Thank you for your letter of November 20, 1969, and enclosed information
concerning the helicopter pad for the Valley Hospital.
1 have examined the material you have sent me and discussed the matter
with one of the Deputy Prosecutors since helicopter facilities are not specifically
mentioned in our Zoning Ordinance. I am of the opinion that the helicopter pad
as proposed in your letter and enclosures is permitted by the Ordinance as an
accessory use to the hospital.
While there is no structure that would require a "building permit ", 1 would
suggest that your contractor secure a "Certificate of Occupancy" from the Build-
ing Codes Department. This will serve to confirm the County's approval of the
installation.

Dear Sir:
This is a letter of application for approval of the use of a 50'x50' rectangular
parcel of Spokane Valley General Hospital site located at the above address for
a helistop. The area to be designated for a helistop is in the Southwest corner
of the hospital site, Tract 3 of Opportunity, Section 15, T25 N, R44E, WM. The
sole purpose of this request is for the use of the aforesaid property for
emergency helistop purposes. There will be no aircraft stationed at the hospital,
no garage facilities, petroleum, etc. This site will be fully paved and will be
painted as illustrated in the attachment figure 19 helistop marker.
The proposal was circulated to the public for comment on 8 Sept. 1969 by the
Federal Aviation Administration. There were no objections according to the
F.A.A., as indicated in their letter dated November 5, 1969. The principal
support for the helistop are that it provides quick accessoof freeway emergencies
to the hospital, as well as lessening the dependency on ground transportation
from such outlying areas as the mountain country surrounding the Spokane County.
You will note further that the site and application have been approved as acceptable
by the Federal Aeronautics Administration.
An early reply will be appreciated.

Dear Mr. Markson:
I read in this morning's paper to the effect that the heliport proposal at
the Valley Hospital had been submitted to the County Planning Commission for
approval, and that the Hospital was awaiting action by the County Planning
Commission. This was not an accurate report.
Approximately ten days ago an oral inquiry was received across our counter
from an individual. I frankly do not know whether the man inquiring represented
the hospital, a contractor, or what. In any case, I indicated to him that we
could make no determination as to the applicability of the Zoning Ordinance with-
out more information. I asked that a letter be sent to us describing the proposal,
and that the letter be accompanied by a plot plan of the - Hospital property showing
the location of the proposed heliport facility.
Since no mention is made in the Agricultural Suburban chapter of our
Ordinance (the zone in which the hospital is located) of heliports, I had intended
to inquire of the Prosecuting Attorney as to whether a heliport could be permitted
as an accessory use to the hospital. As soon as the requested information is
received, we will make the necessary inquiries and advise you of any zoning
requirements.

Proposal, dated 25 August 1969, for the establishment of a private -use
heliport at Spokane, Washington.

Under the Federal Aviation Act, the Federal Aviation Administration advises
proponents the effect of construction on the use of airspace by aircraft.
The FAA has no jurisdiction over zoning or land use. Those are the respon-
sibility of local governmental authorities.
The proposal was circularized to the public for comment on 8 September 1969.
There were no objections.
The aeronautical study conducted by the Federal Aviation Administration
revealed that the heliport, as proposed, would not adversely affect the
safe and efficient use of the airspace.

Therefore, pursuant to the authority delegated to me it is determined that
there is no objection by the Federal Aviation Administration from the stand-
point of safe and efficient use of the airspace to construction of Spokane
Valley General Hospital Heliport, as proposed.
This determination doss not waive the requirements of other government
agencies and does not obligate the United States Goverment to partici-
pate in the financial development and /or improvement of this facility.
The Federal Aviation Administration cannot prevent the construction of
structures near a landing area. Protection of its environs is the respon-
sibility of the owner and can be accomplished through such means as local
Boning ordinances or acquisition of property rights. Also, this determina-
tion doss not relieve a proponent of the responsibility for reporting
proposed buildings or structures which fall within the purview of Federal
Aviation Regulations Part 77.
In the event that the heliport is not completed and operational on or before
1 November 1971 this determination is void.
