Dennis M. Scott, P.E., Director
February 26, 1996
Mr. Richard Rollnick, President
Pentzer Development Corporation
North 3808 Sullivan Road
Spokane, WA 99216 -1670
Re: Spokane Business & Industrial Parks
Dear Mr. Rollnick:
Pursuant to your request for a status report from the County to Pentzer, I asked staff to
advise me of any outstanding items that may still need to be addressed prior to total
approval on issues affecting the park.
Any issues related to our sewer agreement will be handled as a separate issue and as
a matter of fact is being addressed as an amendment at the Board of County
Commissioners meeting being held this evening.
It is our understanding that Pentzer is in the final process of consummating an
agreement with Crown West Realty, L.L.C. for their purchase of the above referenced
property. We also understand that if there are any outstanding issues, your intent is to
know what they might be so you can share these with Crown West Realty, L.L.C.
As you know, any Binding Site Plan could be referred to as a "living Document"
in that as each development occurs there may be conditions that would need to be met
that are not a requirement at this time. The intent of this letter is to identify items that
have been constructed but still need to have some effort to allow them to be accepted.
The work items that appear to be left affect three of the Binding Site Plans. They are
as follows:
BSP 17
1. Construct concrete wheelchair ramps at all intersections for pathway per plans (note
6 on 15/15).
W. 1026 Broadway Ave. Spokane, WA 99260-0170 (509) 156.3600 FAX: (509) 456 -4715 TDD: (509) 324.3166
2. Ponds on Euclid needs definition and finish shape of design length, width, depth
and berms per plans.
3. Adjust drywell frame and grate for 6" pond depth.
4. Remove sod at curb drops to provide proper flow into swales and ponds.
5. Shoulder, pathway and slope have not been constructed per plans, at Euclid and
Sullivan on the right side.
BSP 21
1. Construct Spokane County Specification wheelchair ramps at the intersections for
pathway per plans (note 6 on 15/15).
2. Remove sod at curb drops to provide proper flow into swales and ponds.
BSP 22
1. Construct concrete wheelchair ramps at all intersections for pathway per plans (note
6 on 15/15).
2. Ponds on Sullivan needs definition and finish shape of design length, width, depth
and berms per plans.
3. Clean debris form G.I. and drywells on Sullivan (2 G.I.'s and D.W. @
Fairview /Sullivan and G.I. and D.W. @ Euclid/Sullivan).
4. Adjust drywell frame and grate for 6" pond depth.
5. Remove sod at curb drops to provide proper flow into swales and ponds.
Although this list appears long, some of the items are currently being worked on. There
is also a bond in the amount of $177,500 that needs to be addressed with the property
transfer. When the above items have been completed, by either Pentzer Development
Corporation or Crown West Realty, L.L.C., the County Engineer can certify to the Board
of County Commissioners that all work has been completed on the above referenced
Binding Site Plans and that the roads can be accepted.
Very Truly Yours,
Dennis M. Scott, P.E.

FAX TRANSMITTAL
Date: February 27, 1996
Message consists of 6 page(s) including cover sheet
This fax is in regard to the Plat Punchlist received for the referenced project Following as
referenced by BSP and Item number are our response to the items:
BSP 17
1 Concur, it appears that there are 20 existing asphalt ramps which need to be replace with
concrete ramps.
2. Ponds on Euclid will require some shaping and work based on recommendations your
office should be receiving at the end of the week This item appears to be 65% complete.
3. The 208 requirements are address in the items above. If the inspector is referring to
continuous swales, they are not being used. There may be some areas where drainage is to
be graded from a curb cut to the swale but that would be minimal.
4. Frame and grates will be adjusted as necessary based on the record drawings submitted
and approved by the county.
5. This item appears to be maintenance, however it can be done.
6. Shoulder and sideslope appear to be 2:1 in the field as called out on the plans. In regard
to the pathway, there is existing asphalt surfacing all along the right side of the road, and,
if necessary, a piece approximately 20' long could be installed to connect this area to the
Sullivan pathway.
8.This area is across the frontage of Northwest Culvert and they strongly requested that
this be deleted across their frontage and also it does not appear that there is adequate space
for the pathway.
BSP 22
1. See item 1 above.
2. The ponds ar e shown on the record drawings that were submitted, reviewed and
approved by Spokane County. The only item requiring revisions were 2 or 3 frame and
grates adjusted up.

4. This appears to be a maintenance item.
5. Current plans show constructing the swale from back of curb as was done in the field.
6. It is our understanding that this requires adjusting the drywell frame & grate at Sta.
I4 +75 to 6" above adjacent grade.
7. Appears to be a maintenance item,

A DIVISION OF THE PUBLIC WORKS DEPARTMENT
Dennis M. Stott, P.E., Director
December 23, 1991
We received your letter of December 2, 1991 stating the
reasons why you believe Pentzer Development Corporation should
not be required to extend surety for roadway and drainage
improvements in BSP 17 and BSP 21. I now have had time to
discuss this matter with the Spokane County Engineer.
We do not agree with all items in your letter, however we
have reduced the required surety for all items connected with
the two traffic signal systems and the related paving work. It
is the position of the Spokane County Engineers Office that the
unfinished required improvements not delayed by the signal
construction need to be covered by the surety until such time as
those items are completed. The updated reduced amount of surety
still required would be $80,000.00. This figure is based on the
work remaining to be completed on the railroad crossing on
Euclid Road, the remaining '208' drainage swale construction and
some final adjustments to some of the drywells.
Should you wish to post a

SPOKANE INDUSTRIAL PARK
December 2, 1991
Mr. Jerry Sims
Spokane County Engineers
Plat Inspector
N. 81.1 Jefferson
Spokane, OVA 99260 -0180
RE: Letter of November 5th, 1991
Dear Mr. Sims:
DEVELOPMENT
CORPORATION
A WASMXM WATER MWEe Co.~
N. 3808 Sullivan Road Phone. (509) 924 -112(.
Spokane, WA 992161670 FAX: (509) 9243748
Spokane Industrial Park is in receipt of your letter of November 5th, 1991, addressed to
Seattle First National Bank requesting issuance.of an irrevocable standby letter of credit in
the value of $153,000.00, to remain in effect until such time as all road and drainage
improvements at Spokane Industrial Park under two binding site plans are completed. I
have now.had the opportunity to discuss.this issue with corporate management.
It is the position of Pentzer Development Corporation that all road and drainage
improvements required under the two referenced binding site plans would have been
completed prior to November 1991, had it not been for construction - related delays caused
by representatives of the Spokane County Engineers office.
As you are aware, the Spokane County Engineer's office maintained exclusive control over
the installation of a new traffic signal at Marietta Avenue and Sullivan Road, and the
installation of an improved traffic signal at the intersection of Euclid Avenue and Sullivan
Road. Your office was responsible for designing the necessary specifications, bidding the
project, and supervising work performed by the contractor selected by department
representatives. Pentzer Development Corporation had no control over either project, but
was required to pay whatever costs department representatives verified were payabla to
achieve installation of the two lights.
Due to our lack of control over this part of the construction process, two civil engineers and
I met with representatives of your department to discuss time frames with your office on
May 17th, 1991. During this meeting your representatives verified that the contract for
installation of the Marietta Avenue traffic signal had been awarded to Rod's Electric, and
that the installation would be complete no later than June 20th, 1991.
Your representatives further indicated that work would begin immediately on design
specifications for the improved traffic signal at the intersection of Euclid Avenue and
Sullivan Road, and that the project would be bid out and completed at some point in August
1991.
MANACCD8Y)ULAREANAppop('p '.'i4 PRIN!(D pN R(CYG:Fp PAPJR
Based upon time frames provided to me during this meeting, our contractor, Inland Paving
Company, scheduled certain road improvements to coincide with installation of the traffic
signals. Specifically, Inland Paving representatives verified that final paving of the truck
turnout lane along Sullivan Road between Marietta and Euclid Avenues, together with
paving at both intersections, could not be completed until after both signals were installed.
Subsequent to the meeting, your contractor, Rod's Electric, did not complete installation of
the Marietta Avenue traffic signal until sometime in September 1991. In addition,
engineering department representatives delayed completion of the Euclid Avenue traffic
signal specifications by at least six weeks, preventing subsequent bidding and acceptance
of a contractor until mid- September 1991. Colvico was selected as the low bidder by your
department, and a meeting was scheduled with representatives of Taylor Engineering,
Colvico, your department, Inland Paving Company and I on September 19th; 1991.
During that meeting, I was forced to agree to pay overtime wages to your contractor,
Colvico, in an effort to secure completion of the Euclid Avenue traffic signal improvements
by October 23rd, 1991, in the hope that Inland Paving would still be able to complete
installation of road.surtace and pathways prior to batch plant closing in November. in fact,
I have now received an invoice with letter from Bob Brueggeman dated November 18th,
1991, in the value of $3,255.92 for overtime services performed by Colvico, Inc.
It is the position of my company that; had County Engineering representatives secured
completion of traffic installation services in a timely manner, SIP contractor, Inland Paving
Company, could have completed the road improvements during this construction season,
thereby eliminating the necessity for any form or irrevocable letter of credit. While the
commitment was made to pay for Colvico overtime costs, my company does not wish to
pay the cost of securing an irrevocable letter of credit in the value of $153,000.00 for an
additional one -year period. In addition to overtime charges, SIP may be forced to pay
interest on the unpaid portion of the construction agreement to Inland Paving Company.
While the precise value at issue has not yet been determined, I can assure you that the cost
to my company would be substantial.
While Pentzer Development Corporation does not intend to take out the irrevocable letter of
credit, I can verify that Inland Paving Company remains under contract for remaining
services which are the subject of the letter of credit, and, as a licensed and bonded
contractor, should provide the county with a sufficient guarantee that services will be
performed as required under the binding site plans.
Mr. Sims, I would appreciate your concurrence with my company's position on this issue
via written communication at your earliest convenience. Please do not hesitate to contact
me with any additional questions a, eurnmenis cor_cernir,o this.issue. 1.
Sincerely,
SPOKANE INDUSTRIAL PARK

Re: Spokane Industrial Park - 208 swales along Euclid Avenue
Dear Scott:
As requested, survey shots were taken for the reference project. Attached are the results of that
survey. The swales, in general, appear acceptable with the exception of the Swale located in
front of Yellow Freight. Please see the attached information for further information.
Spokane County is the governing agency which determines final acceptance. Therefore we are
forwarding a copy of this information to their office for their review.
Sincerely,
