From research of our records, I find the property in question was
zoned unclassified until 1955, when the zoning was changed to agricultural -
suburban by the Board of County Commissioner's Resolution #55 -32. From
letters received on inquiry into the use of this property I find:
The property was used by Pat Norton as a general contractor's yard and
for the manufacture of septic tanks and drain field pipes from 1949 to
1955 while zoned unclassified.
In 1955 and until 1965, Appleway Motors used the property to renovate
used cars and to prepare new cars for sale. In 1965 Burton Wood purchased
the property and used it for storage of construction equipment for a short
time. In 1965 Spokane Machinery purchased the property from Mr. Wood and
used it for about six months for storage and repair of construction equip-
ment.
Near the end of 1965, P & T Drilling purchased the property from
Spokane Machinery and used the property for a construction yard and office
until 1970, when H.E. Schimmels purchased the property and has used it
since 1970 as a construction and machinery storage yard.
This interpretation will be circulated to property owners within 300
feet of your property. Anyone not in agreement with this determination may
appeal my determination within ten (10) days of the date of this letter.
Appeal should be made to the Spokane County Zoning Adjustor.

H. E. Schimmels who is the owner of the Cyclone Fenced Yard
on the corner of Ella and Harrington and who is actively
engaged in the Heavy Construction Business would like to
confirm the use of said property from the year 1949 to the
present date.
From 1949 to 1955 Pat Morton used this property as a general
Contractor and to Manufacture Septic Tanks and Drain Field Pipe.
Appleway Motors purchased the property in 1955 and used it
approximately ten years to renovate used cars and to prepare
new cars for sale.
Burton Wood purchased the property in 1965 and used the
property for storage of Construction Equipment.
Elmer Lindol of Spokane Machinery purchased the property from
Burton Woods and used it for a period of about six months for
the Storage and Repair of Construction Equipment.
P & T Drilling purchased the property in 1965 from Elmer
Lindale and used the property for a Construction Yard and
Office.
H. E. Schimmels purchased the property in 1970 and has used
the property to carry on a General Contracting Business and
is now using the property for that purpose.

After reviewing the notarised letters regarding your business (wood stove and
fireplace fabrication), that you have carried on continuously since 1954 some
type of fabrication activity other than primarily agricultural pursuits, I find the
following to be in effect. Because the soning was Unclassified when you began
your light manufacturing, you were in compliance with soning regulations at the
time and until the zoning was changed to Agricultural. Therefore, it is my
interpretation that you have a non - conforming business and can oonttnue your
business at its current level of intensity.
If you desire to enlarge the business, advertise to a different manner, or change
to a more intense business, you would have to apply at this office for an
"expansion of a nonroontormpng use permit`,
This interpretation will be circulated to property owners within 300 feet of your
property. Anyone not in agreement with this interpretation may appeal my
