The proposal is generally located north of and adjacent to Eighth Avenue, approximately 320 feet west of Barker Road within the NW 1/4 of Section 19, Township 25 North, Range 45 EWM, Spokane County, Washington. 2. The proposal consists of a preliminary plat to divide approximately 10 acres into 22 lots for single family dwellings with existing Urban Residential -3.5 (UR -3.5) zoning. 3. The Hearing Examiner Committee held a public hearing regarding the proposal on May 20, 1993, subsequent to which by the Findings of Fact, Conclusion and Decision dated May 21, 1993, it denied the proposal without prejudice. 4. The applicant filed a written appeal with the Board on May 28, 1993, and listed the following as the basis for appeal of the Hearing Examiner Committee decision: the proposal met County requirements; the Hearing Examiner Committee's decision was inconsistent with other land use decisions in the area, and County staff recommended approval. 5. The legal requirements for public notice have been fulfilled. 6. The Board conducted a de novo public hearing on the proposal on August 16, 1993. The record for the hearing included the testimony and documents submitted to the Board at the August 16, 1993, public hearing, additional documents submitted to the Board through August 31, 1993, and the public record files of the Planning department and Board of County Commissioners on the proposal. 7. On appeal, the Hearing Examiner Committee's decision comprised only a recommendation to the Board regarding the approvals sought by the applicant. The oral testimony submitted to the Hearing Examiner Committee on the proposal was not part of the record before the Board and was not considered by the Board. 8. The issues raised at the public hearing included concerns regarding density, incompatibility with surrounding land uses, adequate infrastructure existing in the area, including public sewers, roads, schools and other public services, and environmental concerns regarding on -site sewage disposal in the proposal. 93 1346 BOCC FINDINGS PE- 1701 -93 Page 2 9. The Board takes notice of the provisions of the Spokane County Generalized Comprehensive Plan, the Spokane County Zoning Code and the Spokane County Code. 10. The Comprehensive Land Use plan designates the area encompassed by the proposal as Urban, which recommends a residential density range of 1 to 17 units per acre. 11. The original zoning of the property was established as Agricultural (A) under the Spokane County Zoning Ordinance in 1957. The Agriculture (A) zoning for the site was redesignated by Spokane County on January 1, 1991 to Urban Residential -3.5 (UR -3.5), pursuant to the Program to Implement the Spokane County Zoning Code. 12. The net density of the proposal is 2.5 units per acre. 13. The property is surrounded by large lots or tracts with single family residences ranging in size from 1 to 160 acres. A 160 acre parcel used primarily for • agricultural purposes is located south of the proposal. Large animal keeping and agricultural activities are common in the area, which can best be described as semi - rural. 14. The proposal is generally inconsistent with the density and land uses of the surrounding properties and the area. While a few plats with urban densities have been approved by the County in the general area of the proposal in the past (e. g. Moen Addition, Meadowview Ranch Estates), more recently the Board of County Commissioners has denied preliminary plat proposals in the area. The Board takes notice that the proposed preliminary plat of Hitchcock Addition was denied by the Board on August 16, 1993, after rehearing, for similar reasons as the present proposal was denied. The proposed preliminary plat of Irish Estates, located in the north Greenacres area, was previously denied by the Board in December, 1992 (the Board's decision was recently affirmed on appeal in Spokane County Superior Court Cause No. 93- 200363 -8). The Board also takes notice that the proposed preliminary plat of Flora Meadows located in the north Greenacres area, was denied by motion of the Board on August 24, 1993. Irish Addition was recently approved, but the preliminary plat had not been appealed to the Board from the Hearing Examiner Committee's decision. 15. The single family uses in the proposal will conflict with the agricultural uses and large animal keeping in areas adjacent to the proposal. 16. Eighth Avenue is designated by Spokane County as a local access street, with improvement standards recommended of 30 feet of asphalt and curbing. While the County Engineer has recommended improvement of Eighth Avenue to such standards along the frontage of the development east to Barker Road, this would leave Eighth Avenue west to Long Road as a gravel road of narrow width. 17. Testimony from residents of the area indicates that the proposal would increase traffic on the graveled portion of the road west to Long Road; and that the graveled portion of the road is used by school children walking to Greenacres Elementary, located at Long Road and Fourth Avenue, and also to drive children to school. 18. The applicant indicated in the SEPA checklist that approximately 70 people would reside in the proposal if developed. 19. The Central Valley School District's elementary schools are overcrowded and are currently using portable facilities, school capacity will continue to be exceeded in the future, and the proposal will negatively impact the District's ability to provide adequate student housing. The District requested that the Board either deny the proposal or require the applicant to enter into a voluntary agreement with the District to pay impact fees to mitigate the impacts from the proposal on the District. 20. There is not a park in the area, although the applicant is willing to enter into a voluntary agreement with the County Parks Department to pay impact fees. 21. Public transit is not available in the area of the proposal. 22. The property is located in the Aquifer Sensitive Area and the Priority Sewer Service Area designated by the County. However, public sewer is not expected to be extended to the area for a period of approximately 15 years or longer. • 93 1346 BOCC FINDINGS PE- 1701 -93 Page 3 23. Effective January 1, 1994, the Washington State Board of Health, on June 9, 1993, reimposed density restrictions of one unit per acre for properties located east of Sullivan Road in the Spokane Valley, and relying on on -site sewage disposal. The Board has also indicated its intent to further restrict the allowed densities for such properties proposing to develop with on -site sewage systems to one unit per five acres, pursuant to amendment of the Priority Sewer Service Area boundaries. 24. While the proposal is not subject to the above - referenced density restrictions because of the application date of the proposal, the surrounding properties will be subject to one (1) acre density restrictions as of January 1,1994. This will have the effect of preserving the semi -rural character and large densities of the properties surrounding the proposal, as well as the lack of infrastructure needed to support the proposal and similar urban development in the area, until public sewer becomes available. 25. The Board recognizes that the Aquifer Sensitive Overlay Zone currently authorizes on -site sewage disposal in the Priority Sewer Service Area. However, such • allowance was premised on public sewer being extended to the area within a short range of time, while the facts indicate that such time frame has passed and that several more years will expire before public sewer will be extended to the area. 26. The State Board of Health's action indicates that on -site sewage disposal at urban densities poses water quality concerns in the area of the proposal, especially when considering the potential for cumulative impacts from other proposals that have been authorized or that make application for approval prior to January 1, 1994. 27. The Declaration of Nonsignificance (DNS) issued for the project by the Planning Department on April 29, 1993, did not take into account the action or proceedings by the State Board of Health of June 9, 1993. The Board's action represents significant new information on the proposal's potential impacts on water quality that was not available to the responsible official at the time the DNS was issued or during the DNS comment period, notwithstanding the expert evidence submitted by the applicant on such issue. 28. The proposal is inconsistent with the Comprehensive Plan in several respects. The proposal is inconsistent with the intent of the Urban category to provide for residential development in a "city- like" environment, with a full range of public services. The record indicates that the necessary infrastructure for such urban density does not exist in the area of the proposal, particularly for schools and roads, nor is it likely that it will be present when the proposal is finally developed, even with the conditions recommended by the various agencies. 29. The Urban category anticipates the presence of public sewer, or at a minimum interim sewage disposal systems that protect water quality. The Water Quality element of the Comprehensive Plan encourages "fill -in development" that will have the effect of increasing the cost effectiveness of extending public sewer while maximizing protection to the County's sole source aquifer. Due to the effect of the State Board of Health action on adjacent development and the length of time before public sewer will be extended to the area, the proposal does not constitute "fill -in development ". 30. The Urban category of the Comprehensive Plan encourages buffering between proposed residential development and existing development, where land use conflicts exist. There is no buffer provided between the proposal and the 160 acre tract used for agricultural purposes to the south. 31. There is substantial public opposition to the proposal from the surrounding area. 32. The proposal does not make appropriate provision for the public health, safety and welfare, and for schools, roads and for planning features that assure safe walking conditions for students who walk to and from school, within the meaning of RCW 58.17.110. The public use and interest will not be served by the proposed preliminary subdivision, within the meaning of RCW 58.17.110. 33. Since the Board has decided to deny the proposal, it is unnecessary to make a decision on withdrawal or reconsideration of the Declaration of Nonsignificance issued for the proposal. 93 1346 BOCC FINDINGS The Board does hereby deny the appeal and thereby denies approval of the proposal. PROPOSAL The sponsor, Bud Morrison, requests approval of a 22 lot Preliminary Plat of Pheasant Park Estates, PE- 1701 -93, with existing Urban Residential -3.5 (UR -3.5) zoning within the Aquifer Sensitive Area (ASA) Overlay Zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of and adjacent to 8th Avenue, approximately 320 feet west of Barker Road within the NW 1/4 of Section 19, Township 25 North, Range 45 EWM, Spokane County, Washington. • 2. The committee adopts the Planning Department Report as a part of this record. The Planning Department has recommended that the proposed plat be approved subject to conditions. 3. The existing land uses in the area are large lot single family residences and agriculture. 4. The proposed use could be compatible with the existing uses in the area if timing were appropriate, provisions for sewer, roads and compatibility with the neighborhood need to be addressed. At the present time public sewers are not available, area arterials have not been improved and adjacent land uses include large animal keeping and farming activities. 5. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of creating a "city- like" environment with various land uses, including residential densities of 1 - 17 units per acre or 2.2 units per acre for this proposal. 6. The existing zoning does implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates 8th Avenue as a Local Access Street; with a recommended right of way width of 60 feet. 8. The existing zoning of the property described in the application is Urban Residential -3.5 (UR -3.5) previously established as Agricultural zoning in 1957 and redesignated to DNA- Urban Residential -3.5 (UR -3.5) on January 1, 1991 pursuant to the Program to ant Implement the Spokane County Zoning Code. The provisions of RCW 43.21C (The Suue Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. The owners of adjacent land and the surrounding area submitted a petition opposing the preliminary plat. Concern was expressed regarding on -site sewage disposal and soil composition, inconsistency with surrounding land uses, sewer availability and overcroAding in Greenacres Elementary. 12. The proposed use may not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 13. The subdivision is not in strict conformance with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. Proposal: A twenty -two lot subdivision including one existing single- family residence and twenty -one new single - family residences and one unbuildable lot for a park and those uses permitted in the Urban Residential -3.5 (UR -3.5) zone. II. SITE INFORMATION 5/93 HEC Staff Report for PN- 1701 -93 Page 56 A . Site Size: Approximately 10 acres Gross Density: 2.2 units per acre or .45 acres per unit B . Comprehensive Plan . 1. Land Use Plan: The property is located within the Urban category of the Comprehensive Plan and within the Priority Sewer Service Area (PSSA). The Urban category is intended to provide the opportunity for development of a "city- like" environment which includes various land uses and intensive residential development. Urban areas will have public water systems, sanitary sewer systems, storm sewer systems and other public services available. This category promotes "fill -in" within established development areas where utilities, arterial, schools and community facilities have already been established. Residential net densities in this category will range from 1 to 17 units per acre. The proposed density of this project is in accord with the density guidelines of the Urban category. 2 . Arterial Road Plan: The site fronts 8th Avenue, which is designated by the Spokane County Arterial Road Plan as a local access street. The County Engineer is not requesting dedication or future acquisition area for this proposal, however road improvement must be made prior to finalization. 3 . County Parks Plan: The Spokane County Parks and Recreation Plan does not identify any parks within the immediate vicinity of the site. The applicant is proposing an unbuildable lot for recreational use by the residents in the subdivision. (See also item "P" of this report) C . Site Characteristics: The site is relatively flat with native grasses and pasture covering the area. There is an existing single - family residence on the site along'. with accessory structures. The existing home will be made a part of the plat. D. Neighborhood Characteristics: The surrounding neighborhood is a mixture of large lot single - family residences and open agriculture land. Large animal keeping and agricultural activities are found in the vicinity. Parcel sizes within 1/4 mile range from less than 1 acre to 80 acres. A preliminary subdivision, Meadowview Ranch Estates, is located east of the proposal on the southeast comer of Barker Road and 8th Avenue. E. Zoning Analysis: The zoning of the property surrounding the proposal is zoned Urban Residential -3.5. Prior to the county -wide zone redesignation on January 1, 1991 the site and surrounding area was zoned Agricultural under the former Spokane County Zoning Ordinance. The Program to Implement the Spokane County Zoning Code specified that areas zoned Agricultural (A) and within the Urban category of the Comprehensive Plan were to be redesignated Urban Residential -3.5 (UR -3.5). The applicant is not requesting a rezone with this proposal but is seeking to create twenty-one (21) new single -family lots pursuant to the existing Urban Residential -3.5 (UR -3.5) zone. North: Urban Residential -3.5 (UR -3.5) established in classifies as Agricultural (ZN- 286 -57). South: East West: 5/93 HEC Staff Report for PN- 1701 -93 Urban Residential -3.5 (UR -3.5) established in classified as Agricultural (ZN- 286 -57) Urban Residential -3.5 (UR -3.5) established in classified as Agricultural. (ZN- 286 -57) 1991, previously 1991, previously, 1991, previously Urban Residential -3.5 (UR -3.5) established in 1991, previously classified as Agricultural (ZN- 286 -57). Page 57 Approximately 1 to 2 miles east of the proposed site lying between Barker and ' Henry Roads, is the area that was submitted for an area -wide rezone from Urban Residential -3.5 (UR -3.5) to Suburban Residential -1 (SR -1) by the Mica View , Landowners Association in 1991. (LE- 42 -91). The rezone request included 670 acres, however only 150 acres was approved by the Board of County Commissioners to Suburban Residential -1 (SR -1). The remainder is still Urban Residential -3.5 (UR -3.5). Additional rezone requests for the area north of this site have been submitted. A rezone request from the existing Urban Residential - 3.5 to Urban Residential -7 (UR -7) approximately 1/2 mile north on Sprague Avenue was denied by the Hearing Examiner Committee as well as the Board of County Commissioner's on appeal based on inconsistency with the surrounding area. F . Land Use Analysis: The area surrounding the proposal is largely made up of single - family residences on larger lots and agricultural activity is dominant to the south. There is large animal keeping in the area which indicates a "semi -rural" . lifestyle that existed prior to the cross -over zoning in 1991. The proposal is one of the first to develop in the area at a density consistent with the Urban Residential -3.5 (UR -3.5) zone. Site: The existing land use is a single - family residence and vacant pasture. The proposed land use is a twenty -two lot single - family residential subdivision. North: The land to the north is primarily used for single - family residences on lot sizes ranging from 12,000 square feet to 5 acres. Approximately 1/4 mile northwest of the proposal the Moen Addition Plat. Typical lot sizes in this subdivision are 11,000 square feet. South: The 160 acre parcel south of the proposal, while zoned for residential use, is used primarily for agricultural pursuits. Fast: Unplatted property with parcels of 1 acre to 5 acres in size. A preliminary plat of Meadowview Ranch Estates is located approximately 400 feet east of the proposal. Meadowview was approved in 1991 for 35 lots with lot sizes of 11,000 to 20,000 square feet. West: Single- family residences on parcels between one (1) and five (5) acres. Also northwest of the proposal is a proposed preliminary plat of Hitchcock First Addition (PE- 1651 -92) with existing Urban Residential -3.5 (UR -3.5) zoning Hitchcock is located approximately 1/4 mile northwest of the site on 4th Avenue, just east of Long Road. Hitchcock was given preliminary approval for 29 single- family lots on approximately 8 acres with a density of 3.2 units per acre. Average lot sizes are 10,400 square feet. The project was approved by the Hearing Examiner Committee and Board of County Commissioners on appeal. The project was further appealed by the Mica View Landowners Association to Superior Court, State of Washington. -As of the date of this report , the Superior Court judge has remanded the case back to the Board. 5/93 HEC Staff Report for PN- 1701 -93 Page 58 G . Circulation: The proposed subdivision will be served by two new public roads. The three lots which abut 8th Avenue will have direct access to 8th. The internal lots will be served by both a cul -de -sac and temporary cul -de -sac that may provide future access to property north of the site. All internal roadways serving the site will be constructed with a 50 foot right -of -way which includes 36 feet of asphalt and curb. H. Design: The plat is designed with lots that range in size from approximately ' 11,000 to 24,000 square feet. Duplexes are allowed in the Urban Residential -3.5 (UR -3.5) zone on a lot of 20,000 square feet or greater. The applicant is not proposing duplexes on any of the lots. Most of the lots are rectangular in shape and all lots have frontage on a public road. The common open space lot located along the eastern property line allows direct access by all lots in Block Two. A fifteen (15) foot pedestrian ingress /egress strip will provide access from the lots in Block One to the common open space. The common open space along the 1 eastern boundary and the larger lots along the western boundary provide for a buffer to the adjacent land uses. The common open space cannot be used for storage purposes or residential structures. 1. Preliminary Plat Data Buildine Setbacks: R uir Front yard 30 feet Flanking yard 30 feet Side yard (R) 5 feet @ story Rear yard 20 feet NOTE: The preliminary plat does not illustrate any building setbacks. All lots within the subdivision will be required to meet the minimum setbacksof the underlying zone. The final plat submitted shall indicate all required setbacks. Proposed Buffering /Landscaping Techniques: The preliminary plat is designed with a common open space lot along the east property boundary. The lot will serve as a buffer between the proposed plat and adjacent land uses. I. Density: The net density (excluding roads) is 2.5 units per acre. J. Drainage: A drainage plan is required. This plan must be reviewed and approved by the County Engineer's Department prior to development. K. Power Transmission Lines /Other Known Easements: An existing easement is shown on the preliminary plat between Lots 3 and 4 of Block 2. Any additional required easements or recorded easements will be disclosed during final plat process. 5/93 HEC Staff Report for PN- 1701 -93 Page 59. L . Water Supply: The proposal is within the Consolidated Irrigation Water District #19. An approved water plan will be required prior to finalization of the plat. M. Sewage Disposal: Individual on -site septic systems will be utilized for sewage disposal. Double plumbing and a dry sewer line will be installed as required by the County Utilities Department. N . School: The proposal is in the Central Valley School District No. 356. The school district has submitted to the Planning Department a request that the plat sponsor be required to negotiate with the school district to reach a voluntary agreement to mitigate the impact of the development on the school district. This request is reflected in the conditions of approval of this report. O. Parks and Recreation: The Spokane County Parks Department has responded to the proposal and has requested that approval of this project be subject to the condition that the Owner negotiate with the parks department to , reach a voluntary agreement to mitigate the impact of this proposal on the Parks! department. This condition is included in the Conditions of Approval of this report. P . Fire Protection: The proposal is within Fire District No. 1. The Fire District and the Division of Buildings Department (Fire Marshall) are required to approve fire protection provisions prior to finalizing the preliminary plat. Q. Wetlands: Spokane County Wetland Inventory Maps do not indicate any wetlands on the site. R . Cultural Resources: None have been identified. III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has determined that No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Nonsie nificance ("DNS"). The "DNS" was circulated to 12 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends May 18, 1993 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The ' Hearing Examiner may consider additional environmental related testimony at the public hearing. 5/93 HEC Staff Report for PN- 1701 -93 Page 60 IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed plat conforms to the Spokane County Subdivision and Zoning Codes. The proposal is also in conformance with the Urban category density guidelines of the Comprehensive Plan. Past land use decisions however, have considered the availability of sewers and the impact of on -site sewage disposal systems on the Aquifer. The density of this proposal is similar to the Meadowview Ranch Estates subdivision that was approved east of the site in 1991. As conditioned, the preliminary plat will make appropriate provisions for schools, roads, open space and parks as required by RCW 58.17.110. The Planning Department recommends approval subjec to conditions of reviewing agencies. V. CONDITIONS OF APPROVAL i . All conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant ", which terms shall include the owner or owners of the property, heirs, assigns and successors.' ii. The conditions of approval apply to the preliminary subdivision of record. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Urban Residential -3.5 (UR -3.5) and Aquifer Sensitive Area (ASA) Overlay zones as amended. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director /designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat name /number shall be indicated before the final plat is filed, such name/number to be approved by the Planning Director /designee. 5. Appropriate road name(s) shall be indicated. 6. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Planning Director /designee, may be permitted, including, but not limited to building location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance, and the original intent of the development plans shall be maintained. 7. The preliminary plat is given conditional approval for three (3) years, specifically to June 1, 1996. The applicant may request an extension of time by submitting a written request approximately forty -five (45) days prior to the above expiration date. 5 /931 -IEC Staff Report for PN- 1701 -93 Page 6P 8. Appropriate utility easements shall be indicated on copies of the proposed final plat. ' Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat . The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 10. Three (3) current certificates of title shall be furnished to the Planning Department prior to filing the final plat. 11. Prior to filing of all or a portion of the final plat the applicant's surveyor shall submit one or more maps outlined in red of the area being finalized. The scale shall match the appropriate assessor's map scale. 12. The plat dedication shall contain the following statement: "Lots 1,2,3,10, and 11 of Block 1 and Lots 4 -11 of Block 2 are located on a temporary cul -de -sac. This temporary cul -de -sac may be extended to provide access to adjacent property and/or connect to existing roads or new roads as development and/or circulation needs dictate." 13. The final plat shall indicate yard setback arc lengths on cul -de -sac lots which meet or exceed the minimum frontage of the underlying zone of the final plat. 14. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 15. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 16. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision or 5/93 HEC Staff Report for PN- 1701 -93 Page 62 binding site plan, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 17. No building permit will be issued for any lot within the final plat until certified by a ! Washington state - licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat," including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as- built" water system. 18. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director /designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 19. A survey is required prior to the filing of a final plat. 20. Prior to approval of road and drainage plans, the applicant is required to coordinate with the United States Postal Service to determine type and location of central mail delivery facilities which may include applicable easements for developments of three or more homes. 21. The Owner shall negotiate with the Central Valley School District and submit a recorded copy of a voluntary agreement making provisions for public schools prior to finalization and recording of this plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The Owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (58.17.205), that adequate provisions for school facilities must be made conditioned on a future agreement between the plattor and school district. Voluntary agreements between the Owner and School District shall conform to the requirements of the Revised Code of Washington Chapter 82.02. 22. The Owner shall negotiate with the Spokane County Parks Department and submit a recorded copy of a voluntary agreement making provisions for public parks prior to fmalization and recording of this plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The Owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (58.17.205), that adequate provisions for parks must be made conditioned on a future agreement between the plattor and Spokane County Parks Department. Voluntary agreements between the Owner and Spokane County Parks Department shall conform to the requirements of the Revised Code of Washington Chapter 82.02. , 5/93 HEC Staff Report for PN- 1701 -93 Page 63 23. The following conditions are applicable to Lot 12, Block 2: a. The dedicatory language on the plat shall state: "Any residential development on ' Lot 12, Block 2 is prohibited. Any. structures or improvements erected within Lot 12, Block 2 shall be for recreational purposes only." b. The final plat dedication shall contain the following statement: "The common areas shown on this plat cannot be sold or transferred, regardless of any provision in the covenants to the contrary, and shall be considered subservient estates for tax purposes to the other lots created herein." c. The plat dedication shall contain the following statement: "The common areas shown on this plat are hereby dedicated to the homeowners association created by document recorded under State document No. d. A copy of the homeowners /property owners' association articles of incorporation i and/or bylaws and/or covenants and restrictions, together with any other provisions for maintenance of common areas and facilities, shall be submitted for review and approval to the Planning Department prior to finalizing. e. Subject to approval by the Planning Department, Lot 12, Block 2 may be retainedi under private ownership by the "applicant" subject to the condition that the lot is used by the residents of the subdivision for recreational purposes only. Appropriate provisions for maintenance shall be submitted for approval by the department. If the "applicant" so chooses to maintain private ownership of Lot 12, Block 2, conditions (c) and (d) above are not applicable. 24. The plat dedication shall contain a statement that duplexes are prohibited. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. The conditional approval of the plat is given by the County Engineer subject to deification of right -of -way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross- sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construction and/or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer /surveyor, who shall furnish the County Engineer with "as- built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5/93 HEC Staff Report for PN- 1701 -93 Page 6411 5. No construction work is to be performed within the existing or proposed public right -of -way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public right -of -way is to be completed prior to filing, each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "as- built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Appropriate provision shall be made that the following - described property be held in trust until the continuation of the streets be dedicated or deeded: a one (1) -foot strip at the ends or edges of all streets that terminate or border the subdivision boundary. (Temporary cul -de -sacs are required when streets terminate at the subdivision boundaries.) 8. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 9. A statement shall be placed in the plat dedication providing for future slope easements as required by Spokane County along 8th Avenue. 10. Existing county roads providing direct access to the plat shall be paved and /or curbed to Spokane County standards. 11. All public roads within the plat shall be designed and constructed to Spokane County standards. 12. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of all internal streets, which are to be constructed within the proposed development. This will require the installation of 36 feet of asphalt. The construction of curbing is also required. 14. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of Eighth Avenue, which is adjacent to the proposed development. This will require the addition of approximately 30 feet of asphalt along the frontage of the development and extending to Barker Road The construction of curbing is also required. 15. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this development proposal and has determined . that the impact of this proposal upon the existing county road system warrants the dedication of additional right -of -way and the roadway improvements herein specified. 5/93 HEC Staff Report for PN- 1701 -93 Page 65 17. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utility purveyor and the Spokane County Engineer to determine whether the applicant or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 18. The applicant shall construct a 30 ft strip paved section on Eighth Avenue from the east property line to Barker Road. A 30 ft. section and curbing shall be constructed along the Eighth Avenue frontage of the development. The trip generation of this development and its urban density will impact on the existing gravel road this warrants the improvement of Eighth Avenue to Barker Road. SPOKANE COUNTY DIVISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation' of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4.
