BACKGROUND:
ANALYSIS:
REASONS:
On January 11, 1974, the Commission heard a similar request for the ad-
vertised property for a convenience grocery store. The Commission
recommended denial. The matter was subsequently appealed by the appli-
cant to the Board of County Commissioners. On February 22, 1974, the
Board of County Commissioners concurred with the recommendation of the
Planning Commission and denied the zone change request.
The advertised property is situated on the southeast corner of Broadway
and Park. The applicant proposes to construct a convenience grocery
store on the site. The property is currently occupied by a well maintained
residence with single family homes to the east.
The staff is of the opinion that conditions in the area have not substantially
changed since the previous request. Therefore, the reasons for denial
expressed by the Commission on January 11, 1974 are reiterated as follows:
1. The Comprehensive Plan indicates that the properties east of Park
Road along Broadway Avenue are appropriate for residential uses.
The Commission notes that the advertised property is occupied and
surrounded on three sides by existing residential development.
2. The Commission is of the opinion that the residential neighborhood
lying east of Park Road is adequately buffered from the industrial
and mining district to the southwest. The Commission concludes
that the small business site would be an unwarranted intrusion into
the residential neighborhood.
3. The Commission is of the opinion that there is ample zoning in the
vicinity to accommodate Local Business uses. A two and one -half
(2 1/2) acre parcel on the southwest corner of Park and Broadway
intersection was zoned Local Business in 1972. The Commission
notes that most of the properties south of Broadway and west of
Park retain zoning classifications which would allow business uses.
The Commission has not encouraged the proliferation of Local Busi-
ness zoning on either Broadway Avenue or Park Road. The Commission
recently denied requests for Local Business zoning on Broadway Ave-
nue at Argonne and at Sullivan Road.
