Planning Commission Recommendation: Approve.
Background:
MINUTES
December 11, 1969
In 1967, the Planning Commission and Board of County Commissioners
approved a zone change to Multiple Family Suburban, as requested by
Dr. Bemis, for the purpose of establishing a Veterinary Clinic as permitted
through a "Conditional Use" permit in the Multiple Family Suburban Zone.
However, on September 5, 1968, veterinary clinics were deleted from the
Multiple Family .Suburban Zone as a "Conditional Use" and added to the
"Residential Office" Zone as a "Conditional Use ".
The applicant did not apply for a Conditional Use Permit and Building Permit
until November, 1969, and the Conditional Use Permit was approved by the
Zoning Adjustor on November 17, 1969, after a finding that Dr. Bemis had
made investments in reliance on the previous zoning. A building permit
was subsequently issued on December 5, 1969, for the establishment of a
veterinary clinic on the subject property.
Consequently, at the Commission's direction of October 30, 1969, the
applicant has submitted a zone change application to bring the use of his
property in compliance with the present Zoning Ordinance.
A. Reasons:
1. The Pines Road property frontage has been considered by the
Planning Commission as an appropriate location for high density
residential and professional office land use. Several zone change
applications have been approved by the Planning Commission and
Board of County Commissioners for either Multiple Family Suburban
or Residential Office zoning on North Pines Road frontage between
Sprague Avenue and Trent Road.
South Pines Road property frontage has also been considered
favorably in several instances (Weldon Subdivision apartments and
Valley Green apartments) for Multiple Family Suburban zoning.
The proposed zone change is the first Residential Office zone
change south of Sprague Avenue to be considered by the Planning
Commission. The Commission notes the following two points in
consideration of the proposed Residential Office zoning:

The Planning Commission, in view of the foregoing, is of the
opinion that the proposed Residential Office zoning would be
compatible with both the existing land use along Pines Road and
the Planning Commission's zoning policy for Pines Road in general.
B. General Data:
1) The Multiple Family Suburban zoning permits certain
professional offices as an outright permitted use, and 2) the
present non - residential land use along South Pines Road
immediately north consists of three businesses; namely, a
lodge, and a grocery store and office complex.
