and pave to existing pavement on 4th as directed by the County
Engineer or be a willing participant in any future LID, RID or CRP.
6. Applicant shall obtain approval for on and off -site drainage and
access plans before issuance of building permits.
7. Applicant shall dedicate 10 feet on 4th Avenue for right -of -way.

On April 19, 1979, the Zoning Hearing Examiner Committee met at 8:30 A.M.
to consider nine new zone reclassification applications and one reconsideration
of conditions application. Members present: Mr. Kennedy, Mrs. Byrne, and

A. INTRODUCTION
This matter having come before the Examiner Committee on April 19, 1979, and
the members of the Committee present being Ken Kennedy, Abby Byrne and John
Culler and there being the following person present who wish to request
approval of a Change in Conditions; Grant Groesbeck, for the purpose of
reconsidering changes in the plot plan and in the areas of Phase I and Phase II.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Multiple Family Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or intent of adopted policies.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.

Foundation Permit
We would like to request a foundation permit on the two projects
mentioned above.
Both projects are submitted for permits with Planning, Health
and Engineering Departments previously satisfied. The two
projects were really one project, but got split in two because
of the Third Avenue extension requirement which we will be
building.
We cannot get the road improvement and landscape bonds from the
bonding company until we submit a copy of our mortgage loan
agreement, and conversly, we cannot get our loan agreement until
we submit a building permit.
Tf you will grant us an early start, we agree to conform to
any further requirements of the Planning, Health, Building and
Engineering Departments.
We are currently paying $5,100.00 per month interest on our land
acquisition and would appreciate your approving our request. Our
project is located two blocks east of University on Third Avenue
in the Spokane Valley.

The County Engineer's Office has requested the following be considered if
the rezone is approved:
NOTE: All required improvements shall be built to meet or exceed
minimum County construction standards.
1. Applicant shall dedicate 20' of the W 229.79' of Third Avenue and
dedication of 60' for the extension of Third Avenue and a 45'
minimum radius for a cul -de- sac -at - the east end of Third Avenue.

2. Applicant shall dedicate 50 feet on Pierce Road and a twenty (20)
foot radius on Third and Fourth for right -of -way.
3. Applicant shall dedicate 10 feet on Fourth Road for right -of -way.
4. Applicant shall construct cement concrete curb, sidewalk and pave to
existing pavement on Fourth.
5. Applicant shall construct cement concrete curb, sidewalk and pave 40
feet on Pierce Road and Third.
6. Applicant shall obtain approval for on and off -site drainage plan
before issuance of building permits.
b. Spokane County Health District:
The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.
c. County Fire Marshal's Office: Fire District #1
Mains and hydrants to be installed, in accordinace with the Spokane
County Fire Marshal's requirements.
Access and circulation plans for emergency vehicles to be approved prior
to building permit issuance.
d. Water Purveyor:
Modern Electric. Will require an extension of the Main on Third Avenue
to the property. An agreement with Modern Electric can be worked out.
III. CONDITIONS
If the Planning Commission approves this request, the following conditions
should be considered:
a. Compliance with all requests stated under Reviewing Agency Comments
above.
b. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee. Minor
variations when approved by the Zoning Administrator will be permitted,
including, but not limited to the following changes: Building location,
building materials, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.

and the Board of County Commissioner's Resolution #77 -1392 be
accomplished by the applicant within thirty (30) days of formal action by
the Board, as instructed by the Planning Department staff.
e. Interior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
g.
That, if after one year from the date of the Hearing Examiner Committee's
action, the applicant has not received final adoption of the zone change,
the application is void.
