R E S O L U T I O N
The above - entitled matter coming on regularly for hearing before the Board of County
Commissioners of Spokane County, Washington, on this day, and it appearing to the
Board that the Spokane County Planning Commission has given due notice of the hearing
on the matter in the manner and for the time provided by law; that said Planning
Commission has held a public hearing as required; and that the said Planning Commis-
sion concurs in the plan to zone the following described property as:
Beginning at a point 278 feet west and 608 feet north of the SE corner of the
NW A of Section 20; thence North 538.23 feet; thence West 594 feet; thence
South 539.49 feet; thence East to thepoint of beginning. Section 20, Township
25 N., Range 44, E.W.M. Spokane County, Washington.
NOW, THEREFORE, BE IT RESOLVED, that the above - described property be, and the same
is zoned under the classification of MULTIPLE FAMILY SUBURBAN as defined in the
Zoning Ordinance of Spokane County, adopted August 25, 1953, as amended.
AND FUTHER BE IT RESOLVED that any development on the above - described property shall
be subject to the following conditions:
1. DEDICATIONS AND IMPROVEMENTS.
a) Dedication and improvement of a 50 foot right of way in the Farr Road
alignment through the advertised property. Improvements shall include
paving, curbs, sidewalk, and drainage control.
b) Dedication and improvement of a 50 foot right of way in the Sixth Avenue
alignment from Farr Road to the east boundary of the project. The improve-
ments and the alignment shall be acceptable by the Spokane County Engineer
and the Director of Planning.
c) Dedication and improvement to Spokane County Standards of the North 10
feet of the advertised property along 4th Avenue for r /w. Improvements
shall include curb, sidewalk, and paving to existing oil.
2. ORIENTATION OF STRUCTURES, BUILDING HEIGHTS, APARTMENT DENSITY.
The advertised property shall be developed in substantial conformance to th4
approved development plan; i.e., two and three story garden apartments with
access to Farr Road. The total number of apartment units within the project
shall not exceed 120.
Off- street parking facilities and connecting roadways shall not occupy
any area within 5 feet of an adjacent residential or Agricultural zone
outside the apartment project area.
b) A screen, forty -two (42) inches in height shall be provided along the
periphery of any off - street parking facility or connecting roadway
adjoining any residential or Agricultural zone. The screen shall be
constructed of ornamental masonry. The Director of Planning may approve
a planted screen or ornamental fence in lieu of said ornamental masonry
wall.
c) Any portion of the advertised property which is to be occupied or traveled
by automobiles shall be maintained in hard surface paving.
d) Open parking areas shall be unlighted, except that driveways, walkways,
and landscaped traffic islands may be illuminated by low intensity lighting
on standards not exceeding eight (8) feet in height.
e) The design, location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Planting strips
or landscaped traffic .islands may be required by the Director of Planning
for parking lots which contain more than 20 parking stalls.
4. LANDSCAPING.
All land areas not occupied by buildings, parking, and paved road -ways shill
be landscaped, planted, and maintained in appropriate turf and shrubbery.
5. FIRE PROTECTION.
Provisions shall be made for fire hydrants and mains in accordance with the
requirements of the Spokane Valley Fire Marshal.
6. SEWAGE TREATMENT.
The advertised property shall be served by a biological, mechanical waste
water treatment facility acceptable to the Spokane County health District
until and unless a community sewer system is extended to the site.

Re: Finalization of Zone Change Request, ZE- 59 -72.
On July 14, 1972, the Spokane County Planning Commission approved, subject
to certain conditions and dedications, your Zone Change request (ZE- 59 -72, Agriculture
to Multiple Family Suburban - Section 20, Township 25 N., Range 42, E.W.M.). In
order to obtain final approval, (i.e., effect a change in the Zoning Map), from the
Board of County Commissioners, the following dedications and /or improvements shall
be completed through the Spokane County Engineer's Office:
1) Dedication and improvement of a 50 foot right of way in the Farr Road
alignment through the :advertised property. Improvements shall include
paving, curbs, sidewalk, and drainage control.
2) Dedication and improvement of a 50 foot right of way in the Sixth Avenue
alignment from Farr Road to the east boundary of the project. The improve-

3. The site has reasonable proximity to shopping and other community
facilities (Sprague Avenue business district via Farr) and has
indirect access to two major arterials (Sprague Avenue via Farr Road
and Dishman -Mica Road via Fourth Avenue).
4. The Planning Commission is of the opinion that the conditions of
approval such as density reductions, proper development of off -
street parking areas, and landscaping will make.' the project more
compatible with surrounding residential uses. "

site at 6th & Woodruff. As we discussed, when we 6e
this site, we need the use of the lower 1/3 of this prop-
erty to make the project feasable.
In order to reduce the grade, we find it necessary to
traverse the hillside with our access route out to the 4th
& Farr intersection.
Would you please provide us with a written statement clearly
spelling out all the criteria and requirements the County
engineer would demand in allowing access by our 20 strip
MORTGAGE to the 4th & Farr Intersection.
We are working with an early January deadline to accomplish
several steps and make progress toward this project. So,

A . Site Size: Approximately 5.3 acres
Gross Density: 20.45 dwelling units per acre
B . Comprehensive Plan
1 . Land Use Plan: The property is located within the Urban category of the
Comprehensive Plan and is within the Priority Sewer Service Area (PSSA)
boundary. The Urban category is intended to provide the opportunity for
development of a "city- like" environment which includes various land uses,
intensive residential development and net densities of 1 to 17 dwelling units
per acre. Specific Goals, Objective and Decision Guidelines of the Urban

category encourage multi - family development with direct access to the major
arterial system rather than neighborhood or local access streets, and that
multi - family development should improve or maintain the consistency of
adjacent single family amenities. Buffering and landscaping should be used
to mitigate the difference between proposed developments and existing land
uses. The proposed Change of Conditions, with a density of 20.45
dwelling units per acre, and with near direct access to two arterials, is
generally consistent with the Urban Comprehensive Plan category.
2 . Arterial Road Plan: The Spokane County Arterial Road Plan identifies
6th Avenue, adjacent to the site, as a Local Access Street. Fourth Avenue to
the northwest and Farr Road to the west are designated as Collector
Arterials. Eighth Avenue to the south is identified as a Minor Arterial. As
noted above, the site has direct access to a local access street, and near direct
access to two Collector Arterials (4th Avenue and Farr Road) and a Minor
Arterial (8th Avenue).
C . Site Characteristics: The subject property is vacant, undeveloped and has a
slight slope on the northerly portion. Ground cover consists of natural grasses
and mature pine trees.
D . Neighborhood Characteristics: The surrounding neighborhood is a mix of
single family dwellings, apartments and a manufactured home park. Commercial
uses are found approximately 1/4 mile to the west along Dishman -Mica Road.
E . Zoning Analysis: The zoning of this area was established in the late 1950's
with large "block" rezones to Restricted Industrial (RI), Multiple Family
Suburban (MFS) and Agricultural (A). Later rezones, in the 1970's, reinforced
that pattern of high intensity zones along Dishman-Mica Road with a transition to
lower intensity zoning to the east of Dishman-Mica Road along 4th, 7th and 8th
Avenues. The existing Urban Residential-22 (UR -22) zones for the subject
property (ZE- 59- 72/7F- 106 -72) and for the property to the southeast
(ZE- 18 -74) were established prior to adoption of the Spokane County
Comprehensive Plan and the only recent zone reclassification in the area occurred
in 1986 (ZE- 44 -86) and was approved for transition of an existing manufactured
home park to multi- family development.

F . Land Use Analysis: Land uses have generally developed consistent with the
established zoning classifications and the neighborhood reflects a mixture of
commercial/industrial uses along Dishman-Mica Road with a transition to high
intensity residential (apartments, manufactured home parks) and low density
single family uses.
Site: The existing land use is vacant, undeveloped

West: Multiple family dwellings, manufactured home park
G . Circulation: Access to the site is provided by 6th Avenue and the proposed site
plan illustrates two access points to 6th Avenue, and one possible temporary
access to Woodruff Road. Woodruff Road, which adjoins the south 220 feet of
the site along the east property line, is an unimproved county road right of way,
for which the applicant has requested a Change of Conditions to delete dedication
and improvement of this mad. If the Change of Conditions request is approved,
and the existing Woodruff road right of way is vacated, then the proposed access
to Woodruff Road would be deleted. Unless the existing Woodruff Road right of
way is vacated, all structures must maintain the required front/flanking street
setback. Flow through access to the adjacent multiple family development to the
west is provided by an existing driveway at the southwest comer of the subject
property. Internal access is provided by a circular private driveway which
surrounds the multiple family structures located in the center of the site and
provides off -street parking and garages at the site perimeter.

Proposed Buffering/Landscaping Techniques: The proposed site
plan does not illustrate the type or width of proposed landscaping. Site plan
modification will be required to provide 20 feet of Type III landscaping
along 6th Avenue and that portion of Woodruff Road along the east
property line, and 5 feet of Type III Landscaping along the north and east
property lines. A 6 foot sight obscuring fence, decorative wall, or solid
landscaping is also required adjacent to the Urban Residential -3.5 (UR -3.5)
zone to the north and east. Additional site plan revision will be required to
show a 36 inch high wall, sight obscuring fence, three feet of Type I
Landscaping, or a 3 foot berm with Type D/ landscaping where off street
parking areas abut or are visible from a public right of way. Administrative
review of detailed landscape plans is recommended and would occur prior
to issuance of building permits.
Other Site Plan Considerations: The proposed site plan is very
general in nature and does not illustrate maximum building height, total
floor area, building elevations (cross- sections) lot coverage percentage, or
provide required side and rear yard setbacks for garages, or illustrate
required landscaping and buffering. Site plan modification is necessary to
demonstrate technical compliance with the development standards of the
Spokane County Zoning Code. The absence of specific detail does not
provide the Planning Department enough information to determine how the
proposal will mitigate potential impacts to the adjacent properties. These
issues can be resolved at the building permit stage.
The site plan submitted for review by the Hearing Examiner Committee is
general in nature. Detailed review to determine compliance with all Zoning
Code regulations and conditions of approval is recommended to be
administrative and to occur at the Building Permit stage.
I. Density: The proposed density is 20.45 dwellings units per acre, which is
generally consistent with the density range suggested by the Urban
Comprehensive Plan category, although somewhat denser than surrounding
approvals.
J. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer's Department prior to development.
K . Water Supply: The proposal is within the Spokane County Water District #3.
L. Sewage Disposal: A public sewer system will be made available for the
project and use of individual on -site sewage disposal systems is prohibited.
M. School: The proposal is in the Central Valley School District No. 356. The
Central Valley School District has responded to the proposal and has indicated
that existing facilities are inadequate to accommodate additional students generated
by new residential developments and requests the applicant be required to reach a
voluntary agreement to mitigate the impact of the project on the school district as
per Revised Code of Washington (RCW) 58.17.110. This request is included as
a recommended Condition of Approval.

N . Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve
fire protection provisions prior to issuance of building permits.
O. Cultural Resources: None have been identified.
P. Special Information: The existing Urban Residential -22 (UR -22) zones for
the subject property were established in 1972 as a result of zone reclassifications
ZE -59 -72 and ZE- 106 -72, which changed the zoning from Agricultural to
Multiple Family Suburban (MFS). As per the Program to Implement the Spokane
County Zoning Code, the MFS zone was redesignated to Urban Residential -22
(UR -22) on January 1, 1991. The original zone reclassifications (ZE- 59 -72/
ZE- 106 -72) were approved in 1972, with specific conditions of approval limiting
building style (1 1/2 to 3.units) maximum number of allowed apartment units, and
for specific dedication and roadway improvements.
ZE -59 -72 consisted of approximately 7.34 acres, limited building height to 2 and 3
story structures, with the total number of apartments not to exceed 120, which
equals a density of 16.34 dwellings units per acre.
ZE- 106 -72 consisted of approximately 3.66 acres, limited building height to
1 112 to 2 story structures with the total number of apartments not to exceed 55,
which equals a density of 15.02 dwellings units per acre. ZE- 106 -72 also requires
dedication and improvement of Woodruff Road
The proposed Change of Conditions is to modify the conditions of approval for
zone changes ZE- 59- 72/ZE- 106 -72, by allowing 4 story structures, deletion of
Woodruff Road dedication and improvement, and to allow 109 multiple family
dwellings on approximately 5.3 acres which equals a density of 20.45 dwelling
units per acre. The 5.3 acres within the proposed change of conditions consists of
the entire 3.66 acres of ZE- 106-72 and approximately 1.64 acres of ZE- 59 -72.
Given the allowable densities and area of ZE -59 -72 and ZE- 106 -72, the applicant
could construct (without the Change of Conditions) approximately 81 multiple
family dwellings as follows:
ZE -59 -72 1.64 acres x 16.34 units per acre = 26 dwelling units per acre
ZE- 106-72 3.66 acres x 15.02 units per acre = 55 dwelling units per acre
Total 81 dwelling units per acre
The proposed Change of Conditions proposes the following:
5.33 acres x 20.45 units per acre = 109 dwelling units per acre
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determined that "No

probable significant adverse impacts" would result from the proposal being developed
and has issued a Determination of Nonsignificance ( "DNS ").
The "DNS" was circulated to 11 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment.
The 'DNS" comment period ends October 19, 1993 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider additional environmental related testimony at the
public hearing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed development and Change of Conditions is generally consistent with the
Decision Guideline of the Urban Comprehensive Plan category which encourages
multi- family development with direct access to a designated arterial. Additionally, the
proposed density of 20.45 dwelling units per acre is consistent with the density range
suggested by the Urban category. The proposed uses and density are not entirely
consistent with land use and zoning trends in the area as the adjacent multi - family
developments to the west have a density of 16 to 20 dwelling units per acre and the
adjoining properties are a mix of residential types and densities. In addition, previous
multi- family proposals in the vicinity (ZE- 59 -72, ZE -18 -74 and ZE- 44 -86) have been
limited to 1 12 to 2 story structures, maximum building height, maximum number of
units and additional setbacks or buffering. To mitigate potential impacts upon adjacent
properties, the applicant has provided front and rear yard setbacks substantially greater
than those required by the Spokane County Zoning Code and the site plan has adequate
area to provide additional Landscaping as a buffer to the adjacent land uses. Building
height of 4 stories (maximum 50 feet) may be mitigated through site design and by
construction methods utilizing daylight basements. The proposed site plan, with
modifications, can demonstrate compliance with the applicable development standards
of the Urban Residential-22 (UR -22) zone. Therefore, the Planning Department
recommends approval of the Change of Conditions, as conditioned.
V. CONDITIONS OF APPROVAL
i . All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant ", which terms shall include the
owner or owners of the property, heirs, assigns and successors.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential -22 (UR -22) zone as
amended.
2.. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director /designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director /designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
5. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

of a land use action by a Spokane County Hearing Body or
Administrative Official on [ ], imposing a variety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Planning Department.

6. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of a voluntary agreement making provisions for public schools prior
to finalization and recording of this plat. The agreement shall provide a written
description of the subject property to which the agreement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner shall also notify any potential purchasers who have made an agreement
to purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities must be made
conditioned on a future agreement between the plattor and school district.
Voluntary agreements between the Owner and School District shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior To Issuance Of A Buildine Permit Or Use Of The Property As Proposed.
1. Regarding the change of conditions lc for ZE- 59 -72, 4th Avenue has already been
dedicated west of Farr Road there is no further requirement for the dedication of 10 feet
along Fourth Avenue, all other conditions of approval are applicable.
2. The request for change of conditions for ZE- 106 -72 lb, the County Engineer waives
any further requirement for right of way dedication on Woodruff Road. 50 feet of right
of way was dedicated by the original property owner.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on -site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
5. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
6. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Woodruff Road.
7. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not

participate in the cost of these improvements. This is applicable to Woodruff
Road.
8. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
9. The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of 6th Avenue, which is adjacent to the
proposed development. This will require the addition of varying amounts of
asphalt. The construction of curbing and sidewalk is also required. The applicant
shall construct 6th Avenue consistent with that already built along 6th Avenue per
the zone change.
10. The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of Woodruff Road, which is adjacent to the
proposed development. This will require the addition of approximately 32 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
1 All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
1.2. Access to Woodruff Road shall be prohibited until such time as specifically
authorized by the Spokane County Engineer.
13. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80 -1592 as
amended and are applicable to this proposal.
1.4. No construction work shall be performed within the existing or proposed public
right -of -way until a permit has been issued by the County Engineer. All work
within the public road right -of -way is subject to inspection and approval by the
County Engineer.
1.5. All required construction within the existing or proposed public right -of -way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
16. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree.

(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the formation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement applies to Woodruff Road.
17. All other conditions of the zone change are applicable.
SPOKANE COUNTY DIVISION OF UTILITIES
Not available at the time of printing.
SPOKANE COUNTY HEALTH DISTRICT
1. • Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will
be provided to each lot prior to sale. Use of individual on -site sewage disposal systems
shall not be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Department of Buildings at the earliest possible stage in
order to be informed of code requirements administered /enforced as authorized by the
State Building Code Act. Design /development concems include: Addressing, fire
apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations. (Note: The Department of Buildings reserves
the right to confirm the actual address at the time of building permit.)

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1.. All air pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction - related activities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules.
6. Debris generated as a result of this project must be disposed by a means other than
burning (construction waste, etc.).
