The applicant indicated the property has been utilized in this manner for 10 years. However, it has only been in recent months that the storage of various materials has increased to a point that the Department of Transportation has filed two complaints objecting to the existing use. The applicant indicates he wishes to continue the present use and has submitted a petition with several area residents having no objection to the zone reclassification request. b) . The Spokane County Health District finds that: 1. This project lies over the Spokane Aquifer, within Critical Water Supply Service Area No. 3, and within the water service area of the Washington Water Power Company. It is within the Primary Sanitary Sewer Area recommended in the "208' study. Topography and soils in this area are generally suitable for use of on -site sewage systems. IV. AGENCIES RECOMMENDED CONDITIONS a) COUNTY FIRE MARSHAL 1. The site is located in Fire District ill. 2. Adequate water for fire protection and distribution of such water is required. A water plan is required to be submitted for approval prior to any land development. 3. Plans for emergency access will require approval prior to issuance of building permits. b) COUNTY ENGINEER 1. Access permits "shall be obtained from the Spokane County Engineer's Office prior to issuance of building permits. 2. A detailed combined on -site sewage system and surface water disposal plan for the entire project shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of any building permit. 3. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Conditions of approval required that the entire site be enclosed by a 6 -foot sight- obscuring fence and trees be planted around the perimeter at 20 foot intervals. Since that time, the adjoining site to the south was zoned to Restricted Industrial in 1980, for the purpose of developing warehouses. Conditions required a 60 foot chain link fence and landscape buffer around the perimeter and additional landscaping around each building. The remainder of the area has been zoned Agricultural Suburban since 1959. 5) NEIGHBORHOOD CONSIDERATIONS: Areas around the site to the east and south are primarily older residential uses. Park Junior High School is located southerly of this site along the west side of Ella Road. II. BACKGROUND ANALYSIS (continued) III. SITE ANALYSIS 5) NEIGHBORHOOD CONSIDERATIONS (continued) The only access to the site under consideration is by Ella Road from Broadway Avenue. Ella Road deadends into I -90 at this site and serves primarily residential areas. The other Restricted Industrial parcel, to the south, has access from Park Road. 1) ZONE RECLASSIFICATION NO.: ZE- 205A -79 On tour of the area, it was noted that many of the residential uses are currently in violation of the storage provisions of the Agricultural Suburban Zone. SITE CHARACTERISTICS AND CONSIDERATIONS: The site is currently developed as a machinery shop with storage. Three structures - a shop, office, and storage building, occupy the Restricted Industrial site. The easterly portion of the applicant's ownership contains one single family dwelling and is zoned Agricultural Suburban. Single family use is an approximately 27,000 square foot area extending 100 feet Westerly of Ella Road. 2) AGRICULTURAL SUMMARY: The Urban designation of the Comprehensive Plan doesn't attempt to save farmland. 3) SITE PLAN INFORMATION: SITE SIZE: EXISTING BUILDINGS: Approximately 1.8 Acres 3 BUFFERING TECHNIQUES: As mentioned previously, the conditions of approval required sight- obscuring fencing and landscaping around the rezoned site. To date the tree planting, as specified, has been accomplished. The sight- obscuring fence has only been installed on the easterly side of the rezoned site behind the applicant's house. This measure helps block the view of the shop and storage from the majority of residential uses. A chain link fence, but not sight- obscuring, exists adjacent to I -90 on the north, and adjacent to the southerly Restricted Industrial parcel, on the south. III. SITE ANALYSIS (continued) IV. CONCLUSION BUFFERING TECHNIQUES (continued) ZONE RECLASSIFICATION NO.: ZE- 205A -79 The change of condition request asks that the fencing along the north and south boundaries not be sight- obscuring. Reasons for the change are: * The elevation of I -90 is such that a sight- obscuring fence of 6 -feet would not block the view of the site from motorists. I -90, along most of the site's boundary, is 10 to 15 feet above the site's grade. * The site's southern boundary is common to another Restricted Industrial parcel that was so zoned in 1980. Conditions of that approval only required perimeter landscaping and fencing; not sight- obscuring. Over and above the specific rezone conditions, there is a requirement under the Restricted Industrial Zone of the Spokane County Zoning Ordinance, Section 4.11.120, which requires all storage to be screened with a "6 -foot sight- obscuring unpierced fence ". OTHER 'SITE PLAN CONSIDERATIONS: The single family house, which is on the same tax parcel as this Restricted Industrial site, currently has some storage in the front and side lot areas. This storage is in violation of the Agricultural Suburban provisions. As mentioned previously, some of the area's residential uses are in the same situation. From a practical standpoint, the stated reasons for the Change of Condition (uselessness as a screen from I -90 and the adjoining Restricted Industrial Zone on the south) are legitimate. Apparently the only area of usefulness would be along the easterly boundary of the site; this has already been accomplished. Deletion of the condition along the north and south boundaries would seem appropriate and practical. However, the Spokane County Zoning Ordinance would still require sight- obscuring fencing around all storage. As an additional note for the record, the storage currently existing at the single family dwelling (which is under the applicant's ownership) must be controlled. Members present: Mr. Skalstad, Chairman; Mrs. Myers, and Mr. Williams. Following are the applications in sequence and the action taken by the Committee. If not appealed, these decisions will become final on December 27, 1983.
