and County health authorities. The agencies will certify on the WATER PLAN, prior to the filing of the final Binding Site Plan or any phase that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements and schedule of improvements have been made with the sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule will provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final binding site plan. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the sponsor to satisfactorily complete the approved water system. The sponsor shall also sign the WATER PLAN to confirm the contractual arrangements or agreements. The final binding site plan dedication will contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this binding site plan, and the sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." Conditions of Approval for BSP -15 -86 (Cont'd) County Planning Department (Cont'd) 11. That no building permit will be issued for any lot within the Binding Site Plan until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the Binding Site Plan ", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of the WATER PLAN as a schematic map showing the "As Built" water system. SPOKANE COUNTY ENGINEER DEPARTMENT 1. Applicant shall deed to Spokane County suffient right -of -way so as to permit the construction of the cul -de -sac turn around depicted on the preliminary plan at the terminus of Locust Road. Applicant shall also deed a 20 ft. radius at Montgomery and Woodruff. 2. That plans, profiles, and cross - sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat. That road and drainage plans shall be submitted for review and approval by the County Engineer for the roadway improvements which have been specified for Montgomery Drive, Woodruff Road and Locust Road and the proposed private road. 5. That the private road as depicted on the preliminary site plan is approved by the County Engineer. It shall be designated as a "Tract X" future public right -of -way tract. 6. That the following statement be placed on the face of the Binding Site Plan: WARNING:Spokane County has no responsibility to build, improve, maintain, or otherwise service the private roads contained within or providing service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns including the obligation to participate in the maintenance of the private road as provided herein. 7. That the applicant shall provide to Spokane County a surety acceptable to the County Engineer which warranties the construction of the specified roadway improvements. The following conditions must be complied with prior to the release of a building permit for any lot or portion of a lot contained within the Binding Site Plan: 1. That the improvements for the private road shall at a minimum consist of a paved strip 24 ft. in width which is designed to accommodate the truck traffic normally associated with industrial areas. 2. The County Engineer has designated typical roadway section number one, access standard for the improvement of Woodruff Road which is adjacent to the Binding Site Plan. This will require the addition of approximately 10 ft.+ of asphalt and the installation of curb and sidewalk along the Frontages on Woodruff. Conditions of Approval for BSP -15 -86 (Cont'd) County Engineer (Cont'd) 3. The County Engineer has designated typical roadway section number one, access standard for Locust Road which is adjacent to the Binding Site Plan: This will require the addition of approximately 30 ft. + of asphalt and the installation of curb and sidewalk along the frontages on Locust. 4. The County Engineer has designated typical roadway section number one, major arterial standard for the improvement of Montgomery Avenue which is adjacent to the Binding Site Plan. This will require the addition of approximately 6 to 10 ft. + of asphalt and the installation of curb and sidewalk along the frontages on Montgomery. 5: The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. COUNTY HEALTH DISTRICT l: The final Binding Site Plan shall be designed as indicated on the preliminary plan of record and /or any attached sheets as noted. 2. The dedicatory language of the plat will state that: "Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on -site sewage systems may be authorized." 3: Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. 5. Prior to filing the final plat, the sponsor shall present evidence that the site lies within the recorded service area of the water system proposed to serve the site. The dedicatory language on the binding site plan shall state: "Use of private wells and water systems is prohibited." 6. The binding site dedication will contain a statement to the effect that: "The public water system as approved by County and State health authorities and the local fire district and purveyor will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract." 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that suitable sites for on -site sewage disposal systems is available on all tracts. COUNTY UTILITIES 1 Pursuant to the Board of County Commissioners Resolution No.80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific applicaton approval and issuance of permits by the Health District. The dedication shall state: "The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objection to any assessment(s) on the the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. The dedication shall state: "Each dwelling unit shall be double plumbed for connection to future area -wide collection systems." 5. A dry sewer connection to the future area -wide Sewerage System is to be constructed to serve proposed Lots 5 through 13. Plans and specifications for the dry sewer connection are to be reviewed and approved by the Utilities Department prior to construction. APPROVED THIS DAY OF 1986. BSP -15 -86 ) CONCLUSION AND DECISION THIS MATTER, an application from Max Spalding has been received and decided upon, pursuant to Spokane County Binding Site Plan policies and R.C.N. 58.11:020 (7) on the 1st day of July, 1986. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. FINDINGS OF FACT AND CONCLUSION 1. The proposal is to divide approximately 21.2 acres into 18 lots for the development of industrial sites. 2. The proposal is located north of and adjacent to Montgomery Drive and west of and adjacent to Woodruff Road in Section 8, Township 25N, Range 44 E.W.M., Spokane County; Washington. 3. The current zoning of the property is Restricted Industrial. The proposed lot sizes, frontage and intended uses are allowed within this zone. 4. The Spokane County Comprehensive Plan designates this area as Industrial. The density and uses proposed are in accord with this planning category. 5. That in consideration of the recommended conditions and Spokane County development standards, the proposal is not detrimental to the public health, safety and general welfare. 6. That the project is not exempt from environmental review under the State Environmental Policy Act. (A Declaraton of Non - Significance was issued on June 3, 1986 and circulated to 4 agencies for review and comment. There has not been a recommendation for a more detailed environmental review)— — 7. That the preliminary Binding Site Plan be given conditional approval to July 1, 1989. The Subdivision Administrator may administratively approve a request for a one year extension of time if the sponsor submits a written request forty -five (45) days prior to the above expiration date. A request for an Extension of Time may subject the proposal to new conditions required by reviewing agencies. 2. That the Binding Site Plan be designed as indicated on the preliminary drawing of record and /or attached sheets as noted. 3. That the binding site plan provide for right -of -way width for streets as indicated on the preliminary Binding Site Plan of record. 4. That appropriate street names be indicated. 5. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of County Commissioners Resolution #77 -1392 be accomplished by the project applicant within thirty (30) days of formal action by the Administrator on or before the filing of the final binding site plan, as instructed by the Planning Department. 8. That a survey be required prior to the filing of a final Binding Site Plan. 9. That individual parking, landscaping and other site improvements required by the Spokane County Zoning regulations will be established when development requests are made for the individual lots. 10. That a plan for'water facilities adequate for domestic service and fire protection be approved by the water supplier, fire protection district, Spokane County Building 8 Safety Department and County health authorities. The agencies will certify on the WATER PLAN, prior to the filing of the final Binding Site Plan or any phase that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements and schedule of improvements have been made with the sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule will provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final binding site plan. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the sponsor to satisfactorily complete the approved water system. The sponsor shall also sign the WATER PLAN to confirm the contractual arrangements or agreements. The final binding site plan dedication will contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building 8 Safety Department, and water purveyor, will be installed within this binding site plan, and the sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." Conditions of Approval for BSP -15 -86 (Cont'd) County Planning Department (Cont'd) 11; That no building permit will be issued for any lot within the Binding Site Plan until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the Binding Site Plan ", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of the WATER PLAN as a schematic map showing the "As Built" water system. SPOKANE COUNTY ENGINEER DEPARTMENT 1. Applicant shall deed to Spokane County suffient right -of -way so as to permit the construction of the cul -de -sac turn around depicted on the preliminary plan at the terminus of Locust Road. Applicant shall also deed a 20 ft. radius at Montgomery and Woodruff. 2. That plans, profiles, and cross - sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3; That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat. C That road and drainage plans shall be submitted for review and approval by the County Engineer for the roadway improvements which have been specified for Montgomery Drive, Woodruff Road and Locust Road and the proposed private road. 5. That the private road as depicted on the preliminary site plan is approved by the County Engineer. It shall be designated as a "Tract V future public right -of -way tract. 6. That the following statement be placed on the face of the Binding Site Plan: WARNING:Spokane County has no responsibility to build, improve, maintain, or otherwise service the private roads contained within or providing service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns including the obligation to participate in the maintenance of the private road as provided herein. 7: That the applicant shall provide to Spokane County a surety acceptable to the County Engineer which warranties the construction of the specified roadway improvements. The following conditions must be complied with prior to the release of a building permit for any lot or portion of a lot contained within the Binding Site Plan: 1. That the improvements for the private road shall at a minimum consist of a paved strip 24 ft. in width which is designed to accommodate the truck traffic normally associated with industrial areas. 2. The County Engineer has designated typical roadway section number one, access standard for the improvement of Woodruff Road which is adjacent to the Binding Site Plan. This will require the addition of approximately 10 ft.+ of asphalt and the installation of curb and sidewalk along the frontages on Woodruff. Conditions of Approval for BSP -15 -86 (Cont'd) County Engineer (Cont'd) 3: The County Engineer has designated typical roadway section number one, access standard for Locust Road which is adjacent to the Binding Site Plan: This will require the addition of approximately 30 ft. + of asphalt and the installation of curb and sidewalk along the frontages on Locust: 4: The County Engineer has designated typical roadway section number one, major arterial standard for the improvement of Montgomery Avenue which is adjacent to the Binding Site Plan. This will require the addition of approximately 6 to 10 ft: + of asphalt and the installation of curb and sidewalk along the frontages on Montgomery: 5. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended; which establishes regulations for roads, approaches, drainage and fees in new construction. COUNTY HEALTH DISTRICT I. The final Binding Site Plan shall be designed as indicated on the preliminary plan of record and /or any attached sheets as noted. 2: The dedicatory language of the plat will state that: "Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on -site sewage systems may be authorized." 3: Water service shall be coordinated through the Director of Utilities, Spokane County. 4. K. MacDonald, R. E. Hutchinson and A. E. Jamison and the :;odern Irrigation and Land Company, recorded in Book "E" of Contracts, page 267, in the office of the Spokane County Auditor. Said agreement is hereby amended so as to include the lands herein described. Each and every covenant, obligation, condition and benefit set forth in said November 4, 1905, agreement shall apply to said lands herein described in the same manner as the same now apply to other lands which are covered by said agreement and which hold stock in the Company, to the same extent as those said lands herein described were described in said November 4, 1905, agreement. Accordingly, said lands herein described, and First Party as the owner thereof, shall have all of the rights and privileges provided for in said agreement of Novenher 4, 1905, and shall be subject to all of the covenants, easements, liens, obligations and conditions reserved in said agreement for the benefit of Modern Electric Hater Company; and First Party does hereby consent to his said lands being subject to all of said covenants, easements, liens, obligations and conditions reserved for the benefit of Modern Electric 'later Company, to the same extent and in the same manner as though said lands herein described had been described in said November 4, 1905, agreement. 2. That the following described lands situated in the County of Spokane, State of ifashington, to -wit: Party is the owner of various tracts of land, the specific descriptions of which are set forth in paragraph 1 of this agreeme. ^.t. Said agreement is hereby amended so as to include the lands herein described. Each and every covenant, obligation, - condition and benefit set forth in said November 4, 1905, agreement shall appl to said lands herein described in the same manner as the same now apply to other lands which are covered by said agreement and which hold stock in the Company, to the same extent as those said lands herein described were described in said November 4, 1905, agreement. Accordingly, said lands herein described, and First Party as the owner thereof, shall have all of the rights and privileges provided for in said agreement of November 4, 1905, and shall be subject to all of the covenants, easements, liens, obligations and conditions reserved in said agreement for the benefit of Modern Electric {later Company; and First Party does hereby consent to his said lands being subject to all of said covenants, easements, liens, obligations and conditions reserved for the benefit of Modern Electric 'later Company, to the same extent and in the same manner as though said lands herein described had been described in said November 4, 1905, agreement. 2. Said lands herein described contain 20.5 acres, more or less, and the Company shall provide on its records that First Party is the owner of stock in the Company appurtenant to the lands herein described, on the basis of one share of stock per acre of land, or 20.5 shares of stock for said lands herein described. . 3. First Party hereby warrants that he is the owner of said lands herein described free and clear of encumbrance and that he is authorized to enter into this agreement subjecting said lands to the obligations of said November 4, 1905, agreement. •2- .l 4. It is agreed by First Party that the Company shall have no obligation to extend at its expense its water distribution facilities for the purpose or Pruv iding water service to said lands herein described. The Company has existing mains adjacent to some of said lands, and 311 connections to or extensions of said mains, or installations of Pipelines through said lands, for the purpose of providing water service to or within said lands herein described shall be at the sole expense of First Party and in accordance with the terms and provisions of said Agreement of November 4, 1905, and the rules and regulations and general operating procedures of the Company, including being subject to connection fees. First Party agrees to comply with all of said rules and regulations and general operating policies and to pay all connection fees and other costs of connection required for water service to said lands. Likewise it is agreed that the Company shall have no obligation to extend at its expense its electric distribution facilities to serve any of First Party's lands, except to the extent the parties may agree in a separate agreement. S. As part of their subjecting said lands to all obligations of the November 4, 1905 agreement, First Party agrees to pay electric and water charges for said lands at the Company's usual rates. First Party acknowledges that said lands shall not be entitled to irrigation water service except such as may be taken under pressure through the pipeline distribution system. It is contemplated that all water service to said lands will be metered and paid for by First Party in accordance with the Company's domestic water rate schedule, but First Party acknowledges that the Company has the right under said November 4, 1905, agreement to assess said lands for irrigation service on an acreage basis notwithstanding that the water service to said lands shall be limited to that provided through the pressure system. 6. First Party by execution of this agreenent does hereby grant unto the Company such casements across the above - described lands as the Company may consider necessary for the installation of Company facilities to provide water and electric service to said lands and any part thereof, it being understood, however, that in the installation of any facilities to be installed by the Company there shall be no interference with improvements placed on said lands by First Party. 7. All expenses of the Company in connection with the execution and preparation of this agreement and the recording thereof in the office of the Spokane County Auditor shall be paid by First Party. -3- 48U r,.cE 3 "3 S. The traf- fic impact of this development upon adjoining County streets is such that the roadway improvements specified herein are necessary. These improvements will reduce traffic congestion along Montgomery Drive and accommodate increased traffic flows on Woodruff Road and Locust Road. The following conditions must be complied with prior to the recording of the bind- ing Site Plan: 1. Applicant shall deed to Spokane County sufficient right -of -way so as to permit the construction of the cul -de -sac turn around depicted on the preliminary plan at the terminus of Locust Road. Applicant shall also deed a 20 foot radius at Montgomery and Woodruff. 2. That plans, profiles and cross sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to filing of the Binding Site Plan; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. That drainage plans and design calculations showing the alignment of drainage fa- cilities be submitted to the County Engineer for approval prior to construction and /or the filing of the Binding Site Plan. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. That road and drainage plans shall be submitted for review and approval by the County Engineer for the roadway improvements which have been specified for Montgom- ery Drive, Woodruff Road and Locust Road and the proposed private road. 5. That the private road as depicted on the preliminary site plan is approved by the County Engineer. It shall be designated as a "Tract X" future public right -of -way tract. 6. That the following statement be placed on the face of the Binding Site Plan: WARNING: Spokane County has no responsibility to build, improve, maintain or otherwise service the private roads contained within or providing service to the property described in this Binding Site Plan. By accepting this Binding Site Plan or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or na- ture whatsoever to establish, examine, survey, construct, alter, repair, im- prove, maintain, provide drainage or snow removal on a private road.
