DEDICATION AND IMPROVEMENTS: A. Dedication of the west 5' of the advertised property along Marguerite Street for right of way. B. Dedication of a 20' radius at the northeast corner of Marguerite and Broadway. C. Improvement to Spokane County standards of Marguerite Street adjoining the advertised property. Improvements shall include curb, sidewalk, drainage control, and paving to existing oil. 2. APPROVAL OF ACCESS: Access permits for the advertised property shall be obtained from the Spokane County Engineer's office prior to release of building permits. 3. APARTMENT DENSITY, CONFIGURATION, AND BUILDING HEIGHTS: The advertised property shall be developed in substantial conformance with the revised development plan. i.e., One and two story structures oriented toward an interior court with an 18 car parking area situated in the northerly portion of the project. The total number of apartment units shall not exceed 12. At least 65 percent of t 7a s:te shall remain in open space free of structures and parking. The percentage of the site covered by building including carports shall not exceed 28 percent. NOTE: Minor variances may be required to accommodate the proposed orientation of structures. 4. OFF - STREET PARKING - DEVELOPMENT: A. The off - street parking facility and connecting driveway shall be developer as indicated on the revised development plan. i.e., An 18 car parking area situated within the northerly por ton of the project with access to Marguerite Street. (Coated) .J ZE -60 -75 - AGR TO MULT FAM SUB (Cont'd) B. Any portion of the project which is to be occupied or traveled by auto- mobiles shall be maintained in hard surface paving. Paved areas shall maintain a 5' setback from adjoining properties. C. Open parking areas shall be unlighted except that driveways, walkways, and landscaped traffic islands may be illuminated by low intensity light- ing on standards not exceeding eight (8) feet In height. D. The design, location, and arrangement of parking stalls shall be in accor- dance with standard traffic engineering practices. 5. LANDSCAPING: All areas not occupied by buildings, parking, and paved roadways, shall be landscaped, planted, and maintained in appropriate turf .and shrubbery. The Director of Planning shall approve a landscape plan and installation . schedule for the project incorporating an automatic sprinkler system as a condition of any building permit. A 6 -foot high residential type fence shall be constructed along the east edge of the apartment project. 6. FIRE PROTECTION: Installation of fire hydrants in accordance with the requirements of the Spokane Valley Fire Marshall. REASONS INCLUDING ENVIRONMENTAL ASSESSMENT: 1. In 1969 and 1971, the Planning Commission approved similar court apartment projects on the south side of Broadway Avenue between Argonne and Marguerite. The Comr„isrion is of the opinion that the advertised proposal will conform to the established character of the area. 2. The Planning Commission is of the opinion that the design of the project in conjunction with conditions of approval relating to screening, land- scaping, proper development of off - street parking facilities and fire protection will minimize the impact of the project on surrounding residentle properties. The low profile apartment project offers substantial open space amenities in comparison with the size of the parcel. 3. The site is situated within an urbanizing area on the floor of the Spokane Valley. The zone change would not have any greater effect upon the topography, geology, biological and botanical characteristics, atmospheric and aquatic conditions and other nattirai development than similar uses (Cont'd) -28- ZE -60 -75 - AGR TO MULT FAM SUB (Cont'd) established in the area. The Commission notes that the proposal is compatible with surrounding land uses, transportation and utility services. The Commission, therefore, concludes that an environmental impact :state- - ment is not required for the project. 7. GENERAL DATA: a. Location: Section 18, Township 25 N., Range 44, EWP.
