BSP-17-87 #1B_ 4 BEFORE THE SPOKANE COUNTY SUBDIVISION ADMINISTRATOR IN THE MATTER OF BINDING ) FINDINGS OF FACT, SITE PLAN NO. BSP -87 -17 ) CONCLUSION AND DECISION THIS MATTER, an application from Spokane Industrial Park has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the 5th day of May, 1988. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. FINDINGS OF FACT AND CONCLUSION 1 . The proposal is to divide 160 acres Into 46 lots for the development of industrial lots. 2. The proposal is located in the north half of Section 12, Township 25 North, Range 44 E.W.M., Spokane County, Washington, lying north of the railroad between Sullivan and Flora Roads. 3. The current zoning of the property Is Manufacturing, established in 1960. The proposed lot sizes, frontage and Intended uses are allowed within this zone. 4. The Spokane County Comprehensive Plan designates this area as Industrial. The lots and uses proposed are generally in accord with this planning category. 5. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and asked for recommendations. 6. There was a recommendation for a more detailed environmental review from the Spokane County Engineers. The sponsor and the Spokane County Engineers have agreed upon necessary road Improvements and, phasing of development to mitigate potential Improvements and phasing of development to mitigate potential adverse traffic Impacts. A mitigated Determination of Nonsignificance is substituted for the original D.N.S.. The mitigating measures recommended by the Spokane County Engineer's have been agreed upon by the sponsor to generally reduce anticipated traffic Impacts of the proposal. That in consideration of the recommended conditions and Spokane County development standards, the proposal Is not detrimental to the public health, safety and general welfare. That the project is proposed to have phased development in three stages with necessary Improvements constructed to meet the needs of each phase. Such phasing is consistant with subdivision practices. That the provisions of the Manufacturing Zone and other sections of the Spokane County Zoning Ordinance apply to the use of the individual lots. DECISION Based upon the above noted Findings of Fact, Binding Site Plan Application BSP- 87-17 is hereby APPROVED subject to conditions noted below which shall be complied. with by the applicant and/or sponsor prior to finalization of the binding site plan. PLANNING DEPARTMENT CONDITIONS: 1 . The preliminary binding site plat of record approval is for the property legally described in the application for this proposal. 2. That the Final Binding Site Plan be designed substantially in conformance with the preliminary binding site plat of record as legally described and advertised. No Increase of lot number shall occur without a new application submittal and approval. 3. The Spokane County Subdivision Administrator shall review any proposed Final Binding Site Plan to Insure compliance with the Findings and Conditions of Approval. 4. That the preliminary binding site plan be given conditional approval for three (3) years to June 1, 1991. The applicant may request an Extension of Time by submitting a written request forty -five (45) days prior to the above expiration date. 5. That a Final Binding Site Plan number be indicated before the final binding site plan is filed; such number to be approved by the County Planning Director /Designee. 6. That appropriate road names be Indicated on the binding site plan. 7. That appropriate utility easements be indicated on copies of the proposed final binding site plan. Written approval of said utility easements by said utility companies must be received with the submittal of the final binding site plan. 8. That 3 current certificates of title be furnished the County Planning Department prior to filing the final binding site plan. 9. That the following statement be placed in the final binding site plan dedication: "No more than one primary use be placed on any Lot nor shall any lot be further subdivided for the purpose of creating additional lots, ownerships, or building sites without first filing a replat." 10. The final binding site plan map shall Indicate by a clear dashed line, the required setbacks from all private, tract x or public roads. The dedication shall contain a statement that: "Side yard and rear yard setbacks shall be determined at the time building permits are requested. The setbacks indicated on this binding site plan may be varied from it proper zoning approvals are obtained." 1 1 . That a plan for water facilities adequate for domestic service and fire protection be approved by the water supplier, fire protection district, Spokane County Building & Safety Department and County health authorities. The agencies will certify on the WATER PLAN, prior to the filing of the final binding site plan or any phase of the preliminary binding site plan that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction and be signed by the sponsor. 12. The purveyor will also certify on the Water Plan that appropriate contractual arrangements and schedule of Improvements have been made with the sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule for improvements will provide for completion of the water system and Inspection by the appropriate health authorities prior to application for building permits within the final binding site plan. The arrangements or agreements will Include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the sponsor to satisfactorily complete the approved water system. The final plat dedication will contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building 8 Safety Department, and water purveyor, will be installed within this binding site plan, and the subdivider /sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to Issuance of a building permit for each lot.' 14. That no building permit will be issued for any lot within the Final Binding Site Plan until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the Final Binding Site Plan", signed and stamped by said engineer. 15. That a survey is required prior to the filing of a final binding site plan. COUNTY ENGINEER'S CONDITIONS The County Engineer has examined this development proposal and has determined that the Impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway Improvements herein specified. That conditions of approval of the Binding Site Plan by the County Engineer is given subject to dedication of Right of Way and approval of the road sytem. In conjunction with phasing of the final Binding Site Plans, specific conditions appropriate to each phase will be specified. 2. The proposed Binding Site Plan shall be Improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 3. The applicant shall deed to spokane County 14' feet of the subject property for Road Right of Way along Sullivan Road and shall construct an additional traffic lane along Sullivan Road from Marietta Avenue northward to the intersection of Euclid Avenue realigned. Construction may be phased as development occurs along the Sullivan Road frontage. 4. The applicant shall deed to Spokane County 48' feet of Right of Way for Marietta Avenue In the alignment as shown on the preliminary Binding Site Plan. 5. All required Improvements shall conform to the current State of Washington standard specifications for road and bridge construction and other applicable County standards and/or adopted resolutions pertaining to road standards and stormwater management in effect at the date of construction, unless otherwise approved by the County Engineer. 6. Prior to the filing of each phase of the final binding site plan, appropriate plans, profiles and cross sections as determined by the County Engineer for Sullivan Road, Euclid Avenue and/or Marietta Avenue showing proposed street centerline and curb grades be submitted for approval; road plans to be prepared under the direction of licensed professional Civil Engineer. Euclid Avenue road plans and improvement are to Include full depth pavement design and construction (Includes existing travelway connection to Flora Road). That appropriate road drainage plans and design calculations as determined by the County Engineer showing the alignment of drainage facilities be submitted for approval. Drainage plans to be prepared under the direction of a licensed professional Civil Engineer. The applicant shall submit for approval by the Spokane County Engineer prior to the release of a building permit a surface water disposal plan for the building site or portion thereof if the development Is phased. Prior to the release of a building permit, a parking plan and traffic circulation plan for each site shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. Findings for BSP -17 -87 Page 4 Construction within the existing or proposed public streets and easements shall be performed under the direct supervision of a licensed engineer /surveyor, who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all Improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 10. No construction work Is to be performed within the existing or proposed public right of way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 11 . All construction within the existing or proposed public right of way is to be completed prior to filing the final binding site plan or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans and monumenting the street centerlines shall be filed with the County Engineer. 12. The applicant shall construct Euclid Avenue and Marietta Avenue as shown on the preliminary binding site plan as public roads. These roadways shall be constructed In compliance with the typical roadway cross sections designated and approved by the County Engineer. A copy of those typical cross sections is attached for inclusion in the "Conditions of Approval '. All other roadways shown on the preliminary binding site plan shall be private roads. 13. The change in alignment and vacation of current alignment of Euclid Avenue shall be approved by the Board of County Commissioners prior to the filing of the binding site plan containing that particular phase of the development. In conjunction with the realignment of Euclid Avenue the applicant is responsible for the reconstruction of the existing traffic signal system at the Sullivan Road and realigned Euclid Road intersection and for the construction of the entire additional traffic lane on Sullivan Road. 15. In conjunction with the requirements of Short Plat 86 -457 the applicant is responsible for the future construction of a new traffic signal system at the Intersection of Sullivan Road and Marietta Avenue when the Intersection meets traffic engineering warrants for traffic signal construction. 16. That the minimum curb radii at all street intersections within the proposal shall be 30' feet. Minimum radii at Sullivan Road intersections shall be 40' feet. 17. To construct the road Improvements stated therein, the applicant may, with the approval of the County Engineer, join In and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said Improvements pursuant to RCW 36.68, as amended. At such time as an RID is created or any road improvement project Is sanctioned by Spokane County, the improvements required (curbs, pathways, drainage control, paving, traffic signal systems, etc.) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. 18. Should an RID be pursued, it shall be the responsibility of the applicant to provide road and drainage plans sufficient for the creation of a Road Improvement District. These plans shall be prepared by a licensed professional civil engineer and shall be prepared in compliance with Spokane County road standards and drainage guidelines. In order to construct required roadway improvements on Sullivan Road, Marietta Avenue and Euclid Avenue the applicant may petition the Board of County Commissioners to create a Road Improvement District R.I.D.'The RID must be created by the Board of County Commissioners prior to the filing of the binding site plan. 19. The following statement shall appear on the binding site plan document "Parking will be prohibited along Euclid Avenue ". 20. A statement shall be placed on the binding site plan doucment which prohibits direct access from lots to Sullivan Road or Flora Road. r_ Findings for BSP -17 -87 Page 5 21. Direct access from lots to Marietta Avenue and Euclid Avenue shall be limited to the access points approved by the County Engineer and as shown on the preliminary binding site plan. 22. A minimum 20' foot wide easement shall be provided along the east side of Sullivan Road and each side of the public road right of way on Euclid Avenue and Marietta Avenue. The purpose of the easement is to accommodate pathways, landscaping, and drainage from roadways. 23. A system of pathways, accessible to the public, be constructed along Sullivan Road, Euclid Road and Marietta Avenue. The pathway is to be located within the common pathway, drainage and landscape easement area. That a statement shall be placed on the binding site plan permitting Spokane County to enter within the easement for the purpose of drywell and sign maintenance. Snow removed from the public roadways shall be permitted with the easement. Maintenance of pathways, drainage swales and landscaping areas shall be the responsiblity of the applicant. 24. The proposed private roads as shown on the preliminary binding site plan are approved by the County Engineer. 25. The following statement must appear on the binding site plan document: "The private roads as shown hereon are easements which provide a means of Ingress and egress for those lots within the binding site plan having frontage thereon." 26. Private road plans.wilh connections to a public road are the responsibility of the developer and are required prior to the release of a building permit. A statement to this effect shall be placed in the binding site plan document. 27. Private roads be Improved to a minimum Improved surface width of 30' feet with a minimum 20' foot wide landscaping and drainage easement on either side of the roadway. Subject to approval under section 10.207 of the Spokane County Fire Cale. 28. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be referenced on the binding site plan document. 29. The following statement shall be placed on the binding site plan document: "WARNING: Spokane County has no responsibility to build, Improve, maintain or other wise service the private roads contained within or providing service to the property described in this binding site plan. By accepting this binding site plan or subsequently by allowing a building permit to be Issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns including the obligation to participate in the maintenance of the private road as provided herein. 30. The following statement shall be placed on each phase of the binding site plan: "The owner(s) or successor(s) In Interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If a RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID is feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed. Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, the object to any assessment(s) on the property as a result of the improvements called for in Findings for BSP -17 -87 Page 6 conjunction with the formation of a RID by either petition or resolution method under Chapter 36.88 RCW. 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the Issuance of any on -site sewage disposal permit or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. 5. Prior to filing the final plat, the sponsor shall present evidence that the plat Iles within the recorded service area of the water system proposed to serve the plat. 6. A public sewer system will be made available for the project and individual service will be provided to each lot prior to sale. Use of individual on -site sewage disposal systems shall not be authodzed. 7. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the project and Individual service will be provided to each lot prior to sale. Use of individual on -site sewage system shall not be authorized." 8. The dedicatory language on the plat shall state: "Use of private wells and water systems Is prohibited." 9. The plat dedication will contain a statement to the effect that: "The public water system as approved by County and State health authorities and the local fire district and purveyor will be Installed within this plat, and the subdivider will provide for Individual domestic water service as well as fire protection to each lot prior to sale of each lot." 1 . The dedication shall state: "The owner(s) or Successor(s) in Interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94 which the petition Includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objection to any assessment(s) on the property as a result of Improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94 ". 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. Project will connect to existing Park Sewer System Review and inspection of the sewer plans will be the responsibility of the applicant. 1 . The required fire flow for any building or property development is determined by building size, type of construction, and proximity of exposures. Required fire flows shall be based on an evaluation of each building at the time of building permit application. 2. Project is located within Fire District No. 1. Fire hydrants for commercial and Industrial buildings shall be located so that no portion of the building exterior Is more than 175' feet from the hydrant. 4. Fire hydrants shall be located so as to be accessible to fire apparatus and not be obstructed by any structure or vegetation or have the visibility impaired for a distance of fifty feet in the direction of vehicular approach to the hydrant. 5. Specific location of hydrants shall be determined by the Fire District. 6. The applicant shall provide verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of building permits. 1 . A new water right application for any new wells will probably be required for this project. Please contact Mr. Rynear R. Huffman (509- 456 -6199) of Ecology's Eastern Regional Office for further information. 1 . Water main extension/water system expansions require the applicant to complete a Water System Plan and submit plans and specifications for approval before construction of the proposed water mains. This letter is in regard to the onsite meeting that was held for the referenced items. We went through the items and the following. is our understanding of the method in which the items will be addressed. The items are referenced,by the numbers shown on the Daily Inspection Report - Office of the Spokane County Engineer which is attached to this letter Item No. 1: There did not appear to be many areas where the pathway shoulders were not present, however, as per our discussion, your crews will fill in along the edge of the pathway where necessary. Item No. 2: The curb cut at approximately STA. 1 +00 left wilt need to be removed and replaced with new curb. This plan will need to be revised to show the remaining items mentioned. Item No. 3: Deleted Item No. 4: The road section on the plans and portions of the plans will have to be revised to reflect areas where swales are determined not necessary. Item No. 5: We will survey the swales along the Euclid Avenue to verify installation provides for the designed requirements. Item No. 9: It appears that there is no room for a pathway along the area in question, in front of Northwest Culvert, and that you would like us to convey this to Spokane County. The deletion of the pathway may require revisions to the plans. Item No. 10: Deleted Item No. 11: We will submit a shop drawing to Spokane County to revise the existing asphalt ramps at intersections. The revision will consist mainly of installing a strip of brick pavers which are textured to provide for handicap access. This will require a revision to the plans. Item No. 12: We will coordinate the road section for Sullivan Road with Spokane County and add clarifications to the plans if necessary. Any issues related to our sewer agreement will be handled as a separate issue and as a matter of fact is being addressed as an amendment at the Board of County Commissioners meeting being held this evening. It is our understanding that Pentzer is in the final process of consummating an agreement with Crown West Realty, L.L.C. for their purchase of the above referenced property. We also understand that if there are any outstanding issues, your intent is to know what they might be so you can share these with Crown West Realty, L.L.C. As you know, any Binding Site Plan could be referred to as a "living Document" in that as each development occurs there may be conditions that would need to be met that are not a requirement at this time. The intent of this letter is to identify items that have been constructed but still need to have some effort to allow them to be accepted. The work items that appear to be left affect three of the Binding Site Plans. They are as follows: BSP 17 1. Construct concrete wheelchair ramps at all intersections for pathway per plans (note 6 on 15/15). Remove sod at curb drops to provide proper flow into swales and ponds. Although this list appears long, some of the items are currently being worked on. There is also a bond in the amount of $177,500 that needs to be addressed with the property transfer. When the above items have been completed, by either Pentzer Development Corporation or Crown West Realty, L.L.C., the County Engineer can certify to the Board of County Commissioners that all work has been completed on the above referenced Binding Site Plans and that the roads can be accepted. I have now.had the opportunity to discuss.this issue with corporate management. It is the position of Pentzer Development Corporation that all road and drainage improvements required under the two referenced binding site plans would have been completed prior to November 1991, had it not been for construction - related delays caused by representatives of the Spokane County Engineers office. As you are aware, the Spokane County Engineer's office maintained exclusive control over the installation of a new traffic signal at Marietta Avenue and Sullivan Road, and the installation of an improved traffic signal at the intersection of Euclid Avenue and Sullivan Road. Your office was responsible for designing the necessary specifications, bidding the project, and supervising work performed by the contractor selected by department representatives. Pentzer Development Corporation had no control over either project, but was required to pay whatever costs department representatives verified were payabla to achieve installation of the two lights. Due to our lack of control over this part of the construction process, two civil engineers and I met with representatives of your department to discuss time frames with your office on May 17th, 1991. During this meeting your representatives verified that the contract for installation of the Marietta Avenue traffic signal had been awarded to Rod's Electric, and that the installation would be complete no later than June 20th, 1991. Your representatives further indicated that work would begin immediately on design specifications for the improved traffic signal at the intersection of Euclid Avenue and Sullivan Road, and that the project would be bid out and completed at some point in August 1991. Specifically, Inland Paving representatives verified that final paving of the truck turnout lane along Sullivan Road between Marietta and Euclid Avenues, together with paving at both intersections, could not be completed until after both signals were installed. Subsequent to the meeting, your contractor, Rod's Electric, did not complete installation of the Marietta Avenue traffic signal until sometime in September 1991. In addition, engineering department representatives delayed completion of the Euclid Avenue traffic signal specifications by at least six weeks, preventing subsequent bidding and acceptance of a contractor until mid- September 1991. Colvico was selected as the low bidder by your department, and a meeting was scheduled with representatives of Taylor Engineering, Colvico, your department, Inland Paving Company and I on September 19th; 1991. During that meeting, I was forced to agree to pay overtime wages to your contractor, Colvico, in an effort to secure completion of the Euclid Avenue traffic signal improvements by October 23rd, 1991, in the hope that Inland Paving would still be able to complete installation of road.surtace and pathways prior to batch plant closing in November. in fact, I have now received an invoice with letter from Bob Brueggeman dated November 18th, 1991, in the value of $3,255.92 for overtime services performed by Colvico, Inc. It is the position of my company that; had County Engineering representatives secured completion of traffic installation services in a timely manner, SIP contractor, Inland Paving Company, could have completed the road improvements during this construction season, thereby eliminating the necessity for any form or irrevocable letter of credit. While the commitment was made to pay for Colvico overtime costs, my company does not wish to pay the cost of securing an irrevocable letter of credit in the value of $153,000.00 for an additional one -year period. In addition to overtime charges, SIP may be forced to pay interest on the unpaid portion of the construction agreement to Inland Paving Company. While the precise value at issue has not yet been determined, I can assure you that the cost to my company would be substantial. While Pentzer Development Corporation does not intend to take out the irrevocable letter of credit, I can verify that Inland Paving Company remains under contract for remaining services which are the subject of the letter of credit, and, as a licensed and bonded contractor, should provide the county with a sufficient guarantee that services will be performed as required under the binding site plans.
