This insures the applicant of a timely processing of his /her proposal at the time of the public hearing. BUT, a major purpose of the public hearing is to afford the opportunity to present the decision makers with information as to whether or not a potentially SIGNIFICANT ADVERSE impact upon the physical environment will result from implementation of the proposal, thus resulting in the need for an EIS. However, most "change of conditions" are exempt from the provisions of SEPA; check with the Planning Department staff, if uncertainty exists. East 907 Rosewood Avenue Spokane, WA 99208 ZUNING ADJUSTOR SPOKANE 'COUNTY, WASHINGTON IN THE MATTER UF CUNUITIUNAL USE PERMIT ) FUR AN UFF- STREET PARKING FACILITY, ) RELAXATION OF FRUNT YARU SETBACK REQUIRE- ) MENT AND RELAXATION OF LOT AREA REQUIREMENT ) (CUE- 1- 85/VE- 15 -85); CEDAR BUILDERS ) 2E - 9 cEci FINDINGS UF FACT, CONCLUSIONS, DECISION AND CUNUITIUNS OF APPROVAL THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, in hearing application CUE- 1- 85/VE- 15 -85, hereinafter referred to as the "Proposal',', and the Zoning Adjustor of Spokane County having held a public hearing on March 27, 1985 and having fully considered all testimony presented thereat, and further having visited the site,,nd vicinity in question, and having rendered a verbal decision on the Err day of April, 1985, APPROVING the proposal, makes the following: 1. That the proposal is generally located west of and adjacent to Argonne Road, approximately 4UU feet north of Sprague Avenue and is further described as Assessors Parcel #18544 -2044, being more accurately described in documents contained in File CUE- 1- 85/YE- 15 -85. 2. That the proposal consists of a conditional use permit application to locate an off - street parking facility in the Agricultural Zone and the application also consists of variances to: (1) allow the parking facility to be located on a parcel of land having an area of 5,633 square feet whereas the Spokane County Zoning Ordinance requires a minimum lot size of 7,500 square feet; and (2) to allow the parking facility to be located 5 feet from Argonne Road whereas the Zoning Urdinance requires a 25 foot setback from the front property line. 3. That the adopted Spokane County Future Land Use Plan designates the area of the proposal as Major Commercial and the proposal is consistent with the County;s entire Comprehensive Plan, including the Future Land Use Plan. 4. That the site is zoned Agricultural which would allow the proposed use upon approval of this application. 5. That the existing land uses vacant apartments to the south (soon commercial and local business to the north and business /commercial to the proposal. FINDINGS UF FACT in the area of the proposal include to become offices and parking), east, a residence (deteriorated) to the west all of which are compatible with the b. That the proposal is exempt from the provisions of Chapter 43.216 RCW pursuant to WAG 197 -11 -800 (1) (c) and (b) (b) and Spokane Environmental Ordinance 11.10.070 (d). 7. That property immediately to the south, by hearing Examiner Committee Action ZE- 99 -84, granted approval to an office complex and related parking, with said parking lot designed with a 5 foot landscape strip at the street. 8. That previous Zoning Adjustor action CUE- 59- 84 /VE- 219 -84, did recently approve a very similar proposal for a parking lot in relation to an adjacent piece of property. 9. That the subject property is only 43 feet wide, contains a deteriorated residence, is located in an area of increasingly greater business and commercial land uses and that no single commercial or business land use could reasonably occupy this narrow site and still conform with the Spokane County Zoning Urdinance. 1U. That other business and commercial property in the area are characterized by parking lot, landscaping and street relationships similar to the proposal. FINDINGS OF FACT, CONCLUSIONS, DECISION AND CONDITIONS OF APPROVAL FILE CUE- 1- 85 /VE -15 -85 Page 2 lu. That the businesses to the south and the public in general will benefit from adequate and increased off - street parking stalls. 11. That the proposal will impose no excessive demands upon public utilities in the area. 12. The proposal will not be detrimental to the Comprehensive Plan or, to surrounding properties. 13. That special circumstances, particularly lot size, when combined with the strict application of the zoning ordinance standards do deprive the property of rights and privileges enjoyed by others in the area under identical zones. 14. That the applicant has been made aware of the recommendations of various County /State agencies reviewing this project and has indicated they can comply with those recommendations. 15. That no one appeared to oppose the proposal nor were any written comments adverse to the proposal received. 16. That the proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. From the Findings of Fact, the Zoning Adjustor comes to these: CONCLUSIONS 1. The proposed parking area is listed as a permitted conditional use in the Agricultural Lone and it meets all of the required established and applicable criteria except that it is less than the minimum 7,50U square foot and does not conform to the 25 foot setback from the front yard; and it is these later two criteria which has prompted this submission of a variance application concurrent with the conditional use permit, both of which are dimensional variances which the Zoning Adjustor is empowered to grant. 2. The performance standards which will be used to make the parking facility compatible with other permitted activities in the same vicinity and zone will be the numerous conditions of approval from zone change File LE- 99 -u4. 3. The proposal imposes no excessive demands upon public utilities in the vicinity. 4. 6rantiny the conditional uses permit as conditioned will not be detrimental to the Comprehensive Plan nor to surrounding properties. 5. Various reasonable restrictions, conditions and safeguards designed to uphold the spirit and intent of the Zoning Ordinance help to mitigate any adverse affects to neighboring properties will be imposed through conditions of approval. 6. The proposal is not detrimental to and is compatible with the public health, safety and welfare. 7. The subject property, without the conditional use granted, is deprived of privileges commonly enjoyed by other properties in the same vicinity and zone and the granting of the variance will remedy the difference in privileges. 8. The granting of the variance is not a grant of special privileges inconsistent with privileges enjoyed by other properties in the vicinity and zone. 9. The strict application of the standards of the Spokane County Zoning Urainance deprives the subject property of rights and privileges of other properties in the area and under identical zones. 10. The granting of the variance is not materially detrimental to the public welfare or` injurious to property or improvements in the vicinity or zone in which the subject property is located. FINDINGS UF FACT, CONCLUSIONS, DECISION AND CUNUITIUNS OF APPROVAL FILE Cut- 1- 85/VE -15 -85 Page 3 DECISION From the foregoing Findings of Fact and Conclusions, the Zoning Adjustor APPROVES the proposed conditional use permit and variances. The following CONUITUNS OF APPROVAL are stipulated. CUNUITIUNS UF APPROVAL 1. The following conditions shall apply to the applicant, owner and successors in interest. 2. Any parking facilities and landscape areas which are receptors of stormwater drainage ( 2U8! swales) must be constructed outside of the county right -of -way as depicted on the site plan contained in the file. 3. In general, all conditions of ZE -99 -84 which would also apply to the subject proposal shall become conditions of approval, but specifically the following conditions of approval are stipulated: a. A minimum 5 foot landscape strip shall be provided along the north property line and along the east property line consistent with ingress and egress requirements; and the north property line landscaping theme shall be carried along the west property line for aesthetic continuity of landscaping, in addition to the :208: grass perculation area and catch basin which shall also be located in the westerly end of the property, between the paving and the landscape at the fenced and landscaped west edge of the property. u. The Zoning Administrator shall also approve the specific exterior lighting plan for this parking area at the same time that he /she approves the exterior lighting plan for ZE -99 -84 and said lighting plan shall be an extension of and consistent with the lighting plan for ZE- 99 -84. c. A specific landscape plan, planting schedule and provisions for maintenance shall be included for this subject proposal with the approval of LE -99 -84 and in the same manner and circumstances of approval. d. The applicant shall develop the subject property generally in accordance with the concept presented in subject file of the Zoning Adjustor action and ZE- 99 -84. e. The specific site plan for the subject proposal shall be submitted with the specific development plan for ZE -99 -84 for Planning Department review and approval prior to issuance of building permits. 4. Access permits for approaches to the County road system shall be obtained from the Spokane County Engineer. 5. The applicant shall include in the detailed plan for combined on -site sewage system and surface water disposal the subject property, prior to the issuance of any building permit for this property or the property to the south. 6. This property shall also be included in the parking plan and circulation plan required to be submitted to the County Engineer in file ZE- 99 -84. 7. The construction of any road improvements associated with this parking lot shall be accomplished as approved by the County Engineer. 8. This parcel of land may, at the discretion of the Spokane County Engineer, contain all or a portion of one of the two paved and delineated access approaches on Argonne Road. FINDINGS OF FACT, CONCLUSIONS, DECISION ANU CONDITIONS OF APPROVAL FILE CUE- 1- b5 /VE -15 -85 Page 4 9. if a trash recepticle(s) is located on this property, it shall: (a) not be located adjacent to combustible construction or underneath windows or non - protected eaves; (b) be screened from view by the public using the parking lot and the travelling public; (c) be made accessible to mechanical garbage container collection; and (d) appear on the site plan to be approved by the Zoning Administrator. 10. The surface of the parking lot shall be paved, stripped and contain wheel bumper devices designed to impede the movement of vehicles at the edge of the paving while at the same time allowing the passage of water which may be flowing toward the ;2U8; grass perculation areas. SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER 1. That the existing land use in the area is residential and commercial. 8. That the proposed use is compatible with existing uses in the area. --F - 91y This matter having come before the Zoning Hearing Examiner Committee on November 1, 1984, and the members of the Committee present being Kenneth Kennedy, Chairman, F. Lynn Tennican and Richard L. Skalstad. B. PROPOSAL The sponsor, Cedar Builders, Inc., is requesting approval of a zone reclassification, File No. ZE- 99 -84, Agricultural to Commercial, for the purpose of developing Retail and Commercial Shops. 2. That ,the Comprehensive Plan designates this area as appropriate for Major Commercial and Urban development. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non - Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. C. FINDINGS OF FACT (continued) ZONE RECLASSIFICATION NO. ZE -99 -4 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant ", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT 1. That a minimum 5 -foot landscape strip be provided along the Easterly 171 feet of the North property line, along the East property line, and along the South 83 -feet of the West property line. 2. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such. lighting. (Such plan shall attempt to confine illumination to the area with full consideration ^ to adjacent properties). 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 4. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 2 ZONE RECLASSIFICATION NO. ZE -99 -84 a) COUNTY PLANNING DEPARTMENT (continued) 6. All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site. 7. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay Zone) of the Spokane County Zoning Ordinance. Accordingly, as a condition of approval, the sponsor /applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a "Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS " 8. Signs for this project shall conform to standards as set forth in Section 4.09.125 Signs. 9. Applicant_shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 10. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58 -17 and the Spokane County Platting Ordinances prior to issuance of building permits. 11. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77 -1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements. 12. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non - significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and /or public testimony contain information regarding assessment of the proposal's likely significant adverse impacts to the physical environment; a finding is hereby made that no probable significant adverse impacts upon the physical environ ment are anticipated as a result of the project; and a final declaration of non - significance is hereby to be issued. 3 b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: ZONE RECLASSIFICATION NO. ZE -99 -84 1. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall improve Hutchinson Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on -site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 6. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing - participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 7. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 4 b) COUNTY ENGINEERING DEPARTMENT (continued) ZONE RECLASSIFICATION NO. ZE -99 -84 9. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and /or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 10. Applicant shall construct a paved and delineated access approach(s) to meet the existing pavement on Hutchinson Road. 11. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No. 80 -1592 as amended. These standards are applicable to this proposal. 12. Only two driveway approaches will be permitted from this proposal to Argonne Road. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 5 COUNTY UTILITIES DEPARTMENT (continued) e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. ZONE RECLASSIFICATION NO. ZE -99 -84 4. The unit shall be double - plumbed for connection to future areawide collection systems. 5. Plans and specifications for the double plumbing are to be reviewed and approved by the Utilities Department prior to septic tank application. d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on -site sewage system may be authorized. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 2. The proposed structure will require some revisions to provide the required fire flow for this structure. Having calculated the fire flow requirements based upon the presented plan, a fire flow of 7,500 g.p.m. is required for this complex. It appears that 5 hydrants will be required. 6 e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) f) WATER PURVEYOR 9) 3. A water plan showing location, size, etc. will be required for approval. The hydrants shall be installed prior to the building permit and construction of the complex. Each hydrant shall be capable of flowing a minimum of 1,500 g.p.m. at 20 p.s.i. residual when any two (2) hydrants are flowing simultaneously. These hydrants shall be placed so that no portion of the building is more than 175 feet from the hydrant. Each building constructed shall be accessible to fire department apparatus by way of access roadways with all- weather driving surface of not less than 20 feet of unobstructed width with adequate roadway turning radius (20 feet and a minimum of 45 feet outside) capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearances. All roadway grades are required to be approved by the Fire District prior to release of building permits. 4. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. 5. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 1. Water Purveyor is Hutchinson Irrigation District #16, and they will supply the site with adequate water for domestic, fire and irrigation uses. COUNTY AIR POLLUTION CONTROL AUTHORITY ZONE RECLASSIFICATION NO. ZE -99 -84 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 7 ZONE RECLASSIFICATION NO. ZE -99 -84 g) COUNTY AIR POLLUTION CONTROL AUTHORITY (continued) 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept. clean. 4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using the site following completion of the project and from occupants of the proposed project. 5. Additional Comments: The applicant must comply with requirements of the National Emission Standards for Hazardous Air Pollutants (NESHAPS) as explained in the attached letter. E. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that • the application of Cedar Builders, Inc., for a zone reclassification as described in the application should be APPROVED. Staff recommends this project be conditioned to maintain past landscaping requirements of a 5 -foot strip along property lines and adjacent to the building. OTHER SITE PLAN CONSIDERATIONS: Parking stalls are shown extending up to the roads abutting this site; this can create a sight distance problem for vehicles leaving the site. (The County Engineer (recommending only two_(2) access points to Argonne Road. The site configuration is somewhat limiting as to development potentials; however, Staff feels other alternatives are available to better utilize the site and provide the recommended amenities. IV. CONCLUSION: This zone change is consistent with the Comprehensive Plan and past actions in the area.
